O presente trabalho versa sobre a aplicação do princípio da igualdade pelo Poder Judiciário. Busca-se analisar de que maneira o mandamento constitucional de igualdade se concretiza no contexto jurídico-evolutivo enquanto princípio de norma de controle, que é justamente no âmbito em que ele é justificado pelo órgão jurisdicional. Saber até onde o juiz constitucional pode ir, conhecer seus limites de atuação, parcos ou largos, definíveis ou nubilosos, bem como o que vem contido nessa vertente do princípio que o distingue de um enunciado geral da igualdade, faz dessa dissertação um estudo interdisciplinar, mas que não deixa de ser voltado para o entendimento jurídico-normativo dessa função específica do princípio. A conhecida fórmula da proibição do arbítrio recebe uma leitura que não é inovadora, mas que almeja aferir a sua suficiência no exercício daquela função. Ou algo mais vem a ser exigido do princípio? Desde já uma resposta de tal envergadura não pode ser encontrada sem o retrato da jurisprudência respectiva. Por isso que, ao fim, e sem a pretensão de esgotamento, se optou por conhecer alguns dos julgados do Tribunal Constitucional português sobre o tema proposto. A indicação da disfunção ou não do perfil da referida Corte com a posição doutrinária só pode ser resultante da análise conclusiva sobre o tema. Fica o convite à leitura.

A presente dissertação busca abordar a questão da restrição ao direito fundamental de liberdade da pessoa toxicodependente no Brasil, consistente, precisamente, na internação forçada para o tratamento de sua saúde e/ou para a segurança pública, sob o olhar do princípio constitucional da dignidade da pessoa humana em suas dimensões positiva, que exige uma obrigação de fazer por parte do Estado, e negativa, que cobra deste uma postura omissiva de proteção, em torno de um mesmo indivíduo; sem se olvidar do interesse público na execução da medida. Para tanto, ao longo do trabalho, a legislação brasileira atinente ao tema é posta em comparação com a sua correspondente portuguesa e, à luz, basicamente, das doutrinas desses países, são examinados direitos afetos à liberdade individual e ao direito social à saúde, sob a costura do apontado princípio estruturante das respectivas Constituições, de modo a permitir a visualização do amparo da medida restritiva no texto maior brasileiro e, ao final, uma análise crítica à ponderação de bens (direitos) realizada pelo legislador ordinário, com possíveis soluções para a sua aplicação em concreto, quando da análise da proporcionalidade da intervenção da liberdade pelo Poder Judiciário.

Let A be a simple, unital, finite, and exact C*-algebra which absorbs the Jiang-Su algebra Z tensorially. We prove that the Cuntz semigroup of A admits a complete order embedding into an ordered semigroup which is obtained from the Elliott invariant in a functorial manner. We conjecture that this embedding is an isomor phism, and prove the conjecture in several cases. In these same cases - Z-stable algebras all - we prove that the Elliott conjecture in its strongest form is equivalent to a conjecture which appears much weaker. Outside the class of Z-stable C*-algebras, this weaker conjecture has no known counterexamples, and it is plausible that none exist. Thus, we reconcile the still intact principle of Elliott's classification conjecture -that K-theoretic invariants will classify separable and nuclear C*-algebras- with the recent appearance of counterexamples to its strongest concrete form.

A major achievement of new institutionalism in economics and political science is the formalisation of the idea that certain policies are more efficient when administered by a politically independent organisation. Based on this insight, several policy actors and scholars criticise the European Community for relying too much on a multi-task, collegial, and politicised organisation, the European Commission. This raises important questions, some constitutional (who should be able to change the corresponding procedural rules?) and some political-economic (is Europe truly committed to free and competitive markets?). Though acknowledging the relevance of legal and normative arguments, this paper contributes to the debate with a positive political-scientific perspective. Based on the view that institutional equilibria raise the question of equilibrium institutions, it shows that collegiality was (a) an equilibrium institution during the Paris negotiations of 1950-51; and (b) an institutional equilibrium for the following 50 years. The conclusion points to some recent changes in the way that European competition policy is implemented, and discusses how these affect the “constitutional” principle of collegial European governance.

