In an increasingly globalized society, the crime appears as a reality that crosses borders. Globalization has potentiated the emergence of new forms of crime, which have been the subject of more interventional, particularly in terms of political, judicial and police authorities as well as civil society approaches. The media allow rapid expansion of criminal methodologies, which aggregate to the ease of movement of itinerant criminal groups, increases the opportunities for the continuation of the practice of criminal offenses, threatening, increasingly, the tranquility and safety of populations. Criminal organizations are characterized by their complexity, thus contributing to the difficulty in combat, by police and judicial authorities, forcing rapid adaptation to new political and criminal reality, particularly at the level of institutional cooperation, national and international, as exemplified by the creation of the "European Area of Freedom, Security and Justice" and new agencies in the field of police cooperation. It was intended with this paper to answer the central question: Is it possible to define a concept of Itinerant Crime in the European regulatory framework (Police and Judiciary)? To fulfill this aim, we performed the characterization of the concept of itinerant crime including itinerant criminal group, we analyzed the work that is being done by the authorities, police and judiciary, in order to contain the phenomenon. Finally, we studied type of existing cooperation at European level between the Member States and the authorities with responsibilities in this area. At the end, we conclude that efforts are being made towards the enhancement of operational, police and judicial cooperation, between the competent authorities of the European Union by combating this phenomenon. Define, and also proposed, a unique concept of Itinerant Crime, in order to be included in the legal standards, in order to facilitate research, in particular to better fit the itinerant crime and assist the prosecution of offenders.

The subject of study of this Thesis aims to highlight and recognize as an object of reflection the undoubted relationship between the Internet and the Justice System, based on the issue of digital evidence. The simultaneously crossing of the juridical-legal implications and the more technical computer issues is the actual trigger for the discussion of the issues established. The Convention on Cybercrime of the Council of Europe of 23rd November 2001 and the Council Framework Decision n.° 2005/222/JHA of 24th February 2005 were avant-garde in terms of the international work about the crimes in the digital environment. In addition they enabled the harmonization of national legislations on the matter and, consequently, a greater flexibility in international judicial cooperation. Portugal, in compliance with these international studies, ratified, implemented and approved Law n. º 109/2009 of 15th September concerning the Cybercrime Act, establishing a more specific investigation and collection of evidence in electronic support when it comes to combating this type of crime, as it reinforced the Substantive Criminal Law and Procedural Nature. Nevertheless, the constant debates about the New Technologies of Information and Communication have not neglected the positive role of these tools for the user. However, they express a particular concern for their counterproductive effects; a special caution prevails on the part of the judge in assessing the digital evidence, especially circumstantial evidence, due to the its fragility. Indisputably, the practice of crimes through the computer universe, given its inexorable technical complexity, entails many difficulties for the forensic investigation, since the proofs hold temporary, changeable, volatile, and dispersed features. In this pillar, after the consummation of iter criminis, the Fundamental Rights of the suspects may be debated in the course of the investigation and the construction of iter probatorium. The intent of this Thesis is to contribute in a reflective way on the issues presented in order to achieve a bigger technical and legal awareness regarding the collection of digital proof, looking for a much lighter approach to its suitability in terms of evidentiary value.

