Proposing a 'Consent Commons' in open education - balancing the desire for openness with the rights of people to refuse or withdraw from participation

A new 'Consent Commons' licensing framework is proposed, complementing Creative Commons, to clarify the permissions given for using and reusing clinical and non-clinical digital recordings of people (patients and non-patients) for educational purposes. Consent Commons is a sophisticated expression of ethically based 'digital professionalism', which recognises the rights of patients, carers, their families, teachers, clinicians, students and members of the public to have some say in how their digital recordings are used (including refusing or withdrawing their consent), and is necessary in order to ensure the long term sustainability of teaching materials, including Open Educational Resources (OER). Consent Commons can ameliorate uncertainty about the status of educational resources depicting people, and protect institutions from legal risk by developing robust and sophisticated policies and promoting best practice in managing their information.

Opening Education Beyond the Property Relation: From Commons to Communism

Open Education, and specifically the OER movement, seeks to provide universal access to knowledge, undermining the historical enclosure and the increasing privatisation of the public education system. In this paper we examine this aspiration by submitting the implicit theoretical assumptions of Open Education to the test of critical political economy. We acknowledge the Open Education movement's revolutionary potential but outline the inherent limitations of its current focus on the commons (property relations) rather than the social relations of capitalist production (wage work, the company) and because of this, argue that it will only achieve limited, rather than revolutionary, impact.

Después de leer el artículo "El sistema de las Creative Commons" de Marco Marandola1, me gustaría presentar de manera más completa el proyecto de las licencias de Creative commons. Actualmente las palabras copyleft, copyright, open access, creative commons, procomún, se utilizan mucho pero a veces se mezclan conceptos y se informa de manera errónea. Agradezco a los editores la posibilidad de escribir esta nota que personalmente considero de rectificación.

Discours économique et évolution institutionnelle, les apports de J. R. Commons

John Roger Commons est, de manière quasi systématique, considéré comme l'un des pères fondateurs de l'ancien institutionnalisme américain. On souligne tout aussi couramment l'influence que la philosophie pragmatiste a pu avoir sur ses travaux, du moins en ce qui concerne son ouvrage de 1934. Plus rares sont les commentateurs soulignant le rôle qu'a le langage, a fortiori le langage de l'économiste, dans l'analyse qu'il fait de l'évolution institutionnelle. Notre but sera de souligner ce fait : pour Commons, dire c'est faire, dans la lignée de la linguistique performativiste, dire c'est agir sur l'évolution institutionnelle. Abstract : John Roger Commons is well known as one of the founders of old institutionnalism. It is current to emphazise his philosophical roots : the american pragmatism, at least in his masterpiece of 1934. On the other hand, it is less frequent to point out the important role that the langage, and a fortiori economics' langage, has in his understanding of institutional evolution. Our aim will be to spotlight this point : for Commons, we can do things with words, on the way of performativist linguistic, when we use words, we influence institutional evolution.

Les llicències de Creative Commons a l'Estat espanyol

[eng] The Creative Commons project in Spain has its beginnings in early 2003, but until one year ago it was not possible to access licenses adapted to Spanish legislation on intellectual property. In addition to this effort of adaptation, other activities have been carried out -centred especially on the dissemination and explanation of the licensing system- and the level of acceptance has been quite positive. This article covers the history of the project and provides an explanation of the licenses and a description of some of the initiatives that this legal system is carrying out.

Las licencias Creative Commons en el Estado Español

L'aparició d'aquesta nova eina legal ha obert un debat sobre els models de difusió de qualsevol contingut i, en definitiva, del coneixement que ha obligat a replantejaments no tan sols entre els autors i els creadors sinó també entre institucions i administracions. En aquest llibre es presenta el model que proposa Creative Commons per facilitar la difusió i l'accés als continguts de qualsevol persona, tot respectant-ne els drets d'autor.

Aplicación de las licencias de Creative Commons en el ámbito educativo

En este texto se presentan las licencias que ofrece la organización Creative Commons para gestionar los derechos de propiedad intelectual de una manera distinta al tradicional “todos los derechos reservados”. Estas licencias inspiradas en el movimientodel software libre se ofrecen gratuitamente para todos aquellos autores que quieran compartir sus obras permitiendo determinados usos con algunas condiciones sin tener que pedir permiso previo. Además se hace un repaso a la aplicación de estas licencias en el ámbito educativo mostrando ejemplos y analizando su uso con respecto al tipo de proyecto y el tipo de licencias.

In the past f ew years numerous authors have examined how the current economic crisis in Spain has dif f erential impacts on women and men.1 While this is important to show, this article’s goal is to make the leap f rom a mere description of the gendered effects of the crisis, to an analysis of some of the very gendered processes that shape it at its core. In other words, the intent is to understand how both the crisis itself and the ways the state manages it are structurally shaped by gender.
