Many of the principles and indeed the rhetoric of New Public Management proved attractive to both politicians and senior bureaucrats across the developed world as a remedy for problems in policy processes. Ireland shares many features of its constitutional structures and political practices with Britain, Canada, Australia, New Zealand, all of them early and enthusiastic adopters of NPM. Some of the organizational and procedural changes in Irish public administration do indeed bear similarities to those we would expect to see as a result of adopting principles of NPM. However, we contend that surface impressions are misleading. Drawing on a time-series database of Irish state institutions, we show that organizational changes were not necessarily driven by NPM. The absence of strong political drivers meant that reform initiatives did not fundamentally alter the configuration of the Irish public administration. Many of the problems that NPM was intended to address are only now coming under scrutiny.

This article reassesses the relationship that existed in the period 1649–53 between war in Ireland and politics in England. Drawing upon a largely overlooked Irish army petition, it seeks to remedy an evident disconnect between the respective historiographies of the Cromwellian conquest of Ireland on the one hand and the Rump Parliament on the other. The article reconstructs some of the various disputes over religion, authority and violence that undermined the unity of the English wartime regime in Ireland. It then charts the eventual spilling over of these disputes into Westminster politics, arguing that their impact on deteriorating army-parliament relations in the year prior to Oliver Cromwell’s expulsion of the Rump in April 1653 has not been fully appreciated. The key driver of these developments was John Weaver, a republican MP and commissioner for the civil government of Ireland. The article explains how his efforts both to place restraints on the excessive violence of the conquest and to exert civilian control over the military evolved, by 1652, into a determined campaign at Westminster to strengthen the powers of Ireland’s civil government and to limit the army’s share in the prospective Irish land settlement. Weaver’s campaign forced the army officers in Ireland to intervene at Westminster, thus placing increased pressure on the Rump Parliament. This reassessment also enables the early 1650s to be viewed more clearly as a key phase in the operation of the longer-term relationships of mutual influence that existed between Dublin and London in the seventeenth century.

Family farms are a fertile source of litigation, especially when it comes to succession planning and inter-generational transfers. The problems are obvious: large value assets, emotional ties to the land, a lack of retirement planning and the ‘older’ generation’s unwillingness to relinquish control, and managing the expectations of siblings or others who have worked on the farm. Recent years have seen a spate of estoppel cases involving farms in both Northern Ireland and England and Wales, brought by children, nephews, close friends and long-term partners who were promised or had expected to inherit farms. The recent decision of the English Court of Appeal in Davies v Davies is another example, this time involving an adult daughter who had worked on her parents’ farm for years in the belief that it would pass to her. When her parents changed their minds, this particular daughter brought a successful proprietary estoppel claim. The issue then turned to satisfying the claim, and what financial remedy the daughter was entitled to.

Since the creation of the first viral hepatitis plan in 2004 several documents and advancements have been released that help Iowa plan and prioritize this revision of our hepatitis plan. The Institute of Medicine report identified that current approach to the prevention and control of chronic hepatitis B and hepatitis C is not working. As a remedy, the IOM recommends increased knowledge and awareness about chronic viral hepatitis among health care providers, social service providers, and the public; improved surveillance for hepatitis B and hepatitis C; and better integration of viral hepatitis services.

