Le déroulement du commerce électronique sur un marché global suscite de nombreux questionnements juridiques. D'une part, le droit est conçu à l'échelle nationale en fonction d'un milieu social tributaire de son histoire et de sa culture et d'autre part, le commerce électronique global présente des caractéristiques très singulières : dématérialisation, ubiquité et dimension transfrontalière. Or, une telle confrontation est susceptible de menacer la sécurité juridique des parties dans leurs transactions commerciales en ligne mais aussi la confiance nécessaire à leur développement. Les territoires nationaux, en limitant le pouvoir d’action effectif des États, pose un problème d’échelle : réglementer un phénomène global confronté à des souverainetés territoriales multiples. L’encadrement normatif du commerce électronique global se développe désormais, en partie, à un niveau extra étatique, confirmant l’érosion du monopole des États dans la régulation des rapports juridiques globalisés. La normativité devient le résultat d’un jeu normatif ouvert non seulement quant aux acteurs de la régulation, mais également quant à la qualification des normes impliquées dans cette régulation. Prenant la mesure de la complexité croissante de la normativité, les États interviennent pour tenter de concilier les pratiques nouvelles avec la règle de droit dans une logique de définition des règles du jeu et d’harmonisation du comportement des acteurs économiques. Les systèmes de droit nationaux apprennent à interagir avec des normes multiples de sources différentes. Cette évolution reflète l’articulation des dynamiques de mutation de la normativité avec le phénomène de globalisation du commerce électronique.

The tough competition in the global and national markets and new trends in consumerism resulted in an increase in the volume of advertisements. Sometimes advertisers are successful in achieving their intended objectives with a particular advertisement and sometimes they are not .These factors contributed a lot towards the decision making problems of advertising agencies with regard to the selection of appropriate advertising strategies and tactics. The tough competition and large volume of advertising make the consumers confused and this even created doubts in the minds of consumers about the genuineness and reliability of manufacturers and products. These factors caused a query regarding the active role of credibility element in advertising. The proposed study examines the effects of advertising credibility in consumer health care non durable product advertising on communication effect, purchase behavior and ad skepticism. This paper examines the need for the study of advertising credibility and reviews the advertising- consumer behaviour- credibility – healthcare theories which form a basis for the study. It identifies the different components and dimensions of advertising credibility and the importance of communication effect, purchase behavior and ad skepticism. It also studies the relevance of credibility in the consumer healthcare products advertising and suggests a Theoretical Framework for the proposed study

El proyecto que se quiere plantear es la creación de una Plataforma electrónica a través de la cual se pretende agrupar a los diferentes proveedores que intervienen en la cadena de abastecimiento de la comunidad logística de San Antonio, abriendo la posibilidad de participación de empresas grandes y pequeñas y más aun promoviendo la creación de las mismas por parte de los ciudadanos de la región, de esta manera, se eliminan las brechas asimétricas existentes entre la oferta y la demanda permitiendo que las empresas medianas y grandes accedan a ofertas y transacciones con empresas proveedoras medianas y pequeñas. Dicho proyecto, tiene como objetivo general el consolidar los procesos de abastecimiento implementados por las empresas a través de la organización y estandarización de los mismos mediante el uso del portal, planteado en el presente proyecto, como apoyo tecnológico. Existen dos conceptos básicos a analizar de manera teórica dentro del proyecto, el primero de ellos es el de clúster logístico-portuario, lo cuales son reconocidos como instrumentos importantes para el progreso del desarrollo industrial, innovación, competitividad y crecimiento, tomando como ejemplos a los puertos de Valencia y Long Beach en la ciudad de Los Ángeles. El segundo concepto es el de E-Procurement, el cual se desarrolla siguiendo los pasos básicos de una cadena de abastecimiento tradicional, sin embargo, lo que genera un cambio real dentro de los procesos es el hecho que los procesos de cotización y seguimiento de proveedores se van a llevar a cabo a través de una plataforma electrónica con base a las evaluaciones que se llevan a cabo por parte de las empresas demandantes de los productos o servicios ofrecidos por las compañías proveedoras. (Renko, 2011) De la misma manera, se tomaran varios proyectos de e-procurement desarrollados a nivel mundial como base comparativa y de apoyo para el presente proyecto tales como: HYDRA: Es un sistema que tiene su soporte en la web, el cual es orientado “en el medio” lo cual lo hace un sistema con una arquitectura híbrida, que posee tanto un diseño en capas como una estructura comprensiva para desarrollar integración de negocios, colaboración y monitoreo en la gestión de la cadena de suministro (Renko, 2011) IPT: BidNet ha proporcionado servicios de oferta de información a miles de proveedores y compradores de bienes en el ámbito gubernamental por más de 25 años. (Bidnet, 2013) E-BUYPLACE: E-buyplace.com es el 1° especialista en SupplierRelationship Management que ha desarrollado un original y singular SRM 100% a través de Internet. (e-buyplace, 2013) RosettaNet: La iniciativa RosettaNet anima a optimizar los procesos de la cadena de suministro mediante el establecimiento, implementación y promoción de estándares abiertos en el mercado e-Business (AQS, Advance Quality Solutions, 2002)

