The intersection of gender, welfare and immigration regimes has been one of the main focus of a rich scholarship on paid domestic work in Europe. This article brings into the discussion the nexus of employment and immigration law regimes to reflect on the role of legal regulation in structuring and reducing the vulnerability of domestic workers. I analyse this nexus by looking at the cases of Cyprus and Spain, two states falling under the cluster of Southern Mediterranean welfare regimes, that share certain characteristics in terms of immigration regimes, but have substantially different employment law regulation models. The first part sketches the debate on the employment law regulation of domestic work. The second part starts by giving an overview of the immigration regimes of Cyprus and Spain in relation to migrant domestic workers and then proceeds to analyse the two countries’ models and substance of employment law regulation in domestic work. The comparison of these two divergent approaches informs the debate on how the legal regulation of domestic work should be best structured. In Spain there have been recent dynamic legislative changes in the employment law regulation of domestic work. The final part of the article traces these changes and reflects on why such processes have not taken place in Cyprus.

La monografía titulada “La Aplicación del principio Interés Superior del Niño, Niña y Adolescente” en los procesos disciplinarios administrativos del Ministerio de Educación; analiza el cumplimiento del mismo principio, en relación a la aplicación de acciones educativas disciplinarias en los procesos instaurados en contra de los estudiantes, dependiendo de la gravedad de la falta cometida. Posteriormente se analiza la legislación ecuatoriana en cuanto a la clasificación de las faltas, la sustanciación y resolución del proceso, a través de la Ley Orgánica de Educación Intercultural, con su Reglamento General, y el Acuerdo Ministerial 434, cuerpos normativos que velan por el respeto y garantía de los principios y derechos constitucionales de este grupo de atención prioritaria. Serealiza un análisis jurídico de aspectos relacionados al ámbito disciplinario entre la normativa colombiana del departamento de Caqueta, con respecto de la Ley Orgánica de Educación Intercultural y su Reglamento General. También se consideran los procesos disciplinariosinstaurados en contra de los estudiantes del Colegio Nacional Juan Pio Montufar de la ciudad de Quito,desde el Auto Inicial hasta la emisión de la Resolución;fiscalizando que en cada una de sus etapas se respete el principio del Interés Superior de los niños, niñas y adolescentes, yel derecho al Debido Proceso.

A number of laws in Canada which uphold rights are referred to as quasi-constitutional by the courts in recognition of their special importance. Quasi-constitutional statutes are enacted through the regular legislative process, although they are being interpreted and applied in a fashion which has become remarkably similar to constitutional law, and are therefore having an important affect over other legislation. Quasi-constitutionality has surprisingly received limited scholarly attention, and very few serious attempts at explaining its significance have been made. This dissertation undertakes a comprehensive study of quasi-constitutionality which considers its theoretical basis, its interpretation and legal significance, as well as its similarities to comparable forms of law in other Commonwealth jurisdictions. Part I examines the theoretical basis of quasi-constitutionality and its relationship to the Constitution. As a statutory and common law form of fundamental law, quasi-constitutionality is shown to signify an association with the Canadian Constitution and the foundational principles that underpin it. Part II proceeds to consider the special rules of interpretation applied to quasi-constitutional legislation, the basis of this interpretative approach, and the connection between the interpretation of similar provisions in quasi-constitutional legislation and the Constitution. As a statutory form of fundamental law, quasi-constitutional legislation is given a broad, liberal and purposive interpretation which significantly expands the rights which they protect. The theoretical basis of this approach is found in both the fundamental nature of the rights upheld by quasi-constitutional legislation as well as legislative intent. Part III explores how quasi-constitutional statutes affect the interpretation of regular legislation and how they are used for the purposes of judicial review. Quasi-constitutional legislation has a significant influence over regular statutes in the interpretative exercise, which in some instances results in conflicting statutes being declared inoperable. The basis of this form of judicial review is demonstrated to be rooted in statutory interpretation, and as such it provides an interesting model of rights protection and judicial review that is not conflated to constitutional and judicial supremacy.

