The normative construction of the public security system in the Constituent Assembly of 1987-1988 preserved paradoxical normative space, the military police linked to the Army with a restrictive legal statute of the police offices citizenship through a hierarchical and disciplinary model that is anachronistic. This research originates from the following problem: How is it possible to tailor the constitutional system of public safety, specifically the Military Police, according to the democratic paradigms constructed by the Constituent from 1988 and carry the right to public safety under these molds? The militarists limitations of the Constitution allowed the growing militarization of police departments, organizational culture and authoritarian institutional practices. Underlying this, the problems related to difficulties in realization of Right to Public Safety, the strikes of the military police, the incomplete policy cycle started demanding from the constitutional-legal system appropriate responses. Utilizing the dialogical method and an interdisciplinary approach to the subject, and theoretically grounded in overcoming of the constitutional normativist juspositivism.It was found that the constructed infraconstitutional legislation was insufficient to supply the systemic shortcomings of constitutional law, when looking to create a single system of public security without giving due scope to the federal principle and expand the autonomy the Federated States, and even grant democratic legal status to the military police. Formal legal limits imposed by the Constitution constructed a legal anachronism, the military police. Thus, a democratic reading of military police institutions becomes inconceivable its existence in the constitutional regulatory environment. Thus, reform the Constitution in order to demilitarize the police and conduct a normative redesign of the public security system is fundamental to Brazilian constitutional democracy

The inequalities that mark the women’s lives in societies around the world have been the subject of intense discussion by the feminist movement, with developments in questioning about possibilities of full citizenship. In this scenario the Brazilian feminist movement has achieved steadily, in recent decades, an effort to participate in the formulation of the public policy agenda, as well as the realization of demands to institutionalize the legal parameters as regulations for the issue of violence against women. On the grounds of social justice, many discourses are made with a focus on reframing the institutional role of the state in the areas of constitutional law and criminal law. Considering these discourses, proposals were reformulated and the action of the state was resized, what ended in the enactment of Law 11,340 / 2006 (Maria da Penha Law), with a great impact on the Brazilian criminal justice system. Taking this perspective as its starting point, this research is focused on understanding the struggles for access to the legal field regarding the implementation of the Maria da Penha Law. This qualitative and quantitative research analyses the way the social practices and social representations which involve activists of the feminist movement and operators from the justice system are established in Juazeiro/ BA and Petrolina/PE before the institutional reshuffles of the state. As a result, it was revealed that, despite inconsistencies in the performance of the criminal justice system, the positioning of feminist activism is grounded on the assumption.

This scientific investigation begins with the recognition of the authorization granted by the Constitutional Legislator to the State for, relativizing its neutrality towards the private sector, intervene in the behavior of economic agents, through different means, including fiscal incentives and tax increases in order to achieve the objectives and directives of the Federal Constitution, as well as achieve the rights and guarantees also described in the Federal Constitution. Demonstrates, however, that this intervention in the private sector has the power to generate both salutary reflections as perverse and divorced goals from what was established by the Federal Constitution and Multilateral Agreements and this is the basis that justifies the relevance of the study: because of the urgency to provide a thorough analysis of the phenomenon of state intervention in the Economic Order, given the importance of its impacts, both for citizens' lives, as well as for the maintenance of the State established as it is nowadays. From this premise, this research examines the issue of tax policies adopted in the country, focusing on tax incentives, comparing its use with the principles of the Economic Order and the General Agreement on Tariffs and Trade - GATT analyzing whether these have been respected or if Brazil adopted unjustified protectionist measures. From this context, this research approximated different branches of the law, developed through literature review in areas such as constitutional law, economic law, tax law, financial law and law and economics. This study verifies the motivations and objectives that underlie the adopted justifications for the use of tax incentives, as well as its results, seeking to empirically answer if its use is reasonable and consistent with the terms enshrined in the Federal Constitution of 1988 and GATT. The answer to this research question will be sought through doctrinal analysis, jurisprudence and hard cases. Thus, the study begins with the historical evolution of extrafiscality, analyzes the principles that should guide the behavior of economic agents. Subsequently analyzes the legal regime of tax incentives and the results achieved by hard cases in which the tax policies with extrafiscal nature were adopted in order to demonstrate the positive and negative consequences arising from the adoption of this type of benefit

