There have been two main approaches to feature detection in human and computer vision - luminance-based and energy-based. Bars and edges might arise from peaks of luminance and luminance gradient respectively, or bars and edges might be found at peaks of local energy, where local phases are aligned across spatial frequency. This basic issue of definition is important because it guides more detailed models and interpretations of early vision. Which approach better describes the perceived positions of elements in a 3-element contour-alignment task? We used the class of 1-D images defined by Morrone and Burr in which the amplitude spectrum is that of a (partially blurred) square wave and Fourier components in a given image have a common phase. Observers judged whether the centre element (eg ±458 phase) was to the left or right of the flanking pair (eg 0º phase). Lateral offset of the centre element was varied to find the point of subjective alignment from the fitted psychometric function. This point shifted systematically to the left or right according to the sign of the centre phase, increasing with the degree of blur. These shifts were well predicted by the location of luminance peaks and other derivative-based features, but not by energy peaks which (by design) predicted no shift at all. These results on contour alignment agree well with earlier ones from a more explicit feature-marking task, and strongly suggest that human vision does not use local energy peaks to locate basic first-order features. Illiteracy is often associated with people in developing countries. However, an estimated 50 % of adults in a developed country such as Canada lack the literacy skills required to cope with the challenges of today's society; for them, tasks such as reading, understanding, basic arithmetic, and using everyday items are a challenge. Many community-based organizations offer resources and support for these adults, yet overall functional literacy rates are not improving. This is due to a wide range of factors, such as poor retention of adult learners in literacy programs, obstacles in transferring the acquired skills from the classroom to the real life, personal attitudes toward learning, and the stigma of functional illiteracy. In our research we examined the opportunities afforded by personal mobile devices in providing learning and functional support to low-literacy adults. We present the findings of an exploratory study aimed at investigating the reception and adoption of a technological solution for adult learners. ALEX© is a mobile application designed for use both in the classroom and in daily life in order to help low-literacy adults become increasingly literate and independent. Such a solution complements literacy programs by increasing users' motivation and interest in learning, and raising their confidence levels both in their education pursuits and in facing the challenges of their daily lives. We also reflect on the challenges we faced in designing and conducting our research with two user groups (adults enrolled in literacy classes and in an essential skills program) and contrast the educational impact and attitudes toward such technology between these. Our conclusions present the lessons learned from our evaluations and the impact of the studies' specific challenges on the outcome and uptake of such mobile assistive technologies in providing practical support to low-literacy adults in conjunction with literacy and essential skills training. © 2013 Her Majesty the Queen in Right of Canada.

Ironically, the “learning of percent” is one of the most problematic aspects of school mathematics. In our view, these difficulties are not associated with the arithmetic aspects of the “percent problems”, but mostly with two methodological issues: firstly, providing students with a simple and accurate understanding of the rationale behind the use of percent, and secondly - overcoming the psychological complexities of the fluent and comprehensive understanding by the students of the sometimes specific wordings of “percent problems”. Before we talk about percent, it is necessary to acquaint students with a much more fundamental and important (regrettably, not covered by the school syllabus) classical concepts of quantitative and qualitative comparison of values, to give students the opportunity to learn the relevant standard terminology and become accustomed to conventional turns of speech. Further, it makes sense to briefly touch on the issue (important in its own right) of different representations of numbers. Percent is just one of the technical, but common forms of data representation: p% = p × % = p × 0.01 = p × 1/100 = p/100 = p × 10-2 "Percent problems” are involved in just two cases: I. The ratio of a variation m to the standard M II. The relative deviation of a variation m from the standard M The hardest and most essential in each specific "percent problem” is not the routine arithmetic actions involved, but the ability to figure out, to clearly understand which of the variables involved in the problem instructions is the standard and which is the variation. And in the first place, this is what teachers need to patiently and persistently teach their students. As a matter of fact, most primary school pupils are not yet quite ready for the lexical specificity of “percent problems”. ....Math teachers should closely, hand in hand with their students, carry out a linguistic analysis of the wording of each problem ... Schoolchildren must firmly understand that a comparison of objects is only meaningful when we speak about properties which can be objectively expressed in terms of actual numerical characteristics. In our opinion, an adequate acquisition of the teaching unit on percent cannot be achieved in primary school due to objective psychological specificities related to this age and because of the level of general training of students. The crisis of the model of technical and formal rationality is discussed in light of a paradigmatic change of the Law that arises in the context of recent transformations of capitalism worldwide, proposing a humanization of Law and Justice with a new ethical-political foundation that promotes a reconciliation between the rules that governs the social order and the world of life, a process of society’s emancipation. As empirical cut it is taken the Right of Children and Youth and, in a practical perspective, the recognition and effectiveness of the Rights of Children and Adolescents in Brazil. It is proposed to analyze the process of democratization and legitimacy of the children and youth rights from the study and apprehension of knowledge that advocate a multidisciplinary view of knowledge and a dialogic praxis for construction of a thought able to contribute to the analysis of public policies and to develop strategies that allow a real change on the social thinking about the doctrine of integral protection of children and adolescents. The proposed methodological approach was developed from a dialectical view of science and as a research strategy for data collection of symbolic cartography or cartographic sociology of law and justice. It is shown that in the process of humanization of the Law and Justice there is a gap between the rights and the democratic participation of these rights.

