Alexander McLeod was Deputy Sheriff of the Niagara District during the Rebellion of 1837-38 in Upper Canada. On December 24, 1837, he became aware of a scheme by the rebels to use the American steamboat Caroline to provide supplies to William Lyon Mackenzie and his followers on Navy Island in the Niagara River. McLeod notified the authorities in Upper Canada about the situation. A few days later, on December 29, Commodore Andrew Drew led a band of men, including McLeod, to the American side, where the Caroline was moored at Schlosser’s Wharf. A scuffle ensued, in which American Amos Durfee was killed. The Caroline was then released from its moorings, set on fire, and drifted downstream before sinking. Many Americans viewed the incident as a violation of their sovereignty. Tensions between the United States and England were already strained over a boundary dispute between Maine and New Brunswick, and the situation with the Caroline further escalated the tension. McLeod was subsequently arrested in November, 1840 in Lewiston, NY and indicted for arson and murder. The British foreign secretary, Lord Palmerston, insisted that McLeod be released and could not be held personally responsible for the incident, as he was acting on orders from authorities in Canada. Eventually, McLeod was acquitted.

Ce mémoire traite du droit de l’adoption dans une perspective comparative entre régimes arabo-musulman, français et québécois. Dans un premier temps est abordée la place de l’enfant dans l’Islam : de sa conception au sein de la famille musulmane à l’ensemble de ses droits selon le droit religieux. Ce tour d’horizon permet d’aborder l’épineux problème de l’interdiction de l’adoption par le Coran et les alternatives qui ont été développées pour y remédier, plus particulièrement la kafala. La kafala sera expliquée et située dans l’ordre public international, puis examinée au regard de quatre législations arabes : le Maroc, la Tunisie, l’Algérie et le Liban. Dans un deuxième temps, la question sera examinée d’un point de vue occidental. Il y sera analysé la possibilité et les difficultés entourant l’application des règles musulmanes de statut personnel en France et au Québec. Finalement sera abordé l’accueil que ces deux sociétés ont réservé à la kafala dans leur système respectif.

Routine activity theory introduced by Cohen& Felson in 1979 states that criminal acts are caused due to the presenceof criminals, vic-timsand the absence of guardians in time and place. As the number of collision of these elements in place and time increases, criminal acts will also increase even if the number of criminals or civilians remains the same within the vicinity of a city. Street robbery is a typical example of routine ac-tivity theory and the occurrence of which can be predicted using routine activity theory. Agent-based models allow simulation of diversity among individuals. Therefore agent based simulation of street robbery can be used to visualize how chronological aspects of human activity influence the incidence of street robbery.The conceptual model identifies three classes of people-criminals, civilians and police with certain activity areas for each. Police exist only as agents of formal guardianship. Criminals with a tendency for crime will be in the search for their victims. Civilians without criminal tendencycan be either victims or guardians. In addition to criminal tendency, each civilian in the model has a unique set of characteristicslike wealth, employment status, ability for guardianship etc. These agents are subjected to random walk through a street environment guided by a Q –learning module and the possible outcomes are analyzed

This research project focuses on contemporary eagle-taming falconry practice of the Altaic Kazakhs animal herding society in Bayan Ulgii Province in Western Mongolia. It aims to contributing both theoretical and empirical criteria for cultural preservation of Asian falconry. This cultural as well as environmental discourse is illustrated with concentrated field research framed by ecological anthropology and ethno-ornithology from the viewpoint of “Human-Animal Interaction (HAI)” and “Human-Animal Behavior (HAB)”. Part I (Chapter 2 & 3) explores ethno-archaeological and ethno-ornithological dimensions by interpretive research of archaeological artefacts which trace the historical depth of Asian falconry culture. Part II (Chapter 4 & 5) provides an extensive ethnographic narrative of Altaic Kazakh falconry, which is the central part of this research project. The “Traditional Art and Knowledge (TAK)” in human-raptor interactions, comprising the entire cycle of capture, perch, feeding, training, hunting, and release, is presented with specific emphasis on its relation to environmental and societal context. Traditional falconry as integral part of a nomadic lifestyle has to face some critical problems nowadays which necessitate preventing the complete disappearance of this outstanding indigenous cultural heritage. Part III (Chapter 6 & 7) thus focuses on the cultural sustainability of Altaic Kazakh falconry. Changing livelihoods, sedentarisation, and decontextualisation are identified as major threats. The role of Golden Eagle Festivals is critically analysed with regard to positive and negative impact. This part also intends to contribute to the academic definition of eagle falconry as an intangible cultural heritage, and to provide scientific criteria for a preservation master plan, as well as stipulate local resilience by pointing to successive actions needed for conservation. This research project concludes that cultural sustainability of Altaic Kazakh falconry needs to be supported from the angles of three theoretical frameworks; (1) Cultural affairs for protection based on the concept of nature-guardianship in its cultural domain, (2) Sustainable development and improvement of animal herding productivity and herder’s livelihood, (3) Natural resource management, especially supporting the population of Golden Eagles, their potential prey animals, and their nesting environment.

