Complemento do Inventário Florestal Comercial, DST (s/d) - levantamento de árvores com DAP maior ou igual a 25 cm. Neste caso, o objetivo principal do inventário foi a regeneração natural pré-existente das espécies listadas (EL), desde as plântulas até as mudas estabelecidas, através da amostragem linear em quadrados de 2 x 2 metros. Num outro nível, quadrados de 10 x 10 metros, as classes superiores às mudas estabelecidas foram observadas para se ter uma idéia do grau de ocupação e desenvolvimento das EL e da floresta como um todo. Outras características foram observadas durante as coletas de dados. A ênfase maior, entretanto, é sobre o Índice de estocagem das EL, parâmetro que vai permitir a formulação dos níveis de intervenção na floresta natural de modo a encaixar nos objetivos do projeto de Manejo Ecológico e Exploração da Floresta Tropical Úmida, na Bacia 3.

The global and increasingly technological society requires the States to adopt security measures that can maintain the balance between the freedom, on the one hand, and the security and the respect for fundamental rights of a democratic state, on the other. A State can only achieve this aim if it has an effective judicial system and in particular a criminal procedure adequate to the new criminogenic realities. In this context, the national legislator has adopted, following other international legal systems, special means of obtaining proof more stringent of rights. Within those special means are included the covert actions, that, being a means to use sparingly, is a key element to fight against violent and highly organized crime. Therefore, the undercover agent, voluntary by nature, develops a set of activities that enables the investigation to use other means of taking evidence and/or probationary diligences itself, with the purpose of providing sufficient proof to the case file. In this milieu, given the high risks involved during the investigation, as well as after its completion, the undercover agent can act upon fictitious identity. This measure can be maintained during the evidentiary phase of the trial. Similarly, given the latent threat that the undercover agent suffers by its inclusion in criminal organizations, as well as the need for his inclusion in future covert actions it is crucial that his participation as a witness in the trial is properly shielded. Thus, when the undercover agent provides, exceptionally, statements in the trial, he shall do so always through videoconference with voice and image distortion. This measure can guarantee the anonymity of the undercover agent and concomitantly, that the adversarial principle and the right of the accused to a fair trial is not prejudiced since, in those circumstances, the diligence will be supervised in its entirety (in the audience and with the undercover agent) by a judge.

Images have gained a never before seen importance. Technological changes have given the Information Society extraordinary means to capture, treat and transmit images, wheter your own or those of others, with or without a commercial purpose, with no boundaries of time or country, without “any kind of eraser”. From the several different ways natural persons may engage in image processing with no commercial purpose, the cases of sharing pictures through social networks and video surveillance assume particular relevance. Consequently there are growing legitimate concerns with the protection of one's image, since its processing may sometimes generate situations of privacy invasion or put at risk other fundamental rights. With this in mind, the present thesis arises from the question: what are the existent legal instruments in Portuguese Law that enable citizens to protect themselves from the abusive usage of their own pictures, whether because that image have been captured by a smartphone or some video surveillance camera, whether because it was massively shared through a blog or some social network? There is no question the one's right to not having his or her image used in an abusive way is protected by the Portuguese constitution, through the article 26th CRP, as well as personally right, under the article 79th of the Civil Code, and finally through criminal law, articles 192nd and 193rd of the Criminal Code. The question arises in the personal data protection context, considering that one's picture, given certain conditions, is personal data. Both the Directive 95/46/CE dated from 1995 as well as the LPD from 1998 are applicable to the processing of personal data, but both exclude situations of natural persons doing so in the pursuit of activities strictly personal or family-related. These laws demand complex procedures to natural persons, such as the preemptive formal authorisation request to the Data Protection National Commission. Failing to do so a natural person may result in the application of fines as high as €2.500,00 or even criminal charges. Consequently, the present thesis aims to study if the image processing with no commercial purposes by a natural person in the context of social networks or through video surveillance belongs to the domain of the existent personal data protection law. To that effect, it was made general considerations regarding the concept of video surveillance, what is its regimen, in a way that it may be distinguishable from Steve Mann's definition of sousveillance, and what are the associated obligations in order to better understand the concept's essence. The application of the existent laws on personal data protection to images processing by natural persons has been analysed taking into account the Directive 95/46/CE, the LPD and the General Regulation. From this analysis it is concluded that the regimen from 1995 to 1998 is out of touch with reality creating an absence of legal shielding in the personal data protection law, a flaw that doesn't exist because compensated by the right to image as a right to personality, that anyway reveals the inability of the Portuguese legislator to face the new technological challenges. It is urgent to legislate. A contrary interpretation will evidence the unconstitutionality of several rules on the LPD due to the obligations natural persons are bound to that violate the right to the freedom of speech and information, which would be inadequate and disproportionate. Considering the recently approved General Regulation and in the case it becomes the final version, the use for natural person of video surveillance of private spaces, Google Glass (in public and private places) and other similar gadgets used to recreational purposes, as well as social networks are subject to its regulation only if the images are shared without limits or existing commercial purposes. Video surveillance of public spaces in all situations is subject to General Regulation provisions.