A aceleração do ritmo de mudança verificado nas sociedades atuais, tem sido impulsionado pela globalização, fenómeno decorrente da evolução das tecnologias da informação, das telecomunicações, das comunicações e transportes e do desaparecimento de fronteiras. Viver na “aldeia global” ou à escala global como o previu Marshall McLuhan (1964) no livro Understanding Media, é hoje uma realidade inquestionável. As consequências desta transformação foram múltiplas quer do ponto de vista dos benefícios, quer do ponto de vista dos problemas gerados. No plano da segurança, face ao multiculturalismo envolvido e ao aumento crescente do crime transfronteiriço, tornou-se essencial a partilha de informação a nível internacional tendo em vista o seu combate não só olhando a situação dos cidadãos como a defesa dos princípios democráticos. Realça-se que os progressos tecnológicos e as facilidades que criam aos seus utilizadores, neste caso os criminosos, fazem com que as ações por estes praticadas sejam cada vez mais meticulosas, imprevisíveis, sofisticadas e complexas o que impõe uma resposta correspondente e adequada. Por essa razão, as políticas de segurança existentes mostraram-se insuficientes e esgotadas requerendo novas respostas capazes de produzir os efeitos desejáveis para uma efetiva prevenção da criminalidade. Pelas dimensões que tem vindo a tomar, a criminalidade tornou-se uma preocupação que ultrapassou o domínio da segurança interna de cada país para ser encarada a nível internacional ou mesmo mundial. Para o efeito urge concertar processos e procedimentos securitários agregando vontades que convirjam e defendam a unificação dos sistemas dos países a nível mundial. A verificar-se tal intento, daí resultariam significativas melhorias da segurança a todos os níveis (nacional, internacional e mundial). Além disso também resultariam ganhos em termos de tempo, redução de custos, impacto na qualidade dos serviços prestados, na gestão das pessoas e na eficiência das organizações. Realça-se que a democracia ao promover a dignidade do homem densificando os seus direitos, liberdades e garantias, criou indiretamente condições para que fosse gerada instabilidade e o desenvolvimento de comportamentos criminosos. Importa, portanto, face à situação existente e à previsível complexidade do crime no futuro, estudar profundamente a nova realidade neste domínio, para tomar as medidas preventivas tendentes a reporem a estabilidade e a promoverem a paz social. Foi neste contexto que a presente investigação, desenvolvida no âmbito académico, mas também suportado na realidade profissional, pretendeu refletir sobre o estado da segurança global e dar o seu contributo nesta matéria.

The challenge of this work is to assess the importance of the municipal police in improving the safety of citizens, if gauging from this reality through contributions from the Municipal Police Guimarães. The IV Constitutional Review in 1997, enabled the Portuguese municipalities creating administrative police bodies. These services, known as Municipal Police, have gradually come up in several municipalities. Currently the Municipal Police have their fundamental legal regulations of Law No. 19/2004 of 20 May, which, according to the Portuguese Constitution provides that these must be seen as municipal services, which act in a space territorially delimited, which corresponds to the municipality that each belongs. Under Article 237, paragraph 3, of the Constitution, the Municipal Police are municipal services, which shall cooperate in the maintenance of public order and protection of local communities, acting in cooperation with the security forces, public security functions. The safety concept has been taking an increasingly significant importance within the population. Is also no doubt say that, currently, insecurity affects all of society and is a major concern of law enforcement authorities. To find suitable answers we found that there are several studies on these subjects. In order to be able to make our contribution, text looks us on this subject, having had the support of the Municipal Police Guimarães, in the preparation of this work. Thus, based on a survey, they were sounded out, as privileged actors, agents of the Municipal Police Guimarães, in order to know their perceptions with regard to security issues faced in the context of security. We understand ask them to answer in particular the following questions: What are the most facilitators situations of crime? How important is the Municipal Police Guimarães in crime prevention? What are the strategies for prevention of incivilities? What other skills that can be conferred upon the Municipal Police? The results obtained allowed us to conclude that incivilities facilitate the occurrence of crimes and that the Municipal Police may have a more active role in the security of the population. If you were given other duties, in addition to that already have, the Municipal Police could reach another level of effectiveness. However we understand that any change to the tasks of this police need a serious and profound reflection, to find complementary alternatives with the security forces, which does not conflict with current assignments of any of the parties or with the interests of citizens.