La ruptura del acogimiento familiar se ha definido como aquella situación en la que alguna de las partes implicadas causa una terminación de la intervención antes de haber alcanzado los objetivos establecidos en el plan de caso. Este trabajo presenta un estudio llevado a cabo en una muestra española de 318 casos cerrados de niños que fueron acogidos en familia ajena y extensa. Los datos se obtuvieron a través de la revisión exhaustiva de los expedientes de protección y acogimiento, complementada con entrevistas a los técnicos encargados de cada caso. La tasa de ruptura del conjunto de la muestra fue de 26,1%, si bien fue significativamente diferente en familia extensa (19,7%) que en familia ajena (31,2%). Los resultados de este estudio indican que las variables relacionadas con la ruptura dependen de la modalidad del acogimiento, en familia ajena o extensa. En el primer caso destacamos las variables relacionadas con las características del niño, especialmente los problemas de conducta y escolares, con especial relevancia en el grupo de 9-12 años, y el haber estado en acogimiento residencial previamente. En cambio, en extensa resulta más importante la problemática en los padres (prisión, salud mental) y el tener una medida de tutela. También el hecho de que se realice el acogimiento tras pasar por hogares de acogida resulta trascendental. Finalmente, la disponibilidad de recursos económicos e incluso los estudios de los acogedores parecen ser variables relacionadas con la ruptura de la acogida

El Estado español tiene más de 100.000 construcciones ilegales. En la actualidad, la ejecución de las sentencias en materia urbanística no es eficaz. Existe, por tanto, una situación de inejecución de las sentencias urbanísticas. Un ciudadano puede construir una casa al amparo de una licencia. Sin embargo, a veces, esta licencia es ilegal porque infringe el plan urbanístico aplicable y incluso la propia ley de urbanismo. La consecuencia jurídica de la ilegal es la obligatoriedad del derribo de lo ilegalmente construido. Lo mismo sucede ante la declaración de ilegalidad de un plan urbanístico. En este caso, el juez o tribunal estimará la ilegalidad del plan y el fallo deberá ser ejecutado. La solución no es un fácil porque la demolición o derribo de la construcción ilegal trae consigo el pago de una indemnización a los propietarios que han edificado al amparo de una licencia ilegal.El derecho a la ejecución de sentencias es prescrito por el artículo 24 de la Constitución española. Este artículo 24 garantiza el derecho de todos ciudadanos a una tutela judicial efectiva. El Tribunal Constitucional español en sus sentencias número 67/1984 y 28/1989, reconocieron que el derecho a la ejecución de las resoluciones judiciales deriva del propio derecho a la tutela judicial efectiva. La justicia administrativa está regulada por la Ley 29/1998, del 13 de julio, reguladora de la jurisdicción contencioso-administrativa. En su artículo 103.1 de la Ley 29/1998, establece que los jueces y los tribunales de la jurisdicción administrativa son los competentes para hacer ejecutar las sentencias. Por otro lado, el artículo 117.3 de la Constitución Española otorga la competencia en exclusiva a los jueces y tribunales para hacer ejecutar las sentencias, como manifestación del principio de división de poderes.En último lugar, los valores que la legislación urbanística española incorpora, tales como, el desarrollo sostenible, urbanismo sostenible y la cohesión social, quedan inaplicados si las sentencias urbanísticas no se ejecutan.

O direito à assistência está subsidiado pela Constituição Federal de 1988 como um direito fundamental de todos os cidadãos considerados hipossuficientes. Em face dessa gratuidade, direito fundamental, são protegidos e viabilizados outros princípios constitucionais maiores, como a igualdade entre os cidadãos, haja vista a desigualdade social e econômica evidenciadas na sociedade brasileira. Portanto, é imprescindível um instrumento que garanta o acesso à tutela jurisdicional. Através de pesquisa realizada com os magistrados das entrâncias do Estado do Maranhão, todos possuem conhecimento da finalidade do Fundo Especial para Reaparelhamento do Judiciário (FERJ), apenas um pequeno número dos juízes desconhecem o plano de elaboração e execução de programas e projetos para a modernização e o desenvolvimento dos serviços judiciários. Assim, torna-se grande o número de processos acumulados, em face do número insuficiente de juízes, além da burocracia excessiva que dificultam o andamento das ações. Conclui-se que, a reestruturação do Poder Judiciário no Maranhão não trouxe as melhorias esperadas.

