A presente Tese de Doutorado tem por objetivo estudar a atuação dos órgãos do Sistema Interamericano de Direitos Humanos no que se refere à proteção e à promoção dos direitos econômicos, sociais e culturais. Para tanto, a pesquisa parte de considerações acerca do que seriam tais direitos, analisando e refutando teorias e concepções que tentaram recusá-los enquanto normas de Direitos Humanos, o que teria motivado a elaboração de dispositivos normativos vagos e a ausência de mecanismos de monitoramento de igual forma, como havia sido previsto para o rol do grupo de Direitos Humanos, denominado de direitos civis e políticos. A fim de demonstrar que os direitos econômicos, sociais e culturais fazem parte de um grupo de direitos plenamente justiciáveis, a tese também analisa elementos que comumente são conferido-lhes, como progressividade, proibição de retrocesso, aplicação do máximo de recursos disponíveis e núcleo mínimo de direitos, a partir do que é desenvolvido pelo Comitê de Direitos Econômicos, Sociais e Culturais da Organização das Nações Unidas, para, posteriormente, apresentar como enfrentam tais aspectos, os órgãos do Sistema Interamericano. Do estudo de normas internacionais e do sistema internacional de monitoramento, que foram especialmente construídos para os direitos econômicos, sociais e culturais, verificam-se diversos níveis de obrigações jurídicas, do que se propõe uma classificação para os diferentes mecanismos de acesso ao Sistema de Proteção dos Direitos Humanos Regional, os quais podem ser direcionados à tutela de um órgão jurisdicional ou quase-judicial, ou mesmo por outros meios que também promovam tais direitos e possibilitem sua reparação em caso de violação. Os diferentes mecanismos são utilizados pelos órgãos do Sistema Interamericano para tutelar os direitos econômicos, sociais e culturais. Dada a sua importância, Comissão e Corte Interamericanas de Direitos Humanos foram estudadas pela presente pesquisa, atribuindo-se enfoque a sua atuação para proteção dos direitos em tela, bem como sobre as recentes modificações das suas funções e ritos processuais.

This work addresses the erosion caused by rain, describing their steps and factors that most influence the intensity and volume of transported material. The work presents the Universal Soil Loss Equation that quantifies the erosion, with the influence of different factors that affect it. The following notes the occurrence of this process in cutting slopes. They suffer with removal of the vegetation and surface soil layer, making them even more susceptible to this process. In this way it's necessary a protection model for the slopes. Some protection methods are presents with their main features, advantages and disadvantages, implementation process, especially to survey the approximate cost of each method and their application restrictions

O estudo da responsabilidade civil dos administradores de companhias abertas na doutrina nacional trata usualmente dos deveres fiduciários, do ato regular de gestão e da teoria ultra vires, da culpa ou dolo do administrador, das ações ut universi e ut singuli e da solidariedade entre a responsabilidade do administrador e a da companhia. Poucos abordam as causas extintivas dessa responsabilidade, e raro são os que tratam da hipótese de exclusão de responsabilidade do artigo 159, § 6º, da Lei nº 6.404/76. Como a disciplina dos deveres fiduciários prevista na lei societária brasileira tem forte influência do Direito norte-americano, buscou-se na legislação, doutrina e jurisprudência daquele país os fundamentos necessários à melhor interpretação e aplicação da regra de exclusão e, em especial, na business judgment rule, doutrina que protege os administradores contra responsabilização por prejuízos à companhia decorrentes de decisões por eles adotadas, proteção esta também conferida pela hipótese do artigo 159, § 6º, da Lei nº 6.404/76, ao administrador leal e de boa-fé.

The social and economic changes of the last decades have enhanced the dehumanization of labor relations and the deterioration of the work environment, by the adoption of management models that foster competitiveness and maximum productivity, making it susceptible to the practice of workplace bullying. Also called mobbing, bullying can occur through actions, omissions, gestures, words, writings, always with the intention of attacking the self-esteem of the victim and destroy it psychologically. In the public sector, where relations based on hierarchy prevail, and where the functional stability makes it difficult to punish the aggressor, bullying reaches more serious connotations, with severe consequences to the victim. The Federal Constitution of 1988, by inserting the Human Dignity as a fundamental principle of the Republic, the ruler of the entire legal system, sought the enforcement of fundamental rights, through the protection of honor and image of the individual, and ensuring reparation for moral and material damage resulting from its violation. Therefore, easy to conclude that the practice of moral violence violates fundamental rights of individuals, notably the employee's personality rights. This paper therefore seeked to analyze the phenomenon of bullying in the workplace, with emphasis on the harassment practiced in the public sector as well as the possibility of state liability for harassment committed by its agents. From a theoretical and descriptive methodology, this work intended to study the constitutional, infra and international rules that protect workers against this practice, emphasizing on the fundamental rights violated. With this research, it was found that doctrine and jurisprudence converge to the possibility of state objective liability for damage caused by its agents harassers, not forgetting the possibility of regressive action against the responsible agent, as well as its criminal and administrative accountability.