Graffiti, Memory and Contested Space: Mnemonic Initiatives Following Periods of Trauma and/or Repression in Buenos Aires, Argentina This thesis concerns the popular articulation ofmemory following periods or incidents of trauma in Argentina. I am interested in how groups lay claim to various public spaces in the city and how they convert these spaces into mnemonic battlegrounds. In considering these spaces of trauma and places of memory, I am primarily interested in how graffiti writing (stencils, spray-paint, signatures, etchings, wall-paintings, murals and installations) is used to make these spaces transmit particular memories that impugn official versions of the past. This thesis draws on literatures focused on popular/public memory. Scholars argue that memory is socially constructed and thus actively contested. Marginal initiatives such as graffiti writing challenge the memory projects of the state as well as state projects that are perceived by citizens to be 'inadequate,' 'inappropriate,' and/or as promoting the erasure of memory. Many of these initiatives are a reaction to the proreconciliation and pro-oblivion strategies of previous governments. I outline that the history of silences and impunity, and a longstanding emphasis on reconciliation at the expense of truth and justice has created an environment of vulnerable memory in Argentina. Popular memory entrepreneurs react by aggressively articulating their memories in time and in space. As a result of this intense memory work, the built landscape in Buenos Aires is dotted with mnemonic initiatives that aim to contradict or subvert officially sanctioned memories. I also suggest that memory workers in Argentina persistently and carefially use the sites of trauma as well as key public spaces to ensure official as well as popular audiences . The data for this project was collected in five spaces in Buenos Aires, the Plaza de Mayo, Plaza Congreso, La Republica Cromanon nightclub, Avellaneda Train Station and El Olimpo, a former detention centre from the military dictatorship.

Bullying was approached as a social phenomenon in the present study. The central aim of this thesis was to uncover some of the factors that contribute to the attitudes and behavioural choices of bystanders during bullying situations. With this type of information, interventions can be tailored to change the behaviour of bystanders during bullying situations, and thus the ethos of the larger group. Thus, acting to alter the available sources of reinforcement for bullying behaviour and peer intervention attempts. Six hundred and twenty-six students participated. Students were sampled from grades 4 (n=140), 5 (n=l 13), 7 (n=205), and 8 (n=168). Students were measured for their involvement in bullying and victimization, as well as for involvement in the following bystander behaviours: encouraging, onlooking, defending, and seeking adult support. In addition, students were measured for tolerance of deviance, pro-victim attitudes, social anxiety and fear, and self-efficacy for peer intervention. Last, students were asked to complete a series of qualitative measures, including a series of hypothetical vignettes and open-ended questions. Analyses centered on the following areas: 1) rates of bullying, victimization, and bystander behaviour; 2) the influence of age and gender on bystander behaviour; 3) the characteristics associated with students who predominantly report involvement with defending, seeking adult assistance, encouraging, and onlooking behaviour; and 4) the influence of past involvement with bullying and victimization on bystander behaviour. b .--' -i . k Rates of bullying, victimization, and bystander behaviour were comparable to findings in the existing literature, where male students were more likely than female students to report involvement in both bullying and victimization. Boys were more likely than girls to report participation in encouraging and onlooking behaviours, while being less likely to report involvement in defending and seeking adult assistance. Partly consistent with existing findings, older students were more likely to report involvement in bullying, encouraging, and onlooking behaviour than younger students, who were more likely to report victimization, defending, and seeking adult assistance. Self-identified encouragers and onlookers reported a similar array of characteristics, in that they tended express high levels of tolerance of deviance, while expressing low levels of pro-victim attitudes and self-efficacy for peer intervention. Likewise, self-identified defenders and seekers of adult assistance tended to report a similar array of characteristics to each other, in that they tended to report low levels of tolerance of deviance, while expressing high levels of pro-victim attitudes and self efficacy for peer intervention. Additionally, self-identified bullies and self-identified bully-victims tended to report increased involvement in encouraging and onlooking, whereas self-identified victims tended to report increased involvement in defending behaviour and seeking adult assistance. Results are discussed in terms of implications for bullying prevention and intervention. Specifically, evidence from the present study suggests that as bystanders, students predominantly act to either support bullying acts or to support the victims of these acts, or alternatively, to actively remain outside bullying situations. Thus, encouraging students to make small changes in the way they express these sentiments during bullying situations would act to alter the culture of the larger peer group and the sources of reinforcement available for bullying acts as well as peer intervention attempts.

