Con el paso del tiempo y la evolución de los distintos modelos jurídicos se han venido originando fenómenos alternos a la justicia interna de cada país para la solución de conflictos, generalizando las decisiones a todos los conflictos jurídicos de las personas, sin importar a que sistema jurídico pertenece. Es así, como llega a incorporarse a nuestro modelo jurídico el Arbitraje, un método alternativo de solución de conflictos a través del cual las partes involucradas en un conflicto de carácter transigible, deciden llevar sus controversias ante un tribunal arbitral, el cual queda transitoriamente investido de la facultad de administrar justicia, profiriendo una decisión denominada laudo arbitral.

Conflictes socioterritorials i participació pública en la gestió de l'aigua de la conca del riu Muga (Alt Empordà) és un treball que incideix sobre la conflictivitat en la gestió dels rius mediterranis i prospecta en la participació pública -activa i vinculant- per a la resolució de conflictes i la planificació i gestió dels recursos hídrics. En concret, s'ha intentat donar resposta a cinc objectius: Objectius del marc teòric - Comprovar l'existència de dos discursos antagònics (radicalment oposats) en l'esfera social, científica i de gestió dels rius que generen conflicte i que són insostenibles per a una gestió integral dels recursos fluvials: el discurs antropocèntric i el discurs ecocèntric. Matèria d'estudi: L'excepcionalisme humà i l'ecologia profunda en la societat; Les disciplines de la regulació de l'aigua i de l'ecologia fluvial en la ciència; El contracte antropocèntric i el balanç ecocèntric en la gestió; El discurs ambiental (el riu antròpic i ecosistemàtic). - Valorar si les estratègies de participació pública (que involucren als agents socials) gaudeixen -respecte els processos de decisió unilaterals (siguin autoritàries o arbitràries)- de més garanties per corregir i prevenir conflictes desconstructius relacionats amb l'aigua i els recursos fluvials. Matèria d'estudi: Definició de conflicte en positiu; L'estratègia de cooperació i consens en la Resolució Alternativa de Disputes (Alternative Dispute Resolution) i 13 casos resolts de conflictes per l'aigua a l'Oest dels Estats Units; Bases d'un pla de gestió integral, adaptatiu i participatiu i el cas del San Joaquin River Management Plan (Califòrnia, Estats Units). Objectius del marc pràctic. Conca del riu Muga (Alt Empordà) - Contextualitzar la diversificació i intensificació dels usos de l'aigua dins un procés de canvi dels usos del sòl, particularment accelerat a partir de la dècada de 1960 i objecte de problemàtiques socioterritorials d'ençà de la dècada de 1980. Cartografia i matriu de canvi dels usos del sòl de la conca anys 1993 i 1957. Matèria d'estudi: Cartografia i estadística dels usos del sòl de la conca del riu Muga (49 municipis altempordanesos, 1.050 km2), anys 1957 i 1993. Retrospectiva dels espais forestals, d'aigua, conreats i urbanitzats. - Identificar i descriure les tensions i conflictes en l'ús de l'aigua, així com les característiques de les solucions adoptades en el període 1980-2000. Constatar si determinades solucions estructurals han esdevingut problemàtiques a mig o llarg termini, i estimar la probabilitat de conflictes futurs. Matèria d'estudi: 50 incidents problemàtics en abastament d'aigua (26 tensions i 24 conflictes) i 53 mesures per fer-hi front (12 d'adaptació de la demanda i 41 d'adaptació de l'oferta d'aigua) entre els anys 1980 i 2000, i diferenciant dues unitats territorials de la conca (la Muga interior i la plana de la Muga). - Caracteritzar quins són els temes en matèria d'aigua que no disposen de consens entre els agents socioeconòmics, tècnics i polítics locals reunits en les sessions de discussió del projecte MUGA. Determinar si les estratègies participatives poden prosperar perquè són factibles i idònies. Matèria d'estudi: Projecte MUGA: Gestión del recurso agua con participación de agentes. Estudio para la cuenca del río Muga (Girona), 2000-2003 - UAB i UdG; La dissensió d'opinions dels 30 participants a les 4 sessions de discussió entorn l'ús i gestió de l'aigua de la conca de la Muga; 6 temes de conflicte, 14 subtemes i 31 punts de discussió, 9 dels quals punts calents de conflicte (destructius i indicadors de punts de disfunció en la gestió de l'aigua de la conca).

