Simplifying business formalization and eliminating outdated formalities is often a good way of improving the institutional environment for firms. Unfortunately, the World Bank s "Doing Business" project is harming such policies by promoting a reform agenda that gives them priority even in countries lacking functional business registers, so that the reformed registers keep producing valueless information, but faster. Its methodology also promotes biased measurements that impede proper consideration of the essential tradeoffs in the design of formalization institutions. If "Doing Business" is to stop jeopardizing its true objectives and contribute positively to scientific progress, institutional reform and economic development, then its aims, governance and methodology need to change.

This essay reviews some findings in cognition sciences and examines their consequences for the analysis of institutions. It starts by exploring how humans specialization in producing knowledge ensures our success in dominating the environment but also changes fast our environment. So fast that it did not give time to natural selection to adapt our biology, causing it to be potentially maladapted in important dimensions. A main function of institutions is therefore to fill the gap between the demands of our relatively new environment and our biology, still adapted to our ancestral environment as hunter-gatherers. Moreover, institutions are built with the available elements, which include our instincts. A deeper understanding of both aspects, their adaptive function and this recruitment of ancestral instincts, will add greatly to our ability to manage institutions.

Organisatorisen luottamuksen tutkimuksessa luottamus nähdään yleensä henkilöiden välisenä ilmiönä kuten työntekijän luottamuksena työtovereihin, esimieheen tai lähimpään johtoon. Organisatorisessa luottamuksessa on kuitenkin myös ei-henkilöityvä ulottuvuus, ns. institutionaalinen luottamus. Tähän mennessä vain muutamat tutkijat ovat omissa tutkimuksissaan käyttäneet myös institutionaalista luottamusta osana organisatorista luottamusta. Tämän työn tavoitteena on kehittää institutionaalisen luottamuksen käsitettä sekä mittari sen havainnoimiseksi organisaatioympäristössä. Kehitysprosessi koostui kolmesta vaiheesta. Ensimmäisessä vaiheessa kehitettiin mittariin tulevia väittämiä sekä arvioitiin sisällön validiteetti. Toinen vaihe käsitti aineiston keruun, väittämien karsimisen sekä vaihtoehtoisten mallien vertailun. Kolmannessa vaiheessa arvioitiin rakennevaliditeetti sekä reliabiliteetti. Työn empiirinen osatoteutettiin internet-kyselynä aikuisopiskelijoiden keskuudessa. Aineiston analysoinnissa käytettiin pääkomponenttianalyysiä sekä konfirmatorista faktorianalyysiä. Institutionaalinen luottamus muodostuu kahdesta ulottuvuudesta: kyvykkyys ja oikeudenmukaisuus. Kyvykkyys muodostuu viidestä alakomponentista: operatiivisen toiminnan organisointi, organisaation pysyvyys, kyvykkyys liiketoiminnan ja ihmisten johtamisessa, teknologinen luotettavuus sekä kilpailukyky. Oikeudenmukaisuus puolestaan muodostuu HRM-käytännöistä, organisaatiossa vallitsevasta reilun pelin hengestä sekä kommunikaatiosta. Lopullinen mittari kyvykkyydelle käsittää 18 väittämää ja oikeudenmukaisuudelle 13 väittämää. Työssä kehitetty mittari mahdollistaa organisatorisen luottamuksen entistä paremman ja luotettavamman mittaamisen. Tutkijan tietämyksen mukaan tämä onensimmäinen kokonaisvaltainen mittari institutionaalisen luottamuksen mittaamiseksi.