Os ataques de 11 de setembro de 2001 impuseram um novo olhar sobre a ameaça terrorista contra a aviação civil e evidenciaram a vulnerabilidade da segurança aérea europeia pela inexistência de uma política comum nesse setor. A União Europeia desenvolveu, desde então, a prevenção do terrorismo e a proteção dos transportes (entendidos como infraestruturas críticas) através da ampliação do quadro normativo comunitário e da arquitetura institucional, securitizando assim o multifacetado setor da aviação civil. Este artigo pretende, numa primeira parte, analisar a evolução da segurança aérea enquadrando as ameaças, a dinâmica global e a arquitetura institucional europeia da aviação; e numa segunda parte, questionar, com base nos desafios para a segurança da aviação, da necessidade de uma Estratégia Europeia de Segurança Aérea.

An earlier CRC-CI project on ‘automatic estimating’ (AE) has shown the key benefit of model-based design methodologies in building design and construction to be the provision of timely quantitative cost evaluations. Furthermore, using AE during design improves design options, and results in improved design turn-around times, better design quality and/or lower costs. However, AEs for civil engineering structures do not exist; and research partners in the CRC-CI expressed interest in exploring the development of such a process. This document reports on these investigations. The central objective of the study was to evaluate the benefits and costs of developing an AE for concrete civil engineering works. By studying existing documents and through interviews with design engineers, contractors and estimators, we have established that current civil engineering practices (mainly roads/bridges) do not use model-based planning/design. Drawings are executed in 2D and only completed at the end of lengthy planning/design project management lifecycle stages. We have also determined that estimating plays two important, but different roles. The first is part of project management (which we have called macro level estimating). Estimating in this domain sets project budgets, controls quality delivery and contains costs. The second role is estimating during planning/design (micro level estimating). The difference between the two roles is that the former is performed at the end of various lifecycle stages, whereas the latter is performed at any suitable time during planning/design.

This paper aims to develop the methodology and strategy for concurrent finite element modeling of civil infrastructures at the different scale levels for the purposes of analyses of structural deteriorating. The modeling strategy and method were investigated to develop the concurrent multi-scale model of structural behavior (CMSM-of-SB) in which the global structural behavior and nonlinear damage features of local details in a large complicated structure could be concurrently analyzed in order to meet the needs of structural-state evaluation as well as structural deteriorating. In the proposed method, the “large-scale” modeling is adopted for the global structure with linear responses between stress and strain and the “small-scale” modeling is available for nonlinear damage analyses of the local welded details. A longitudinal truss in steel bridge decks was selected as a case to study how a CMSM-of-SB was developed. The reduced-scale specimen of the longitudinal truss was studied in the laboratory to measure its dynamic and static behavior in global truss and local welded details, while the multi-scale models using constraint equations and substructuring were developed for numerical simulation. The comparison of dynamic and static response between the calculated results by different models indicated that the proposed multi-scale model was found to be the most efficient and accurate. The verification of the model with results from the tested truss under the specific loading showed that, responses at the material scale in the vicinity of local details as well as structural global behaviors could be obtained and fit well with the measured results. The proposed concurrent multi-scale modeling strategy and implementation procedures were applied to Runyang cable-stayed bridge (RYCB) and the CMSM-of-SB of the bridge deck system was accordingly constructed as a practical application.

This paper is a continuation of the paper titled “Concurrent multi-scale modeling of civil infrastructure for analyses on structural deteriorating—Part I: Modeling methodology and strategy” with the emphasis on model updating and verification for the developed concurrent multi-scale model. The sensitivity-based parameter updating method was applied and some important issues such as selection of reference data and model parameters, and model updating procedures on the multi-scale model were investigated based on the sensitivity analysis of the selected model parameters. The experimental modal data as well as static response in terms of component nominal stresses and hot-spot stresses at the concerned locations were used for dynamic response- and static response-oriented model updating, respectively. The updated multi-scale model was further verified to act as the baseline model which is assumed to be finite-element model closest to the real situation of the structure available for the subsequent arbitrary numerical simulation. The comparison of dynamic and static responses between the calculated results by the final model and measured data indicated the updating and verification methods applied in this paper are reliable and accurate for the multi-scale model of frame-like structure. The general procedures of multi-scale model updating and verification were finally proposed for nonlinear physical-based modeling of large civil infrastructure, and it was applied to the model verification of a long-span bridge as an actual engineering practice of the proposed procedures.
