O presente estudo visa caracterizar a dimensão do insucesso escolar no Arquipélago da Madeira no período compreendido entre 1994 e 2000. Enquadramos esta problemática nas tendências de reforma e de mudança educativas vividas antes e durante este período, quer no continente português quer no espaço insular. Confrontamo-nos ainda com algumas teorias explicativas que no campo da Sociologia da Educação intentam explicar as desigualdades no sucesso académico. A caracterização desta Região ao nível do enquadramento ecológico, dos indicadores de qualidade de vida e a própria dinâmica da população madeirense são também aspectos abordados, com o objectivo de contextualizar o insucesso escolar neste espaço geográfico. Apesar de possuir dimensões reduzidas, a especificidade concelhia é uma realidade que não é susceptível de ignorar. Deste modo, a evolução dos indicadores educativos é efectuada numa perspectiva concelhia, onde a evolução do número de alunos inscritos na escolaridade obrigatória e as taxas de progressão, retenção e abandono escolar são tratadas ao nível da divisão administrativa e territorial. Através de uma metodologia de tipo etnográfico procurámos delinear o perfil-tipo do aluno vítima de insucesso escolar nos dois concelhos mais críticos - Câmara de Lobos e São Vicente - de modo a delinear e sugerir algumas medidas profilácticas para este problema. Neste estudo concluímos que as razões do insucesso escolar não se distanciam das assinaladas no espaço continental, embora o seu enquadramento seja concomitante com o espaço físico e social em que decorrem.

No âmbito da dissertação apresentada à Universidade da Madeira para cumprimento dos requisitos necessários à obtenção do grau de Mestre em Engenharia Civil, foi desenvolvida uma pesquisa na área da Segurança Contra Incêndio em Edifícios, abreviadamente designada por SCIE, desde 1951 a 2008 e a sua aplicação como especialidade da Engenharia, designadamente ao nível da fenomenologia da combustão, no que concerne à evolução histórica dos organismos, legislação, normas técnicas e factos históricos marcantes ao nível socioeconómico. Foi feita uma abordagem às normas europeias e à sua transcrição para as normas portuguesas devido ao factor político com a entrada de Portugal na C.E.E. em 1986. Neste sentido, este trabalho pretende dar a conhecer a evolução da SCIE em Portugal e exemplifica a sua aplicação como especialidade obrigatória para o licenciamento de qualquer edifício, independentemente da sua Utilização-Tipo à excepção dos estabelecimentos prisionais, instalações das forças armadas, espaços destinados ao armazenamento de explosivos e pirotecnia. O estudo de caso escolhido foi de um edifício de utilização mista da 4ª Categoria de Risco. Identificaram-se as diferenças entre a legislação anterior e o novo Diploma, a evolução histórica e as medidas a implementar no estudo de caso, apresentado no (anexo II), de acordo com o novo quadro legislativo.

This paper presents some reflections on the social world of young female transgression. The context corresponds to those ones that obey social and educational measures in The Padre João Maria Education Centre (CEDUC), in Natal- RN. This behavior, according to the Statute of Children and Young (ECA, 1990), is defined as "conduct described as crime or misdemeanor." Our goal is to discuss aspects of the contexts in which young women are interacting with the universe of total institutional control mechanisms. Through the socio-anthropological analysis of the ethnographic practice in field research, it was necessary to question the concept of misuse engaged in the practice of penalties awarded to young women in the context of private freedom. So was built a frame relating the representations of the relations of gender, generation, the practice of violence and crime from the look on CEDUC/ Padre João Maria Education Centre

This paper aim to check a hypothesis that assumes several behaviors related to social work norm´s obeying as a phenomenon that can be explained by actor´s social network structure and the rational choice processes related to the social norm inside that network, principally the payoff´s analysis received by the closest actors, or neighbors, at a social situation. Taking the sociological paradigm of rational action theory as a basis, the focus is on a debate about the logic of social norms, from Émile Durkheim´s method to Jon Elster´s theory, but also including social network analysis´s variables according to Robert Hanneman; and also Vilfredo Pareto´s constants related to human sociability, at the aim to detect elements that can help the scholars to develop an agent based model which could explain the sociological problem of deviance by a better way than the common sense´s view about morality and ethics at a social work environment