Através do presente trabalho, buscar-se-á discorrer sobre o cabimento das tutelas de urgências na esfera do procedimento arbitral, englobando a possibilidade de decretação e execução das medidas urgentes pelo árbitro – seja previamente ou no curso da arbitragem –, a partir da análise dos dispositivos da Lei de Arbitragem (Lei nº 9.307/1996), bem como da doutrina nacional dominante sobre o tema. Tal estudo faz-se relevante na medida em que o processo arbitral vem sendo amplamente utilizado por particulares como meio eficaz de solução de litígios relativos a direitos patrimoniais disponíveis. Todavia, mesmo sendo dotada de maior celeridade do que o provimento judicial, nem sempre a arbitragem conseguirá tutelar o direito material alegado pelas partes até que seja proferida a decisão final de mérito. Assim, em algumas situações, nas quais haja fundado receio de dano irreparável à parte, as medidas de urgência são imprescindíveis a fim de assegurar o direito pleiteado, tornando possível a prolação de uma sentença justa e revestida de utilidade prática. Neste contexto, entende-se o árbitro é dotado de poder jurisdicional para conceder medidas cautelares e antecipatórias que se façam necessárias, ainda que tal poder não esteja expressamente delimitado na convenção de arbitragem. Para efetivá-las, no entanto, precisará recorrer ao Poder Judiciário (monopolizador do poder de coerção) para dar cumprimento às medidas decretadas pelo árbitro, sempre que a parte em face da qual a medida for decretada se recusar a cumprir a determinação arbitral espontaneamente.

This study approaches the question of the administrative procedure of the environmental licensing of ranks of fuel resale, taking as basis a study case of the reality of the City of Natal/RN (Brazil). For in such a way, it was done a retrospect on the evolution of the system of road transport in Brazil, having started to briefly analyze the urbanization process that if after accented in the capitals of the Brazilian States the decade of 1950, relating these subjects with the growth of the sector of fuel resale. After that, it was transferred boarding of the defense of the national environment to the light of ambient principles constitutional. In the sequence, a boarding on the ambient guardianship in the Federal Constitution of 1988 was made, treating basically specifies and on the national urban politics and the national politics of the environment, with its instruments. In the sequence, it was transferred the analysis of the abilities and attributions of the National Advice of the Environment (CONAMA) and its Resolutions, for then only enter in the most important part of this work: an analysis of the environmental licensing of ranks of fuel resale, in the reality of the City of Natal/RN. Before this specific boarding, it was proceeded specifically a survey and communication from the applicable norms to such establishments (Resolutions of the CONAMA and norms of the ABNT), for after that carrying through an geo-ambient characterization of the City of Natal/RN. Finally, a reflection was made on the possibility of magnifying of the state activity, in terms of guarantees for the responsible members for the environmental policy and of administrative efficiency, through the idea of the ambient regulation. For the accomplishment of this study, it was proceeded research in diverse sources such as books, magazines, sites of the Internet, periodicals, thesis and dissertations, among others material, beyond visits the agencies that direct or indirectly act with the ambient defense and as fuel resale, such as Secretariat of Environment and Urbanism of the City of Natal (SEMURB), Institute of Economic Development and Environment of RN (IDEMA), Brazilian Institute of the Environment and the Natural resources You renewed, Executive Management of RN (IBAMA/RN), Public prosecutor's office of the Environment of Natal (Public prosecution service of the RN), National Agency of Oil (ANP) and Union of the Retailing of Derivatives of Oil of the RN, among others. To the end, satiated regulation is observed that although on the substance of the ambient licensing in ranks of fuel resale, also with federal, state and municipal norms, the municipal Public Power is very far from the fulfilment of its institutional functions, in the question environmental policy of these establishments, a time that few are the permitted ranks of resale in the city of Natal/RN

