Este trabalho tem como objeto de pesquisa o processo de consulta pública online para elaboração do Marco Civil da Internet, nova lei que dispõe sobre os direitos dos usuários de Internet no Brasil. Ele busca responder às seguintes perguntas: (i) como foi idealizado processo de consulta pública online do Marco Civil da Internet? (ii) Como a consulta foi gerenciada e executada? (iii) Quais foram os resultados da consulta em termos de soluções jurídicas aos conflitos políticos do setor da Internet? A proposta é realizar uma descrição desta experiência de participação social pela Internet a partir de um mapeamento das contribuições dos cidadãos e instituições, de informações em fontes variadas (imprensa especializada ou não e outros trabalhos acadêmicos) e do confronto deste levantamento com entrevistas dadas pelos gestores do projeto sobre seu planejamento e execução. A pesquisa trabalhou com a hipótese de que a consulta pública online que elaborou o Marco Civil da Internet se colocou como alternativa a um debate instaurado dentro do Congresso Nacional e bloqueado por propostas de lei de enfoque penal. O resultado da pesquisa sugere a confirmação dessa hipótese, bem como a relevância da experiência analisada para o sucesso uma estratégia política de reversão dessa agenda legislativa anterior.

A presente dissertação de mestrado consiste em um estudo de caso de três programas de pagamento por serviços ecossistêmicos - PSE, que ajudaram a definir o papel que o direito deve assumir na implementação e manutenção desses mecanismos. Buscou-se, primeiramente, delimitar algumas bases teóricas, sobretudo, o que se entende por desenvolvimento sustentável e sustentabilidade institucional. Para tanto, optamos por demonstrar a evolução conceitual de serviços ambientais para serviços ecossistêmicos e entender este como uma segunda fase daquele, destacando os reflexos desse entendimento na estrutura jurídica dos programas de pagamento por serviços ambientais, que optamos por chama-lo de pagamento por serviços ecossistêmicos. Em seguida, descrevemos toda a evolução das discussões sobre REDD+, exemplo de PSE, para enfatizar os desafios que o direito assume com essa nova concepção de serviços ecossistêmicos. A experiência indica que o sucesso dos programas analisados são, em grande medida, consequência da ideia de função promocional do direito, bem como da observação das suas funcionalidades, quais sejam, orquestração, sinergia, flexibilização e legitimidade, que garantem, antes de mais nada, a sustentabilidade institucional dos mecanismos, permitindo sua perfeita adequação à realidade em que se insere e, mais do que isso, permitindo a manutenção desses instrumentos, mesmo diante de mutações do meio em que estão inseridos.

A presente pesquisa se baseia na teoria crítica da branquidade, especificamente no que concerne aos elementos mais evidenciados da formação da identidade Branca, para realizar uma análise, por amostra, da tendência das demandas judiciais e julgamentos jurisprudenciais acerca da conduta de discriminação racial, prevista na legislação brasileira. Tendo em vista que as decisões dos tribunais a respeito desse tema se mostram bastantes controversas, os elementos da branquidade são trazidos a esse trabalho com a finalidade de contribuir com a tarefa dos operadores do direito de realizar a interpretação sobre dúvidas, dubiedades, lacunas e questionamentos sobre a eficácia da implementação da norma em reduzir as manifestações do racismo.

O atual arcabouço normativo de proteção do investidor no mercado de capitais brasileiro teve suas linhas mestras cravadas pela reforma bancária introduzida pelas Leis 4.595, de 31 de dezembro de 1964, e 4.728, de 14 de julho de 1965, pela criação de um regulador especializado em mercado de capitais pela Lei 6.385, de 07 de dezembro de 1976, e pela reforma da legislação das sociedades anônimas introduzida pela Lei 6.404, de 15 de dezembro de 1976. Desde 1976, o arcabouço normativo de proteção do investidor no mercado de capitais brasileiro vem sendo desenvolvido a partir dessas linhas mestras iniciais, incorporando as lições aprendidas com as turbulências e euforias vividas pela economia nacional. Esse arcabouço normativo que aí está desde 1976 foi inspirado por contribuições do direito federal norte-americano, as quais foram conscientemente captadas no Brasil pelo legislador e pela comunidade jurídica nacional. Difundiram-se internacionalmente dos EUA para o Brasil os preceitos da proteção do investidor no mercado de capitais calcados na existência de um órgão regulador do mercado de capitais, na divulgação de informações relevantes para decisões de investimento (disclosure), na regulação funcional dos agentes do mercado de capitais e na vedação de fraudes com valores mobiliários.

