La disposición adicional cuarta de la Ley de tasas y precios públicos. Análisis crítico y propuesta alternativa

El presente trabajo estudia la disposición adicional cuarta de la Ley de Tasas y Precios Públicos. El estudio de la norma se escinde en tres partes: en primer lugar el supuesto de hecho que recoge el precepto, en segundo lugar los efectos jurídicos que de su aplicación se van a derivar y en tercer lugar su conformidad constitucional. Como cierre del estudio se formula una propuesta alternativa y se exponen de modo sucinto las conclusiones obtenidas a lo largo del trabajo.

Ohjelmakauden 1995 - 1999 yritystukien vaikuttavuus Etelä-Karjalassa

TE-keskusten toimenkuvaan ei ole kuulunut systemaattisesti selvittää hankkeen päätyttyä tuen vaikutuksia. Vaikuttavuusarviointi on ollut lähinnä hankkeen aloitusajankohdan tietojen keräämistä yrityksiltä. Ensimmäisen ohjelmakauden 1995 - 1999 yritystukien vaikuttavuutta ei ole tutkittu Etelä-Karjalassa jälkikäteisarvioinnilla. Tutkimus selvitti, mitä yhteiskunnallisia ja yrityskohtaisia vaikutuksia TE-keskuksen yritystuilla on ollut 3-5 vuoden jälkeen viimeisestä tukirahan maksatuksesta. Vaikuttavuutta mitattiin laaditulla kyselylomakkeella. Lisäksi tutkimustuloksia verrattiin TE-keskuksen etukäteisarviointituloksiin tukien vaikutuksista. Tutkimustulokset painottuvat eri vaikuttavuustekijöihin kuin TE-keskuksen tuloksissa. Kysely osoitti suurimmiksi tukien vaikutuksiksi yrityksen kilpailukyvyn muutoksen, muun rahoituksen helpomman saannin ja hankkeen nopeamman toteuttamisen. Muut merkittävimmät vaikutukset olivat yritysten tuotteiden ja palveluiden laadun sekä teknologiatason parantaminen ja tuotantomenetelmien kehittäminen. Yritystuilla on myös muita vaikutuksia, mutta ne jäävät alueella pieniksi. Vuoden 2003 lopussa yritystukea saaneista 366 yrityksestä vain 49 % oli toiminnassa olevaa ja 51 % todennäköisesti toimintansa lopettanutta. Tuilla luotiin vain 184 uutta työpaikkaa Etelä-Karjalaan. Keskimäärin syntyi yksi uusi työpaikka yritystä kohden, joka maksoi 38 200 euroa. Tehty arviointi osoittaa tukien vaikuttavuuden jäävän pienemmäksi kuin TE-keskuksen etukäteisarvioinnissa.

Las leyes que han ido preservando el patrimonio a lo largo del tiempo han evolucionado según el significado que ha ido teniendo a lo largo de la historia, pasando de un concepto de propiedad y disfrute individual en sus inicios, a otro mucho más colectivo en los últimos tiempos. Esta evolución no sólo se ha limitado a la propiedad sino que también lo ha hecho como elemento identificador de una sociedad, proporcionando una secuencia histórica de las leyes relativas a la conservación y divulgación del patrimonio histórico.

Cambios en la distribución salarial en españa, 1995-2002. efectos a través del tipo de contrato

En este trabajo analizamos los cambios en la distribución salarial en España entre 1995 y 2002, utilizando la información contenida en la Encuesta de Estructura Salarial. El análisis revela un notable cambio en la distribución salarial que afecta, básicamente, a los niveles salariales bajos y medios, mientras que los correspondientes a los elevados permanecen inalterados entre ambos años. El análisis detallado de las distribuciones salariales para trabajadores con contrato indefinido y temporal muestra como estos últimos son los protagonistas de las mejoras salariales, mientras que los cambios en los niveles salariales intermedios son causados principalmente por los cambios producidos en la distribución de los trabajadores indefinidos. Empleando una técnica semi-paramétrica que permite considerar los efectos en el conjunto de la distribución salarial, encontramos que las variaciones observadas en las distribuciones salariales son consecuencia de cambios en la estructura retributiva, que han afectado de forma distinta a los trabajadores temporales (mejoras salariales homogéneas) y a los indefinidos, (reducción de los salarios intermedios).

Análise química de sais de cobre fabricados entre 1877 e 1995

Samples of copper compounds covering all of the XXth century and the end of the XIXth century were submitted to classical and instrumental quantitative analysis. The amount of impurities greatly decreased with time, reaching a constant level since the 1960's. The gravimetric method was suitable for the determination of copper although other procedures also gave good or reasonable results. However, for metal contaminants, atomic absorption spectrometry was the best choice because of its lower detection limits, being able to determine several elements in the oldest samples. Ion chromatography detected several anions in copper salts manufactured before the 1950's. An increasing quality of raw materials and a better sensitivity of analytical methods led to quality improvement of copper compounds with time.

El present treball pretén oferir al lector un estudi sobre el nou Codi Processal Penal com esborrany d'avantprojecte de Llei, realitzant un anàlisis dels aspectes més rellevants i innovadors que introdueix el citat Codi així com l’adaptació d’aquests a les realitats socials de cada temps. A més, la idea per la qual neix el treball és analitzar les raons per les quals s’ha vist necessari i important realitzar una modificació total de la actual LECrim, estudiant la forma en què el legislador enfoca el nou Codi així com el seu contingut, destacant les principals diferències que conté l’actual LECrim amb aquelles que el nou Codi pretén instaurar.

Of the many dimensions of the problem of violence exercised by men toward women in the context of the relations of partner or ex partner, this article deals with the analysis of the discursive productions of the institutional actors that are part of the judicial process. Our intention is to investigate the relationship between criminal law and gender-based violence starting from the implementation of the Law of Integral Gender-based Violence in Spain (LO. 1 / 2004) from a theoretical perspective which includes contributions from social psychology, and socio-legal feminism. We have approached the legal instrument - the Law of Integral Gender-based Violence - through the discourse of legal officers with a perspective that questions the values, so often proclaimed, of universality, objectivity and neutrality of the law

The strategic use of military contractors : American commercial military service providers in Bosnia and Liberia, 1995-2009

Drawing from strategic theory, this study investigates the strategic roles of commercial companies providing military services, frequently referred to as private military companies. Theoretically, the thesis analyzes how states organize its military capabilities in order to be able to wield power within the international system while empirically, it examines the character and role of commercial companies that provide military training services to the United States Government and partner nations. The reason for this rather instrumental and functional, rather than critical, approach is that this work is written within the discipline known as War Studies. Strategic theory is used first to logically organize the empirical findings in two case studies and then to develop an analytical framework with which the strategic roles of companies providing military services can be investigated. The analysis has been conducted using both new and hitherto unknown sources in the shape of interviews as well as previously classified telegrams, but also draws on previous research and other secondary sources. The main findings are that commercial companies have five typical strategic roles: first, they cloak the state by substituting traditional uniformed troops; second, they act as trailblazers by securing US influence in new regions and by breaking new ground by contributing to the build-up of new partners; third, they act as scene setters by preparing the ground for military exit out of a theater of operations or by facilitating inter-operability between foreign militaries and the US military; fourth, they can be used to infiltrate the security structures of foreign countries; fifth and finally, they can be used to provide offensive capabilities by providing either kinetic or cyber warfare effects. Another finding is that military service contracting is an important part of the US strategic culture.