This dissertation analyzes how the current Constitution and the Brazilian law establish consumer protection, arbitration and access to justice. Following we try to demonstrate why arbitration is a method rarely used in the resolution of consumer disputes in Brazil. It also examines the doctrinal and jurisprudential aspects of the conflict between the Brazilian Arbitration Law (Law nº. 9.307/96), which allows the arbitration clause in contracts of adhesion, and the Consumer Protection Code (Law nº 8.078/90) that in article 51, VII, considers as abusive the arbitration clause. Furthermore, analyzes new proposed bills under scrutiny by the National Congress on the issue and identifies the causes, in the Brazilian legal system, hampering the use of arbitration in consumer relations. Concludes that there are no principle obstacles preventing consumer litigations to be settled by arbitration. High costs, mistrust, oppression, misinformation of consumers and non-participation of the State, being a totally private institute, are factors that generate distrust, suspicion, and have prevented the development of arbitration in consumer relations in Brazil.

Apresenta um modelo matemático para expressar a taxa de regeneração natural em florestas tropicais, através dos valores de abundância. 0 modelo proposto e. o seguinte-.tr = { (A1/A0)- 1 }. 100, onde:tr = taxa de regeneração natural em percentagem;A = abundância absoluta = número de indivíduos por unidade de área;A1 = A0 + ne - ns = abundância absoluta final;ne = número de indivíduos que ingressaram no estudo, por germinação ou mudança de categoria de tamanho (in-put)) ;ns = número de indivíduos que saíram do estudo, por morte ou mudança de categoria de tamanho (out-put).-1 = constante que indica a mortalidade.Os resultados demonstram que a floresta está em equilíbrio dinâmico, uma vez que, apresentou um valor de + 0,10% para a taxa de regeneração natural, a qual pode ser utilizada para espécies, grupos de espécies ou para o total da floresta.

Foi feito um inventário de seis hectares de floresta de. terra firme na área de influência da Estrada Cuiabá-Porto Velho (BR-364). Destes seis hectares, dois foram feitos no Município de Jaru, vicinal 605 e quatro na área do Projeto Machadinho, vicinais MC-2, MA-9. A flonesta apresenta uma altura média de 15m e um total de 278 espécies diferentes, representadas por 2.235 indivíduos e 57 famílias nos seis hectares estudados. Os hectares I e II do Município de Jaru apresentaram, respectivamente, uma diversidade florística de 113 e 136 espécies de 10cm ou mais de diâmetro (DAP), enquanto que os hectares III, IV, V e VI da área do Projeto Machadinho apresentaram respectivamente, 103, 115, 122 e. 121 espécies. A espécie mais importante no hectare I é o breu manga (Tetragastris altíssima (Aubl.) Swartz) com o IVI (Índice de Valor de Importância) de 12,07, o que representa 4,0%do total; no hectare II, muiraquatiara (Astronium lecointelDucke) com o IVI 28,94, ou se,ja 9,6% do total; no hectare III, Macrolobiumsp., com o IVI de 28,94, representando 9,6% do total; no hectare IV, pau d'alho (Gallesia integrifolia(Sprenq.) Harms), com IVI de 39,41, representando 13,1% do total; no hectare V, tauari (Couratari macrospermaA.S. Smith), com IVI de 11,32, ou seja, 3,8% do total; no hectare VI, violeta Peltogyne catingae Ducke subsp. glabra(W. Rodr.) M.F. da Silva), com o IVI de 11,68, representando 3,9% do total. As seis famílias mais importantes em ordem de importância são: Leguminosae, Moraceae, Sapotaceae, Lecythidaceae, Bursenaceae e Pal mae. Os dados quantitativos da regeneração natural indicaram que as espécies que apre-sentaram maior número de indivíduos regenerando, foram: Duguetia flagellaresHuber e Maquirasp. no Município de Jaru e Coussareasp. e. Micrandrasp. na área do Projeto Macha dinho, em Ariquemes.

