La délinquance juvénile a été souvent dépeinte de façon globale sans distinction de genre, ou encore, elle fut décrite principalement chez les garçons. Constater la faible représentation des adolescentes prises en charge en vertu de la Loi sur le système de justice pénale pour adolescents, comparativement aux garçons, conduit vers diverses explications. Certaines mettent l’accent sur la personne, arguant que la délinquance des filles est différente de celle des garçons, moins fréquente et surtout moins violente. D’autres mettent l’accent sur le traitement des instances judiciaires qu’on dit protectionniste vis-à-vis des filles, ce qui fait qu’on les dirige plutôt vers le système de Protection de la jeunesse pour troubles de comportement. Devant cette divergence d’explication, nous avons cherché à comprendre si la faible représentation des filles dans le système de justice pénale pour adolescent est due aux comportements des adolescents en tant que tels, ou à la manière dont leurs comportements sont perçus et gérés par les intervenants oeuvrant auprès de ces jeunes impliqués dans des situations-problèmes, lesquelles sont susceptibles ou non, d’être judiciarisées. Notre étude pose un regard sur l’enclenchement du processus judiciaire auquel des adolescents se trouvent confrontés, c’est-à-dire leur arrestation ou leur signalement à une instance officielle, sous l’angle de la représentation sociale des jeunes par les intervenants. Pour ce faire, nous avons rencontré des intervenants du milieu scolaire, puisque l’école se situe au deuxième rang des signalants vers le système de prise en charge des adolescents en difficulté, après les parents. Nous leur avons présenté des cas-types, sous forme de vignettes, visant à saisir leurs perceptions et réactions vis-à-vis des situations-problèmes impliquant des adolescentes et des adolescents, en souhaitant déterminer si celles-ci varient en fonction du genre. Bien qu’en théorie la vision des interviewés quant à la délinquance juvénile soit assez uniforme, et ce, peu importe le sexe du délinquant, nos résultats montrent qu’en pratique, il y a un double standard. Ainsi, si les règles sont conçues pour tous et les conséquences de leur non-respect doivent en principe s’appliquer également sans distinction, lorsqu’il s’agit d’intervenir, les interviewés conviennent que leur approche diffère selon qu’ils aient affaire à une fille ou à un garçon. Par ailleurs, ils déplorent le manque criant de ressources et questionnent la volonté de certains parents de contribuer à la réussite scolaire de leur enfant. Ultimement, ils remettent en cause, dans une large mesure, le système éducatif québécois. En tant qu’acteurs sociaux, les intervenants ont le pouvoir de faire valoir leur point de vue. L’analyse de ce point de vue, dans le cadre de notre mémoire, montre l’importance de leur rôle dans le parcours des adolescents, garçons et filles, plus spécialement lorsque ceux-ci se trouvent impliqués dans des situations-problèmes.

This dissertation examines different aspects involved in the formation of psychologists’ expert opinion in the Portuguese criminal justice system, more precisely, as this opinion is reflected in assessment reports. The present dissertation is comprised of three qualitative studies, the first sought to provide a general portrait of a sample of 106 forensic psychological reports as to their overall quality as measured in terms of relevance and coherence. Results show that the formal markers of quality are present in the sample analysed, a certain number of weaknesses have been observed, notably concerning the internal coherence of the reports as well as the relevance of the information reported on. The second study explored the opinions of 17 Portuguese judges and state prosecutors concerning the use they make of this type of forensic report. It appears that they consider these reports to be useful and very credible, specially so when they have been produced under the auspices of the National Institute of Legal Medicine and Forensic Sciences, which is the state forensic institution. Furthermore, it appears that judges and prosecutors were particularly interested in data that allowed for a personalised portrait of the assessee. The third study sought to better comprehend the conceptual bases on which psychologists construct their reports. To this end, an exploratory study was undertaken with a sample of key-actors; the analysis of their interviews shows that they define their judicial mandate as well as the basic concepts that are associated to this mandate in different ways. A theoretical framework provided by an implicit theories model was used to help understand these results.