This dissertation deals with the constitutional limits on the exercise of patent rights and its effects on the oil, natural gas and biofuels. Held with the support of ANP / PETROBRAS, It seeks to show how the law will limit the exercise of industrial property, based on a reinterpretation of private law by the constitutional development perspective . Today it is a fact that Petrobras, a Brazilian joint venture, has the latest technology in various sectors of the oil industry, and is one of the highest investments in developing new technologies. The overall objective of this thesis is to establish the relationship between the public interest of the Petroleum Industry, Natural Gas and Biofuels and constitutional limits to the free exercise of patent rights, then confirm or refute our hypothesis that Article 71 on Industrial Property Law is contrary to the existing objectives in Article 3 of the Constitution of the Federative Republic of Brazil. The research aims to examine the relevant aspects of the legal nature attributed to IPGN constitutionally confronting the constitutional limits on the free exercise of patent rights, with the purpose to outline the state of the performance limits in the regulation of the economy, in particular the application of feasibility limitations on the right of property in favor of national interest on the strategic energy industry. The aim is to confront the fundamental rights to property and economic development, against the public interest, limiting these first. As to the objectives, the research will be theoretical and descriptive and harvest of industrial property, respect the possible impact of regulatory standards and limiting the right of ownership in the oil industry. To establish how the state will mitigate the intellectual property right, we discuss, at first, a definition of public interest from the general theory of state and sovereign character in order to establish a new concept of national interest and popular interest, which will in turn the definition of our concept of public interest. In the second phase, will be addressed the issue of industrial property rights and how to will be free exercise thereof, in the constitutional sphere, infra, and demonstrating the use of industrial property rights with examples of market and IPGN . After situating the industrial property rights in the constitution and national legislation, establish their relationship with the national and regional development, will be addressed in this chapter in particular the patent law, as most usual form of intellectual property protection in IPGN. Used a study highlighting the number of patents in the area of the analyzed industry, demonstrating with hard data the importance of a sector for industrial development. The relationship between the social function of intellectual property and the constitutional objective of development was characterized to demonstrate the strategic nature of oil to Brazil in the national and international scene, and put into question the hypothesis of the research which provides that even with large investments the lack of legal certainty in the sector turns out not to have a considerable volume of investment as it could.

In the context of current capitalist society, marked by the logic that restricts the human person their status as workforce, in order to generate profits, old age is often treated as an underprivileged life stage. This reality becomes more intense considering the sharp aging process that affects brazilian society is accompanied by the country's entry into a globalized world and tensioned by the dictates of capital. Thus, despite the increasing development of policies to strengthen the guarantee of elderly rights, it is necessary to establish effective strategies of these measures to ensure a higher quality of life to these subjects. Therefore, it is necessary to develop studies that problematize the issue of the elderly, which represent a growing portion of the population, and hence have more visible demands, including in health. With the increase in the elderly population in Brazil it is possible to realize the country is going through a demographic transition and epidemiological changes that contribute to change the landscape of health care of the elderly, especially the hospitalization. Thus, this study aimed to analyze the multiple aspects of ensuring the rights of elderly patients admitted to the State Hospital Dr. Ruy Pereira dos Santos (HRPS), located in Natal / RN, whose most patients are elderly. Specifically sought to understand the aging process, its social consequences and the vulnerability to which it is exposed, especially during the disease situation; understand the process of construction of the Brazilian public health and their actions for older people; learn the expressions of citizenship formation in Brazil with regard to policies for older people; and investigate the design of health professionals about the guarantee of the right of hospitalized elderly. Starting from an integrated coordinated theoretical and practical possibilities, a qualitative research and literature character, documentary and field was held. For this, there were four semi-structured interviews with health research locus Hospital professionals - namely, two social workers, a doctor and a nurse - as well as life stories with the hospitalized elderly patients, one in each deck the said Hospital, totaling three. The results pointed to the difficulty of health policy become effective as law and stressed one historical scenario violation of the rights of elderly hospitalized patients, which persists due to the precarious situation and the difficulty of effective implementation of the Unified Health System (SUS ) and other public policies to that end.