Cette thèse examine l’interprétation et l’application, par l’Haute Cour d'Israël (HCJ), de principes du droit international de l’occupation et du droit international des droits de la personne dans le traitement de requêtes judiciaires formulées par des justiciables palestiniens. Elle s’intéresse plus particulièrement aux jugements rendus depuis le déclenchement de la deuxième Intifada (2000) suite à des requêtes mettant en cause la légalité des mesures adoptées par les autorités israéliennes au nom d’un besoin prétendu d’accroitre la sécurité des colonies et des colons israéliens dans le territoire occupé de la Cisjordanie. La première question sous étude concerne la mesure dans laquelle la Cour offre un recours effectif aux demandeurs palestiniens face aux violations alléguées de leurs droits internationaux par l’occupant. La recherche fait sienne la position de la HJC selon laquelle le droit de l’occupation est guidé par une logique interne tenant compte de la balance des intérêts en cause, en l’occurrence le besoin de sécurité de l’occupant, d’une part, et les droits fondamentaux de l’occupé, d’autre part. Elle considère, en outre, que cette logique se voit reflétée dans les principes normatifs constituant la base de ce corpus juridique, soit que l’occupation est par sa nature temporaire, que de l’occupation découle un rapport de fiduciaire et, finalement, que l’occupant n’acquiert point de souveraineté sur le territoire. Ainsi, la deuxième question qui est posée est de savoir si l’interprétation du droit par la Cour (HCJ) a eu pour effet de promouvoir ces principes normatifs ou, au contraire, de leur porter préjudice. La réunion de plusieurs facteurs, à savoir la durée prolongée de l’occupation de la Cisjordanie par Israël, la menace accrue à la sécurité depuis 2000 ainsi qu’une politique de colonisation israélienne active, soutenue par l’État, présentent un cas de figure unique pour vérifier l’hypothèse selon laquelle les tribunaux nationaux des États démocratiques, généralement, et ceux jouant le rôle de la plus haute instance judiciaire d’une puissance occupante, spécifiquement, parviennent à assurer la protection des droits et libertés fondamentaux et de la primauté du droit au niveau international. Le premier chapitre présente une étude, à la lumière du premier principe normatif énoncé ci-haut, des jugements rendus par la HCJ dans les dossiers contestant la légalité de la construction du mur à l’intérieur de la Cisjordanie et de la zone dite fermée (Seam Zone), ainsi que des zones de sécurité spéciales entourant les colonies. Le deuxième chapitre analyse, cette fois à la lumière du deuxième principe normatif, des jugements dans les dossiers mettant en cause des restrictions sur les déplacements imposées aux Palestiniens dans le but allégué de protéger la sécurité des colonies et/ou des colons. Le troisième chapitre jette un regard sur les jugements rendus dans les dossiers mettant en cause la légalité du tracé du mur à l’intérieur et sur le pourtour du territoire annexé de Jérusalem-Est. Les conclusions découlant de cette recherche se fondent sur des données tirées d’entrevues menées auprès d’avocats israéliens qui s’adressent régulièrement à la HCJ pour le compte de justiciables palestiniens.

Nurses – along with many others – are often told that they should or must accept and work towards the promotion of social justice. Further, it is claimed that social justice represents or is a shared nursing value. This presentation challenges these assertions. Claims regarding shared values easily fall prey to forms of attribution error. Alternatively, while social justice is sometimes presented as a remedy or alternative to market disutility, the quality of arguments in which this linkage appears leave much to be desired and, in such instances, the robustness of these claims collapse. Or, assertions regarding social justice frequently appear without supporting explanation or justification. It is simply assumed that social justice (inadequately defined) is a ‘good thing’. This is not necessarily a problem. The normative strength of a claim does not rest only upon the arguments put forward in support of it. However, when social justice is advanced as mere assertion, often in a manner devoid of specificity, claims that the concept should be embraced and claims that the concept should or can promote action in the world, lack persuasive force. Moreover, in some articulations, the concept appears to generate illiberal and intolerant consequences. This presentation does not argue for inequality or social injustice. Rather, it suggests that underdeveloped and frail arguments require improvement or dismissal.