Os resultados obtidos sobre a germinação de 10 espécies de leguminosas arbóreas da Amazônia (Campsiandra comosa var. laurifolia, Cassia negrensis, Crudia pubescens, Machaerium inundatum, Macrolobium acaciifolium, Peltogyne prancei, Pterocarpus amazonicus, Swartzia polyphylla, Tachigalia paniculata, Vatairea guianensis) demonstraram que 70% das espécies estudadas se enquadram nos padrões de germinação rápida (menos de 60 dias). Apenas Peltogyne prancei aprensentou germinação lenta (superior a 60 dias), em condições padronizadas. O percentual de germinação pana cinco das espécies estudadas foi superior a 70% enquanto que as outras cinco atingiram 50% de germinação total. O mais alto índice verificado foi em Vatairea guianensis - 91%. 0 IVE (índice de Velocidade de Emergência) alcançou maior índice nas espécies de germinação mais homeogênea, sendo o mais elevado o de Tachigalia paniculata - 2,39. Foi observado também que Swartzia polyphylla possui sementes poliembriônicas. A germinação inicial de seis espécies estudadas e do tipo epígeo e das 4 restantes hipógeo. Um percentual de 50% das espécies estudadas mostrou capacidade de se associar simbioticamente a bactérias fixadoras de N2 gênero Rhizobium.

The use of wastes and industrial by-products as building materials is an important issue in order to decrease costs with waste management and the embodied energy of building products. In this study scrap tire rubber was used as additional aggregate of mortars based on natural hydraulic lime NHL 3.5 and natural sand. Different particle size fractions and proportions of scrap tire rubber were used: a mix obtained directly from industry and separated fine, medium and coarse fractions; 0 %, 18 %, 36 % and 54 % of the weight of binder, corresponding to 2.5 %, 5 % and 7.5 % of the weight of sand. As mortars based on NHL specifications became stricter with the current version of EN 459–1:2015, the influence of the rubber’s additions on the mortars’ fresh state, mechanical and physical performance is presented in this work: flow table consistency, water retention, dynamic elasticity modulus, flexural and compressive strength, open porosity and bulk density, capillary absorption, drying and thermal conductivity are studied. The use of the rubber mix coming from the waste tire industry seems advantageous and may open possibilities for use as raw material by the mortars industry.

This study specifically addresses the situation of minority shareholders after the transfer of control in an listed company. The various underlying interests and reasons that shareholders have for investing in a company can demonstrate shareholders’ reasoning for taking radically different positions on issues relating to the transfer of control of the referred company. This study analyses the current legal system in Portugal and in the European Union in order to assess whether, in the event of a takeover bid of a listed company where there is a transfer of control, minority shareholders have the same appraisal rights as other shareholders to sell their shares and leave the company. The study then examines the European Court of Justice decision on whether a general principle of equal treatment of minority shareholders exists upon a transfer of control (Audiolux) and the Portuguese Securities Market Commission decision regarding the delisting of Brisa - Autoestradas de Portugal, S.A. based on the principle of investor protection. The study concludes that although the principle of equality amongst shareholders has made progress in the European legal system e.g. it is laid down in Directive 2004/25/EC of 21 April 2004 on takeover bids and the Portuguese Securities Market Code, there is also a need for further improvement, which can be accomplished by allowing minority shareholders to exercise an appraisal right in similar unregulated situations.

O autor apresenta informações fenológicas mensais de 82 matrizes de Copaiba (Copaifera multljuga Hayne), obtidas na Reserva Florestal Adolfo Ducke no período de fevereiro de 1979 a dezembro de 1985. São mostradas as percentagens de ocorrência das fases de floração, frutificação e mudança foliar e uma análise de regressão múltipla das fenofases com sete variáveis do clima (temperatura máxima, temperatura minima e temperatura média, em C°; umidade relativa em %; precipitação total em milímetros; insolação total em horas e evaporação líquida total em milímetros. A plena floração ocorreu na estação de chuvas e a frutificação (frutos maduros) apresentou picos máximos no fim da estação chuvosa e inicio da estação seca, comportamento que. difere da maioria das espécies arbóreas tropicais. A espécie portou-se como perenifólia e a fase de folhas novas antecedeu a da floração.