Los avances tecnológicos y la entrada a una nueva era digital son una realidad presente en todos los aspectos de la sociedad actual. El mundo organizacional se incluye en esta nueva era digital modernizando sus procesos y soportando sus actividades empresariales en tecnologías de la información y comunicaciones. La inclusión en la era digital por parte de las organizaciones es un paso importante que se debe dar para obtener los crecientes beneficios que la tecnología ofrece. Esta transformación organizacional hacia la implementación de herramientas TIC, como soporte del quehacer misional, debe darse bajo unos lineamientos de planeación estratégica e integración organizacional. Este estudio contiene una revisión conceptual con los lineamientos que una empresa debe tener en cuenta al momento de implementar herramientas TIC a sus áreas y actividades. Los hallazgos teóricos planteados son llevados a la realidad estudiando cómo empresas de Bogotá adoptan recursos tecnológicos. Los resultados principales del estudio muestran que la agrupación empresarial clasificada como gran empresa es el segmento que mejor aplica los lineamientos teóricos para la implementación correcta de herramientas TIC en un ambiente organizacional. El segmento de mediana y pequeña empresa da muestras de uso de herramientas TIC, sin embargo se nota una debilidad en la falta de planeación estratégica e integración de estos recursos tecnológicos al sistema organizacional. Esta investigación concluye mostrando un conjunto de recomendaciones y hallazgos de acuerdo a los datos analizados.

This article analyses the results of an empirical study on the 200 most popular UK-based websites in various sectors of e-commerce services. The study provides empirical evidence on unlawful processing of personal data. It comprises a survey on the methods used to seek and obtain consent to process personal data for direct marketing and advertisement, and a test on the frequency of unsolicited commercial emails (UCE) received by customers as a consequence of their registration and submission of personal information to a website. Part One of the article presents a conceptual and normative account of data protection, with a discussion of the ethical values on which EU data protection law is grounded and an outline of the elements that must be in place to seek and obtain valid consent to process personal data. Part Two discusses the outcomes of the empirical study, which unveils a significant departure between EU legal theory and practice in data protection. Although a wide majority of the websites in the sample (69%) has in place a system to ask separate consent for engaging in marketing activities, it is only 16.2% of them that obtain a consent which is valid under the standards set by EU law. The test with UCE shows that only one out of three websites (30.5%) respects the will of the data subject not to receive commercial communications. It also shows that, when submitting personal data in online transactions, there is a high probability (50%) of incurring in a website that will ignore the refusal of consent and will send UCE. The article concludes that there is severe lack of compliance of UK online service providers with essential requirements of data protection law. In this respect, it suggests that there is inappropriate standard of implementation, information and supervision by the UK authorities, especially in light of the clarifications provided at EU level.

As a continually growing financial service of electronic commerce, Internet banking requires the development and implementation of a sound security procedure. This involves designing effective methods via which users can
be authenticated in a remote environment. Specifically for Internet banking there is areal need for away uniquely to identify and authenticate users without the possibility of their authenticity being cloned. Some technologies in use have been presented for meeting the security requirements for national, regional and global Internet banking assurance. However, there has been little research conducted particularly on the creation of secure
and trusted pathways. Concentrates on presenting a security framework for Internet banking based on discovering and defining these pathways in terms of adequate authentication mechanisms. Proposes a framework concerning how to identify security requirements for Internet banking such that the
transactions being conducted are secured within their respective environments.