Cette thèse s’intéresse aux choix institutionnels des législateurs. Elle propose une analyse diachronique et comparative du développement des Chambre Nationale des Députés argentines et chiliennes des années 1940 aux années 2000. Inspiré de la théorie du Cartel (Cox et McCubbins, 1993), ce travail se concentre sur le rôle des partis politiques dans ce développement institutionnel. Il montre qu’en dépit de leurs différences, les partis uniques, coalitions, forces majoritaires ou minoritaires qui ont dirigé ces chambres ont adopté un large éventail de règles et de normes organisationnelles qui les avantagent. Ils se sont, en un mot, comportés comme des coalitions procédurales. L’analyse des modifications des règles de fonctionnement de ces chambres et de leurs systèmes de direction et de commissions montre que les partis et coalitions au pouvoir ont, pendant cette période, renforcé leur pouvoir, contrôlé l’agenda législatif, structuré les systèmes de commission et adopté des règles qui leur ont profité. Les résultats obtenus suggèrent en particulier que les coalitions qui ont dirigé la chambre Chilienne ont installé certains de leurs membres à plusieurs postes comme les présidences d’assemblée et de commissions. Ils montrent l’existence d’un pouvoir de véto sur l’agenda législative plus importante au Chili qu’en Argentine. L’étude du cas argentin montre que les partis au pouvoir ont, en particulier depuis les années 1960, conservé le contrôle de la chambre, non seulement en modifiant les règles et les structures du système de commissions, mais également en créant et distribuant à l’opposition des postes permanents mais sans réel pouvoir. Cette analyse confirme également les résultats obtenus par de récentes études concernant ce champ de recherche, notamment le professionnalisme du système de commission chilien et le caractère amateur des législateurs argentins. A l’inverse, elle met à jour des différences, négligées jusqu’alors, entre l’Argentine et le Chili concernant le contrôle de l’agenda législatif. Cette thèse est divisée en sept chapitres. Le premier introduit le sujet, l’hypothèse générale et les questions posées par la thèse, en expliquant également pourquoi les choix institutionnels des législateurs importent. Le chapitre II présente la théorie et la méthodologie. Il propose une définition du développement institutionnel et explicite les prédictions et critères permettant de tester l’hypothèse générale. Les chapitre III et IV, qui concernent respectivement l’Argentine et le Chili, décrivent le système politique de chaque pays et l’organisation des chambres durant la période étudiée. Les chapitre IV et VI, respectivement pour l’Argentine et le Chili, analysent les réformes des règles régissant les chambres, l’évolution de l’autorité qui les dirige et celle du système de commission. Ces chapitres se concluent par un résumé des différents schémas mis en évidence et une évaluation préliminaire de l’hypothèse générale. En conclusion, le chapitre VII résume les découvertes, donne un verdict global sur la fécondité de la théorie et suggère de nouvelles pistes de recherche.

This report examines organizational and governance structures of four public university systems. It explores the organizational structures of governing boards and administrative offices, as well as the role of system offices in coordinating across constituent campuses and protecting mission differentiation.

Esta tese compõe-se de três ensaios que versam sobre o formato, em termos de estrutura de governança, das indústrias e como a estrutura interna das mesmas in fluenciam esses formatos e seus produtos. O primeiro capítulo apresenta um modelo de como a qualidade institucional, confiança e incompleteza contratual afetam as decisiões das firmas sobre a melhor forma de se organizarem internacionalmente. O segundo capítulo vai na mesma direcão de explicar a organização das indústrias, mas com foco no efeito da transmissão de informação entre as unidades constituintes das organizações sobre o formato ótimo das mesmas. Ambos trabalhos usam modelos dinâmicos. O terceiro capítulo se utiliza da modelagem de organização industrial para mostrar como a estrutura interna de uma indústria in fluencia no risco de crédito consignado.

Using food bait stations and colony trap nests, the spatial relation between the foraging activity of established colonies of the polygynous and unicolonial exotic pharaoh's ant, Monomorium pharaonis, and colonization by colony fragments was studied over an 8 month period in a large institutional setting in Brazil. Both foraging activity and colonizations demonstrated significant spatial clumping. However, colonizations were significantly negatively clumped spatially with respect to foraging activity. This suggests that the colonization strategy of this species under the studied conditions was that of complete habitat domination.

The issue addressed in this article is whether and to what extent a lawyer has an ethical responsibility to pursue implementation of the remedy in institutional reform litigation. Institutional reform litigation refers to cases in which an individual or class of individuals sues a large organization in order to vindicate constitutional or statutory rights. The types of cases with which this article is concerned are the "public law" type, such as school desegregation, prisoners' rights and patients' rights cases, although included under the rubric of institutional reform can be, inter alia, antitrust, reapportionment and bankruptcy cases. The implementation stage of institutional reform litigation arises after an individual or class of individuals prevails at the liability stage, or pursuant to a settlement, and a court orders the defendant organization to change in order to vindicate the plaintiffs' rights. At that point, the defendant organization, whether it be a prison, mental hospital or school district, usually has the burden of implementing the order. One conclusion drawn is that the ethical duty of the lawyer must always be consistent with the lawyer's "special responsibility for the quality of justice."

