Com o advento do Plano Real, que procedeu à estabilização da moeda em meados da década de noventa, ficou patente a gravidade da situação fiscal das unidades subnacionais. De um lado figuravam as dificuldades na condução da gestão financeira por meio da ausência do processo inflacionário que anteriormente possibilitava a indexação das receitas tributárias enquanto as despesas correntes tinham a sua liquidação e pagamento postergados. Por outro lado, a dívida consolidada, majoritariamente mobiliária, disparava em função da política monetária restritiva. Esta situação financeira precária tornou urgente a realização do ajuste fiscal dos estados que teve como condutor a União que instituiu medidas primordiais para atingir este fim, destacando-se três leis federais: a Lei de Renegociação das Dívidas Estaduais, a Lei de Responsabilidade Previdenciária e a Lei de Responsabilidade Fiscal. O trabalho em tela estuda a condução das contas públicas do Estado do Rio de Janeiro no período de 2000 a 2007, objetivando verificar a existência de esforços de ajuste fiscal e em que medida estes esforços trouxeram resultados satisfatórios, demonstrando a eficácia do arcabouço legal instituído pela União. Conclui-se neste trabalho que, no período de 2000 a 2006, não ocorreu avanço significativo em direção da melhoria das contas públicas estaduais e que os superávits primários alcançados no período foram impulsionados pelo aumento de receitas de caráter instável, extraordinário e finito. Destacou-se quanto aos riscos inerentes à excessiva e crescente dependência que as finanças estaduais apresentam, relativamente às receitas supracitadas, tendo em vista que estas têm sido utilizadas para pagamento de despesas públicas correntes de caráter continuado. O presente trabalho conclui também que, a partir do ano de 2007, foi dado o pontapé inicial para o alcance do ajuste fiscal, tendo em vista a mudança de patamar do superávit primário, com ênfase na redução das despesas primárias e não no aumento das receitas extraordinárias.

O trabalho se presta a identificar semelhanças entre o instituto da Repercussão Geral, nos recursos extraordinários interpostos perante o Supremo Tribunal Federal, e do Recurso Repetitivo, nos recursos especiais interpostos perante o Superior Tribunal de Justiça. Com isso, é realizada uma tentativa de busca jurisprudencial até o fim de 2009, não obtendo êxito na busca dos julgados em Direito Tributário, para identificar uma possível contradição entre o entendimento dos fundamentos dos filtros recursais entre as Cortes Superiores. Por fim, há uma análise crítica sobre as possíveis interferências do julgamento do STJ nos julgamentos do STF, procurando compreender o papel do Supremo, bem como as possíveis conseqüências das decisões do STF nos contribuintes e suas formas de defesa possíveis, caso venha ocorrer a hipótese formulada no trabalho.

O trabalho tem como objeto o estudo de temas específicos relacionados à Participação dos trabalhadores nos Lucros ou Resultados (PLR) empresariais, tais como a periodicidade do pagamento, do pagamento de PLR a somente algumas áreas da empresa e das regras claras e objetivas sobre a forma do acordo celebrado entre empregado e empregador. A matéria será introduzida por meio do exame da controvérsia constitucional acerca da auto aplicabilidade do art. 7°, XI, da Constituição Federal de 1988, questão que é objeto do Recurso Extraordinário n° 569.441-RS, cuja repercussão geral foi recentemente reconhecida pelo Supremo Tribunal Federal (STF) e que ainda está pendente de julgamento. Após breve histórico sobre a legislação que regulamenta a PLR, por meio da análise prática da jurisprudência do Conselho Administrativo de Recursos Fiscais (CARF), será apresentado o entendimento do tribunal acerca de temas controvertidos existentes na legislação (Lei n 10.101/2000) que regulamenta a matéria.

Como em países de tradição civil law, o sistema jurídico brasileiro consagra a lei como fonte primária e garantia do Estado de Direito. A hermenêutica, como teoria científica da arte de interpretar, impõe-se em nosso sistema como canal destinado a suprir as vaguezas e imprecisões da lei e resolver-lhe os conflitos normativos, pelos métodos e critérios tradicionais. A jurisprudência, entendida como um conjunto uniforme e constante de decisões sobre assuntos similares, tem um papel secundário, e as ideias de Direito e Justiça, nesse contexto, muito se aproximam da lei. Com a promulgação da Constituição democrática de 1988, e o renascimento do direito constitucional brasileiro, cujo marco filosófico é o pós-positivismo, o constituinte atribuiu normatividade aos princípios constitucionais. Mas não sistematizou as relações dos princípios entre si, e destes com regras igualmente positivadas na Constituição, fazendo emergir certas tensões principiológicas e também entre princípios e regras constitucionais. Superado o modelo positivista, que equiparava o Direito à lei, ganharam grande importância as discussões relacionadas à neutralidade do aplicador da norma, e os voluntarismos e personalismos praticados sob ideais subjetivos de justiça. Nesse novo contexto, a jurisprudência assume papel protagonista, e aproxima o modelo brasileiro das jurisdições do common law. Entretanto, a vinculação apenas extraordinária dos julgadores aos precedentes, que deita raízes no regime de livre convencimento, induz falta de uniformidade e de coerência dos julgados, acerca de questões jurídicas similares, comprometendo a estabilidade, gerando incerteza e insegurança jurídica, e por via de consequência, relevantes empecilhos ao planejamento empresarial e aos investimentos que dele dependem, o que tende a gerar prejuízos ao ambiente de negócios do País. Essa perspectiva tem o objetivo de demonstrar que o Direito, enquanto sistema harmônico de normas, requer limites claros, e que esses limites, em nosso sistema constitucional, significam precisamente a imposição de métodos que assegurem à sociedade pronunciamentos uniformes e coerentes por parte do aplicador da norma, mediante observância de precedentes adequadamente sopesados em direção à harmonia, segurança jurídica e previsibilidade.