Arbuscular mycorrhizal fungi (AMF) are ancient asexually reproducing organisms that form symbioses with the majority of plant species, improving plant nutrition and promoting plant diversity. Little is known about the evolution or organization of the genomes of any eukaryotic symbiont or ancient asexual organism. Direct evidence shows that one AMF species is heterokaryotic; that is, containing populations of genetically different nuclei. It has been suggested, however, that the genetic variation passed from generation to generation in AMF is simply due to multiple chromosome sets (that is, high ploidy). Here we show that previously documented genetic variation in Pol-like sequences, which are passed from generation to generation, cannot be due to either high ploidy or repeated gene duplications. Our results provide the clearest evidence so far for substantial genetic differences among nuclei in AMF. We also show that even AMF with a very large nuclear DNA content are haploid. An underlying principle of evolutionary theory is that an individual passes on one or half of its genome to each of its progeny. The coexistence of a population of many genomes in AMF and their transfer to subsequent generations, therefore, has far-reaching consequences for understanding genome evolution.

Hybrid is often used as a default attribute reflecting lack of clear understanding of the influence of new patterns and actors of structural change beyond states, firms and institutions traditionally involved in regulatory practices across nations. The article argues that the notion of hybrid has a distinct relevance for engaging shortcomings of global governance literature. It explores the lessons to be drawn from ancient mythology by highlighting that ontological ambiguity and emotional ambivalence represent core features of hybrid creatures. It then builds upon critical scholarship in global political economy to conceptualise three generic levels of transfers of authority at which situating the hybrid dimension of governance in contemporary capitalism. Following this approach, the concept of hybrid explicates the ambiguity between formal and informal transfers of authority, which in turn provides an insight into the contested nature of the procedures used to reinforce this type of governance practices.

1. According to the handicap principle of sexual selection, colourful ornaments honestly signal absolute quality only if they entail fitness costs. The degree of melanism often covaries positively with aspects of individual quality, and hence melanin-based coloration should be costly to produce or to maintain in a good shape. This is, however, unlikely because melanin-based coloration is often strongly heritable and in birds the rate of feather wear decreases with the amount of melanin pigments packed in feathers. 2. The hypothesis that melanin pigments reduce the cost of maintaining colourful ornaments in a good shape predicts a negative correlation between the degree of melanism and both the size of the uropygial gland that produces preening secretions and the intensity of preening behaviour. 3. Using a correlative approach, I evaluated these two predictions in the barn owl Tyto alba in which the body underside varies from immaculate to heavily marked with black spots, a eumelanin-based trait, and from white to reddish-brown, a phaeomelanin-based trait. I correlated plumage traits with preening behaviour in nestlings and with the size and mass of the uropygial gland in dead adults. I also weighed nonornamental wing and tail feathers to assess whether the quality of nonornamental feathers is positively correlated with the degree of melanism of an ornamental plumage trait. 4. The degree of phaeomelanism was neither associated with preening behaviour nor with the size and mass of the uropygial gland. In line with the two predictions, individuals with more and larger black spots had a lighter uropygial gland and preened less frequently. Because nonornamental wing and tail feathers of spottier individuals were heavier per unit of surface area, the entire plumage of eumelanic individuals may be more robust and in turn require less care than the plumage of nonmelanic conspecifics. 5. In conclusion, the degree of eumelanism can be associated with aspects of individual quality even if eumelanic ornaments are neither costly to produce nor to maintain in a good shape. The present work contains a general overview of the sentences of the Inter-American Court of Human Rights (IACtHR), which have recognised that crimes against humanity are pre-existing in customary law, and do not prescribe, nor can they be subject to amnesty or pardon. Specific attention is paid to the consequent restrictions and opportunities offered by said verdicts to countries such as Argentina, Chile, Uruguay and Peru, which find themselves in postconflict transition processes and where peace has been negotiated with certain groups and state structures that are responsible for carrying out crimes against humanity. In doing so, special attention is paid to the impact of the recognition of the nature of crimes against humanity on the notion of the principle of legality, stricto sensu; on the development and evolution of the doctrine and the practice of international human rights law in the inter-American context; and finally on the aforementioned processes of transitional justice.