Connecting (small) family farmers to the emerging biodiesel industry requires careful design of the institutional arrangements between the producers of oil crops and the processing companies. According to institutional economics theory, the design of effective and efficient arrangements depends on production and transaction characteristics, the institutional environment, and the organizational environment supporting the transaction between producers and the industry. This paper presents a comparative study on two cases in the feedstock-for-biodiesel industry in the state of Minas Gerais, Brazil. The two case studies represent the production and transaction system of soybeans (Glycine max L Merrill) and castor beans (Ricinus communis L). Important elements of effective and efficient institutional arrangements are farmer collective action, availability of technical and financial support, and farmer experience with particular crops. The time is ripe for a comprehensive mission to explore and document Earth's species. This calls for a campaign to educate and inspire the next generation of professional and citizen species explorers, investments in cyber-infrastructure and collections to meet the unique needs of the producers and consumers of taxonomic information, and the formation and coordination of a multi-institutional, international, transdisciplinary community of researchers, scholars and engineers with the shared objective of creating a comprehensive inventory of species and detailed map of the biosphere. We conclude that an ambitious goal to describe 10 million species in less than 50 years is attainable based on the strength of 250 years of progress, worldwide collections, existing experts, technological innovation and collaborative teamwork. Existing digitization projects are overcoming obstacles of the past, facilitating collaboration and mobilizing literature, data, images and specimens through cyber technologies. Charting the biosphere is enormously complex, yet necessary expertise can be found through partnerships with engineers, information scientists, sociologists, ecologists, climate scientists, conservation biologists, industrial project managers and taxon specialists, from agrostologists to zoophytologists. Benefits to society of the proposed mission would be profound, immediate and enduring, from detection of early responses of flora and fauna to climate change to opening access to evolutionary designs for solutions to countless practical problems. The impacts on the biodiversity, environmental and evolutionary sciences would be transformative, from ecosystem models calibrated in detail to comprehensive understanding of the origin and evolution of life over its 3.8 billion year history. The resultant cyber-enabled taxonomy, or cybertaxonomy, would open access to biodiversity data to developing nations, assure access to reliable data about species, and change how scientists and citizens alike access, use and think about biological diversity information.

This dissertation is about collective action issues in common property resources. Its focus is the “threshold hypothesis,” which posits the existence of a threshold in group size that drives the process of institutional change. This hypothesis is tested using a six-century dataset concerning the management of the commons by hundreds of communities in the Italian Alps. The analysis seeks to determine the group size threshold and the institutional changes that occur when groups cross this threshold. There are five main findings. First, the number of individuals in villages remained stable for six centuries, despite the population in the region tripling in the same period. Second, the longitudinal analysis of face-to-face assemblies and community size led to the empirical identification of a threshold size that triggered the transition from informal to more formal regimes to manage common property resources. Third, when groups increased in size, gradual organizational changes took place: large groups split into independent subgroups or structured interactions into multiple layers while maintaining a single formal organization. Fourth, resource heterogeneity seemed to have had no significant impact on various institutional characteristics. Fifth, social heterogeneity showed statistically significant impacts, especially on institutional complexity, consensus, and the relative importance of governance rules versus resource management rules. Overall, the empirical evidence from this research supports the “threshold hypothesis.” These findings shed light on the rationale of institutional change in common property regimes, and clarify the mechanisms of collective action in traditional societies. Further research may generalize these conclusions to other domains of collective action and to present-day applications.

This article discusses performance in the context of the World Trade Organization (WTO). Applying the framework by Gutner and Thompson and inspired by principal-agent theory, it is argued that existing studies have underspecified the institutional milieu that affects performance. The WTO represents a member-driven organization where Members are part of the international organization (IO) (e.g., through rule-making) and at the same time act outside the IO (e.g., through implementation). Thus, a narrow reading of the IO (focusing on the civil servants and the Director-General and his staff) will not suffice to understand IO performance in the WTO context. Selected evidence is presented to illustrate aspects of the WTO’s inner-working and the institutional milieu of performance. In addition, the article discusses a number of performance parameters, including the relationship between Secretariat autonomy and performance, the role of information, and the mechanisms of performance aggregation. The article ends by cautioning against quick fixes to the system to improve performance.