This thesis is shows the result of the research work on the inherent Powers of the High Court in criminal jurisdiction. The criminal justice system in India recognizes inherent powers only of the High Court. The Theory and Philosophy of inherent powers are concerned the Distinction between civil and Criminal laws are of very little consequence. In formulating the research programme the confusion created by the concept of inherent powers and its application by High Court form the central point. How fully the concept is understood, how correctly the power is used, and how far it has enhanced the rationale of the administration of criminal justice, what is its importance and what are the solutions for the inherent power to earn a permanent status in the province of criminal jurisprudence are the themes of this study. The precipitation of new dimensions is the yardstick to acknowledge the inherent powers of the High Court and Supreme Court. It is of instant value in criminal justice system. This study concludes innovativeness provided by the inherent powers has helped the justice administration draw inspiration from the Constitution. A jurisprudence of inherent powers has developed with the weilding of inherent powers of the Supreme Court and the High Court. It is to unravel mystery of jurisprudence caused by the operation of the concept of inherent powers this research work gives emphasis. Its significance is all the more relevant when the power is exercised in the administration of criminal justice. Application or non application of inherent powers in a given case would tell upon the maturity and perfection of the standard of justice

Trata-se de uma pesquisa de natureza marcadamente descritiva, com etapas exploratórias, que visa a descrever as percepções e reflexões desveladas pelos sujeitos da pesquisa nas análises temáticas realizadas sobre diversas questões que envolvem o tema da autonomia da Perícia Criminal Oficial, no âmbito da Polícia Federal. Para esse fim, utilizou-se da metodologia da análise de conteúdo, segundo Bardin (1977). Os sujeitos da pesquisa foram escolhidos segundo o critério de acessibilidade e da natureza dos cargos, quais sejam: Delegado da Polícia Federal, Juiz Federal, Perito Criminal Federal e Procurador da República. Face à predominância do cunho qualitativo neste estudo, não há expectativas de generalizações dos resultados obtidos no campo, assim como a seleção desses sujeitos não priorizou pela representatividade quantitativa de cada cargo. O referencial teórico foi construído com o propósito de contextualizar e favorecer a compreensão do leitor sobre como é constituída a realidade em que se insere o objeto de estudo, buscando descrever os termos e conceitos necessários a essa compreensão, tais como: (i) o que é o Sistema de Justiça Criminal e como se deu seu processo de formação no Estado moderno; (ii) como é a estrutura e o fluxo processual básico do modelo brasileiro, com destaque para a posição que ocupam os órgãos ou Instituto de Criminalística; (iii) qual o nível de efetividade desse sistema, no Brasil, e quais os principais problemas que afetam a funcionalidade da Perícia Oficial em sua estrutura; (iv) quais os reflexos do uso dos paradigmas repressivo e preventivo, pelo Estado, no controle da violência, da criminalidade e da impunidade dos criminosos, visando a garantir a manutenção da ordem pública como bem coletivo; (v) que relevância tem o papel da Perícia Oficial para a efetividade do Sistema de Justiça Criminal, segundo o paradigma preventivo; (vi) o que é Criminalística e qual a natureza de sua atividade; e (vii) como se apresenta a atual estrutura administrativa e a rede de clientes da Perícia Oficial. Ao se aproximar do objeto de estudo, o pesquisador buscou descrever como se deu a origem do processo de autonomia da Criminalística, no Brasil, e como esse processo vem sendo desenhado como uma política de segurança pública, destacando as principais medidas administrativas e normativas adotadas no país que favoreceram a sua consolidação, tais como: a aprovação do PNSP (2002), do PNDH I (1996), do PNDH II (2002) e do PNDH III (2009), além da promulgação da Lei nº 12.030/2009, que assegura, de forma específica, a autonomia técnico-científica e funcional da função pericial criminal. Tratamento especial foi dado ao significado e ao alcance que têm as dimensões conceituais do termo “autonomia” para a função pericial. Em que pesem os resultados obtidos, as conclusões revelam que a complexidade do tema, teoria e prática, aguarda continuidade em pesquisas futuras.

Este trabalho investiga as contribuições da interação entre os órgãos públicos para a efetividade do Sistema de Justiça Criminal, à luz dos atores envolvidos e tendo como arcabouço conceitual as teorias de redes interorganizacionais, notadamente redes de políticas públicas. O estudo foi orientado pela suposição inicial de que a atuação em rede pode proporcionar melhores resultados para a administração pública, comparativamente àqueles obtidos com as instituições trabalhando isoladamente. A literatura sobre o tema apresenta que, dentre outras vantagens, redes podem ser mais apropriadas para lidar com problemas complexos, proporcionando mais flexibilidade que as hierarquias, complementaridade nas ações e incentivo à colaboração. Por outro lado, aponta limitações de ordem gerencial ou relacionadas a prestação de contas e responsabilização, a questões legais e culturais, a conflitos de interesses e ao poder. Para a obtenção de dados empíricos, foram entrevistados Delegados de Polícia Federal, Peritos Criminais Federais, Auditores Federais de Controle Externo, Analistas de Finanças e Controle e Procuradores da República, todos detentores de função de gestão. Mediante a categorização dos depoimentos colhidos na pesquisa de campo foi possível sintetizar a percepção dos entrevistados, o que revelou que, corroborando os atributos identificados na literatura, vários são os benefícios da atuação em rede. Mas, do mesmo modo que verificado na literatura, os entrevistados igualmente destacaram que redes apresentam muitos desafios e limitações.