This project aims to clarify the importance of acquiring cross-disciplinary competencies in the Law and Criminology degrees, specifically entrepreneurial capability in order to further students' comprehensive training and complete preparation for the legal and professional sector, thereby fostering students' greater involvement in the development of such competencies.

Mathematical skills that we acquire during formal education mostly entail exact numerical processing. Besides this specifically human faculty, an additional system exists to represent and manipulate quantities in an approximate manner. We share this innate approximate number system (ANS) with other nonhuman animals and are able to use it to process large numerosities long before we can master the formal algorithms taught in school. Dehaene´s (1992) Triple Code Model (TCM) states that also after the onset of formal education, approximate processing is carried out in this analogue magnitude code no matter if the original problem was presented nonsymbolically or symbolically. Despite the wide acceptance of the model, most research only uses nonsymbolic tasks to assess ANS acuity. Due to this silent assumption that genuine approximation can only be tested with nonsymbolic presentations, up to now important implications in research domains of high practical relevance remain unclear, and existing potential is not fully exploited. For instance, it has been found that nonsymbolic approximation can predict math achievement one year later (Gilmore, McCarthy, & Spelke, 2010), that it is robust against the detrimental influence of learners´ socioeconomic status (SES), and that it is suited to foster performance in exact arithmetic in the short-term (Hyde, Khanum, & Spelke, 2014). We provided evidence that symbolic approximation might be equally and in some cases even better suited to generate predictions and foster more formal math skills independently of SES. In two longitudinal studies, we realized exact and approximate arithmetic tasks in both a nonsymbolic and a symbolic format. With first graders, we demonstrated that performance in symbolic approximation at the beginning of term was the only measure consistently not varying according to children´s SES, and among both approximate tasks it was the better predictor for math achievement at the end of first grade. In part, the strong connection seems to come about from mediation through ordinal skills. In two further experiments, we tested the suitability of both approximation formats to induce an arithmetic principle in elementary school children. We found that symbolic approximation was equally effective in making children exploit the additive law of commutativity in a subsequent formal task as a direct instruction. Nonsymbolic approximation on the other hand had no beneficial effect. The positive influence of the symbolic approximate induction was strongest in children just starting school and decreased with age. However, even third graders still profited from the induction. The results show that also symbolic problems can be processed as genuine approximation, but that beyond that they have their own specific value with regard to didactic-educational concerns. Our findings furthermore demonstrate that the two often con-founded factors ꞌformatꞌ and ꞌdemanded accuracyꞌ cannot be disentangled easily in first graders numerical understanding, but that children´s SES also influences existing interrelations between the different abilities tested here.

El derecho internacional, como el derecho administrativo de cada Estado, se encuentra vinculado a la finalidad universal del derecho. No obstante, la influencia de la comunidad internacional en los asuntos jurídicos de los Estados está generando, con el auge de la globalización, mecanismos o instrumentos que de forma no impositiva pero sí persuasiva, vienen delimitando las competencias estatales. Estos instrumentos ejercen la función de ordenar los ámbitos de validez de dichas competencias jurídicas y administrativas internas, a través de formas declaratorias de carácter internacional, mediante normas jurídicas blandas denominadas soft law. El amplio y variado uso del soft law en temas como los derechos humanos y el medio ambiente plantea una dificultad para la teoría tradicional de fuentes, inspirada en la voluntad de los Estados, los cuales se constituyen a partir de su soberanía estatal (hard law). Esto sugiere una dicotomía jurídica, en donde el soft law se contrasta con las reglas legales que definen obligaciones específicas de hard law, es decir, “son normas o principios más abiertos o generales en su contenido y significado, comprendiéndose como suaves. En tal caso, el Soft Law plantea una apertura a la internacionalización y democratización del derecho administrativo. La creciente adopción de instrumentos de soft law de influencia internacional o global permite la participación de actores no estatales, tales como las organizaciones no gubernamentales (ONG), y de carácter civil en la construcción de políticas e instrumentos que en ocasiones adquieren más legitimidad que las leyes creadas para atender tales asuntos.