En aquest treball s’ha dissenyat i fabricat una antena monopol en estructura planar capaç de treballar correctament a les freqüències WLAN de 2,45-2,5 GHz (802.11b/g) i 4,9-5,875 GHz (802.11a/h/j). Per arribar a aquest objectiu primer s’ha presentat el model de línia de transmissió acabada en circuit obert per simular el comportament d’una antena. S’han comparat i verificat els resultats amb el model d’antena de fil. Seguidament, s’ha estudiat el comportament que introdueix el fet de carregar l’antena amb un ressonador LC. Finalment, s’ha passat del model d’antena de fil a una estructura planar. Aquesta geometria ha permès la realització del trap LC de forma distribuïda a través d’un ressonador CLL. El principi de disseny de l’antena està basat en la introducció d’aquest ressonador CLL amb freqüència de ressonància situada entre les dos bandes de treball i que junt amb l’ajust dels diversos paràmetres que defineixen l’antena han permès obtenir més 1 GHz d’ample de banda a la freqüència de 5 GHz.

En aquest projecte s'ha dissenyat i simulat una càmera d'ones mil·limètriques mitjançant "Spinning Reflectors" amb l'objectiu d'estudiar la qualitat de les imatges obtingudes, així com determinar la configuració de reflectors acceptable per a la nostra càmera. Per al seu disseny, s'ha realitzat el model d'una antena Cassegrain amb botzina alimentadora a FEKO i s'han simulat els diagrames de radiació corresponents als diferents angles de rotació d'ambdós reflectors al voltant de l'eix en el qual estan situats. Finalment, a partir del principi de funcionament de la nostra càmera, s'ha exposat la seva implementació física i s'ha representat en Matlab la seva PSF (Point Spread Function) i la imatge d'un objecte arbitrari d'acord amb les tècniques de formació d'imatges.

La “Clínica Jurídica Ambiental” constitueix una experiència d’innovació docent desenvolupada en el marc del Màster Oficial en Dret Ambiental i de la Llicenciatura en Dret de la Universitat Rovira i Virgili des del curs 2005-2006. El mètode clínic, que parteix dels principis de la contextualització de l’aprenentatge en escenaris reals, el model de learning by doing i la redefinició dels rols de l’alumne i del professor en el procés d’ensenyament-aprenentatge, és una estratègia que permet a l’alumne una formació integral orientada a la capacitació professional, d’acord amb el canvi de paradigma educatiu que suposa la creació de l’EEES. Es pretén així assolir una millor qualitat dels titulats a partir d’una formació en competències genèriques i específiques assolibles només amb estratègies d’aprenentatge actiu que facilitin l’autonomia i la responsabilització en la construcció del propi aprenentatge. Paral·lelament, la metodologia obliga a establir mecanismes de coordinació entre el professorat de diverses àrees de coneixement jurídiques. Els alumnes treballen en petits grups, durant el curs acadèmic, sobre un cas real subministrat per un client extern (administracions públiques, fiscalia, ONG,s). Els alumnes tenen un tutor intern, professor, i un tutor extern, que pertany a la institució que ha subministrat el cas. El tutor intern avalua de manera contínua i individual el procés d’aprenentatge de l’alumne (60% de la qualificació final); l'extern avalua el resultat final (40 % de la qualificació final), que s’ha de presentar com a treball de grup quan finalitza el curs acadèmic. El finançament atorgat per l’AGAUR, en el marc de la convocatòria MQD 2006, ha permès introduir millores significatives en aquest projecte: la introducció de la figura dels practitioners (advocats en exercici) en l’equip docent; l’organització d’un Seminari Internacional sobre Clinical Legal Education, i la realització de sessions plenàries formatives pels professors i els alumnes de la Clínica.