A responsabilidade socioambiental tem fomentado novas relações no ambiente organizacional, para promover uma forma de desenvolvimento que ampare as dimensões econômica, ambiental e social, corroborando com os pressupostos estabelecidos pelo desenvolvimento sustentável. Assim, o presente trabalho tem por objetivo identificar as ações de gerenciamento ambiental na Pioneiros Bionergia S.A. O estudo de caso se deu por meio de observação sistemática, entrevista semiestruturada e análise documental. Os resultados apontam que a empresa se preocupa com a responsabilidade ambiental, investindo em inovações que reutilizem os resíduos para gerar novos processos de produção e, assim, contribuir com o meio ambiente. Além disso, a empresa seleciona os fornecedores que não problema com a legislação ambiental e trabalhista.

O objetivo desse estudo foi investigar representações sociais de professores de Direito acerca do exercício da docência. Buscou-se compreender quais são os saberes docentes que o professor de Direito julga necessários à sua atuação, já que a legislação vigente não exige que o operador do Direito frequente um curso específico que o capacite para a docência no ensino superior. Em razão disso, geralmente, o professor de Direito se depara com inúmeras dificuldades no início de carreira e constata que, na prática, ser um bom profissional do Direito não lhe basta para a docência, pois necessita de didática e de um método pedagógico pelos quais seus alunos o compreendam. A pesquisa teve como sujeitos professores de Direito que se encontram na docência, no mínimo, há dois anos, no município de São Paulo e região do Grande ABC paulista. Os autores que possibilitaram a fundamentação teórica foram: Serge Moscovici (1978), Denise Jodelet (2005), Marília Claret Geraes Duran (2006), dentre outros estudos significativos. O estudo foi realizado mediante pesquisa quantitativa e qualitativa de dados. Para levantamento dos dados, foi utilizado um questionário que, na sua parte inicial, contava com três palavras indutoras. Em seguida, foram apresentadas quinze questões, sendo três abertas e doze fechadas. A partir das descrições das respostas dadas pelos sujeitos no questionário, foi possível realizar a análise dos dados coletados, por meio da análise de conteúdo (Laurence Bardin, 1977). A pesquisa realizada possibilitou a análise da percepção e a concepção dos sujeitos da pesquisa quanto ao ensino jurídico e à sua própria formação. Demonstrou, ainda, que o professor de Direito deve apropriar-se de saberes docentes específicos para lecionar, ultrapassando a ideia de que lhe basta o conhecimento técnico, já que a docência, assim como as demais profissões, tem especificidades importantes.

Este trabalho investigativo tem como objetivo a análise da evolução do direito à educação nos textos constitucionais no Brasil republicano, por intermédio de uma pesquisa histórica em fontes documentais. O caminho da mediação jurídico-constitucional foi escolhido, em razão de permitir desvelar a relação entre educação, sociedade e Estado, considerando a possibilidade de apreender as limitações que este impõe a esse tipo de prática social, bem como compreender as condições materiais que efetivamente o Estado instaura de modo a favorecer a fruição do direito à educação. A análise do direito à educação no aparato jurídico-constitucional, a partir do enfoque sociológico, se fez pela abordagem dos conflitos de interesses presentes no momento da elaboração do texto constitucional, mediante a perspectiva teórica e metodológica proposta por Saes (2003a), no que se refere ao estudo das conexões existentes entre prática social e legislação educacional-constitucional. Este estudo foi construído, então, a partir dos seguintes eixos conceituais: educação como uma prática social inerente à existência humana, em sentido amplo, e da educação letrada como uma necessidade imposta pelo modo de organização das relações de produção na sociedade capitalista, segundo o proposto por Saviani (2004); configurada posteriormente como um direito, compreendido como um fenômeno histórico e social necessário ao funcionamento ou reprodução de um determinado tipo de sociedade, especialmente, no que diz respeito ao surgimento histórico da forma sujeito de direito, a constituição da personalidade jurídica, de acordo com o pensamento de Miaille (1994) e a construção da cidadania na ordem capitalista, como resultado das mudanças nas relações de autoridade entre o Estado e os indivíduos, conforme aporte teórico tomado de Bendix (1996), considerando a extensão, o alcance, a profundidade e a precisão da declaração do direito à educação, tomadas como categorias de estudo, variáveis presentes nas constituições adotadas nos Estados burgueses modernos, explicáveis pelos conflitos de interesses que atravessam a vida social

