Através do presente trabalho, buscar-se-á discorrer sobre o cabimento das tutelas de urgências na esfera do procedimento arbitral, englobando a possibilidade de decretação e execução das medidas urgentes pelo árbitro – seja previamente ou no curso da arbitragem –, a partir da análise dos dispositivos da Lei de Arbitragem (Lei nº 9.307/1996), bem como da doutrina nacional dominante sobre o tema. Tal estudo faz-se relevante na medida em que o processo arbitral vem sendo amplamente utilizado por particulares como meio eficaz de solução de litígios relativos a direitos patrimoniais disponíveis. Todavia, mesmo sendo dotada de maior celeridade do que o provimento judicial, nem sempre a arbitragem conseguirá tutelar o direito material alegado pelas partes até que seja proferida a decisão final de mérito. Assim, em algumas situações, nas quais haja fundado receio de dano irreparável à parte, as medidas de urgência são imprescindíveis a fim de assegurar o direito pleiteado, tornando possível a prolação de uma sentença justa e revestida de utilidade prática. Neste contexto, entende-se o árbitro é dotado de poder jurisdicional para conceder medidas cautelares e antecipatórias que se façam necessárias, ainda que tal poder não esteja expressamente delimitado na convenção de arbitragem. Para efetivá-las, no entanto, precisará recorrer ao Poder Judiciário (monopolizador do poder de coerção) para dar cumprimento às medidas decretadas pelo árbitro, sempre que a parte em face da qual a medida for decretada se recusar a cumprir a determinação arbitral espontaneamente.

O presente trabalho dedica-se à análise da possibilidade do exercício do direito de retirada parcial por parte de acionista de sociedade anônima. Para tanto, fez-se, primeiramente, um estudo das bases essenciais do instituto do direito de retirada, para, então, analisar a possibilidade do exercício do direito de retirada parcial. Concluiu-se que o ordenamento jurídico brasileiro não veda o exercício do direito de retirada com apenas parte das ações do sócio de sociedade anônima.

Este trabalho tem por objetivo analisar o comportamento da Empresa Brasileira de Correios e Telégrafos (ECT) no âmbito judicial diante de seus concorrentes e os clientes destes, buscando verificar se há evidências de que a empresa estaria praticando um ilícito concorrencial e utilizando o judiciário para prejudicar concorrentes no mercado e dificultar a entrada de novos agentes (ou seja, se haveria litigância predatória pelos Correios), mediante a criação de novos custos aos seus rivais e, assim, prejudicando a competição no setor postal. No âmbito jurídico, há pouca clareza quanto à extensão do monopólio postal e verifica-se, uma carência de política pública para o setor. Para realizar o estudo, foi analisado o contexto no qual se insere a conduta da ECT e foi elaborada uma base de dados a partir da análise de processos judiciais movidos pela ECT. Na análise empírica dos dados coletados, buscou-se avaliar como a decisão do STF sobre a existência e validade de uma exclusividade da ECT na prestação de certos serviços postais, tais quais definidos por lei, afetou a probabilidade de uma decisão final em 1ª instância ser favorável aos Correios. Os resultados indicaram que tal probabilidade é significativamente menor após a decisão do STF em 2009, o que serve de evidência de que a ECT vinha extrapolando seus direitos nos pedidos realizados judicialmente. Apesar de o contexto no qual a conduta se insere, especialmente quanto aos custos de litigar, indicarem racionalidade na conduta e de a análise empírica ir no mesmo sentido, as evidências não são fortes o suficiente para se concluir que a ECT praticou litigância predatória.

O fato de que o Estado brasileiro deve, de acordo com sua Carta Magna, garantir o direito de seus cidadãos à saúde não significa, necessariamente, que a provisão destes serviços tem de ser feita diretamente pelo poder público. As parcerias com organizações sociais, previstas na Lei Federal 9.637/1998 e regulamentadas pelos Contratos de Gestão, pretendem oferecer uma alternativa à eficiência, agilidade e flexibilidade na assistência à saúde. Entretanto, a estrutura dos contratos de gestão com Organizações Sociais de Saúde (OSS), elaborada com a pactuação de metas e indicadores de desempenho, não pode ser considerada, isoladamente, como fator garantidor da prestação adequada de tais serviços públicos. É fundamental considerar neste contexto os arranjos organizados pelo poder público para assegurar que os serviços oferecidos representam o que, de fato, os cidadãos consideram valor. O presente trabalho tem como objeto as parcerias com OSS no âmbito do governo do estado de São Paulo. As entrevistas realizadas e as pesquisas empreendidas na confecção deste estudo revelam que, caso se pretenda trabalhar com estas parcerias sob uma perspectiva de value-for-money e geração de valor público, faz-se necessário aprimorar os mecanismos de escuta aos cidadãos, os arranjos de governança colaborativa entre entes federados, o alinhamento com órgãos de controle e, sobretudo, qualificar a capacidade organizacional do Estado e das OSS, por meio da revisão das metas e indicadores dispostos nos contratos de gestão.

