In November 2013 the European Commission issued the “Proposal for a Directive on the European Parliament and of the Council on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure” (referred to as “TSD”). The TSD offers minimum harmonisation and aims at promoting sharing of knowledge, and the exploitation of innovations on the Internal Market. The European Parliament adopted the TSD on April 14, 2016 and the EU Member States will have two years to implement it. The TSD includes a harmonised definition of a trade secret that builds on the definition provided in Article 39 of the TRIPS Agreement. Moreover, it also ensures the freedom of expression and information and the protection of whistle-blowers. Appropriate means of actions and remedies against unlawful acquisition, use and disclosure of trade secrets are also included, such as provisional and pecuniary measures, injunctions and corrective measures or allocation of damages. This study examines the protection of trade secrets in the course of litigation regulated in Article 9 of the TSD. Currently, the protection of trade secrets within the EU is fragmented especially in this regard, which makes companies reluctant to resort to litigation when a trade secret has unlawfully been misappropriated or it is suspected that a trade secret is being misused. The regulations in Article 9 expand only to the hearing in court. Such protection is welcomed and a step in the right direction. However, in my study I have found that in order for the protection to be sufficient there is a need to further establish measures to protect trade secrets during the entire process, from the filing of the claim to the end when the judgement is given. Consequently, I also discuss different measures that could be used to strengthen the protection of trade secrets before the hearing in court, as evidence are gathered.

THE COSTS OF RAISING EQUITY RATIO FOR BANKS Evidence from publicly listed banks operating in Finland

The solvency rate of banks differs from the other corporations. The equity rate of a bank is lower than it is in corporations of other field of business. However, functional banking industry has huge impact on the whole society. The equity rate of a bank needs to be higher because that makes the banking industry more stable as the probability of the banks going under will decrease. If a bank goes belly up, the government will be compensating the deposits since it has granted the bank’s depositors a deposit insurance. This means that the payment comes from the tax payers in the last resort. Economic conversation has long concentrated on the costs of raising equity ratio. It has been a common belief that raising equity ratio also increases the banks’ funding costs in the same phase and these costs will be redistributed to the banks customers as higher service charges. Regardless of the common belief, the actual reaction of the funding costs to the higher equity ratio has been studied only a little in Europe and no study has been constructed in Finland. Before it can be calculated whether the higher stability of the banking industry that is caused by the raise in equity levels compensates the extra costs in funding costs, it must be calculated how much the actual increase in the funding costs is. Currently the banking industry is controlled by complex and heavy regulation. To maintain such a complex system inflicts major costs in itself. This research leans on the Modigliani and Miller theory, which shows that the finance structure of a firm is irrelevant to their funding costs. In addition, this research follows the calculations of Miller, Yang ja Marcheggianon (2012) and Vale (2011) where they calculate the funding costs after the doubling of specific banks’ equity ratios. The Finnish banks studied in this research are Nordea and Danske Bank because they are the two largest banks operating in Finland and they both also have the right company form to able the calculations. To calculate the costs of halving their leverages this study used the Capital Asset Pricing Model. The halving of the leverage of Danske Bank raised its funding costs for 16—257 basis points depending on the method of assessment. For Nordea the increase in funding costs was 11—186 basis points when its leverage was halved. On the behalf of the results found in this study it can be said that the doubling of an equity ratio does not increase the funding costs of a bank one by one. Actually the increase is quite modest. More solvent banks would increase the stability of the banking industry enormously while the increase in funding costs is low. If the costs of bank regulation exceeds the increase in funding costs after the higher equity ratio, it can be thought that this is the better way of stabilizing the banking industry rather than heavy regulation.