O presente estudo trata da discussão de um novo modelo organizacional para a Perícia Criminal no qual seja possível a um só tempo, uma atuação integrada, harmônica e independente em relação à Investigação Policial, de modo a contribuir para alterar o modelo atual em que a Perícia Criminal atua apenas de forma limitada e pontual, para um modelo que permita um paralelismo entre esta e aquela, ressaltando a importância da aplicação da criminalística como ferramenta de excelência na investigação criminal e no combate à impunidade nos procedimentos investigatórios. Inicialmente, são apresentados o tema estudado seus objetivos, delimitação e relevância. Em seguida, é realizado um panorama de trabalhos anteriores relevantes para o tema aqui abordado, incluindo uma sintética exposição dos conceitos basilares da Criminalística e suas interrelações no Sistema de Justiça Criminal de modo a demonstrar o seu potencial no procedimento investigatório. É apresentada então a metodologia de pesquisa utilizada, para, em seguida, discutir-se a análise dos processos de investigação policial e perícia criminal e os resultados da pesquisa exploratória e sua análise, buscando-se identificar os problemas e propor mecanismos de melhoria do modelo organizacional. São apresentados também casos que envolvam áreas diversas do conhecimento pericial, em que se chegou a resultados efetivos graças à aplicação do modelo proposto. Ao final espera-se demonstrar que a implementação de um modelo organizacional em que haja paralelismo, integração e independência dos processos de investigação de campo e perícia técnica possibilitará uma otimização no desenvolvimento e no resultado da investigação criminal, o que contribuirá para uma maior eficiência do sistema de persecução penal e justiça criminal.

Criminal offending and poor mental health are both recognised as important social problems warranting prevention and intervention efforts. Although there is some evidence for comorbidity between these problems, little research has examined the causal relationship between offending and mental health, particularly for young people. The present investigation addresses these issues by using data from the Sibling Study, a longitudinal investigation of delinquency as self-reported by 731 adolescents and young adults in south-east Queensland, Australia. The results suggest that for young women, but not men, offending behaviours (including the use of illicit drugs) lead to increases in self-harm and depression. Conversely, poor mental health, as indicated by having low self-esteem, a poor future outlook, and a belief that life is very confusing, does not influence subsequent levels of offending for either sex. The implications for prevention and intervention are discussed, with emphasis on the need for the criminal justice system to provide mental health services to young female offenders.

The present study investigated the impact of different legal standards on mock juror decisions concerning whether a defendant was guilty or not guilty by reason of insanity. Undergraduate students (N = 477) read a simulated case summary involving a murder case and were asked to make an insanity determination. The cases differed in terms of the condition of the defendant (rationality deficit or control deficit) and the legal standard given to the jurors to make the determination (Model Penal Code, McNaughten or McNaughten plus a separate control determination). The effects of these variables on the insanity determination were investigated. Jurors also completed questionnaires measuring individualism and hierarchy attitudes and perceptions of facts in the case. Results indicate that under current insanity standards jurors do not distinguish between defendants with rationality deficits and defendants with control deficits regardless of whether the legal standard requires them to do so. Even defendants who lacked control were found guilty at equal rates under a legal standard excusing rationality deficits only and a legal standard excluding control and rationality deficits. This was improved by adding a control test as a partial defence, to be determined after a rationality determination. Implications for the insanity defence in the Criminal Justice System are discussed.