Cette recherche constitue un essai de théorie critique féministe matérialiste et radicale. Elle poursuit principalement un objectif de dénonciation de la structure actuelle du droit du logement. À partir d’un cadre conceptuel fondé sur le féminisme matérialiste et radical, elle souhaite faire ressortir le point de vue de la classe des femmes dans l’habitation. Le droit du logement est ici utilisé dans un sens large, puisqu’il se réfère à la fois au logement comme phénomène juridique, mais aussi sociologique. À l’intérieur de la discipline juridique, il renvoie à l’ensemble des législations actuellement en vigueur au Québec en ce qui concerne la vie à domicile. Notre étude se concentre sur deux modes d’occupation des lieux, à travers le droit de propriété et le système locatif. Le droit au logement fait l’objet d’une reconnaissance internationale dans les textes portant sur les droits humains. Il est reconnu comme le « droit à un logement suffisant ». Au Canada et au Québec, il ne fait pas l’objet d’une reconnaissance explicite, malgré les engagements pris sur la scène internationale. Un portrait statistique, appuyé sur le critère du sexe, permet de mettre en évidence qu’il existe des écarts entre les hommes et les femmes en ce qui concerne la mise en application du droit du logement. Les femmes accèdent plus difficilement à un logement; elles y effectuent la majorité du travail domestique, de service et de « care » et elles sont les principales victimes des violences commises à domicile. Dans le système d’habitation, l’expérience des femmes se comprend comme une appropriation à la fois privée et collective par la classe des hommes, telle que réfléchie par Colette Guillaumin, qui se concentre autour de la division sexuelle du travail et des violences sexuées. Le droit du logement, dans sa forme actuelle, repose sur l’appropriation de la force de travail des femmes et de leur corps. Ces deux critères permettent de construire une grille d’analyse féministe matérialiste et radicale pour analyser la structure du droit du logement, tel que conçu en droit civil. Cette analyse féministe permet également de situer le droit étatique comme une pratique patriarcale. Cette dernière contribue à assurer le maintien du système d’habitation, qui est assimilable à un système hégémonique, au sens développé par Gramsci. Cette étude réfléchit sur le droit du logement dans le climat politique néolibéral. Le néolibéralisme est développé comme une idéologie qui impose une rationalité marchande à l’ensemble des politiques étatiques. À partir d’une méthode décrite comme métathéorique externe radicalement réflexive, puisqu’elle propose l’importation d’outils conceptuels étrangers à la discipline du droit moderne, nous réfléchissons de manière radicale la construction du droit civil et des institutions qui encadrent le droit du logement. La collecte des données s’effectue à partir de la recherche documentaire. Quatre institutions du droit civil seront examinées dans le détail, soit le sujet du droit, la dichotomie privé/public, la médiation du droit du logement par les biens immeubles, à travers le rapport contractuel et le droit de propriété, et finalement les notaires. L’analyse féministe du sujet du droit insiste sur un paradoxe. D’une part, l’universalité présumée de ce sujet, laquelle permet de poser l’égalité et la liberté pour toutes les personnes juridiques. Or, plutôt que d’être neutre sexuellement comme le prétend le droit positif, nous démontrons comment ce sujet est constamment un membre de la classe des hommes. D’autre part, nous analysons comment le droit reconnaît le sexe de ses sujets, mais surtout comment cette sexualité est construite sur l’idéologie naturaliste. Ce modèle de sujet masculin est fondamental dans la construction du droit du logement. L’étude féministe de la dichotomie privé/public en fait ressortir le caractère situé. En effet, si par essence aucun domaine ou enjeu n’est en soit privé ou public, le processus de qualification, lui, est un acte de pouvoir. Nous verrons comment le droit civil crée des zones de droit privé, comprises comme des zones de non-droit pour les femmes. La qualification de privé dévalue également le travail accompli par cette classe de sexe. Le droit du logement est pourtant centré sur le rapport contractuel et sur le droit de propriété. Il importe alors d’examiner la nature du consentement donné par les femmes comme groupe social dans les contrats de vente et de location. Ces contrats ne prennent pas en compte l’expérience des femmes dans leur formation. Les catégories qui y sont attachées, telles que vendeur.e ou locataire, représentent le point de vue de la classe des hommes. Bien que la popularité de la copropriété auprès de la classe des femmes semble porteuse d’un vent de changement, nous analysons comment le discours dominant qui l’entoure instrumentalise certaines revendications féministes, tout en laissant dans l’ombre la question du travail domestique et des violences sexuées. Finalement, nous nous intéressons aux notaires en les repensant comme des intellectuel.les organiques, tels que conçu.es par Gramsci, pour la classe des hommes. Cette fonction d’intellectuel.les permet de mettre en lumière comment chaque transaction immobilière favorise la reproduction des intérêts patriarcaux, remettant ainsi en question la nature des devoirs de conseil et d’impartialité du notariat. À la lumière de cette analyse, le Code civil du Québec est qualifié dans une perspective féministe matérialiste et radicale pour devenir un système qui institutionnalise l’appropriation des femmes par l’entremise du droit du logement. Ce travail de recherche permet d’envisager certaines pistes de réflexion pour des rénovations potentielles des pratiques juridiques entourant le droit du logement, notamment la pratique notariale, tournées vers des objectifs féministes de justice sociale.