Increasing use of the World Wide Web as a B2C commercial tool raises interest in understanding the key issues in building relationships with customers on the Internet. Trust is believed to be the key to these relationships. Given the differences between a virtual and a conventional marketplace, antecedents and consequences of trust merit re-examination. This research identifies a number of key factors related to trust in the B2C context and proposes a framework based on a series of underpinning relationships among these factors.

E-commerce security is a complex issue; it is concerned with a number of security risks that can appear at either a technical level or organisational level. This paper uses a systemic framework, the viable system model (VSM) to determine the high level security risks and then uses baseline security methods to determine the lower level security risks.

Ethics is an important element in all aspects of computing, but proves to be a real problem in the development and delivery of E-Commerce systems. There are many aspects of ethics that can affect E-Commerce systems, but often research is focused on the ethics after the E-Commerce system has been implemented, focusing on issues such as trust, privacy and disclosure.

This paper will discuss how ethical matters can affect the design of E-Commerce systems and how a framework designed for E-Commerce can be used to create and deliver effective, ethical E-Commerce systems.

Until recently little research had been undertaken into the process of eCommerce implementation, especially in relation to the implementation of business-to-business (B2B) relationships. Given the complexity of this process we have, in this paper, endeavoured to contribute to what we perceive as a gap in the body of theory surrounding the implementation process in the extant business-to-business literature. We describe the findings of a series of multiple case studies comprising ten major Australian eCommerce initiators. In addition to confirming our earlier finding of the importance of nontechnical factors for the success of the implementation process we also present, through our case studies, the various management and business issues associated with the success or otherwise of B2B eCommerce implementation.

In recent years there has been a remarkable increase in information exchange between organizations due to changes in market structures and new forms of business relationships. The increase in the volume of business-to-business (B2B) transactions has contributed significantly to the expanding need for electronic systems that could effectively support communication between collaborating organizations. Examples of such collaborating systems include those that offer various types of business-to-business services, e.g. electronic commerce, electronic procurement systems, electronic links between legacy systems, or outsourced systems providing data processing services via electronic media. Development and running of B2B electronic systems has not been problem free. One of the most intractable issues found in B2B systems is the prevalence of inter-organisational conflict reported to exist and persists between the participants of interorganisational electronic networks. There have been very few attempts, however, to prescribe any practical method of detecting the antecedents of such conflict early in B2B development to facilitate smooth construction and the subsequent operation of B2B services. The research reported in this paper focuses on the identification and analysis of antecedent conflict in a joint process involving different organizations in a B2B venture. The proposed method involves identification of domain stakeholders, capturing and packaging their views and concerns into a reusable form, and the application of captured domain experience in B2B systems development. The concepts and methods introduced in this paper have been illustrated with examples drawn from our study of six web-enabled payroll systems.

Existing research on B2B iMarketplaces (and intermediaries operating them) focuses primarily on viewing US iMarketplace web sites or conducting case studies. This paper extends this work by presenting survey findings of the total identifiable population of Australian B2B iMarketplace intermediaries to describe the iMarketplace characteristics and to determine if the findings provide more generalisable support for the literature.

This paper describes research supporting the development of a conceptual model for understanding the sources of business value of Business-to-Business (B2B) Electronic Markets. Based on six case studies and an analysis of current literature, Aggregation, Matching, and Integration emerged as the three key sources of business value. The framework provides a structured and systematic approach for understanding various B2B Electronic Market models, and helps develop strategies to leverage these sources of business value.

Lack of trust in e-commerce transactions has been identified by researchers as one of the main factors that hamper e-commerce from reaching its full potential. Various trust-related supporting features for online transactions are available to improve trust management. However, most of these existing approaches have insufficient conditions to establish online trust among businesses and customers. There are many relevant factors that influence potential buyers to make decisions. In this paper, we identify several desirable properties of an ideal trust management system that existing trust management systems do not support. A multilevel trust management framework is proposed to improve the support for existing trust management in e-commerce.

Strategic use of information technology, especially electronic commerce, has been used by organisations throughout the world in a vast array of industries to gain a competitive industry. With growing interest in electronic commerce organisations are now developing a new range of electronic commerce applications. However, justification in allocating organisation resources does not always follow the more commonly accepted methods. This paper explores why organizations invest in electronic commerce applications and highlights several approaches to justification. Central to the work was to determine the underlying benefits of investing in Web applications. This paper examines various models and frameworks that can be used as a form of justification. A conclusion of this paper is a framework for the justification of web-based applications by utilizing the Delphi methodology.