La igualdad ante la ley es uno de los derechos fundamentales de las Constituciones modernas. Sin embargo, hay algo más. De hecho podría decirse que los modernos sistemas jurídicos se han ido formando alrededor de la idea de igualdad. El valor de la igualdad parece expresar una manera común de entender las relaciones humanas, especialmente en el caso de la igualdad de género, expresamente mencionado por el artículo de las Constituciones democráticas modernas que se refiere al principio de igualdad ante la ley. El presente estudio trata esa forma específica de igualdad que se caracteriza por la paradoja de querer tratar como igual lo que es diferente, o sea, de hacer distinciones sin discriminar. Con este fin nos referimos al enfoque jurídico y al enfoque político del tema como se encuentran en la reforma del derecho de familia. No es un problema de una específica legislación nacional, sino más bien una versión específica de un problema de nivel general. Se trata de la imposibilidad de construir como indistinguible lo que es diferente. El intento político de reformar el derecho de familia para implementar el principio constitucional de igualdad no consigue resolver el problema. Éste vuelve a aparecer por la imposibilidad que el derecho funcione sin crear diferencias. Al mismo tiempo, surgen problemas nuevos relacionado con formas nuevas de organizar la vida familiar.

The relationship between France and its minorities is complex. Recent events including the 2015 terrorist attacks, the prohibition on wearing religious symbols in public, or the 2005 riots, have been perceived as symbols of great tension in French society when its comes to its minorities.2 Indeed the ten-year anniversary of the riots prompted reporting that nothing had changed in the intervening period in the structures of inequality that caused them,3 while in January 2015, the French Prime Minister Manuel Valls declared that the country was facing a “territorial, ethnic and social apartheid”.4 This statement from the Prime Minister seems to be at odds with the overall policy of rejecting any targeted policies or laws to protect minorities in France. As a tradition France is against minority rights. French authorities have consistently rejected the use of the term ‘minorities’, and have banned any form of special measures for national, racial, ethnic, religious or linguistic groups.5

La restitución de tierras, como instrumento de reparación enel contexto de la justicia transicional, cuenta con importantesherramientas para lograr una acción articulada con los objetivosde justicia social agraria, propios del derecho constitucional ydel derecho internacional de los derechos humanos. Przedmiotem artykułu jest problem ochrony prawa do prywatności w polskim procesie karnym w kontekście relacjonowania przebiegu rozprawy głównej przez media. Analizie zostały poddane zarówno warunki dopuszczalności relacjonowania rozprawy, przedmiot ingerencji, jak i podmioty, których prawo do prywatności może być naruszone w toku relacjonowania rozprawy głównej przez media. Prawo do prywatności jest współcześnie chronione nie tylko przez normy prawa cywilnego, ale również przez prawo konstytucyjne, stąd obowiązek przestrzegania i poszanowania prawa do prywatności ciąży także na organach prowadzących postępowanie karne. Jak wynika z zamieszonych w artykule rozważań, możliwe jest pogodzenie pozornie sprzecznych celów procesu karnego z koniecznością poszanowania prawa do prywatności, a sfera prywatna jednostek podlega ochronie również w procesie karnym. Wśród zagrożeń dla efektywnej ochrony prawa od prywatności należy jednak wskazać brak sankcji za złamanie zakazu publikacji danych osobowych czy wizerunku, którego nie przewidują ani normy prawa karnego ani prawa prasowego.

El trabajo que se presenta se centra en dos aspectos que son fundamentales en el diseño y desarrollo de los TFG: Por una parte, los objetivos y competencias a validar en el TFG y, por otra, las modalidades que puede revestir dicho trabajo. Se trata de individualizar estos elementos en el marco regulador correspondiente y analizar cómo se desarrollan en el diseño de los TFG del Grado en Derecho en la UCM, y más concretamente los que son tutorizados en el Departamento de Derecho Constitucional. Finalmente se trata de individualizar los posibles problemas y aportar algunas reflexiones sobre su tratamiento académico.

El texto explora las concepciones sobre democracia y Estado Constitucional de Derecho. Intenta explicar las posibles diferencias entre ambas expresiones y sus puntos de encuentro. Recurre tanto a doctrina de ciencia política como de derecho constitucional.Se sostiene la conveniencia científica, desde una perspectiva también histórica, de hablar de estado constitucional de derecho entendido como una categoría más exacta de lo que debe entenderse como forma de acceder al poder y proteger los derechos fundamentales.Finalmente, se hace un análisis de la situación actual de Centroamérica y se relaciona aquella con la existencia real de estados constitucionales de derecho en la región. The article analyzes on the concepts about democracy and rule of constitutional law. It aims to explain the possible differences and coincidences between these notions throughout the political sciences and constitutional law. From an historic view, it points out to the scientific convenience and correctness of the term ‘constitutional rule of law’, understood as a more precise category of what it must be defined as a means to access the power and the protection of fundamental rights.Finally, the article examines on the current situation of the Central American region emphasizing on whether these states embrace a true constitutional rule of law.