It is in light of this phenomenon and the constitutional perspective, the present work aims to analyze item IV of article. 8 of Law n. 6.967/96, regulatory Property Tax Vehicle Automotive (property taxes) in the State of Rio Grande do Norte, in view of its possible incompatibility with the principles of the Basic Statute and with international guidelines for protection of the environment The problem of this research is Seated in art. 225 of the Constitution, which provides that everyone has the right to an ecologically balanced environment. From the reading of this standard, extracted it is the responsibility of the state protecting the environment, which requires the adoption of suitable actions to that end. However, we look to state law cited follows th e constitutional path, since it exempts the collection of property taxes automotive vehicles with over 10 years of manufacturing, which could encourage the conservation of a fleet of old vehicles, mostly more polluting and harmful to the environment and hu man health. Would the state legislature oblivious to the constitutional principles and the global trend of environmental preservation? Thus questions whether such an incentive for more polluting vehicles, emitting more gases in the atmosphere. Moreover, th e international community is already moving through important conventions in an attempt to minimize and control global warming and climate change. Predicting the theme in CF/88 demonstrates that the country is no stranger to the issue. Thus, the work is a retelling of Law No. 6.967/96 order to check whether it is compatible with the existing system. The methodology consists of a documentary, deductive, dialectical literature. At the end of the survey, it was found that provide a tax benefit to these vehicle s is encouraged to maintain them in circulation and contribute to the increase in air and noise pollution, in addition to the traffic problems generated. Thus, this potiguar anything standard can be expressed extrafiscality because the medium and long term there is encouragement and worsening environmental problem. Despite the ability to pay clause, but this remission is an affront to legally protected interests. Thus, this device goes in reverse order compared to the values of the legal system and in relat ion to sustainable development. Modern Tax Law should be used as a tool to achieve the purposes collimated by the State, and not otherwise. It was noticed that the vast majority of Brazilian states does not follow this rule, including Mato Grosso and Minas Gerais have no such exemption. Therefore, the RN State does not constitute a model for sustainable public policies, nor example of environmental protection by state law.

Equality as a principle and as a legal rule, integrates brazilian constitutional order since the Constitution of 1891, constituting the target always be sought, built and promoted by the state and society as a whole. Also e xs urgem for protection of equality and non - discrimination, declarations and international treaties, mostly ratified by Brazil. The international protection of human beings with intrinsic value began in the UN Declaration of 1948, which declared the equality of all men in rights and dignity, followed by more specific international documents, in a growing movement of ratification of international standards protection of human rights occurs after the atrocities during the Second World War. Within the Internation al Labour Organisation (ILO), the theme of equality and non - discrimination in employment relationships integrates one of its main conventions, to No. 111, ratified by Brazil since 1965, which aims to eliminate discrimination in respect of employment and oc cupation. In this context, lies the collective bargaining work, with her normative instruments arising from the collective agreement and the agreement recognized constitutionally and with full ability to create and establish standards and conditions for de tails of suitable work for each occupational category and economic having the unions the power and duty to use them as a means of effecting the postulates of equality and non - discrimination in employment relationships, filling gaps in state law and / or su pplementing it, molding them to existing events in the capital - job. Driven by greater freedom contained in the Constitution of 1988, trading, and with it, the private collective autonomy, in fact, have included the issue of equality and the right to differ ence between clauses created, scheduled to affirmative action and sealing exclusionary conduct, and reported some positive outcomes, such as greater diversity in work and training followed by admission of persons with disabilities environment. The Federal Constitution of 1988 gave special treatment to the issue of the environment, raising this diffuse right to the status of a fundamental right. In order to preserve it, the constitutional order is provided with various means to this purpose, including the possibility of using taxation. Several principles both constitutional, as infraconstitucional, support the use of taxation as a legal instrument to protect the environment. There is an intense legal debate about the suitability, characteristics, purposes and principles which underlie and restrict the environmental taxation. Discussions and proposals for reform of the tax system in order to include the ecological aspect at its core have been developed. The use of taxation as a way to fund public expenditures related to environmental causes, promote the internalization of negative externalities and as a way to induce behavior to benefit the environment finds support in the Brazilian legal system. This paper seeks to demonstrate that the national tax system is fully able to act as a tool available to the state for the implementation of the fundamental right to an ecologically balanced environment, whether through the taxes fiscal role or due, mainly, through the phenomenon of extrafiscality. Also, it is intended, through doctrinal, jurisprudential analysis and concrete cases, to investigate whether the tax system can be effective in protecting the environment in the way it is currently constructed, or if there is need to proceed with changes in its structure in order to achieve this goal

