Aplicação do princípio da igualdade na legislação experimental em Portugal

The experimental legislation follows the development of legislative evaluation practices. Being a legislative technique used not only with the aim of gathering political and social consensus, but also, especially in controversial matters, to provide data and information that will serve as basis for a clarified and justified legislative decision. The characteristic features of the experimental laws are its limited application in time and/or in territory and the prediction, in the law itself, of an evaluation after the experimental period. The application of an experimental law just in a specific geographic area raises constitutional issues because of the implications of the principle of equality. Indeed, the principle of equality, despite admitting some treatment differences between people, commands that these differences have to be legitimate, reasonable and proportional, namely, not arbitrary. Besides the constitutionality problem for the violation of the principle of equality, the experimental laws may also consist of laws restricting fundamental rights and be the cause of the liability of the State, within its legislative function.

A experiência da Rede Maniva de Agroecologia do Amazonas (Rema) em transformar os laboriosos procedimentos estabelecidos pela legislação brasileira de orgânicos em mobilização social promotora da agroecológica.

Agricultores agroecológicos são penalizados pela legislação ao terem que comprovar a conformidade da qualidade orgânica de seus produtos para comercialização. Essa imposição é necessária para a garantia do consumidor, mas injusta em relação à impunidade daqueles que produzem com insumos químicos e agrotóxicos. Agricultores da Associação de Produtores Orgânicos do Amazonas (APOAM), técnicos e consumidores se organizaram como Rede Maniva de Agroecologia (Rema) para fortalecer o Controle Social da produção orgânica para venda direta e constituir um Sistema Participativo de Garantia para a ampliação de mercado por meio da certificação participativa, validada pelo Organismo Participativo de Avaliação da Conformidade Orgânica (OPAC Maniva). Tais mecanismos de garantia, mais que processos a serem cumpridos, foram utilizados pela Rema para fortalecer a construção coletiva de conhecimentos; criar estratégias de otimização da produção e comercialização e integrar agricultores, técnicos e consumidores.

Análise dos efeitos da legislação urbanística na formação e crescimento do Bairro de Lagoa Nova: planos diretores de 1974, 1984 e 1994

LEGISLAÇÃO AMBIENTAL BRASILEIRA E OS IMPACTOS SOCIOAMBIENTAIS DOS GRANDES EMPREENDIMENTOS TURÍSTICOS EM FLORIANÓPOLIS

Este trabalho analisa a dinâmica geográfica e econômica instaurada no processo de apropriação de capital e domínio do espaço, efetivada por parte dos grandes empreendimentos turísticos de Florianópolis, utilizando o caso do Condomínio Residencial Costão Golf como objeto de estudo. Também é destacada a participação comunitária no caso Il Campanário Villaggio Resort e no caso Porto da Barra. São identificados os Princípios do Direito Ambiental, a Legislação Ambiental do Brasil, as fases de urbanização em Florianópolis, o surgimento dos grandes empreendimentos turísticos na capital catarinense, e suas relações com as comunidades locais onde atuam. Ao final, são analisadas as relações dos grandes empreendimentos turísticos de Florianópolis com o Poder Público, que afrontam os Princípios do Direito Ambiental e a Legislação Ambiental do Brasil, possibilitando impactos socioambientais como a contaminação do Aqüífero Ingleses com o manejo do gramado de um campo de golfe.

Legislação sobre violência contra o idoso e serviços de saúde

Este objeto inicia mostrando com um gráfico que a população idosa foi a que mais cresceu no Brasil nos últimos 40 anos. Comenta sobre os direitos dos idosos garantidos por várias políticas e estatutos, mas lembra que embora os idosos estejam amparados legalmente, a violência que os atinge é a negação dos direitos de cidadania conquistados por eles. Segue detalhando o que a Organização Mundial de Saúde entende por maus-tratos e negligência e como surgiram serviços voltados para este fenômeno no Brasil, como as casas de abrigo, os centros de referência multiprofissionais e as instituições próprias para denúncias das violências aos idosos. Mostra ainda como vários dispositivos governamentais possuem objetivos comuns visando resolver esta situação. Conclui mostrando detalhes para a identificação de situações de maus-tratos ao idoso. Unidade 3 do módulo 11 que compõe o Curso de Especialização em Saúde da Família.

Gases e ruídos em edificações para suínos: aplicação das normas NR-15, CIGR e ACGIH

Swine production represents an important segment of Brazilian economy, and the possibility of increasing production is eminent mainly if considered the low pork consumption when compared to other meat and the consumption of other countries. The increasing need in the international market demands show that in a near future the commercial barriers will be based on welfare, in the protection of the environment as well as in the worker's legislation. Little knowledge is available in the subject of worker's standards in the environmental agents in rural activities as well as the air quality under Brazilian conditions. The objectives of this research were to apply the main used standards related to noise and gases and to estimate occupational risk using measurements of noise level, hydrogen sulfide, methane and oxygen in swine housing, in piglet's nursery and finishing. The results showed that the continuous noise level were below the one found in the standards, however there were observed differences (P < 0.05) in relation to the noise level measured in piglet's nursing cages and in semi-slatted floor. The respective concentrations of hydrogen sulfide and methane were less than 1 ppm and less than 0,1% by volume, which was lower than the recommended limits in NR-15, CIGR and ACGIH. The oxygen level was 21% in average.

Qualidade da classificação do tomate de mesa em unidades de beneficiamento

Quality evaluation of classification was done in two fresh market tomatoes packing house, using electronically and mechanical equipments in two harvest periods, summer and winter seasons. The main goal of this work was to evaluate size and color grading conformity with the standards proposed by the Brazilian Program for Horticulture Modernization and size grading obtainded with the one established by the packer. The cultivar studied was Carmen. The results showed that there was no grade conformity with the fresh tomato quality standards proposed by the Brazilian Program for Horticulture Modernization. The grade conformity obtained when compared with the one programmed by the packer, was only for large sizes, in both equipments. The electronically equipment has presented better performance, over the mechanical, considering grading quality and fruits post-harvest quality. However, the electronically equipment must be constantly monitored to achieve efficiency and investment return. On the other side, for mechanical equipment it will be necessary to review the actual system of size grading, in order to follow the fresh tomato quality standards.

Determinação de substitutos da manteiga de cacau em coberturas de chocolate através da análise de triacilgliceróis

Brazilian regulations prohibit the addition of cocoa butter replacements to chocolate, in total or partial substitution. The objective of the present work was to check the quality standards of four of coating bitter Brasilian chocolate bars and five of coating milk chocolate bars, commercialized in Campinas. In order to check the possible addition of substitutes, the triacylglycerol composition was determined, and the results were analysed by Padley & Timms mathematical method. The triacylglycerol composition of each sample was determined by high temperature gas chromatography (HTGC). The presence of cocoa butter replacements was not detected in the brands of coating chocolate.

Levotiroxina e o problema da permutabilidade de drogas de estreito intervalo terapêutico

The exchange of a prescribed drug by other similar, by generic products and even by custom products has become common practice in our country, often ignoring basic tenets of bioequivalence, interchangeability, stability and characteristics of the pharmaceutical compounds. In the case of drugs of narrow therapeutic index, such as levothyroxine, these problems are intensified, putting the effectiveness of treatment and patient health at serious risk. We review the pertinent legislation, emphasizing the characteristics of levothyroxine and adverse effects that limit the interchangeability of the compound.