Discretion plays a role in nearly every facet of the American criminal justice system. It is widely regarded as necessary to do justice but is not without criticisms – especially when it leads to unfavorable or disparate treatment. The role of discretion in sexual assault cases has been particularly scrutinized. Since the majority of sexual assaults do not fit stereotypic beliefs about what constitutes a “real rape” and “genuine victim,” criminal justice officials use their discretion to filter these cases out of the justice system. This study explored this issue by examining two stages of the criminal justice process: the police decision to refer cases for prosecution and the prosecutorial decision to accept referred cases. In doing so, it contributes to this body of literature in three ways. First, it included sexual assault cases that involve Alaska Native victims and suspects. Second, it addressed a gap in the theoretical scholarship by examining the downstream nature of police decision-making. And finally, it examined the formal reasons prosecutors give for charge dispositions. This study found a significant amount of attrition of sexual assault cases as they progressed through the criminal justice system. Moreover, a combination of legally relevant and extralegal factors was found to be important, but not consistently across all types of sexual assaults. Among legal factors, the number of victim injuries was the most consistent predictor. Among extralegal factors, cases that involved Alaska Native suspects had significantly higher odds of case referral and case acceptance compared to white suspects. The effect of suspect race was particularly pronounced in cases with a white victim. Additionally, the findings suggest that not only are Native American defendants more likely to have their cases referred by police, but once referred, they are also more likely to have them accepted for prosecution. Contrary to expectations, victim-suspect relationship, specifically non-stranger assaults, increased the odds of police referral compared to stranger cases. However, the opposite appears to be true for the decision to prosecute cases. Once referred, prosecutors were five times more likely to accept sexual assaults perpetrated by strangers. The implications of these findings are also discussed.

In the extant literature, adult-onset offending has usually been identified using official sources. It is possible, however, that many of the individuals identified would have had unofficial histories of prior offending. To investigate this issue, the men from the Cambridge Study in Delinquent Development (CSDD) were examined. The CSDD is a prospective longitudinal study of men from inner-city London, followed from age 8 to age 48. Onset of offending was identified using official records and then the self-reported offending of the adult-onset offender group (with a first conviction at age 21 or later) was compared to others. All the adult-onset offenders self-reported some previous offending in childhood and adolescence but most of this offending was not sufficiently frequent or serious to lead to a conviction in practice. About one-third of adult-onset offenders were considered to be self-reported delinquents who were realistically in danger of being convicted because of the frequency of their offending. For some, the adjudication by the criminal justice system was simply the first time that their ongoing pattern of offending had been detected. Their lack of detection was because the types of offences they were committing had lower detection rates.

This thesis examines why and how Indigenous Australians convert to Islam in the New South Wales suburbs of Redfern and Lakemba. It is argued that conventional religious conversion theories inadequately account for religious change in the circumstances outlined in this study. The aim of the thesis is to apply a sociological-historical methodology to document and analyse both Indigenous and Islamic pathways eventuating in Indigenous Islamic alliances. All of the Indigenous men interviewed for this research have had contact with Islam either while incarcerated or involved with the criminal justice system. The consequences of these alliances for the Indigenous men constitute the contribution the study makes to new knowledge. The study employs a socio-historical and sociological focus to account for the underlying issues by a literature review followed by an ethnographic participant observation methodology. In-depth open-ended interviews with key informants provided the rich qualitative data to compliment literature review findings. For the Indigenous people involved in this study, Islamic religious identity combined with resistance politics formed a significant empowering framework. For them it is a symbolic representation of anti-colonialism and the enduring scourge of social dysfunction in some Indigenous communities.

The use of “Day in Prison” programs to deter young adult offenders is a concept which originated in the United States and was replicated in Australia during the late 1970s. After almost a decade of uncertainty this model of ‘crime prevention’ re-emerged in Victoria with the introduction of a pilot “Day in Prison” program. This article traces the development and operation of the Victorian experience and provides evaluation research findings which conclude that coercive, intimidatory and degrading aversion techniques should not be utilised by the criminal justice system for the purposes of individual deterrence.

Communication between cultures that do not share similar norms, values, beliefs, experiences, attitudes and practices has long proven to be a difficult exercise (Balsmeier & Heck, 1994). These difficulties can have serious consequences when the miscommunication happens in the justice system; the innocent can be convicted and witnesses undermined. Much work has been carried out on the need for better communication in the courtroom (Eades, 1993; Lauchs, 2010; Supreme Court of Queensland, 2010; Supreme Court of Western Australia, 2008) but far less on language and interactions between police and indigenous Australians (Powell, 2000). It is ethically necessary that officers of the law be made aware of linguistic issues to ensure they conduct their investigations in a fair and effective manner. Despite years of awareness raising issues still arise. Issues of clashes between police and indigenous peoples are still prevalent (Heath, 2012; Remeikis, 2012). This paper will attempt to explain the reason for this discrepancy and, in doing so, suggest some solutions to the problem. This paper draws on cultural schema theory in an attempt to determine if cultural difference in language could be negatively affecting communication between Aboriginal people and the police of South East Queensland. Findings from this research are significant in determining if miscommunication is adding to the already unequal standing of Aboriginal people within the Criminal Justice system, and encouraging the already volatile relationship between Aboriginal people and police.