The ten years since the Olivos Protocol entered into force represent a milestone in Mercosur’s dispute-resolution system. In this sense, this paper aims to analyze the antecedents of the present system (Annex III of Asuncion Treaty and Brasilia Protocol), and evaluate the present conflict-resolution mechanisms, with special reference to the innovations introduced in this respect and disputes resolved under the Olivos Protocol. Finally, the article analyzes some of the possible paths that the dispute-resolution system might take in the future.

FOREWORD Welcome to this West Africa Built Environment Research (WABER) conference taking place here in Ghana. Thank you for coming and welcome to Accra. The main aims of the WABER conference are: to help young researchers and early-career scholars in West Africa to develop their research work and skills through constructive face-to-face interaction with experienced academics; to provide a platform for networking and collaborative work among senior built environment academics in West Africa; and to serve as a vehicle for developing the field of construction management and economics in Africa. Waber 2009 The WABER event in 2009 was held at the British Council in Accra, Ghana on 2-3 June. The event was a resounding success. It attracted participation from 32 researchers, from 12 different institutions, who presented their work to an audience of approximately 100 people. Each presenter received immediate and constructive feedback from an international panel. The event was opened by Professor K.K. Adarkwa, Vice Chancellor of KNUST, Kumasi, Ghana, with several senior academics and researchers from universities, polytechnics, and other institutions in Ghana and Nigeria in attendance. There was also a significant level of attendance by senior construction practitioners in Ghana. Thank you to the School of Construction Management and Engineering, University of Reading, UK for funding the inaugural event in 2009. We are also grateful to all of you who helped to make the event a success and to those of you who have joined us here today to build upon the success and legacy of WABER 2009. Waber 2010 This year, we have 60+ peer-reviewed papers and presentations on topics relating to Building services and maintenance, Construction costs, Construction design and technology, Construction education, Construction finance, Construction procurement, Contract administration, Contract management, Contractor development, Decision support systems, Dispute resolution, Economic development, Energy efficiency, Environment and sustainability, Health and safety, Human resources, Information technology, Marketing, Materials science, Organisation strategy and business performance, Productivity, Project management, Quantity surveying, Real estate and planning, Solar energy systems, Supply chain management and Urban development. The term commercial management has been used for some time, similarly the job title commercial manager. However, as of yet, little emphasis has been placed on defining. This paper presents the findings from a two-year research initiative that has compared and contrasted the role of commercial managers from a range of organisations and across industry sectors, as a first step in developing a body of knowledge for commercial. It is argued that there are compelling arguments for considering commercial management, not solely as atask undertaken by commercial managers, but as a discipline in itself: a discipline that, arguably, bridges traditional project management and organisational theories. While the study has established differences in approach and application both between and within industry sectors, it has established sufficient similarity and synergy in practice to identify a specific role of commercial management in project-based organisations. These similarities encompass contract management and dispute resolution; the divergences include a greater involvement in financial and value management in construction and in bid management in defence/aerospace.

As a result of the sovereign debt crisis that engulfed Europe in 2010, investors are much more likely to pursue dispute resolution options when faced with losses. This paper seeks to examine the position of investors who suffered losses in the Greek haircut of 2012 in the context of investment treaty arbitration. The paper evaluates arguments that investments in Greek sovereign bonds have been expropriated by the introduction of retrofit CACs and that compensation is payable as a result of the protections offered by BITs. The paper investigates whether sovereign bonds come within the definition of protected investment in BITs, assesses the degree to which CACs act as a jurisdictional bar to investor-state claims and attempts an evaluation of whether claims could be successful. The analysis uses as an illustration recent cases brought against Greece at ICSID. The paper concludes by considering whether the Greek haircut was expropriatory and reflects on the possible outcome of current arbitrations.

Este trabalho analisa os Acordos Preferenciais de Comércio (APCs) com ênfase em seus Mecanismos de Solução de Controvérsias (MSC). A partir da seleção de alguns APCs bilaterais celebrados por Estados Unidos e União Europeia com outros parceiros comerciais, o trabalho objetiva (i) explicar como funcionam os MSC previstos pelos APCs para, em seguida, (ii) testar a hipótese de que a forma como os MSC são negociados nos APCs possibilita, em alguma medida, sua coexistência com o Órgão de Solução de Controvérsias (OSC) da Organização Mundial do Comércio (OMC). This paper analyzes Preferential Trade Agreements (PTA) focusing in its Dispute Resolution Mechanisms (DRM). Bilateral agreements signed by the United States and the European Union with other countries were selected with the aim to (i) explain how the DRMs stablished by PTAs work and, aftwards, (ii) test the hypothesis that the way the DRMs are negotiated in the PTAs enables its coexistence with the Dispute Settlement Body (DSB) of the World Trade Organization.

