The copyright has been the subject of discussion in national and international forums, which involve lots of interests, both personal and economic. Costa Rica has been the exception.Its importance and the protection that the country's legal system provides, is such that many of the benefits received as a nation (exemptions, preferential tariffs, export quotas) have been subject to the protection that the Costa Rican government granted this fees.

No momento atual, assiste-se ao eclodir da sociedade de conhecimento em que os ativos fixos intangíveis assumem um papel importante. A falta de substância ou materialidade, no sentido de forma física, é uma característica dos ativos fixos intangíveis. No entanto, a forma física não é essencial à existência de um ativo, daqui decorre que as patentes e os copyrights, por exemplo, sejam ativos se deles for esperado que fluam benefícios económicos para a empresa e se forem controlados por esta. Poder-se-á , em termos gerais, dizer que os ativos fixos intangíveis são o resíduo, o saldo, isto é, a parte dos ativos totais de uma empresa que residem na situação física vista como um todo, mas que não podem ser considerados – exceto em algumas situações particulares – inerentes a, ou terem ligações com unidades de ativos fixos tangíveis. A intangibilidade decorre de que o total dos valores dos vários bens físicos existentes numa empresa, inventariando unidade a unidade, não atinge o valor global da empresa, diferença esta que expressa o valor do ativo fixo intangível. O grande problema está na correta avaliação dos ativos fixos intangíveis. È neste desiderato que surge a NCRF6 – Ativos Intangíveis que tem por base a Norma Internacional de Contabilidade IAS38 – Ativos Intangíveis cujo objetivo é o de prescrever o tratamento de ativos intangíveis. Esta norma exige que uma entidade reconheça um ativo intangível se, apenas se, critérios especificados forem satisfeitos. A Norma também especifica como mensurar a quantia escriturada de ativos intangíveis e exige divulgações especificadas acerca dos ativos intangíveis. Esta obra tem, assim, como principal objetivo o tratamento contabilístico, com referência aos aspetos fiscais e de auditoria, dos ativos fixos intangíveis, baseado no estudo da NCRF6 e apresentação de casos concretos de aplicação.

Three texts were prepared for delivery at the first honorary doctorate awarded simultaneously by three Lisbon universities on 27 February, 2012: an introduction, a lecture and a comment. The event included the award of member of the Lisbon Academy of Science (ACL) by Manuel Jacinto Nunes, dean of the economics and finance section of ACL who proposed his name and Olivier Blanchard’s on the 30th anniversary of James Tobin receiving an honorary doctorate from Nova University. On 24 February , Paul Krugman visited ACL and participated in a session of the project dubbed “Letter to the lusofonia Queen”. Since this project is promoted by Nova SBE’s Center for Globalization and Governance and has been featured in some of the graduate courses, a short note on the meeting is included in annex. On 15 June, the three universities authorized an edition in Portuguese and donated the copyrights to a student award on “Krugman economics”, in a way still to be determined by the editor. The lecture and the comment will be translated as soon as a suitable publisher is found. Since a lot of the teaching at Nova SBE is in English, it seemed appropriate to reproduce the original texts in the order in which they were presented. A lively question and answer period was also recorded by Nova TV and should be made available in the book, together with highlights of the media coverage. Introduced as a “militant economist”, he speaks about a crisis “his mind loves but does not let the heart forget the poor and the unemployed”. The Nobel prize winner described as a“progressist pessimist of the world economy” concludes with a severe indictment of the profession. “In normal times, when things are going pretty well, the world can function reasonably well without professional economic advice. It’s in times of crisis, when practical experience suddenly proves useless and events are beyond anyone’s normal experience, that we need professors with their models to light the path forward. And when the moment came, we failed”. The comment, by the official responsible for Paul Krugman’s mission to Portugal in 1976, contains an equally dire prediction: “I would very much like to see in the near future the weakening of the influence not only of freshwater economists but also of their conservative European followers. But I fear that this will not happen until we find ourselves in a more calamitous situation than at present”. Fortunately Silva Lopes closes in the hope “that the ideas of Paul Krugman will soon have more influence in policy makers than at present seems to be the case”.

This thesis evaluates a start-up company (Jogos Almirante Lda) whose single asset is a board game named Almirante. It aims to conclude whether it makes sense to create a company or just earn copyrights. The thesis analyzes the board game’s market, as part of the general toy’s market, from which some data exists: European countries as well as the USA. In this work it is analyzed the several ways to finance a start-up company and then present an overview of the valuation of the Jogos Almirante based on three different methods: Discounted Cash Flow, Venture Capital Method and Real Options.