Ce projet de mémoire s’intéresse à la mise en relation du cognitive enhancement observé dans les universités occidentales contemporaines et de la société dans laquelle il s’insère. Nous avons voulu détacher la perspective du phénomène des analyses principalement orientées vers les programmes de sciences de la santé et de droit, ainsi que de l’approche quantitative, clinique, athéorique et somme toute moralisatrice qui lui est usuellement accordée afin d’explorer la nature des pratiques d’usages de psychotropes des étudiants universitaires en sciences humaines et sociales en vue d’augmenter leurs performances cognitives, d’approfondir la compréhension des raisonnements sous-jacents à ces pratiques, puis de resituer ces derniers dans leur contexte élargi. Nous avons interrogé treize étudiants de divers programmes de sciences humaines et sociales consommant, ou ayant déjà consommé, des psychotropes en vue de rehausser leurs performances cognitives en contexte académique. Les résultats suggèrent un écart dans la nature de leurs pratiques d’usage par rapport aux domaines d’études habituellement préconisés en ce sens qu’une grande variété de substances sont considérées comme supports cognitifs ; ensuite, que le recours aux psychotropes dans une visée de performance cognitive s’éloigne des logiques de la nécessité médicale et de la toxicomanie. En premier lieu, le cognitive enhancement est associé par plusieurs à une souffrance psychique liée à une perte de repères existentiels et les étudiants y ont recours dans une optique de compréhension de soi et de quête de repères dans un monde qu’ils ressentent comme instable. En second lieu, la consommation de psychotropes s’apparente davantage à un désir de satisfaire aux conditions incertaines et menaçantes des demandes externes de performance telles qu’ils les appréhendent qu’à un souci de soigner quelque condition médicale de la cognition. Nous pensons que le rapport au psychotrope qu’entretiennent les étudiants universitaires en sciences humaines et sociales s’insère en toute cohérence dans les discours et injonctions contemporaines de performance, en ce sens que leur souffrance psychique individuelle expose les limites de ce que la société attend d’eux.

This study aimed to assess the alcohol consumption habits and the different coping strategies of a group of students from the Instituto Politécnico de Bragança - IPB (Polytechnic Institute of Bragança) with a sample made out of 126 of its students (n=126). For this study, which is descriptive-correlational and transversal, a socio-demographic questionnaire, the AUDIT (Alcohol Use Disorders Identification Test, Cunha 2002) and the Brief COPE questionnaire (Pais-Ribeiro, J. and Rodrigues, A. 2004) were used as evaluation instruments. Findings were that the majority of young students stated they do not have significant life problems, that they have good social supports and they do not consume alcohol in an inadequate way. Similarly, the coping strategies that they indicate as most frequent seem also to be the most adaptive, which may help to explain the fact that most do not perceive significant current problems and do not resort to alcohol in an inadequate way.

High population growth fragmented rural landholdings leading to low harvests and crop yields per acre per annum creating surplus labour that may resort to migration as a coping mechanism in least developing countries including Ethiopia. The main aim of the study is to assess trends and differentials of out-migration in south central Ethiopia. The Butajira demographic surveillance system database from 1987 to 2008 was used to conduct event history analysis. There were 3.97 out-migrations per 100 person years. Probability of out-migration was higher among males, teenagers, the youth, completed primary and secondary plus education; not in marital union; Christians, urbanites; lived in rented and owed house compared to their respective counterparts. The higher chances of out-migration among these groups may have social and economic significance.