This article, based on the Brazilian experience, examines how Private Equity and Venture Capital (PE/VC) adapts to an emerging economy Our dataset is based on two extensive questionnaires answered by each of the 65 PE/VC organizations with offices in Brazil. The results reveal that a lack of infrastructure and security create investment opportunities. However, institutional idiosyncrasies represent a major barrier and force PE/VC – a U.S. investment model – to adapt by investing in different stages of business development, avoiding LBOs, taking a generalist industry approach, geographically concentrating in the financial cluster and relying on arbitration for dispute resolution.

O presente trabalho tem por objetivo apresentar um estudo que analisa e identifica forças e fraquezas na atuação convergente em rede por órgãos estatais na Câmara de Resolução de Litígios de Saúde e no Núcleo de assessoria técnica da Secretaria de Estado de Saúde, perante a Justiça Federal do Rio de Janeiro, na resolução de conflitos que envolvem demandas sanitárias. Foi realizado um estudo de caso conjugado com pesquisa de campo, bibliográfica e documental, na busca de descrever a intervenção da Câmara de Resolução de Litígios de Saúde e do Núcleo de Assessoria Técnica da Justiça Federal do Rio de Janeiro, no contexto da vida real em que atuam, ou seja, a judicialização de políticas públicas de saúde na cidade do Rio de Janeiro. Os resultados mostram que a atuação em rede de órgãos governamentais gera ganhos sociais para os cidadãos do Rio de Janeiro.

L’elaborato ha ad oggetto lo studio della conciliazione e dell’arbitrato con riferimento alle controversie individuali di lavoro privato e pubblico. Vengono trattati i diversi profili che caratterizzano gli strumenti di risoluzione delle liti alternativi al processo, al fine di comprenderne la disciplina e l’effettiva portata, e di evidenziarne le criticità. L’elaborato si occupa, in primo luogo, di ricostruire il percorso di sviluppo della disciplina legislativa dei due istituti, partendo dalla configurazione del quadro della sua evoluzione storica e affrontando, poi, approfonditamente le più recenti tappe di tale evoluzione. Nella ricostruzione della disciplina della conciliazione e dell’arbitrato viene dato conto dell’assetto delle fonti, legislativa e contrattuale, definendone i rispettivi ruoli e competenze in materia: la tesi si sofferma quindi sul ruolo che il legislatore attribuisce all’autonomia collettiva e sulle modalità con le quali questo ruolo viene concretamente esercitato in sede di contrattazione. Successivamente, viene compiuta una valutazione delle conciliazioni e dell’arbitrato diretta a comprenderne l’efficacia e l’effettività. L’analisi pone in rilievo taluni elementi che sono ritenuti indispensabili per lo sviluppo delle predette caratteristiche e, quindi, per l’opzione e per la fiducia delle parti verso gli strumenti di composizione stragiudiziale delle liti. L’attenzione viene poi focalizzata sui regimi di impugnazione dei provvedimenti con cui si concludono le procedure stragiudiziali, sulla base della riflessione per la quale la diffusione di uno strumento di composizione delle controversie postula necessariamente un certo grado di stabilità degli atti che esso genera. L’ultima parte dell’elaborato è dedicata alla disamina delle ipotesi applicative di successo nell’esperienza italiana di Alternative Dispute Resolution, ossia il tentativo obbligatorio di conciliazione nei licenziamenti economici introdotto dalla Riforma Fornero, la conciliazione monocratica e l’arbitrato per l’impugnazione delle sanzioni disciplinari, anche con l’intento di comprendere quali caratteristiche ne abbiano favorito la diffusione, in rapporto alle altre tipologie di conciliazione e arbitrato di lavoro.

La tesi approfondisce i profili processuale della responsabilità medica allo scopo di elaborare una proposta alternativa di gestione del contenzioso. Si esamina, altresì, il tema dei limiti di utilizzo della mediazione nelle controversie in cui vengono in gioco interessi di rilievo pubblicistico.