In the casting of reactive metals, such as titanium alloys, contamination can be prevented if there is no contact between the hot liquid metal and solid crucible. This can be achieved by containing the liquid metal by means of high frequency AC magnetic field. A water cooled current-carrying coil, surrounding the metal can then provide the required Lorentz forces, and at the same time the current induced in the metal can provide the heating required to melt it. This ‘attractive’ processing solution has however many problems, the most serious being that of the control and containment of the liquid metal envelope, which requires a balance of the gravity and induced inertia forces on the one side, and the containing Lorentz and surface tension forces on the other. To model this process requires a fully coupled dyna ic solution of the flow fields, magnetic field and heat transfer/melding process to account for. A simplified solution has been published previously providing quasi-static solutions only, by taking the irrotational ‘magnetic pressure’ term of the Lorentz force into account. The authors remedy this deficiency by modelling the full problem using CFD techniques. The salient features of these techniques are included in this paper, as space allows.

In 2010 a group of farmers in the Dry Run Creek watershed, an Iowa High Quality Water Resource, formed the Dry Run Creek Watershed Improvement Association to learn more about and implement solutions to remedy a bacteria impairment in their stream. Through a partnership with Luther College, Iowa DNR Watershed Monitoring and Assessment and Iowa State University Extension the farmers were able to conduct an assessment of their stream and watershed. The assessment showed multiple potential sources of bacteria, dependent on whether water samples were collected following rain events or during dry conditions. This project will allow watershed farmers to implement solutions to reduce bacteria delivery during both wet and dry weather. Funding will be targeted to feedlot runoff control improvements, cover crops and vegetative filters, manure management strategies and livestock stream access. The council intends to continue intensive water monitoring to determine whether the strategies are successful. Research shows the bacteria reduction in water bodies can be seen relatively quickly, within 1-2 years, compared to other types of impairments.

A saúde oral na terceira idade é um fator indispensável para o envelhecimento saudável e uma boa qualidade de vida. O tratamento médico dentário não se resume apenas na cura de lesões já existentes, e é necessário promover um programa preventivo, que vise controlar a incidência de problemas médico dentários, um programa curativo para tratar os problemas presentes e também a procura de um programa educativo servindo de apoio para as demais ações. O paciente idoso requer uma atenção maior durante o tratamento, por isso é preciso que o Médico Dentista conheça adequadamente a saúde geral dos idosos, pois estes podem apresentar um quadro de saúde complexo e serem portadores de diversas patologias crónicas e serem poli-medicados. São necessários cuidados especiais na consulta e uma correta anamnese desses pacientes, realizando um exame clínico oral detalhado apoiada por exames complementares. O objetivo principal do presente estudo é analisar as condições clínicas dos idosos portadores de Diabetes Mellitus e as suas complicações orais e ainda a sistematização de procedimentos de forma protocolada para o atendimento médico dentário de idosos portadores desta patologia.

Current coastal-evolution models generally lack the ability to accurately predict bed level change in shallow (<~2 m) water, which is, at least partly, due to the preclusion of the effect of surface-induced turbulence on sand suspension and transport. As a first step to remedy this situation, we investigated the vertical structure of turbulence in the surf and swash zone using measurements collected under random shoaling and plunging waves on a steep (initially 1:15) field-scale sandy laboratory beach. Seaward of the swash zone, turbulence was measured with a vertical array of three Acoustic Doppler Velocimeters (ADVs), while in the swash zone two vertically spaced acoustic doppler velocimeter profilers (Vectrino profilers) were applied. The vertical turbulence structure evolves from bottom-dominated to approximately vertically uniform with an increase in the fraction of breaking waves to ~ 50%. In the swash zone, the turbulence is predominantly bottom-induced during the backwash and shows a homogeneous turbulence profile during uprush. We further find that the instantaneous turbulence kinetic energy is phase-coupled with the short-wave orbital motion under the plunging breakers, with higher levels shortly after the reversal from offshore to onshore motion (i.e. wavefront).