In August 2000, the federal government began an internal review of the Access to Information Act (ATIA). The ATIA gives Canadians a qualified right of access to records held by federal institutions. Decisions about reform should be based on good evidence about the operation of the Act and the likely impact of proposed reforms. This paper describes how data on ATIA operations is collected by federal institutions and provides a guide to academic researchers interested in conducting empirical research on the operation of the law. It constructs a small dataset that describes the processing of a sample of 663 requests received in 1999, and uses this dataset to illustrate the potential of an evidence-based approach to ATIA reform. Cuando se aprueba la Constitución Española en 1978, España se convierte en un Estado aconfesional, reconociendo por primera vez un verdadero derecho de libertad religiosa de todos los individuos. Precisamente, el ejercicio de esta libertad en una situación de igualdad ha originado diversas polémicas desde que se instauró la democracia. Una de las controversias que más repercusión ha tenido en los últimos años viene determinada por la presencia de los crucifijos u otros símbolos en las aulas de algunos colegios públicos, cuestión que ha sido abordada por los tribunales españoles, así como por el Tribunal Europeo de Derechos Humanos.

The first of a number of public commentaries contributing to the mid-eighteenth century debate over the nature of literary property (see also: An Enquiry into the Nature of Literary Property (uk_1762a); An Argument in Defence of Literary Property (uk_1774a)).
Warburton, a strong proponent of the common law rights of the author, provided the first significant commentary upon the nature and classification of property and its relevance to, and relationship with, an author's work. Part of this commentary discusses Warburton's attempts to articulate a clear conceptual distinction between the claim of an inventor to the protection of a patent provided by the state, and the natural right of an author to the property in his work.

Lord Mansfield, leading a majority decision of the court, provides a robust and influential justification as to the existence of an author's rights in literary property at common law. Yates, J., focussing upon the potential detriment to the public that would flow from the existence of a perpetual right, provides the dissenting opinion. The commentary explores the background to the litigation, in particular the nature of the threat which the Scottish reprint industry posed to the London book trade, relevant case-law leading up to the decision, as well as the substance of the judicial opinions.

Este trabalho analisa as políticas de ação social escolar no ensino superior público a partir da década de 60, nomeadamente na atribuição de bolsas de estudo a estudantes da Universidade de Coimbra. Analisa ainda as alterações que estas políticas têm vindo a sofrer ao longo dos anos e a sua relação com o direito ao ensino e igualdade de oportunidades de acesso e êxito escolar consagrado na Constituição Portuguesa. O Serviço Social tem uma intervenção relevante nos Serviços de Ação Social da Universidade de Coimbra, em várias áreas, praticamente desde a sua criação. Neste trabalho, a análise das práticas do Serviço Social centra-se na atribuição de bolsas de estudo, nos últimos 10 anos. Trata-se de um estudo exploratório realizado com base em pesquisa bibliográfica e documental. Outra fonte de recolha de informação foi a entrevista, realizada à Assistente Social, e Responsável pelo Serviço de Bolsas entre 1978 e 2012, Dra. Elisa Decq Motta. As alterações às políticas de ação social no que se refere à atribuição de bolsas de estudo, relacionadas com o cálculo dos rendimentos ou com as condições de elegibilidade, têm vindo a pôr em causa o direito à igualdade de oportunidades dos estudantes, no acesso e na permanência no ensino superior. Muitos deles, economicamente carenciados, estão a ficar de fora do sistema de ação social no ensino superior em virtude destas alterações. É preocupação dos Serviços de Ação Social da Universidade de Coimbra a regressão a que se tem vindo a assistir, e as suas consequências para os estudantes do ensino superior, pelo que é urgente inverter este caminho. / This study analyses the academic social policies in the high-level educational institutions since the 60’s, namely in the allocation of scholarships to students from the University of Coimbra. Furthermore, the changes that such policies have been suffering over the last years, and their relationship with the right to education and equal opportunities to the access and scholar success that every citizen has, as stated by the Portuguese Constitution, are also examined. Since its establishment, the Social Service is a relevant area of the Social Services of the University of Coimbra, in several areas. The analyses present in this study will focus on the last 10 years, specifically on the scholarships allocation. This study is based on literature and documents research, as well as on an interview to the Social Worker responsible for the Scholarships Service from 1978 to 2012, Dra. Elisa Decq Motta. The social policies changes related with the scholarships assignment, especially those associated with the income assessment and eligibility conditions are serious hindrances to the right of equal admission opportunity and maintenance in higher education that all students have. Due to these changes, several students with financial issues are not supported by the social service in higher education. The observed changes, and its consequences for students are a matter of concern for the Social Services of University of Coimbra. It is imperative to revert the current situation.