The Federal Constitution states that the reduction of social and regional inequalities is one of the goals to be achieved by the Brasilian State. The economic constitution states that the national economy must be developed so as to achieve, amongst other objectives, the reduction of those inequalities. In this paper, we aim to demonstrate the duty, imposed by the Constitution to the State, of acting in the national economy so as to promote the achievement of the constitutional goals, among wich we highlight the reduction of inequalities. One of the instruments that can be used by the State to achieve this objective is its fiscal policy. It is also an aim in this paper to demonstrate that inducing tax norms can be used by the State, because it can encourage the economic agents to bring about the reduction of social and regional inequalities. Therefore, after bibliographic and jurisprudential research, we conclude that the duty, imposed to the State, of acting in the national economy so as to promote the achievement of the constitutional goals exists. We also conclude that this acting must be planed and constant, because the consequences are slow and that, within the limits of the constitution, the inducing tax norms can be an instrument for the State in order to reduct the social and regional inequalities

This work presents an analysis about the legitimation of independent regulatory commission`s rulemaking power by participation procedure. It is observed that political and administrative decentralization and fragmentation of State, with the purpose of approaching citizens and provide, more efficiently, the functions acquired by the passage of the Welfare State, leads to a deficit of legitimacy (democratic crisis), which is noticeable in the making of legal norms by directors of independent regulatory commission to regulate specific economic sector. However, we understand that this crisis stems from the observation of the contemporary world from dogmas and legal institutions of the eighteenth century, without their evolution and adaptation to the modern world. The legitimacy must be perceived as the justification of power, relation command /obedience, which, from the Modern State, has the democracy as standard. Therefore, just as the world has evolved and demanded political and administrative decentralization to accompany him, it is necessary to the development of the idea of representative democracy (formal legitimacy) to participatory democracy (legitimacy stuff). Legitimacy is not confused with the legality: as the legality is on observance to internal legal system, the "rules of play"; legitimacy, as inputs to be fed into this system, the selection of the different expectations in the environment. Nevertheless, the legitimacy will take place by legality, through introduction of rational and communicative procedures: procedures get fundamental importance because these will be the means to select the expectations to be introduced in the legal system in order to make decisions more fair, rational and qualified towards society. Thus, it is necessary to its opening to the environment for dialogue with the government. In this context, we try to make an analysis of constitutional norms based on systematic and teleological interpretation of these norms to build these arguments. According to the Constitution of 1988, participatory democracy is a result of the democratic principle (sole paragraph of art. 1 of the Constitution), and it is an expression of citizenship and political pluralism, both foundations of Republic (respectively Art. 1st, inc . V and II of the Constitution), as well as the national consciousness. From another point of view, that principle consists of an evolution in the management public affairs (principle of Republic). The right of interested participate in the rulemaking process derives both the principle of popular participation (part of the democratic principle) and the republican principle as the due process constitutional (art. 5, LIV and LV, CF/88) and the right to petition (Art . 5 °, inc. XXXIV, "a", CF/88), and it is the duty of the State not only be open to participation and encourage it. Ignoring stakeholder involvement in procedures and / or expressions compiled can be causes of invalidation of the rule of law produced by addiction of procedure, motive, motivation and/or because of the administrative act. Finally, we conclude that the involvement of stakeholders in the process of making rules within the independent regulatory commission is the legitimacy and the validity of rules; and that, despite of the expressions do not bind the decision making, they will enter the system as juridical fact, balancing the field of technical discretionary of agencies

Visando estabelecer normas para o DRIS na cultura do algodão, um produto agrícola em franca expansão no território nacional e com significativa contribuição econômica no PIB brasileiro, o presente trabalho estudou lavouras comerciais de municípios do Norte do Estado de Mato Grosso do Sul e Centro-Sul do Estado de Mato Grosso. Os resultados indicaram que a escolha da relação modifica a interpretação dos resultados, exceto quando é utilizada a metodologia proposta por Elwali e Gascho, pois, neste caso, os índices nutricionais convergem independentemente do método de escolha das relações. O método DRIS otimiza o gerenciamento das informações nutricionais do algodoeiro, e é possível detectar os nutrientes limitantes nas lavouras desta cultura.