The acronym BRICS was a fad among the media and global investors. Now, the acronym sounds passé. However, the group of countries remains important, from both political and economic reasons. They have a large aggregate size, 28% of the global GDP and 42% of the world’s population, high growth potential due to the current significant misallocation of resources and relatively low stock of human capital, structural transformation is in progress and one of them, China, is taking steps to become a global power and a challenger to the US dominance. This paper provides a brief overview of the five economies, Brazil, Russia, India, China and South Africa. We focus on some aspects of their history, the Chinese initiatives in international finance and geopolitical strategic moves, their growth experience and structural transformation over the last 35 years, trade and investment integration into the global economy and among themselves, the growth challenges faced by their economies and the potential gains to the Brazilian economy from a stronger integration with the other BRICS. In association with its efforts to be a global power, China aims to become a major player in global finance and to achieve the status of global currency for the renminbi, which would be the first currency of an emerging economy to attain such position. Despite the similarities, the BRICS encompass very diverse economies. In the recent decades, China and India showed stellar growth rates. On the other hand, Brazil, Russia and South Africa have expanded just in line with global output growth with the Russian economy exhibiting high volatility. China is by far the largest economy, and South Africa the smallest, the only BRICS economy with a GDP lower than US$ 1 trillion. Russia abandoned communism almost 25 years ago, but reversed many of the privatizations of 90’s. China is still ruled by communism, but has a vibrant private sector and recently has officially declared market forces to play a dominant role in its economy. Brazil, Russia and South Africa are global natural resources powerhouses and commodity exporters while China and India are large commodity importers. Brazil is relatively closed to international trade of goods and services, in marked contrast to the other four economies. Brazil, India and South Africa are dependent on external capital flows whereas China and Russia are capital exporters. India and South Africa have younger populations and a large portion living below the poverty line. Despite its extraordinary growth experience that lifted many millions from poverty, China still has 28% of its population classified as poor. Russia and China have much older populations and one of their challenges is to deal with the effects of a declining labor force in the near future. India, China and South Africa face a long way to urbanization, while Brazil and Russia are already urbanized countries. China is an industrial economy but its primary sector still absorbs a large pool of workers. India is not, but the primary sector employs also a large share of the labor force. China’s aggregate demand structure is biased towards investment that has been driving its expansion. Brazil and South Africa have an aggregate demand structure similar to the developed economies, with private consumption accounting for approximately 70%. The same similarity applies to the supply side, as in both economies the share of services nears 70%. The development problem is a productivity problem, so microeconomic reforms are badly needed to foster long-term growth of the BRICS economies since they have lost steam due a variety of factors, but fundamentally due to slower total factor productivity growth. China and India are implementing ambitious reform programs, while Brazil is dealing with macroeconomic disequilibria. Russia and South Africa remain mute about structural reforms. There are some potential benefits to Brazil to be extracted from a greater economic integration with the BRICS, particularly in natural resources intensive industries and services. Necessary conditions to the materialization of those gains are the removal of the several sources of resource misallocation and strong investment in human capital.

Este trabalho contempla o descasamento entre a extraordinária expansão do campo do gestão estratégica (GE) e as crescentes críticas à incapacidade de lidar com as crises da globalização neoliberal. A análise crítica mostra como a universalização do americanismo é acompanhada pela universalização do management e do strategic management. Em seguida, explora como os discursos neoliberais de mercado e não-mercado reproduzem discursos simplistas que contribuem para a legitimação da atuação das corporações em escala global. Por fim, é tratada a preferência pela grande corporação moderna, por meio da marginalização de outros formatos organizacionais de grande relevância principalmente para economias emergentes. O framework integrativo resultante é então aplicado a uma seleção de artigos científicos de GE que permitiu a identificação de cinco temas: geopolítica do conhecimento, empiricismo cientificista, concepções simplificadas de mercado e instituições, governança corporativa e capitalismo. A exploração da conexão entre o conhecimento em GE e o ordenamento econômico e geopolítico do neoliberalismo mostra como o campo pode ter relevância para a sociedade, além de promover a aproximação do mainstream com as perspectivas críticas.