La presente tesi affronta l’evoluzione dei rapporti tra costituzionalismo democratico e diritto sovranazionale in Europa. L’ipotesi della ricerca si basa sull’idea che l’aumentare sempre più incessante negli ultimi decenni di conflitti costituzionali tra i due ordinamenti sia dovuto ad una loro differenza di fondo, di cui una parte importante è rappresentata dall’assenza della questione sociale nel diritto sovranazionale. Il primo capitolo si occupa di analizzare le principali teorie giuridiche che hanno fornito l’habitus teorico per leggere il processo di integrazione, giustificando l’adozione di una lettura delle dinamiche ordinamentali attraverso il prisma dei conflitti e della costituzione materiale. Nel secondo capitolo si volge lo sguardo all’analisi del diritto giurisprudenziale, suddiviso in due blocchi: un primo in cui – dopo aver approfondito alcuni capisaldi del diritto sovranazionale – si confrontano i due sistemi, in maniera statica, su alcuni temi (principio di non discriminazione, libertà di impresa e il bilanciamento con interessi collettivi, i diritti di pressione democratica, ecc.) per mettere in luce i diversi approcci; un secondo blocco in cui, invece, si studiano, in maniera più dinamica, le diverse perturbazioni che hanno interessato i rapporti tra ordinamenti, di cui una prima si è sviluppata sul rispetto dei diritti fondamentali da parte del diritto sovranazionale, mentre una seconda, ancora in corso, si concentra sul discorso sull’identità costituzionale. Nel terzo capitolo, in chiusura, si prova a sviluppare – sulla base delle risultanze del dibattito teorico e dell’analisi giurisprudenziale – una proposta finale che cerchi di unire la questione sociale e il discorso sull’identità costituzionale nel diritto pubblico europeo, che abbia alla sua base un nuovo e più centrale ruolo che dovranno svolgere le Corti costituzionali nello sviluppo delle dinamiche ordinamentali, al fine di far emergere alcuni conflitti di valore assenti nello spazio pubblico europeo.

Contemporary private law, in teh last few decades, TEMPhas been increasingly characterized by teh spread of general clauses and standards and by teh growing role of interpreters in teh framework of teh sources of law. dis process TEMPhas also consistently effected those systems dat are not typically centered on judge-made law. In particular in contract law general clauses and standards has assumed a leading role and has become protagonists of processes of integration and harmonization of teh law. Wifin dis context, teh reasonableness clause TEMPhas come to teh attention of scholars, emerging as a new element of connection between different legal systems -first of all between common law and civil law – and even between different legal traditions. dis research aims at reconstructing teh patterns of emersion and evolution of teh TEMPprincipal of reasonableness in contract law both wifin European Union Law and in teh Chinese legal system, in order to identify evolutionary trends, processes of emersion and circulation of legal models and teh scope of operation of teh TEMPprincipal in teh two contexts. In view of teh increasingly intense economic relations between Europe and China, wifin teh framework of teh new project called Belt and Road Initiative, a comparative survey of dis type can foster mutual understanding and make communications more TEMPeffective, at teh level of legal culture and commercial relations, and to support teh processes of supranational harmonization of contract law rules.

L’applicazione del principio di buona fede oggettiva all’attività della pubblica amministrazione, sia contrattuale che provvedimentale, è attualmente fuori discussione, tuttavia i limiti e le modalità attraverso cui questo principio si articola sono ancora oggetto di dibattito dottrinale e giurisprudenziale, in particolare modo per quanto riguarda l’istituto della responsabilità precontrattuale della p.a. Tale ultimo istituto è oggetto di uno specifico approfondimento, che tenterà di analizzare i principali punti cruciali del dibattito: la tutela del legittimo affidamento del privato durante le trattative instaurate con la p.a., la natura giuridica della responsabilità precontrattuale e questioni di stampo più processuale, come il riparto di giurisdizione tra giudice ordinario e amministrativo. Al fine poi di comprendere pienamente le funzioni svolte dal principio di buona fede nell’ambito delle attività pubbliche, sia contrattuali che autoritative, la ricerca si è concentrata anche sulle diverse interpretazioni che gli studiosi del diritto hanno attribuito oggi al giudizio di buona fede, inteso sia come principio civile contrattuale che come nuovo principio amministrativo costituzionalmente orientato. Nel proseguo della dissertazione, infatti, si cerca di valutare l’applicabilità del giudizio di buona fede da un punto di vista interdisciplinare, civile e amministrativo, allo scopo di dimostrare come tale principio sia riuscito lentamente a pervadere anche la materia amministrativa, condizionando in senso garantista non solo il dictum giurisprudenziale, ma anche l’intervento normativo del legislatore.