Este trabalho teve como objectivo inicial o estudo de processos oxidativos avançados de forma a remediar e tratar águas contaminadas por pesticidas. No entanto, ao longo do trabalho experimental, constatou-se que os produtos resultantes da degradação de pesticidas são muitas vezes mais tóxicos do que os compostos que lhes deram origem e que, por isso, degradar um composto nem sempre é o melhor para o ambiente. Assim, neste trabalho, procurou-se estudar o processo de degradação com o objectivo de minimizar o impacto ambiental dos pesticidas na água e no ambiente em geral. A parte experimental deste trabalho foi dividida em duas etapas, sendo que, em ambas, a voltametria de onda quadrada e a espectrofotometria de UV/Vis foram os métodos de análise utilizados, para acompanhar o processo de fotodegradação. Na primeira etapa estudou-se a relação entre a estrutura química dos pesticidas MCPA, MCPP, 2.4-D e Dicloroprop e a sua fotodegradação. Soluções aquosas dos pesticidas enunciados foram submetidas a irradiação UV/vis, com incrementos variáveis de tempo de irradiação. Os resultados obtidos, nesta etapa, permitiram constatar diferenças na percentagem de degradação dos diferentes pesticidas. Dos pesticidas estudados verificou-se uma maior fotodegradação para o MCPA e MCPP seguido do Dicloroprop e finalmente o 2.4-D que se degradou menos. Os dados obtidos sugerem que a fotodegradação destes pesticidas está intimamente ligada com a estrutura das moléculas. A presença de um maior número de grupos cloro ligados ao anel aromático nos pesticidas 2,4-D e Dicloroprop faz com que estes sejam mais estáveis e por isso se degradam menos que o MCPA e o MCPP. Por outro lado, o facto de o 2,4-D apresentar um potencial de oxidação mais elevado do que o Dicloroprop, faz com que este seja mais difícil de degradar, o que justifica a diferença entre os dois. Desta forma, foi possível concluir que a estrutura dos pesticidas condiciona o processo de degradação, como esperado. Na segunda etapa, estudou-se a estabilização dos pesticidas MCPA e MCPP após encapsulação, com 2-hidroxipropil-β-ciclodextrina (HP-β-CD), em água desionizada e em água do rio. Para tal, submeteram-se as soluções aquosas dos pesticidas com e sem ciclodextrina, a irradiação UV/vis, também com incrementos variáveis de tempo. No caso do MCPA verificou-se que, tanto para água desionizada como para água do rio, que este herbicida encapsulado se degrada bastante menos do que o MCPA livre. O encapsulamento permitiu reduzir quase para metade a taxa de fotodegradação. Assim, confirmou-se que a HP-β-CD permite estabilizar este pesticida, tornando-o mais resistente à fotodegradação. Desta forma, originam-se menos produtos de degradação, os quais podem ser mais tóxicos, e reduz-se de o impacto ambiental deste herbicida. Verificou-se também que o MCPA livre se degrada mais em água do rio do que em água desionizada, provavelmente devido à matéria orgânica presente nesta água, que promove o processo de degradação. No que respeita ao MCPP também se constatou que este herbicida se degrada menos encapsulado do que livre, em água desionizada e em água do rio. Neste caso, conseguiu-se reduzir pouco a taxa de fotodegradação, mas, ainda assim se verifica uma estabilização deste pesticida através do encapsulamento. No entanto, tornou-se mais evidente a estabilização do MCPP após encapsulação em água do rio, já que apresenta uma taxa de fotodegradação menor. Este facto demonstra que a HP-β-CD permite estabilizar também este pesticida, tornando-o mais resistente à fotodegradação, e reduzindo seu impacto ambiental.