Ouvir a voz das crianças e valorizar o seu papel no entendimento da vida das suas comunidades foi o ponto essencial nesta investigação. Procuramos partir das suas perceções sobre a realidade do Bairro e do Parque que ocupa parte do seu território, para um diálogo centrado na procura e discussão de soluções para problemas por elas identificados em iniciativas anteriores. Partindo da ideia de Tonucci, partilhada por muitos outros autores, de que o que é bom para a qualidade de vida e autonomia das crianças na Cidade é bom para todos os grupos sociais que a (co)habitam, convidamos as crianças a observar e a reimaginar o Parque como espaço público e como lugar de convivência entre pessoas de todas as idades. O objetivo deste trabalho foi analisar as condições locais com que se tem procurado que os interesses e as opiniões crianças sejam tidas em conta nas decisões que visem a melhoria do Parque de Santiago, de forma a que o Bairro deixe de ser considerado, como um território de exclusão. Pretendemos também que a participação das crianças possa ser reconhecida, neste processo, como um parâmetro da qualidade da vida urbana. Tendo como referência a metodologia de investigação-ação participativa, partiu-se da escuta e debate de opiniões já expressas, para a organização das crianças como um sujeito coletivo capaz de reclamar o direito de todas as crianças ao Parque se Santiago, como espaço de lazer e tempos livres e espaço público relevante para a vida do bairro, da comunidade e para a Cidade de que é parte.

O conceito de Escola Inclusiva reforça o direito de todos os alunos frequentarem o mesmo tipo de ensino, preconizando um modelo de atendimento adequado a cada um. Com a publicação de nova legislação entre 2009 e 2012, a escola, ao nível do ensino secundário, encontra-se perante o repto de responder a um grupo de alunos cada vez mais heterogéneo, nomeadamente a alunos com Currículo Específico Individual (CEI). O que implica a existência de novos desafios para as escolas e para os professores. Este estudo essencialmente quantitativo, visa identificar e descrever as atitudes e práticas de professores do ensino secundário, relativamente à inclusão de alunos com CEI na sala de aula, assim como identificar e descrever as dificuldades sentidas pelos mesmos. No que diz respeito à recolha da informação, recorreu-se à opção do inquérito por questionário a 94 professores do ensino secundário. Os resultados obtidos mostram-nos que, no geral, os professores revelam atitudes e práticas favoráveis à inclusão dos alunos com CEI na sala de aula, no entanto, quando se aprofunda a questão, nos itens de resposta descritiva, as atitudes e práticas não são tão favoráveis como as perguntas fechadas pareciam revelar. Concluiu-se que as variáveis “género” e “idade” exercem influência sobre as atitudes, enquanto o “grau académico” e a “experiência profissional a lecionar turmas com alunos com CEI” influenciam as práticas pedagógicas dos professores inquiridos. Por sua vez, a “formação na área da Educação Especial (EE)” influência de forma significativa as atitudes dos professores inquiridos, bem como de forma menos significativa as práticas. Os professores referem como principais dificuldades a existência de um número elevado de alunos por turma, a falta de equipamento pedagógico/didático adequado, a falta de formação em EE e de técnicos, bem como dificuldades na elaboração de um Currículo Específico Individual e na gestão do currículo. As dificuldades sentidas são influenciadas pelas variáveis “funções desempenhadas” e “formação na área da EE”. Sendo esta última essencial para a superação das dificuldades sentidas.