Considerando o importante papel que as instituições educativas desempenham na formação das crianças e dos jovens, o respeito pelos direitos dos alunos é condição fundamental, para lhes proporcionar uma educação de qualidade. Partindo desta consciência, resolvemos efetuar um estudo de caso, numa escola da rede pública de ensino e numa escola da rede privada de ensino, ambas situadas no concelho de Lisboa, com o objetivo de conhecer as perceções dos alunos sobre a promoção dos seus direitos em contexto escolar e descortinar as semelhanças e as diferenças entre os dois contextos educativos, atendendo à diferente natureza jurídica das duas instituições. Para concretizarmos esse objetivo, formulámos as seguintes perguntas derivadas, cujas respostas procuraremos obter no decurso do nosso estudo: (i) os alunos têm conhecimento de que são titulares de direitos?; (ii) exercem os seus direitos em condições de plena igualdade e sem qualquer discriminação?; (iii) o interesse superior do aluno é a primordial consideração que a Escola tem em conta, em todos os assuntos que lhe dizem respeito?; (iv) o direito à vida, à sobrevivência e ao desenvolvimento dos alunos é garantido na Escola? e (v) a opinião dos alunos é tida em consideração, em todos os assuntos que lhes dizem respeito?. Para atingirmos os objetivos que delineamos, desenvolvemos um estudo de caso, recorrendo a uma abordagem metodológica predominantemente qualitativa, com recurso a técnicas variadas, designadamente a entrevista, o inquérito por questionário e a análise documental. Procedemos à revisão da literatura, de acordo com as áreas conceptuais previamente definidas, que se consubstanciaram nos princípios gerais de direito internacional, consignados na Convenção sobre os Direitos da Criança de 1989, e à luz dos quais todos os direitos nela constantes devem ser interpretados: o princípio da não discriminação, o princípio do interesse superior da criança, o direito à vida, à sobrevivência e ao desenvolvimento, e o princípio do respeito pelas opiniões da criança. A análise dos conceitos e da diferente natureza jurídica das duas instituições foi, também, objeto do nosso estudo. Por outro lado, a legislação portuguesa relacionada com os direitos dos alunos, também, foi por nós revista neste estudo, nomeadamente, os diversos estatutos do aluno que se sucederam no tempo. A análise dos resultados obtidos permitiu-nos concluir que o respeito dos direitos dos alunos, nas suas diversas dimensões, não foi ainda totalmente conseguido, sobretudo o seu direito à não discriminação e o seu direito à participação a nível micro e meso. Não se podendo generalizar o estudo, a comunidade educativa tem de desenvolver um esforço para a compreensão da dimensão e da importância do respeito dos direitos dos alunos, sobretudo na criação de um clima democrático, que favoreça a plena igualdade de oportunidades a todos os alunos e a livre escolha do projeto educativo pelas famílias das crianças e dos jovens.

Background: Cholera, a severe acute watery diarrhea caused by Vibrio cholerae is endemic in Nigeria with most cases occurring in the rural areas. In South West Nigeria, some individuals resort to alternative treatments such as Ogi-tutu, Psidium guajava and Vernonia amygdalina during infections. The effectiveness of these alternatives in the prevention and treatment of V. cholerae infection requires experimental investigation. Objective: This study was designed to investigate the ameliorative effects of Ogi-tutu, Vernonia amygdalina and Psidium guajava on intestinal histopathology of experimental mice infected with V. cholerae. Methods: Preliminary investigation of in vitro vibriocidal activities of these alternatives were carried out using agar cup diffusion assay. For ameliorative effects, adult mice were inoculated with 100 μl (106 cells) of Vibrio cholerae and dosed at 0 h (immediate prevention) and 4 h (treatment of infection) and their intestines were histopathologically evaluated. Results: The histopathological changes were the same irrespective of the treated groups, but the lesions varied in extent and severity. The ameliorative effects in decreasing order were V. amygdalina > P. guajava > Ogi-tutu. Conclusion: V. amygdalina gave the best ameliorative effects in the prevention and treatment of V. cholerae infection.

A presente dissertação visa uma aplicação de séries temporais, na modelação do índice financeiro FTSE100. Com base na série de retornos, foram estudadas a estacionaridade através do teste Phillips-Perron, a normalidade pelo Teste Jarque-Bera, a independência analisada pela função de autocorrelação e pelo teste de Ljung-Box, e utilizados modelos GARCH, com a finalidade de modelar e prever a variância condicional (volatilidade) da série financeira em estudo. As séries temporais financeiras apresentam características peculiares, revelando períodos mais voláteis do que outros. Esses períodos encontram-se distribuídos em clusters, sugerindo um grau de dependência no tempo. Atendendo à presença de tais grupos de volatilidade (não linearidade), torna-se necessário o recurso a modelos heterocedásticos condicionais, isto é, modelos que consideram que a variância condicional de uma série temporal não é constante e dependente do tempo. Face à grande variabilidade das séries temporais financeiras ao longo do tempo, os modelos ARCH (Engle, 1982) e a sua generalização GARCH (Bollerslev, 1986) revelam-se os mais adequados para o estudo da volatilidade. Em particular, estes modelos não lineares apresentam uma variância condicional aleatória, sendo possível, através do seu estudo, estimar e prever a volatilidade futura da série. Por fim, é apresentado o estudo empírico que se baseia numa proposta de modelação e previsão de um conjunto de dados reais do índice financeiro FTSE100.