My dissertation presented seven violin concertos in three recital programs. Three of these concertos are acknowledged masterpieces performed in established concert venues throughout the world. They are the concertos of Mozart, Beethoven and Tchaikovsky. The other four are less standard and are composed by Viotti, Kreutzer, Rode and Spohr. These less standard concertos were popular during their time yet they seem not to have stood the test of time. A curriculum devoted exclusively to the standard concertos creates problems for the young violinist. The Mozart violin concertos are often the first standard concertos that the young violin student encounters. They are considered to be the least technically demanding of the standard concertos. The next most advanced standard concertos that the student will usually encounter are Bruch’s G minor concerto, Wieniawski’s D minor concerto and Barber’s concerto. The trouble is that the work on Mozart concertos does not adequately prepare a student for the next most advanced standard concerto. There is a discontinuous leap in the progression of technical difficulty between the Mozart concertos and the next most advanced concertos. Likewise the standard concerto repertoire provides no smooth historical or stylistic progression between the Mozart concertos and the next most advanced concertos. If the young violinist is limited to the standard repertoire then she has no smooth progression either technical, historical or stylistic. I seek to demonstrate that, by adding concertos of Spohr, Viotti, Kreutzer, and Rode to the standard violin curriculum, one could remedy this problem. The first and third recitals were performed in the Gildenhorn Recital Hall and the second recital in the School of Music’s Smith Lecture Hall, both at the University of Maryland. Trinitrotoluene in the purification step (TNT) produced in industries, are carried out two washes at the end of the process. The first wash is done with vaporized water, which originates from the first effluent called yellow water, then the second washing with the use of sodium sulfite is performed (Na2SO3), generating a second effluent red water. This study aimed to study the individual effects, as well as the association of heterogeneous photocatalysis using TiO2 and biological treatment in air lift reactor using activated sludge (bacterial biomass) for the remediation of wastewater contaminated with nitroaromatic compounds in order to reduce toxicity and adjust the legal parameters according to regulatory agencies for disposal in waterways. The photocatalytic treatment was conducted by factorial design obtaining the best reaction conditions (pH 6.5 and concentration of TiO2 0.1 gL-1), with best results obtained at 360 minutes of reaction, reducing the absorbance 97.00%, 94.20% of the chemical oxygen demand (COD), 67.70% of total phenols, as well as a total reduction of observed peaks and assigned to nitroaromatic compounds by high-performance liquid chromatography. In the biological treatment, there was a 53.40% reduction in absorbance at 275 nm 10.00% 36.00% COD and total phenols in a short time (3 days), while for extended periods (48 days) there was an antagonistic influence on the results so that was the elevation of these parameters (COD and total phenols) instead of reducing. Chromatographic analysis confirmed the effectiveness of the biological degradation by reducing the peaks corresponding to compounds DNT and TNT. The Association of photocatalytic and biological treatments decreased results in the order of 91.10% absorbance, 70.26% of total phenols and 88.87% of COD. While the combination of biological and photocatalytic treatments generated relatively lower efficiencies, with 77.30% of absorbance reduction, 62.10% reduction of total phenols and a decrease of 87.00% of COD. In general, when comparing the chemical and biological processes in isolation, the photocatalytic treatment showed the best results. However, comparing the results of isolation and established associations, the association biological x photocatalysis showed more promising results in the treatment of red water effluent.

Résumé : Par l’adoption des Projets de loi 33 et 34, en 2006 et 2009 respectivement, le gouvernement du Québec a créé de nouvelles organisations privées dispensatrices de soins spécialisés, soient les centres médicaux spécialisés. Il a de ce fait encadré leur pratique, notamment dans l’objectif d’assurer un niveau de qualité et de sécurité satisfaisant des soins qui y sont dispensés. L’auteure analyse les différents mécanismes existants pour assurer la qualité et la sécurité des soins offerts en centres médicaux spécialisés, afin de constater si l’objectif recherché par le législateur est rencontré. Ainsi, elle expose les mécanismes spécifiques prévus dans la Loi sur les services de santé et services sociaux applicables aux centres médicaux spécialisés qui jouent un rôle quant au maintien de la qualité et de la sécurité des services, de même que des mécanismes indirects ayant une incidence sur ce plan, tels que la motivation économique et les recours en responsabilité. Ensuite, elle s’attarde aux processus issus de la règlementation professionnelle. Elle arrive à la conclusion que deux mécanismes sont manquants pour rencontrer l’objectif visé par le législateur et propose, à ce titre, des pistes de solution.