Brazilian law provides a series of rules and policies which regulate space use and occupancy as well as guide environmental planning. Among those are the Permanent Preservation Areas (PPAs) which purpose is to ensure the preservation of elements that are essential to maintain the environmental function and landscape. Another important instrument identifier of spaces are geoenvironmental units, which are synthesis elements grouping areas of similar characteristics and can be used for the analysis of risk, fragility and potential use of spaces. The geoenvironmental units are defined by more complex processes (information integration), focusing not only on individual elements, but being determined from a systemic analysis. Is It possible to identify and delineate APPs from the identification and determination of geoenvironmental units? The aim of this study was to evaluate the potential of geoenvironmental units in the process of identification and delineation of APPs a see how much of the study area, the area by the Coast line in Natal/RN, is still good for occupation. It was used the physiognomic method, in which the limits of the units are plotted on a synthetic document (aerial photographs), valuing aspects of relief in a range of detail by the analysis of systemic categories (element, structure, function and interaction), observed. The methodology used allowed the identification and delineation of eleven geoenvironmental units and, from these, it was possible to identify and delineate four out of the five PPAs occurring in the study area. Only a small space of 1.2 ha of the study area is not considered APP by law. Thus, the occupation of the unoccupied area by the Coast line is not feasible from a legal standpoint. The geoenvironmental units as well as the identified and delineated APPs in the area by the Coast line are spaces which preservation is guaranteed by law in various scopes and are necessary to maintain the environmental functions of the area. The planning for the use and occupation of the area should involve the recovery of degraded areas and the creation of elements that make possible the use as well as attract the community, as provided in the initial planning, by ensuring the public utility and social interest in the Project.

The Environmental Education is a plural and diversified knowledge field, composed by a group of social agents of specific State, government and civil society sectors, with different world views and theoretical matrices that exercised and influenced its genealogy and constitutive dynamic. The Environmental Education – while specific knowledge field – has been produced, systematized and diffused in Brazil in the last decades by official State organisms, through public policies, as well as by social movements of popular education, and constitutes a large and historical movement about the environmental question, that was worldwide projected in the 1960 decade (the environmentalist movement). Concerning the creation of public policies and specific programs to the Environmental Education, in the scope of the governmental initiative, the approval of the National Policy of Environmental Education, by means of the Law n. 9.795/99 – together with its regulatory decree, the Decree nº 4.281 – represents the consolidation of a inclusion process of the environmental dimension in the educational field. These normative acts, beyond charging the public power with the incumbency to define public policies that incorporate the environmental dimension and to promote the Environmental Education in all education levels, also charge the educational institution with the duty of promoting this component in an integrated and articulated way with the educational programs that such institutions develop. In this context, it is aimed to identify and analyze under the light of the dialectical and historical materialism, the practices and concepts developed under the Federal University of Rio Grande do Norte (UFRN), with regard to its institutional policy on Environmental Education, relating it to establishing the Pnea. The analysis by means specific legislation on the subject and institutional documents UFRN. The research showed that, in general, the National Environmental Education Policy has limits to its effectiveness given the absence of specific funding for this purpose and the little government involvement in that the Brazilian State assumes, by through effective policies, the material conditions of financing actions with respect to this field of education. The fragmented and disjointed way the analyzed actions are developed constitutes a limit to the challenge for the UFRN implement, consistently and objectively, an Environmental Education policy, which can be monitored and evaluated as an effective public policy, both landmarks major goal of own Pnea as the demands of development whose agenda a critical environmental perspective.

In our first chapter was recorded the perception of fishermen and gatherers of Patané about the absence of local forests, was collected a list of species considered locally as strategic use, the ethnoknowledge associated with those, and identify which of these plants are already perceived as scarce in the region. In the second chapter, was studied all species of plants known by the community, the associated knowledge and the various uses. Were used individual interviews, formal and semi-structured, that have been consecutively applied to sampled respondents not probabilistically by snowball. Were collected socioeconomic data of informants. A adequacy test was performed. Guided tours were conducted to gather photographs and samples witnesses of plants, all identified by the usual methods of botany. Excerpts of the interviews on perceptions appear by looking for consensual information. Some data were presented by descriptive statistics. Were mounted two lists of plants, one with the strategic use and one with all the species listed in the study. It was shown that knowledge about plants remains resilient despite the forest resources now no longer be available.

This thesis investigates the historical influence of the criminal policy in the context that shapes the first specific law for children and adolescents in Brazil, the 1927 Children's Code, a standard that inaugurates the conceptual scission between children and "minor" and their different treatment by the State. The study addresses the demand for order in the context of changes in the working world in the transition from the slave system to the capitalist mode of production, and the corresponding disciplinary and punitive control mechanisms directed to the segment of childhood and adolescence. The theoretical route proposes a questioning of the political construction of law and justice, as well as the conformation of the punitive techniques, and the construction of the stereotype of the "delinquent", prime target of the criminal policy, focusing on the process of criminalization of the segment in question through the confrontation of the Critical perspective with the approaches of Classical and Positive schools. This research shows the imposition of a bourgeois morality that obscures the social conflict attributing it to people isolated by the criminalization of their conduct; and points out that the historical forms of selective social control were greatly influenced by psychiatry and psychology, either by the elaboration of the image of the "delinquent" or by the expected performance of custodial institutions. Finally, the developments and the permanence of the historical roots of the criminal policy are problematized, relating them to the difficulties currently encountered in the consolidation of the legal garantism paradigm proposed by the Children and Adolescent Statute.
