En concevant que toute société a deux clivages dominants, l’un social et l’autre partisan, cette thèse développe une théorie sur le changement institutionnel. L’hypothèse initiale, selon laquelle les groupes sociaux créés par le premier clivage agiront pour restreindre le changement institutionnel et que le changement aura lieu lors de l’émergence d’un groupe partisan capable de croiser le clivage social, fut testée par les processus traçant les changements qui furent proposés et qui ont eu lieu au sein des conseils nominés en Amérique du Nord britannique. Ces conseils furent modifiés un bon nombre de fois, devenant les chambres secondaires de législatures provinciales avant d’être éventuellement abolies. La preuve supporte l’hypothèse, bien qu’il ne soit pas suffisant d’avoir un groupe partisan qui puisse croiser le clivage qui mène le changement : un débat partisan sur le changement est nécessaire. Ceci remet aussi en cause la théorie prédominante selon laquelle les clivages sociaux mènent à la formation de partis politiques, suggérant qu’il est plus bénéfique d’utiliser ces deux clivages pour l’étude des institutions.

Christine Riefa is a lecturer in Consumer Law and Intellectual Property Law at Brunel University in the UK. She is an elected board member of the International Association of Consumer Law and an academic correspondent to the Euro-American Chair for the legal protection of consumers (University of Cantabria, Spain). In 2009-2010, Dr Riefa is a Fulbright EU Scholar-in-Residence at Cleveland-Marshall College of Law, Ohio USA. A first version of this article was presented at the Summer School in Consumer Law, organised by the GREDICC (Groupe de recherche en droit international et comparé de la consummation), UQAM, Montréal, 29th June – 4th July 2009.

This paper presents a reform initiative, the Supporting Montreal Schools Program (SMSP), created by the government of Quebec to assist 184 low socio-economic-status schools in Montreal implement seven reform strategies prescribed by the government. On a regular basis, the professional team of the SMSP engages in reflection and research with universities concerning one or more of the strategies they are charged with helping schools implement or the functioning of the SMSP more generally. The present research programme is part of the team’s ongoing reflection on a component of Strategy 4: professional development of school administrators and the school team. In this paper, we detail results from this initial and subsequent studies on the work of principals in low-performing schools. We also describe our collaborative relationship with the SMSP team, discuss the effectiveness of the SMSP in promoting the implementation of the seven governmentmandated strategies and critique the utility of our partnership with the SMSP and our use of that programme as a vehicle for linking research to practice.

In this paper I compare the habeas corpus systems of El Salvador, the United States and Argentina. My purpose is to develop a general understanding of the procedure for bringing the writ in each country and analyze the substantive law governing the rights of habeas corpus petitioners in each country. I evaluate the systems against the backdrop of each country’s political and legal history with respect to the writ of habeas corpus. The ultimate aim of this paper is to reform the habeas corpus law of El Salvador by analyzing the Salvadoran system as compared to the Argentine and U.S. systems. I conclude that the Argentine habeas corpus system provides a better model for the Salvadoran system than does the U.S. system. I draw this conclusion because the two countries share common foundations for their legal systems, in addition to common histories of civil war, during which there were numerous disappearances and denial of habeas corpus rights. Moreover, Argentina’s habeas corpus law protects the liberty interest of the detained individual more so than U.S. habeas corpus law. This heightened protection of the right to liberty largely results from the country’s past history of forced disappearances and incommunicado detention. Because El Salvador witnessed similar problems in its past, the Argentine model provides a good model for Salvadoran reform.

A comparative assessment of the successes and failures of the judicial reform efforts of El Salvador and Brazil in the 1980’s produces striking results. The reforms varied greatly in scope and were conducted in very different socio-political and economic backgrounds. While El Salvador’s reforms seemed narrow and ill-planned, on paper it appeared that Brazil’s broad reforms would be a successful model for any country with a fledgling democracy. Brazil’s reforms were an exercise in constitutionalism, implementing genuine separation of powers and receiving legislative and executive support. I was very surprised that these different approaches produced strikingly similar negative effects on the people’s assessment of the judiciary. From this outcome I concluded that while judicial reform of a corrupt or inefficient judiciary is an important step in ensuring the rule of law in society, it can not be the vehicle through which democratic reform is implemented. Quite to the contrary, for successful judicial reform to take place there must be considerable penetration of the law in society through enforcement of unbiased legislation, consistency in the laws and their enforcement, and sufficient time for the reform to have an effect on society.