This paper describes a pilot study centred on the technology-enhanced self-development of competences in lifelong learning education carried out in the challenging context of the Association of Participants Àgora. The pilot study shows that the use of the TENCompetence infrastructure, i.e. in this case the Personal Development Planner tool, provides various kinds of benefits for adult participants with low educational profiles and who are traditionally excluded from the use of innovative learning technologies and the knowledge society. The selforganized training supported by the PDP tool aims at allowing the learners to create and control their own learning plans based on their interests and educational background including informal and non-formal experiences. In this sense, the pilot participants had the opportunity to develop and improve their competences in English language (basic and advanced levels) and ICT competence profiles which are mostly related to functional and communicative skills. Besides, the use of the PDP functionalities, such as the self-assessment, the planning and the self-regulating elements allowed the participants to develop reflective skills. Pilot results also provide indications for future developments in the field of technology support for self-organized learners. The paper introduces the context and the pilot scenario, indicates the evaluation methodology applied and discusses the most significant findings derived from the pilot study.

This paper introduces Collage, a high-level IMS-LD compliant authoring tool that is specialized for CSCL (Computer-Supported Collaborative Learning). Nowadays CSCL is a key trend in elearning since it highlights the importance of social interactions as an essential element of learning. CSCL is an interdisciplinary domain, which demands participatory design techniques that allow teachers to get directly involved in design activities. Developing CSCL designs using LD is a difficult task for teachers since LD is a complex technical specification and modelling collaborative characteristics can be tricky. Collage helps teachers in the process of creating their own potentially effective collaborative Learning Designs by reusing and customizing patterns, according to the requirements of a particular learning situation. These patterns, called Collaborative Learning Flow Patterns (CLFPs), represent best practices that are repetitively used by practitioners when structuring the flow of (collaborative) learning activities. An example of an LD that can be created using Collage is illustrated in the paper. Preliminary evaluation results show that teachers, with experience in CL but without LD knowledge, can successfully design real collaborative learning experiences using Collage.

The identification and integration of reusable and customizable CSCL (Computer Supported Collaborative Learning) may benefit from the capture of best practices in collaborative learning structuring. The authors have proposed CLFPs (Collaborative Learning Flow Patterns) as a way of collecting these best practices. To facilitate the process of CLFPs by software systems, the paper proposes to specify these patterns using IMS Learning Design (IMS-LD). Thus, teachers without technical knowledge can particularize and integrate CSCL tools. Nevertheless, the support of IMS-LD for describing collaborative learning activities has some deficiencies: the collaborative tools that can be defined in these activities are limited. Thus, this paper proposes and discusses an extension to IMS-LD that enables to specify several characteristics of the use of tools that mediate collaboration. In order to obtain a Unit of Learning based on a CLFP, a three stage process is also proposed. A CLFP-based Unit of Learning example is used to illustrate the process and the need of the proposed extension.

Organizations across the globe are creating and distributing products that include open source software. To ensure compliance with the open source licenses, each company needs to evaluate exactly what open source licenses and copyrights are included - resulting in duplicated effort and redundancy. This talk will provide an overview of a new Software Package Data Exchange (SPDX) specification. This specification will provide a common format to share information about the open source licenses and copyrights that are included in any software package, with the goal of saving time and improving data accuracy. This talk will review the progress of the initiative; discuss the benefits to organizations using open source and share information on how you can contribute.

A partir de una propuesta metodológica del tipo estudio de caso, un equipo de profesores de la Universidad de Lleida ha creado un espacio de colaboración común mediante un wiki en el marco de un proyecto de innovación docente. Se detalla la manera en la que el wiki se ha ajustado a las necesidades de los usuarios y se exponen tanto el proceso de consenso sobre la arquitectura de la información, como los aspectos técnicos. También se incluyen cuestiones como la protección de los derechos de autor de los materiales generados en este proyecto y publicados en el Wiki. Finalmente se señalan las nuevas líneas en las que se continuará trabajando.