In the 1970s, Corporate Social Responsibility (CSR) was discussed by Nobel laureate Milton Friedman in his article “The Social Responsibility of Business Is to Increase Its Profits.” (Friedman, 1970). His view on CSR was contemptuous as he referred to it as “hypocritical window-dressing” a reflection of the view of Corporate America on CSR back then. For a long time short-term maximization of shareholder value was the only maxim for top management across industries and companies. Over the last decade, CSR has become a more important and relevant factor of a company’s reputation, shifting the discussion from whether CSR is necessary to how best CSR commitments should be done (Smith, 2003). Inevitably, companies do have an environmental, social and economic impact, thereby imposing social costs on current and future generations. In 2013, 50 of the world biggest companies have been responsible for 73 percent of the total carbon dioxide (CO2) emission (Global 500 Climate Change Report 2013). Post et al. (2002) refer to these social costs as a company’s need to retain its “license to operate”. In the late 1990s, CSR reporting was nearly unknown, which drastically changed during the last decade. Allen White, co-founder of the Global Reporting Initiative (GRI), said that CSR reporting”… has evolved from the extraordinary to the exceptional to the expected” (Confino, 2013). In confirmation of this, virtually all of the world’s largest 250 companies report on CSR (93%) and reporting by now appears to be business standard (KPMG, 2013). CSR reports are a medium for transparency which may lead to an improved company reputation (Noked, 2013; Thorne et al, 2008; Wilburn and Wilburn, 2013). In addition, it may be used as part of an ongoing shareholder relations campaign, which may prevent shareholders from submitting Environmental and Social (E&S)1 proposals (Noked, 2013), based on an Ernst & Young report 1 The top five E&S proposal topic areas in 2013 were: 1. Political spending/ lobbying; 2. Environmental sustainability; 3. Corporate diversity/ EEO; 4.Labor/ human rights and 5. Animal testing/ animal welfare. Three groups of environmental sustainability proposal topics of sub-category number two (environmental sustainability) 6 2013, representing the largest category of shareholder proposals submitted. PricewaterhouseCoopers (PwC) even goes as far as to claim that CSR reports are “…becoming critical to a company’s credibility, transparency and endurance.” (PwC, 2013).

Intending to explain the extraordinary lizard coexistence levels found in Australian deserts, Morton & James (1988) figured out a hypothesis which defends that the termite diversity would bring about lizard radiation. This study aims to verify the validation of that hypothesis in Caatinga lizard assemblages. This study also objectives verifying if the termite defense mechanisms influence their consuming levels by lizards and if this pattern differs between different lizard lineages. Termites were collected using a standardized sampling protocol of termites. Besides using haphazard sampling, we collect lizards with 108 pitfall traps in each area. Intending to check the linkage between the termite and lizard assemblages, the lizard stomach contents were analyzed and then a canonical correspondence analysis was performed. The presence of nonrandom patterns of diet overlap among the lizard species was also examined. Aiming to check if the defense mechanisms of termite influence their consuming pattern by lizards it was performed a laboratory experiment where termite with different defense mechanisms were offered to lizards of two different lineages. We verified that lizard assemblages do not consume termites according to termite abundance in ecosystems. Furthermore, mean niche overlap lizard species did not differ significantly from that expected by chance. We found that termite chemical defense mechanism does influence the termite s pattern consuming by lizards. These results do not corroborate premises which support Morton & James hypothesis (1988) and point out that lizard do not chose termites based on their abundance, but, trying to avoid consuming termites which exhibit chemical defense mechanisms. This defense mechanism, however, may not be the only explanation to patterns of termite s consuming by lizards.

This research was based on a study regarding the myth, the landscape and then man in Bolivian literature, a country whose cultural tradition transcends myth and reality, with an exotic nature, inherited from extraordinary people from a remote time, with archeological remains that show its glory, making it particular among other Latin American literatures. To contextualize the literary study of this nation, rich in fantasy literature, understanding its traits in the current literature, we have sought to rescue the history of its first inhabitants, the Kollas, and the cultural reference they inherited and reviewed in the acculturation process between indigenous and Spanish people. This study is based on the contributions of Latin American theorists, such as Antonio Conejo Polar, Nestor Canclini, the Cuban ethnologist Fernando Ortiz, and especially the concept of transculturation of the Uruguayan critic Ángel Rama. Thus, we have tried to rescue a study about the Andean past, approaching the fundamentals of mythic component in literature, addressing landscape and nature as the ones that illustrate, characterize and give life to the mythical characters and social problems of the Andean man