This work primarily aims to investigate the ambiguity between the right to build and the need to preserve nature through one of its instruments: the National Ecological Reserve. In both national and international political effort, forced by increasing ecological awareness of the society were being created regulations for environmental problemsolving frameworks. This significant increase in provisions, that regulated the environment and spatial territory, are directly related to the objectives of the European community. In a year when the soil policy has changed, it is important to review the priorities of regional planning in the face of environmental policies. REN is a restriction of public utility that, among other things, aims to define and integrate diverse areas of our territory which by their structure are essential to the ecological stability of the environment. Going through a historical study of the various regimes that regulated REN, the present work aims to inform the understanding of the concept REN, exposing its objectives and form of delimitation of integrated areas, in order to answer questions about the nature of this institute. It were related to all regulations governing the ecological reserves and land, namely Scheme for Conservation of Nature and Biodiversity; Natura 2000, the National Agricultural Reserve, the Law of the ownership of water resources and water, and the RJIGT RJUE, checking to its compatibility with REN. Through a literature review regarding the jurisprudence of national courts applying the doctrine, analysis of legal regimes, analysis of maps depicting the REN, we carried out a qualitative assessment of the trend and legal effect of REN in protecting populations and environment. Therefore we will work with this reflect on the existing environment awareness in our society and its problems in the management of natural resources.

RESUMOO presente trabalho teve como finalidade determinar a composição florística e os índices de agregação das espécies da regeneração natural de uma floresta tropical úmida da região de Manaus, sob quatro níveis de exploração. Pelos resultados observou-se a influência dos tratamentos no número total de indivíduos e no número de indivíduos por classe de tamanho. A floresta estudada compreendeu 291 espécies, 169 gêneros e 56 famílias botânicas. A testemunha aprensetou o menor número de espécies. Os valores do grau de homogeinidade e Quociente de mistura de Jentsch também evidenciaram uma alta heterogeneidade, sendo a testemunha mais heterogênea. As famílias predominantes foram: Burserapeae, Annonaceae, Violaceae, Melastomataceae e Rubiaceae. As famílias mais ricas em espécies foram: Caesalpiniaceae, Sapotaceae, Lauraceae e Mimosaceae. O ìndice de Fracher & Brischle apresentou maior número de espeécies agrupadas nos 4 tratametnos, já o índice de Payandeh apresentou maior número de espécies não agrupadas.

São comparadas num mesmo latossolo podzólico amarelo de textura média, situações sob vegetação natural, depois da queimada, após um e cinco anos de cultivo e após três anos de pousio consecutivos a dois anos de cultivo. Depois da queimada e um ano de cultivo, há uma forte diminuição de todos os resíduos vegetais. Esta diminuição foi quantidade na liteira e na camada 0-15 cm do solo através do fracionamento granulométrico da matéria orgânica. Esta evolução continua durante os cinco anos de cultivo e se inverte quando o solo é abandonado à capoeira após dois anos de cultivo. O carbono da fração 0-50 μm, que concentra o complexo argilo-húmico, não sofre grandes variações quantitativas. O fracionamento químico desta fração mostra que, sob cultivo, o húmus é caracterizado por um equilíbrio, comportando mais ácidos fúlvicos, principalmente os extraídos pelo hidróxido de sódio, e menos ácidos húmicos do que no ecossistema natural. Isto indica que o húmus incorpora frações jovens pouco polimerizadas e que há, ao mesmo tempo, despolimerização das frações ligadas às argilas. O equilíbrio inicial se restabelece quando, depois de um curto período de cultivo, se deixa o solo em pousio.

Numerous pejibaye plants were evaluated in 12 year old second growth on an abandoned farm to determine the extent of natural regeneration. Adults plabts with crowns above the canopy produce fruit. Fruits are predated by man and seeds by rodents. Lateral shoots grow weell with enough light or show leaf etiolation and reduced number in shade. Two seedlings were found, with low leaf number, riolated petioles and low leaf area, suggesting extremely slow growth in shade. Reproduction appears to depend upon natural or manmade clearings, the former of insuficient duration to permit natural regeneration. This, combined with other modifications, confirms pejibaye's status as a full domesticate.