Diplomityö kartoittaa yleisesti tietoturvaohjelmistokehityksessä huomioitavia immateriaalioikeudellisia näkökohtia ja selvittää yksityiskohtaisemmin niiden soveltamista ja vaikutusta erään tietoturvakomponentin suunnittelussa ja toteutuksessa Soneran TradeXpress-ohjelmistoon. Kyseinen komponentti mahdollistaa muun muassa autentikaation ja salauksen käytön sähköisessä tiedonsiirrossa. Työ käsittää myös perustiedot tietoturvasta ja TradeXpress-ohjelmistosta, jotta komponentin kehitystä käsittelevän osuuden ymmärtäminen olisi helpompaa. Immateriaalioikeutta käsitellään vain niiltä osin, joilla on vaikutusta tietokoneohjelmiin ja ohjelmistotuotantoon. Näitä ovat muun muassa tekijänoikeus, patenttioikeus ja tavaramerkkioikeus. Diplomityön tuloksena syntyi selvitys immateriaalioikeudesta ja sen vaikutuksesta ohjelmistotuotantoprosesseihin.

Peer-to-Peer (P2P) technology has revolutionized file exchange activities besides enhancing processing power distribution. As such, this technology which is nowadays made freely available to all internet users also imposes a threat as it enables the illegal distribution of copyrighted digital work. P2P technology continuously evolves in a greater pace than copyright legislation, leading to compatibility gaps between the applicability of copyright law and the illicit file sharing and downloading. Such issues give high incentives to consumers to practise piracy using P2P systems with a low perception of risk towards prosecution, leading to substantial losses for copyright owners. This study focuses on developing insights for content owners on consumer behaviour towards piracy in Finland, where quantitative analyses are assessed using a data set based on a survey conducted by the Helsinki Institute for IT. The research approach investigates the significance of three fundamental areas in relation to evaluate consumer behaviour as: environmental-related factors, innovation-related factors and consumer-related. each of these are integrates concepts derived in previous theoretical models such as the technology acceptance model, theory of reasoned action, theory of planned behaviour, the issue-risk-judgement model and the Hunt & Vitell’s model.

This thesis regards exhaustion of copyright’s distribution right in intangible transfers of video games. It analyses whether, under the current law of the European Union, the phenomenon of digital exhaustion, especially in relation to games exists. The thesis analyses the consumers’ position in the market for copyright protected goods. It uses video games market as an example of the wider phenomenon of the effect of latest technological developments on consumers. The research conducted for the thesis is mostly legal dogmatic, although also comparative analysis, law and economics and law and technology methods are utilised. The thesis evaluates the effects of the most recent case law of the European Court of Justice to analyse the current state of digital exhaustion. In the analysis of effects that the existence of digital exhaustion has, the thesis uses the consumers’ point of view. The thesis introduces the current state of technology in the field of video games from a legal perspective. Furthermore the thesis analyses the effects on consumers of a scenario that no digital exhaustion exists in the future. Such scenario under the recent European case law at the moment seems realistic. The conclusion of my research is most importantly that the consumer position in the market for digital goods has deteriorated and that the probable exclusion of the exhaustion for digital goods is another piece of evidence of this development. Most importantly however, the state of affairs where no certainty prevails on whether digital exhaustion exists, creates injustice from the consumers’ point of view. Accordingly, acts by EU legislators of the Court of Justice of the European Union are required to clarify the issue.

Chaque apparition d’une nouvelle technologie remet inévitablement en cause le cadre législatif établi pour protéger les droits de propriété. Cependant, avec la numérisation de l’information et l’avènement d’Internet, il est de plus en plus facile de reproduire et de distribuer librement des œuvres protégées. Toutefois, depuis le 20 décembre 1996, l’Organisation Mondiale de la Propriété Intellectuelle (OMPI) a adopté deux traités ayant pour objectif principal d’adapter le cadre juridique du droit d’auteur aux nouvelles technologies. C’est pour se conformer à ces traités que l’administration Clinton a adopté le Digital Millenium Copyright Act (DMCA) en 1998. Cet article examine d’abord les dimensions constitutionnelle du Copyright américain, et plus spécifiquement certaines limites qui viennent tempérer les prérogatives exclusives des titulaires de droits, notamment le domaine public et les usages équitables possibles d’ une œuvre. Sont ensuite examinés le DMCA et sa conformité aux principes énoncés à la clause constitutionnelle, source du pouvoir législatif du Congrès américain en matière de Copyright. De plus, comme le DMCA interdit non seulement le contournement de technologies protégeant une œuvre en format numérique, mais également la fabrication et la diffusion de technologies permettant d’arriver à cette fin, cet article analyse les répercussions de cette loi sur la liberté d’expression.