The discovery of the spatial uniform coexistence of superconductivity and ferromagnetism in ruthenocuprates, RuSr2GdCu2O8 (Ru-1212), has spurred an extraordinary development in the study of the competition between magnetism and superconductivity. However, several points of their preparation process and characterization that determine their superconductive behaviour are still obscure. The improvement of sample preparation conditions involves some thermal treatments in inert atmosphere. Anelastic spectroscopy measurements were made using an inverted torsion pendulum, operating with an oscillation frequency of 38 Hz, temperature in the 90 and 310 K range, heating rate of 1 K/min, and vacuum better than 10(-3) Pa. The results show anelastic relaxation peaks at 210 K related to the presence of interstitial oxygen atoms. The peaks decrease significantly with the oxygen loss caused by the heat treatments in vacuum, appearing again after the annealing of the sample in an oxygen atmosphere. These observed peaks are clearly related to the additional oxygen atoms, with activation energy 0.13 and 0.36 eV, and can be explained in terms by diffusional jumps of interstitial oxygen in the RuO2 planes. It is undeniable that all the extraordinary technological advances in contemporary society have increased the severe patients expectation and quality of life, especially cancer patients. On the other hand, it is easily verifiable by many researches that it was not possible to advance in the same proportion in caring for the human experience of death. Much is said about the anguish of a man facing death, of cancer patients in terminal stage, about their families, and very little about the feelings, anxieties and ways of coping with the medical professional who deals with this situation, specifically the clinical oncologist. Little is known about the experience of the doctor who has learned to take death as an enemy to be defeated, and increasingly is compelled to live at length with his advertisement. However, we started to watch in recent years a growing interest of researchers in this issue. This study seeks to add to this interest in order to understand the experience of clinical oncologists that accompany dying patients, the meanings they attach to death, ways of coping and the implications for providing care. This is a qualitative study in which was used as a tool for data collection an in-depth interview with the projective using script and scenes. Gadameriana Hermeneutics was used for analysis and interpretation of narratives. The subjects were 10 clinical oncologists who work at two institutions from cancer treatments in the state of Rio Grande do Norte, chosen from a variation in the time working in the specialty (minimum of one year, even old ones). However, you can bring some initial results for the dialogue. It was found that the death is still a topic that causes many difficulties in the daily lives of these professionals, the choice for oncology involves dealing with death without preparation in medical education; being close to the patient in the final moment, supporting the family, coping with own pain of loss and the inability to heal. These are central elements of the narratives. We also have investment in medical training and continuing education in setting up a demand that permeates the discourse of participants. Being able to listen to the subjective world of clinical oncologists will support the work not only for them as other professionals who deal with patients with advanced cancer, providing evidence to understand to what extent the meanings attributed to its know-how before patients on the verge of death interfere with the production of care and allow identify coping strategies in everyday life of these professionals that hinder or facilitate coping with death, promote or preclude the care with others and with themselves. It is hoped that research can contribute to the field of knowledge about the know-how in clinical oncology and their terminal-care-death oncologist-patient relationships, bringing runways capable of promoting a better quality of care in the production of all involved in this process: professionals, patients and families

This work verifies the impact caused by the Emergencial Program of Reduction of Consumption of Electric Energy (energy-rationing program) in the results of the concessionary private companies of the public service of electric energy distribution localized in the Northeast Area. As the rationing invigorated from June 2001 to February 2002, its effects are diluted in the results presented by these companies in the second semester of 2001 and first quarter of 2002, with prominence for the last quarter of 2001, when the revenue of extraordinary tariff restore was instituted by the National Agency of Electric Energy (ANEEL), consequence of the so-called General Agreement of the Electric Sector made between the federal government and the companies of the electric sector. The structure of a generic electric sector and a historical review of the Brazilian electric sector from the time it was controlled by the private enterprises, including the State control period, about 1960, and returning to the control of the private enterprises in 1990, under a new regulation structure are presented. An explanation of the models of economic regulation that Brazil used for the electric sector is made, with prominence for the price cap that is the actual effective model. The process of tariff revision foreseen in the concession contracts signed by the federal government and the concessionary companies is presented, highlighting its two stages: the tariff rebalancing that defines the new price cap and the calculation of the factor X that establishes the efficiency goals for the companies. There is made a presentation of the Emergencial Program of Reduction of Consumption of Electric Energy and of the consequent General Agreement of the Electric Sector, which created the revenue of extraordinary tariff restore. A conceptual revision on reviews is presented, regarding to concepts, accomplishment and recognition. A brief review of the six companies that made part of the worked sample is also presented. Analyzing the quarters historical review and of amount of sold energy, it was possible to conclude that the energy-rationing altered the results of the studied companies significantly and that alteration was masked by the accounting process of the revenue of extraordinary tariff restore