The separation, by an optical standing wave, of a beam of two-level atoms prepared in a thermal mixture of ground and excited states, is considered as an example of a Maxwell demon. By including the momentum exchanged with the cavity, it is shown how no violation of the second law is possible. A classical and quantum analysis is given which illustrates this principle in some detail.

We review the description of noise in electronic circuits in terms of electron transport. The Poisson process is used as a unifying principle. In recent years, much attention has been given to current noise in light-emitting diodes and laser diodes. In these devices, random events associated with electron transport are correlated with photon emission times, thus modifying both the current statistics and the statistics of the emitted light. We give a review of experiments in this area with special emphasis on the ability of such devices to produce subshot-noise currents and light beams. Finally we consider the noise properties of a class of mesoscopic devices based on the quantum tunnelling of an electron into and out of a bound state. We present a simple quantum model of this process which confirms that the current noise in such a device should be subshot-noise.

Aim: To identify how the methodology of Reflection Groups (RG) can contribute to approach social-psychological problems, so often observed as obstacles in PE efforts. The objective was also to verify the contributions from RG to the implementation of ergonomics recommendations, which were a starting point and organized group discussions. Method: A concrete case was used as an illustration, and studied in depth: RG with administration and production workers` representatives from the Department of Nutrition and Dietetics of a cardiologic hospital in Sao Paulo, Brazil. RG are temporary thinking groups, taking place outside the workplace and having delegative and consultive participation. They make use of Operative Groups, an adapted form of tripartite group, activity as an instrumental resource, group dynamic techniques and videotaping. In 2007, 31 meetings took place during paid working hours with 7 groups of different composition, ranging from 1.5 h to 3 h. Results: Additionally to the positive effects in communication and psychosocial environment, RG could also contribute to changes in interpersonal relationships, cooperation, personal and work behaviours. By dealing with aspects which could hinder the explicit task: fears, conflicts, and stereotyped beliefs and behaviours; resistance to change could be broken and group members could learn. RG allowed input about new risks; continuous information and feedback about ongoing ergonomics interventions so that immediate corrective action could be taken. The main form of participation was in administrative, organizational, and psychosocial problems which required a better clarification and identification of their real causes, commitment, and elaboration of strategies and negotiation of different stakeholders in their solution. Conclusion: RG takes advantage of homogeneous and heterogeneous groups, in face to face communication. The interactions in the groups are task-oriented (explicit task) but attaining groups` goals depends on a relational interaction (implicit task). Relevance to industry: Reflection groups can bring important contributions to ergonomics and industry because they favour the discussion, disclosure of problems and incorporation of solutions, enabling interventions in working organization, psychosocial environment and relationships in a collective and participatory approach, promoting health and social integration. Hahnemann considered the secondary action of medicines to be a law of nature and reviewed the conditions under which it occurs. It is closely related to the rebound effects observed with many modern drugs. I review the evidence of the rebound effect of statins that support the similitude principle. In view of their indications in primary and secondary prevention of cardiovascular diseases, statins are widely prescribed. Besides reducing cholesterol biosynthesis, they provide vasculoprotective effects (pleiotropic effects), including improvement of endothelial function, increased nitric oxide bioavailability, antioxidant properties, inhibition of inflammatory and thrombogenic responses, stabilisation of atherosclerotic plaques, and others. Recent studies suggest that suspension of statin treatment leads to a rebound imparing of vascular function, and increasing morbidity and mortality in patients with vascular diseases. Similarly to other classes of modern palliative drugs, this rebound effect is the same as a secondary action or vital reaction described by Samuel Hahnemann, and used in homeopathy in a therapeutic sense.