People with intellectual disabilities (ID) are more likely to be victims of abuse and human rights violations than people without ID. The 3Rs: Rights, Respect, and Responsibility project has developed and is testing a human rights training program for adults with ID. The current project was conducted to make recommendations to adapt the 3Rs rights training program to be used with youth with ID and their families. An interpretive phenomenological framework was employed to investigate youth with ID, parents', and siblings' perceptions of the i r experiences with choice making, an enactment of rights, in the family context. Thematic analysis of interviews revealed that, consistent with previous research, family members consider family values, conventions, and family members' well being when making decisions. A training program should promote a consideration of expanded opportunities for youth with ID to make choices and should be flexible to address individual families' cultures, needs, and desires.

This study explored children's bullying experiences (as bully, victim, and bystander) and their self-worth perceptions in a private school in Ontario, Canada. Forty students from 12 different countries participated in a mixed methodology (both quantitative and qualitative) research design using a self-report questionnaire. Students reported involvement in bullying as a bully, victim, and bystander. The overall results reveal a pattern across the three roles where the degree of bullying observed as a bystander is the highest (57%) followed by the experiences as a victim (29%) and that performed as bully (21%). The bystanders reported direct bullying being witnessed, bullies reported indirect bullying interventions as being used, and victims of bullying reported indirect bullying being the most common type of bullying they experienced. Decreased feeling of self-worth is reported in the qualitative research data in regards to bullying. Boarding students reported issues regarding personal safety, need for social relationships, self-worth, and unacceptability of bullying. Implications for practice for the private school are discussed, focusing on the outcome of this study.

Le sous-continent latino-américain vit dans une pauvreté endémique où la lutte pour la survie est au quotidien. Les peuples deviennent de plus en plus pauvres et la vie de la personne humaine est méprisée. Est-il question d’une carence de biens matériels ou d’une mauvaise répartition de la richesse? Nous affirmons qu’il s’agit d’une situation de domination, d’oppression et d’injustice institutionnalisée. Ce mémoire tend à faire une lecture de l’éthique théologique de la libération d’Enrique Dussel dans une perspective émancipatoire. Nous partons du principe que cette éthique matérielle de la vie peut donner une réponse à la morale dominatrice établie et peut contribuer à la transformation de la situation injuste. L’éthique théologique de la libération dusselienne analyse l’être latino-américain considéré comme autre par le système en vigueur et cherche à changer qualitativement les conditions réelles de vie de chaque personne en communauté. Pour ce faire, elle repense de façon critique la totalité des principes de la morale dominatrice à partir de la négation de la vie des victimes et propose une alternative qui doit se réaliser ici maintenant dans l’histoire : la libération des victimes dans n’importe quel système de domination. Ce projet tient compte de la dimension spirituelle du peuple latino-américain. Un sous-continent dit majoritairement chrétien se questionne sur la présence de Dieu et de son agir dans la lutte quotidienne pour la libération. Il se demande comment vivre la foi en Dieu dans une situation d’oppression et de lutte pour la libération. C’est à ce parcours que ce mémoire nous convie en nous rappelant constamment qu’un monde meilleur est possible et que le Dieu de la vie n’abandonne pas sa création.