Esta dissertação busca investigar as consequências jurídicas das expropriações normativas. Trata-se de um ato regulatório, genérico e abstrato, que subtrai ou minimiza o direito de propriedade, do qual não decorre a transferência formal do domínio para Poder Público. A problemática tem lugar na medida em que essa ablação normativa é levada a efeito, sem o estabelecimento do devido processo legal expropriatório (previsto no art. 5º, inciso XXXIV, da Constituição da República – CRFB), o qual impõe o pagamento de uma prévia e justa indenização ao expropriado. Para este fim, será investigado se os institutos por meio dos quais o Estado intervém na propriedade privada (desapropriação, limitação administrativa, ocupação temporária, requisição administrativa, tombamento) dão conta desse fenômeno, ou se se trata de uma falha da regulação, que produz consequências jurídicas. Ao final, será apresentada uma proposta, de lege ferenda, de disciplina desse fenômeno

The present work deals with study on the National Program of Reinforcement of Familiar Agriculture, Group B, referring it offers of agricultural credit the agriculturists who possess familiar prescription until R$ 2,000, 00, and its impact in the agricultural occupation of the city of Ceará-Mirim. From theoretical referencial regarding the agricultural occupation, it collects of data, application of questionnaires between the beneficiaries of PRONAF B and interviews with the involved actors, it was made possible ascertainment of the hypothesis of that the program in this modality of credit, is capable to provide only to the maintenance or diversification of the occupation in the familiar unit and not it generation of remunerated occupation not familiar. This research disclosed to the diverse possibilities of use of the credit and its impact in the agricultural occupation, exactly when it is deviated for other purposes not waked up next to the financial institution, generating impacts not waited, however positive. When destined to the waked up end, still new forms appear of way occupation to complement it the deriving familiar prescription of the main activity. Unable to discard the rise even though very small and informal, non-family gainful occupation. The knowledge is added of that exactly ahead of the easinesses of access to the social base of the program, many familiar agriculturists still find difficulties in the approval of the which had credit, on the other hand, the requirements of the financial institutions

According to the Public National Security Plan, the security is "[ ] a right by democratic excellence legitimately desired by all sectors of society, which is the fundamental right of citizenship, obligation of the constitutional state and responsibility of each one of us." The 1988 Constitution recognized the rights of life, liberty and personal integrity, considered torture and racial discrimination as crimes. The prime directive of the National Security and Citizenship (Law No. 11,707 of June 19, 2008 - PRONASCI-Brazil) expresses the commitment of the Brazilian state with the promotion of human rights. But despite this formal recognition, official violence continues to be used as a means of maintaining social order, consolidating a police action violating human rights (Amnesty International report "They go in shooting" - AI Index: AMR 19/025/2005) . This thesis analyzes the police work combined with the extension of citizenship rights, the spaces of freedom and democracy as a measure for the degree of affirmation or denial of the Human Rights in Brazil, and proposes the construction of a human friendly Police Force (Post - Colonial, Post-Abyss, Intercultural and Democratic)

The Article 225 of Constitution of the Federative Republic of Brazil in its main body, stipulates that everyone is entitled to ecologically balanced environment and the use of common people and essential to the healthy quality of life, should be imposed on public authorities and the community the duty to defend it and preserve it for present and future generations. Following a universal trend, the letter raised the Brazilian environment the category of one of those values ideals of social order, dedicating it, along with a constitution of rules sparse, a chapter, itself, which definitely, institutionalized the right to healthy environment as a fundamental right of the individual. The national public policies and state should be in line with modern theories of Sustainable Development, outlined within the international society, and certainly instruments that should be made effective through the mobilization of civil society as a whole. The implementation of Human Rights, in fact, depends on a strong political action and not just a legal problem. Thus, this work of theoretical-descriptive nature we will address various dimensions of sustainable development, such as environmental education, water, sanitation, health and sustainable development plans, evaluating its current stage in our state

The freedom of social communication referred to those freedoms exercised under of the media. The journalism is professional activity responsible for factual information, real, pluralistic and of the public interest, directed diffusely to social orientation. The right of the information, characterized as diffuse right or of fruition by uncertain and numerous holders, is subdivided in the right of the inform, inform yourself and right to be informed. The journalists, as occupants of a enlarged spectrum concerning of right of the inform, have responsibility for the information they disseminate, devoir that puts on the basis of the constitutional right to be informed. This duty is divided with journalistic companies, when them realized. In the research, examined the existence of constitutional guarantees the right to be informed. To answer the question, realized research to support bibliographical and documentary. The guaranty is a empirical preoccupation coated with legality, since lends itself effect concretize a right. Traced so a panel of guarantees of institutional imprint, substantive and procedural. Treating of the institutional guarantees the right to information, it would refer to true institutions (as the free press) and may begin subjective rights. Electrical energy today is an essential element in the life of any human being. Through the access to electrical energy it is possible to enjoy dignified conditions of life, having in mind the possibility of making use of minimal material conditions of life. The lack of access to electricity is directly linked to poverty and degrading conditions of life, in which are some communities in Brazil, especially the more isolated from urban centers. Access to the electric service is a determining factor for the preservation of human dignity, constitutional principle inscribe in the art.1 of the Federal Constitution, and the promotion of development, being a right of everyone and a duty of the State to promote universal access. For that reason, focuses mainly on the analysis of their setting as a fundamental social right and its importance for national development. For this, the theoretical and descriptive method was used, with normative and literary analysis, in particular the Constitution of 1988. This study also discusses the form of action of the State in the energy sector, to give effect to the fundamental social right of access to electricity, the characteristics of public service and the principles that guide it, in addition to the role of public policies in universalization of access, in particular the analysis of the Program Luz para Todos, and the function of regulation in the implementation of these policies and the provision of adequate public services.