The Federal Constitution of 1988 is recognized for its enlargement in the face of large amount of provisions that make it up, among which many are fundamental rights. The fundamental rules set up the foundation of a democratic state, however, are the necessary legal mechanisms to be effective, its exercise is not enough merely to state them, but to offer ways for them to stop being just written standard on paper, and come to be viewed and exercised day-to-day. In this sense, access to justice presents itself in our times, as a cornerstone for a just society dictates. In this light, access to justice can be seen as the most fundamental of rights, which translates as instruments able to safeguard the fundamental rights not only against the action/omission violating the state but also the very particular. Furthermore, access to justice within the legal country, is not right for everyone, despite the willingness of the Citizen Charter in its article 5, paragraph LXXIV, ensuring that the State shall provide full and free legal assistance to those in need. More than half of the population lives in poverty and can´t afford to pay legal fees or court costs as well as a bump in their own ignorance of their rights. The judiciary, in their primary function, is in charge of trying to correct the violation of the rights, intending to effect a true distributive justice, serving as a paradigm for the promotion of substantive equality of human beings, however, is difficult and tortuous access Justice for those without financial resources. In this vein, we present the Public Defender, as keeper of the masses in its institutional role, defending a disadvantage, in the words, as a mechanism for effective access to justice, ensuring therefore fundamental rights. Public Defenders arise at the time or much discussion highlights the priority of actual access to justice, custody, therefore, intimate bond with the pursuit of fundamental rights, in which, that advance the broad range of rights, without whom could defend them or guardianship them

Brazilian law passes through a crisis of effectiveness commonly attributed to the extravagance of fundamental rights and public shortage. However, public finances are not dogmatically structured to solve the conflicts around the limitations of public spending. There are ethical conditioning factors, like morality, proportionality and impartiality, however, these principles act separately, while the problem of public shortage is holistic. Also, the subjectivity of politics discretionary in the definition of public spending, which is supported in an indeterminate concept of public interest, needs material orientation about the destination of public funds, making it vulnerable to ideological manipulation, resulting in real process of catching rights. Not even the judicial activism (such as influx of constitutionalism) is shown legally appropriate. The Reserve of Possible, also presents basic ethical failure. Understanding the formation of public shortage is therefore essential for understanding the crisis of effectiveness of state responsibilities, given the significant expansion of the state duty of protection, which does not find legal technique of defense of the established interests. The premise of argument, then, part of the possibility of deducting minimal model ethical of desire to spend (public interest) according to objective parameters of the normative system. Public spending has always been treated disdainfully by the Brazilian doctrine, according to the legal character accessory assigned to the monetary cost. Nonetheless, it is the meeting point between economics and law, or is in the marrow of the problem of public shortage. Expensive Subjects to modernity, as the effectiveness of fundamental rights, pass necessarily an ethical legal system of public spending. From the ethical principles deducted from the planning, only the democratic principle guides the public spending through the approval of public spending in the complex budget process. In other words, there is an ethical distancing of economic reality in relation to state responsibilities. From the dogmatic belief of insufficiency, public spending is evaluated ethically, according to the foundations of modern constitutionalism, in search of possible of the financial reserve, certain that the ethics of public economy is a sine qua non condition for legal ethics.

This work discourses about the child and adolescent s Guaranty System of Rights (GSR), on the intervention in cases of juvenile domestic sexual violence, in Recife. The course (trajectory) is analyzed, where circulate cases of sexual violence, until its resolution, in (GSR). Actually, the violence represents a serious problem of public health. Was thought about the difficulties and the limits that make GSR become a full field of contradictions and challenges for the effectiveness of the children and adolescents rights. Therefore, it was verified the treatments that are developed by GSR, how this system is structured and articulated and how occurs the resolution of the sexual violence cases against children and adolescents. Proceedings of the quantitative and qualitative research were used, was done observation, directed interview and analysis of documents. Thus, the field research was the visits in these institutions: Restauração Hospital, Police Management of the Child and Adolescent (PMCA) three Guardianship Councils, Dom Helder Camara Center of Studies and Social Action (CENDHEC) and the Tribunal of Childhood and Adolescence. The research subjects were seven professionals of GSR. The theoretical discussion is guided in reflections about the children and youth rights, in the violence theme and in the construction and institutionalization process of GSR. In this experiment, was noticed there are many difficulties for working together the GSR, because many obstacles are found when we call the responsible institutions, besides some violence cases happen again. This system is not totally institutionalized and articulated, faces structural problems, material, poorly qualified professionals, underinvestment, low transfer of public resources, among other difficulties, causing many losses in the implementation of public policies that enforce secured rights by legislation