Notre recherche analyse des discours théologiques qui épousent les traits caractéristiques de l’afro-descendance dans des ouvrages de l’Atabaque et de la Conférence Haïtienne des Religieux et Religieuses (CHR). Ces publications permettent de nommer la réflexion théologique afro-brésilienne et haïtienne comme l’expression d’un engagement au sein d’un Brésil multiculturel et métissé et d’une Haïti noire. Elles se réfèrent à la lutte des Afro-descendants et à leur résistance contre ce qu’ils considèrent comme les conséquences de la période de l’esclavage commencée au XVIe siècle qui oppriment encore des Noirs au XXIe siècle et empêchent leur pleine émancipation. Elles font partie d’une démarche postcolonialiste de changement qui inclut l’inculturation et la reconnaissance des forces des religions de matrices africaines dans leur quête d’une pleine libération des Noirs. Notre démarche, basée sur l’étude comparative des contenus de ces théologies développées au Brésil et en Haïti, met en relief des éléments essentiels de deux courants distincts de production théologique de 1986 à 2004. Cette délimitation correspond à la période de publication du résultat de trois consultations sur les théologies noires au Brésil en 1986, en 1995 et en 2004. Les ouvrages de la CHR datent de 1991 à 1999. Notre étude permet de suivre la pratique de la foi chrétienne qui s’y dégage, l’élaboration et le parcours d’évolution de cette pensée. Teologia Negra et théologie haïtienne représentent deux manières distinctes de faire de la théologie noire. Une comparaison entre les deux contextes n’a jamais été faite jusqu’à présent. Cette recherche a conduit au constat selon lequel trois paradigmes peuvent englober les principaux aspects des courants théologiques afro-brésiliens et haïtiens. Nous relevons des convergences et des divergences des paradigmes de l’inculturation libératrice, du postcolonialisme et du pluralisme religieux. La réflexion théologique afro-brésilienne est vue comme une démarche sociopolitique, ancrée surtout dans la promotion des actions positives qui consistent à favoriser l’insertion des Noirs en situation relativement minoritaire dans une société multiculturelle. En Haïti, où les Noirs sont en situation majoritaire, cette réflexion théologique va dans la direction de la sauvegarde des racines historiques en vue de motiver des changements dans une société de Noirs. Cette optique de la question des Noirs, interprétée sous un nouvel angle, offre de nouvelles pistes de réflexion théologique en même temps qu’elle renforce les revendications culturelles des Afro-Brésiliens et des Afro-Haïtiens dans le but d’élaborer un nouveau discours théologique. Notre thèse contribue à mettre en évidence deux institutions qui se dévouent à la cause des Afro-Brésiliens et des Afro-Haïtiens. L’œuvre de l’Atabaque et de la CHR témoigne du fait que celles-ci ont été susceptibles d’agir collectivement en contribuant à la diversité de la réflexion théologique des Afro-descendants, en soutenant un processus de solidarité entre les victimes permanentes du racisme explicite et implicite. Notre étude suscite l’ouverture vers le développement d’une théologie de la rencontre au sein des théologies noires tout en érigeant le défi de construire un réseau Brésil-Haïti à partir des Afro-descendants. Finalement, la spécificité de ces théologies contribue à inspirer le christianisme latino-américain et des Caraïbes et cette réflexion ne se limite pas seulement à ces deux pays, mais s’étend à d’autres contextes latino-américains ou africains.

Les violations aux droits humains causent des milliers de victimes chaque année, des mécanismes de justice sont élaborés afin de répondre à ces crimes, mais les victimes demeurent peu consultées. Par le biais d’entretiens semi-directifs, cette étude présente le point de vue et les attentes des victimes de crimes contre l’humanité du Cambodge et du Rwanda sur la justice. La justice sociale constitue le cadre théorique de cette étude. Les résultats montrent que la justice pénale est centrale à la définition de la justice. La réparation et la vérité en constituent aussi les éléments essentiels. Toutefois, la capacité des tribunaux à rendre compte de la vérité est critiquée par les répondants créant un écart entre ce qu’elles veulent et ce qu’elles obtiennent. La qualité de la prise de décision et du traitement interpersonnel favorise aussi la perception de justice du point de vue des victimes. Les différentes composantes de la justice perçues, comme la punition, la réparation et la procédure, varient toutefois en fonction du contexte social et historique de la victimisation.