The present study was an attempt to analyze systematically the techniques of monetary control measures with its relevance and changing importance and to find out their effectiveness in the Indian context especially to achieve the thriving objectives of price stability and economic growth.There is definite and remarkable economic impact of monetary policy on Indian economy in the post-reform period. The importance of monetary policy has been increasing year after year. Its role is very relevant in attaining monetary objectives, especially in managing price stability and achieving economic growth. Along that, the use and importance of monetary weapons like Bank rate, CRR, SLR, Repo rate and Reverse Rate have increased over the years. Repo and Reverse Repo rates are the most frequently used monetary techniques in recent years. The rates are varied mainly for curtailing inflation and absorb the excess liquidity and hence to maintain price stability in the economy. Thus, this short-time objective of price stability is more successful on Indian economy rather than other long-term objectives of development.Monetary policy rules can be active or passive. The passive rule is to keep the money supply constant, which is reminiscent of Milton Friedman’s money growth rule. The second, called a price stabilization rule, is to change the money supply in response to changes in aggregate supply or demand to keep the price level constant. The idea of an active rule is to keep the price level and hence inflation in check. In India, this rule dominates our monetary policy. A stable growth is healthy growth.

Se presenta memoria final de proyecto educativo que propone el diseño de un currículo adaptado para hacer frente al alto nivel de absentismo escolar en el primer ciclo de ESO, mediante el establecimiento de determinados centros de interés y ámbitos que engloban las áreas y la implantación de una tarjeta curricular de seguimiento de cada alumno. Se realiza en el IES Pedro Muñoz Seca en El Puerto de Santa María, Cádiz. Los objetivos son: cambiar la motivación hacia el aprendizaje; crear un nuevo bloque de actitudes personales, individuales y grupales que permitan una socialización ajustada a sus expectativas; asimilar aprendizajes básicos para asumir la formación profesional básica de operarios. El proceso consta de varias fases: 1, planificación; 2, diseño de centros de interés; 3, ejecución o realización; 4, retroalimentación educativa; 5, evaluación; 6, validación del progreso en su tarjeta curricular. El resultado ha sido negativo en relación a lo esperado, sólo un porcentaje pequeño cambió su motivación hacia la escuela.

Se presenta memoria final de proyecto educativo que propone la recopilación de las producciones literarias elaboradas en el aula e intercambiarlas con otros centros como recursos educativos de interés, utilizando nuevas tecnologías informáticas. Se realiza en el CEIP La Esperanza en Cantillana, Sevilla. Los objetivos son: intercambiar experiencias entre centros educativos; utilizar las nuevas tecnologías como una herramienta al servicio de la educación y de la creación curricular; elaborar recursos didácticos contextualizados; implicar a las familias en una dinámica rica en estímulos orales y escritos en coherencia con el paradigma de lectura emergente. El proceso consta de varias fases: 1, aprendizaje y familiarización con aplicaciones de maquetación y edición; 2, reuniones con el equipo técnico de coordinación pedagógica para plantear los recursos que se iban a desarrollar.

Se ha pretendido caracterizar las necesidades educativas del colectivo de alumnos y alumnas del Programa de Diversificación Curricular, con el objetivo último de orientar la práctica didáctica y el desarrollo de medidas educativas que supongan respuestas válidas a las necesidades educativas planteadas. Entre estas medidas, independientemente de las más generales de organización general y de refuerzo educativo, se encontrarían las de adaptación, diseño, elaboración y validación de materiales curriculares que supongan en la práctica la utilización de tecnologías informáticas como refuerzo complementario para el Ámbito Científico-Tecnológico de dicho Programa de Diversificación Curricular.