This work aims to study the material conflict of jurisdiction as to the ownership of public water supply, between the municipalities and the Member States, in metropolitan areas. One of the important points of analysis is the realization of the fundamental right of access to water, a right that is implicit in the Constitution of 1988, being prevented from having their achievement considering the lack of definition of the ownership of the service. Knowing discussed the essential public service, in all its stages, it will realize it is a complex activity that depends for its operation, joint activities of federal entities and the society. In its pursuit of development (understood as better conditions of life), that in view of the Federal Law nº 11.445 of 2007 is the universal access to service, require the adoption of popular participation and the positive benefits of the state, such as planning. The environment, which fundamental importance has already been recognized in all the world, is an actual national and international discussion subject, whose interest grows for the society, and consequently to the Law, in order to prevent the natural resources to the present and future generations. The 1988 Brazilian Constitution, recognizing the importance of the environment, treated about it in many of its parts, even dedicating a specific chapter (Chapter V About Environment, inserted in Title VIII About Social Order). The brazilian constitutional text established to everyone the fundamental right of enjoying an equilibrated environment, obligating the State and all society to defend and preserve the environment to the present and future generations. The economic growing process, that predominated and still persist in the big majority of the countries, where is practiced the capitalist system, has in the enterprises (legal persons) one of its main actors. Many times, these enterprises, especially in the actual globalized world in where we live, where the gain of money is priorized, ends, at the moment they act, making damages to the environment. These damages are, many times, considered by the law. crimes against the environment. The 1988 Brazilian Constitution, according to the Modern Criminal Law, realizing that many crimes were being committed by the enterprises, established in article 225, §3rd, the criminal responsibility of the legal persons. Almost ten years after the 1988 Brazilian Constitution, was published the Law number 9.605/98, in which third article established the penal responsibility of the legal persons that practice crimes against the environment, without excluding the individual responsibility

This work presents an analysis about the legitimation of independent regulatory commission`s rulemaking power by participation procedure. It is observed that political and administrative decentralization and fragmentation of State, with the purpose of approaching citizens and provide, more efficiently, the functions acquired by the passage of the Welfare State, leads to a deficit of legitimacy (democratic crisis), which is noticeable in the making of legal norms by directors of independent regulatory commission to regulate specific economic sector. However, we understand that this crisis stems from the observation of the contemporary world from dogmas and legal institutions of the eighteenth century, without their evolution and adaptation to the modern world. The legitimacy must be perceived as the justification of power, relation command /obedience, which, from the Modern State, has the democracy as standard. Therefore, just as the world has evolved and demanded political and administrative decentralization to accompany him, it is necessary to the development of the idea of representative democracy (formal legitimacy) to participatory democracy (legitimacy stuff). Legitimacy is not confused with the legality: as the legality is on observance to internal legal system, the "rules of play"; legitimacy, as inputs to be fed into this system, the selection of the different expectations in the environment. Nevertheless, the legitimacy will take place by legality, through introduction of rational and communicative procedures: procedures get fundamental importance because these will be the means to select the expectations to be introduced in the legal system in order to make decisions more fair, rational and qualified towards society. Thus, it is necessary to its opening to the environment for dialogue with the government. In this context, we try to make an analysis of constitutional norms based on systematic and teleological interpretation of these norms to build these arguments. According to the Constitution of 1988, participatory democracy is a result of the democratic principle (sole paragraph of art. 1 of the Constitution), and it is an expression of citizenship and political pluralism, both foundations of Republic (respectively Art. 1st, inc . V and II of the Constitution), as well as the national consciousness. From another point of view, that principle consists of an evolution in the management public affairs (principle of Republic). The right of interested participate in the rulemaking process derives both the principle of popular participation (part of the democratic principle) and the republican principle as the due process constitutional (art. 5, LIV and LV, CF/88) and the right to petition (Art . 5 °, inc. XXXIV, "a", CF/88), and it is the duty of the State not only be open to participation and encourage it. Ignoring stakeholder involvement in procedures and / or expressions compiled can be causes of invalidation of the rule of law produced by addiction of procedure, motive, motivation and/or because of the administrative act. Finally, we conclude that the involvement of stakeholders in the process of making rules within the independent regulatory commission is the legitimacy and the validity of rules; and that, despite of the expressions do not bind the decision making, they will enter the system as juridical fact, balancing the field of technical discretionary of agencies