Water scarcity is a long-standing problem in Catalonia, as there are significant differences in the spatial and temporal distribution of water through the territory. There has consequently been a debate for many years about whether the solution to water scarcity must be considered in terms of efficiency or equity, the role that the public sector must play and the role that market-based instruments should play in water management. The aim of this paper is to use a Computable General Equilibrium (CGE) model to analyze the advantages and disadvantages associated with different policy instruments, from both a supply and a demand viewpoint, which can be applied to water management in Catalonia. We also introduce an ecological sector in our CGE model, allowing us to analyze the environmental impact of the alternative policies simulated. The calibration of the exogenous variables of the CGE model is performed by using a Social Accounting Matrix (SAM) for the Catalan economy with 2001 data. The results suggest that taking into account the principle of sustainability of the resource, the policy debate between supply and demand in water policies is obsolete, and a new combination of policies is required to respect the different values associated with water. Projecte de recerca elaborat a partir d’una estada al Universitat de Bonn, Alemanya, entre juliol i desembre del 2008. Aquesta investigació conté algunes observacions sobre el fenomen de l’europeització del Dret penal dels Estats membres de la Unió Europea. En particular, tracta de profunditzar en les implicacions de la vinculació del legislador penal nacional tant a les regulacions europees com al principi de proporcionalitat i d’altres principis essencials del Dret penal. En primer lloc, la investigació descriu els instruments normatius que permeten a la Comunitat Europea i a la Unió Europea influir en el Dret penal dels Estats membres. Després, la investigació se centra en analitzar el exemple dels §§ 232 i 233 Codi penal alemany, els quals implementen la Decisió marc de 19 de juliol del 2002 respecte la lluita contra el tràfic d’éssers humans. En aquest cas, el legislador alemany ha complit els seus compromisos europeus, però no ha respectat el principi de proporcionalitat, ja que ha introduït incoherències dins el Dret penal alemany. Sobre la base dels resultats d’aquest anàlisi, aquesta investigació formula algunes propostes per una adequada “europeització” del Dret penal dels Estats membres de la Unió Europea i, en particular, per a una adequada tècnica legislativa dels Estats membres. En aquest context, el treball emfatitza la corresponsabilitat de la Comunitat Europea i la Unió Europea, per una banda, i els Estats membres, per l’altra, en aquest procés d’europeització. Per últim, la investigació conclou amb algunes observacions sobre la coordinació de la política criminal europea amb les polítiques criminals dels Estats membres.

La importància de la formació permanent és indiscutible en qualsevol context laboral i molt especialment en les actuals circumstàncies de crisi econòmica mundial. Però en l'actual espai europeu d'educació superior (EEES), les tendències i els plans de formació contínua adquireixen una dimensió global, que supera o, millor dit, hauria de superar els plantejaments reduccionistes. Per això, la construcció i el desenvolupament de l'espai europeu de formació permanent, EEFP (Comissió de les Comunitats Europees, 2001a), ha d'entendre's com un procés que està immers en un teixit més ampli. Es tracta d'una acció en xarxa on és necessària la implicació de molts agents actius professionals i on la convergència, el reconeixement i la cohesió han de ser els seus màxims elements qualitatius

 Public reporting of quality indicators promotes the principle of a transparent and accountable health care system that encourages a continuing focus on improving the quality of care it provides. This work brings us a step further in enhancing the quality and safety of our system. It is important that this report is not relied upon to draw conclusions on quality of care. That was not the purpose of the exercise. The data is mostly over five years old and was collected from the system before the improvements to collection and reporting of information that the hospitals were asked to put in place as part of the work to prepare this report. The Department of Health will produce a report of quality indicators based on data from 2011 to 2013 inclusive later in 2014 which will identify regions and hospitals. A governance process will shortly be established to oversee the selection and reporting of these indicators. This system will report at national and regional level and will be aligned with international systems so that international comparisons can be reported. The publication of this report is an important step in the development of this national reporting system. It shows that we can use a major IT system called HIPE which captures information on all hospital stays in all public hospitals to examine quality and safety of care.