La presente monografía es una propuesta de un plan de negocios enfocado a generar el desarrollo de la actividad turística comunitaria en las comunidades de la parroquia de San Rafael de Sharug, este tema surgió debido a las labores realizadas como practicantes en el área de Voluntarios Azuay del Gobierno Provincial del Azuay y del Gobierno Autónomo Descentralizado de la parroquia San Rafael de Sharug; pretendiendo beneficiar a los pobladores fortaleciendo sus actividades cotidianas, costumbres y tradiciones; además de convertirse en un complemento dinamizador de la economía mejorando su calidad de vida. La metodología que se aplicó fue a través de visitas técnicas empleando la observación directa como herramienta clave para el levantamiento de información primaria y recolección de información secundaria, además se realizó entrevistas y encuestas tanto a pobladores como a turistas nacionales y extranjeros. Para el desarrollo de esta propuesta es necesario un estudio previo que indique aspectos precedentes de un diagnóstico situacional de la parroquia que comprenda matrices como el FODA cruzada y la matriz de problemas con la finalidad de determinar aspectos que van a formar parte del complejo, así como también un análisis de las oportunidades y amenazas del entorno competitivo haciendo uso de las fuerzas de mercado de MichellPorter, un plan de marketing para la respectiva difusión del proyecto y la elaboración de la parte financiera para concluir su factibilidad determinando la viabilidad y rentabilidad a través de una investigación de mercado aplicada en un análisis de la demanda y la oferta.

The self-medicatíon is a phenomenon more and more frequent and used for several years already, and tts incidence and dlstribution are related wtth the organizatíon and health system of each country. Following Medeiros thoughts (2011), this practíce conststs in the consumptíon of a medicine with the purpose of treating or relieving the symptoms and diseases or even promote self health, without using a professional prescription. Methods: With thts study, we intend to find the self-medication practice incidence on the students in the School of Health of Polytechnic Institute of Bragança (ESSa), identify the motives that lead these students to resort to this methods and identify the most used medicatíons. lt's a transversal descriptive, observational and quantítative study. To obtain the best results it was applied a questíonnaire built for that purpose. The statístícs analyses was made using Excel program. Our sample hás 219 students of the School of Health from Polytechntc Instítute of Bragança. Results: The studied sample includes 194 female and 25 male students distributed as follows: 36 frequenting Biomedical Laboratory Sdences, 26 Dietetics and Nutrition, 99 Nursing, 33 Gerontology and 22 studying Pharmacy. The self-medicatíon prevalence was 98%. The most used medicines was the analgesics and antipyretics with 86%. The most prevalent reason for the use of self-medicatíon was the thought that the disease was a "minor health issue". It was also considered a risky practice by 77% of the students. Conclusions: The self-medication is an evident practíce on the ESSa students. This results reveal some contradiction stnce the most consider 1t as a risky practíce, however it is, stíll, practíced.

What the dissertation proposes is a reading of Romanticism through its symbols, through the elements that literally shape it and how they are repeated, transformed and reinterpreted according to their new environments; the thesis proposes a kind of semiotic, hermeneutic braid, to account for the evolution and literary influences of these symbols in America: a metaphorical corkscrew. It must be emphasized that this is, above all, an English dissertation and its main theme is British Romanticism, from its origins in the late eighteenth century. It́s not my intention to propose a thesis that exposes or discusses the Romantic Movement; that has been done already and, in some cases, quite unfortunately; but the fact is that the critical literature on the subject overflows the libraries. I do not care for a thesis that is limited to establish a relationship between the English Romantic movement and the movement in the United States or Latin American countries. Although it will be necessary to resort to certain philosophical approaches, I do not care pose a thesis that focuses on the philosophical Romanticism (such as the German one). Finally, I do not wish to propose a thesis that is dedicated to establish the implications of a political Romanticism as it was lived mainly in the Bolivarian countries...