La mesure traditionnelle de la criminalité (taux pour 100 000 habitants) pose problème dans l'analyse des variations de la criminalité dans le temps ou l'espace. Le problème est dû au fait que le taux de criminalité est essentiellement déterminé par des infractions moins graves et très fréquentes. La présente étude a permis de tester l’utilité du nouvel outil développé par Statistique Canada qui procure un index de « gravité de la criminalité » dans lequel chaque crime est pondéré par son score de gravité (basé sur les décisions sentencielles moyennes au Canada de 2002 à 2007 pour chaque forme de crime). Appliquées aux statistiques officielles du Québec de 1977 à 2008, nos analyses montrent que l’indice de gravité s’avère une mesure utile pour dresser un portrait plus juste des tendances des crimes violents d’une année à l’autre. Plus exactement, l’indice de gravité montre que le taux de crimes violents est demeuré stable de 1977 à 1992 contrairement à l'image fournie par le taux traditionnel qui montre plutôt une montée fulgurante durant cette période. L’indice de gravité peut également être utile à l’égard des crimes violents pour comparer plus adéquatement les territoires entre eux afin d’établir ceux qui présentent une criminalité plus grave. Cependant, à l’égard de la criminalité globale et des crimes sans violence, l’indice de gravité n’est d’aucune utilité et présente la même lecture de la criminalité que la mesure traditionnelle. Cela s’explique par le fait que ce sont toujours les mêmes infractions (les vols, les méfaits et les introductions par effraction) qui contribuent majoritairement à chacune des deux mesures de la criminalité.

Ce mémoire s’intéresse au changement de la notion d’asile à travers l’incorporation du concept de genre et son impact sur les processus de demande d’asile et l’octroi du statut de réfugié pour les personnes victimes de violences liées au genre au Canada. À partir d’une perspective diachronique sur les transmutations de l’asile et des transformations sociales et culturelles de ce phénomène social, nous enregistrons des tensions et des contradictions qui émanent de son application et des discours qui lui sont reliés. L’observation des dynamiques contradictoires qui s’enchevêtrent dans ce champ indique une tension dialectique entre les droits humains et la citoyenneté, une symbiose dans le développement des droits de la femme et les lois sur les réfugiés et des contradictions comme celles entre le relativisme et l’essentialisme. L’examen du processus de demande d’asile pour les femmes en particulier victimes de violences liées au genre à travers l’analyse des transformations sociales et culturelles signale le caractère éminemment politique de ce phénomène qui situe l’asile au carrefour du procès d’émancipation du sujet politique.

RÉSUMÉ DE LA RECHERCHE Le conflit armé en Colombie est le troisième conflit le plus long du monde, après le problème entre la Palestine et l’Israël et celui entre l’Inde et le Pakistan. La violence organisée qui caractérise ce conflit a des conséquences sur le plan individuel (souffrance psychologique, etc.) et sur le plan collectif (démobilisation sociale par la terreur, modification de la pensée critique, augmentation de la violence commune). Cette violence a poussé des milliers de Colombiens à l’exil. Certaines de ces personnes arrivent au Québec en tant que réfugiés. La présente étude décrit et analyse les effets de la violence organisée subie en Colombie par ces personnes. Elle fait le lien entre ces conséquences et le processus d’intégration des refugiés colombiens dans une région du Québec, la Haute-Yamaska. Le principal objectif de ce mémoire est de répondre à cette question : selon l’expérience des immigrants réfugiés colombiens victimes de violence organisée, quels sont les effets de cette violence sur leur vie actuelle au Québec? Douze récits d’expériences ont été recueillis et analysés à partir d’entrevues semi dirigées auprès des refugiés colombiens. Les résultats de cette étude montrent la nécessité, pour les réfugiés, d’un travail d’élaboration autour de leur propre identité à travers l’expérience vécue; la présence du retrait et de l’isolement comme mécanismes de protection qui se manifestent en terre d’accueil; la reproduction, par un groupe minoritaire, de certains des comportements qui sont jugés violents en terre d’accueil et qui dans le contexte de la terre d’origine avaient un autre sens. Cette différence de sens est accompagnée d’une tolérance différente à la violence dans un groupe de réfugiés et la société d’accueil. L’attitude personnelle positive face aux difficultés ainsi que le soutien du réseau familial ou des nouveaux amis sont des facilitateurs de l’intégration. Finalement, on constate que les effets d’un deuil prolongé freinent l’investissement affectif et personnel en terre d’accueil.
