A regularização fundiária urbana de interesse social só pode ser compreendida juridicamente se considerar-se que, além da legalização da posse ou da propriedade do bem imóvel, ela abrange obrigatoriamente uma série de intervenções urbanísticas fundamentais. Outra premissa necessária ao estudo jurídico é que esta espécie de operação urbana não pode ser compreendida isoladamente, enquanto uma instituição particular, pois ela pressupõe a definição das condições por meio das quais o planejamento urbano e o planejamento habitacional se determinam reciprocamente, favorecendo a concretização de direitos fundamentais. Três valores-base devem inspirar o desenvolvimento desta correlação entre as políticas urbanísticas e as habitacionais, são eles: a moradia como direito fundamental complexo ligado à ideia mais ampla de direito à cidade, a propriedade como direito protegido juridicamente apenas quando observado o princípio da função social da propriedade e a justa distribuição das mais-valias urbanas como princípio reitor da intervenção dos poderes públicos nos espaços urbanos para efetivar uma distribuição mais isonômica do espaço. Com base no contexto normativo brasileiro e a realidade institucional concreta dos Municípios e tendo em vista a experiência francesa a respeito das políticas urbanas e habitacionais, é possível pensar um quadro legal e regimes jurídicos adequados à realização mais eficaz das operações urbanas de regularização fundiária.

As biometrias vêm sendo utilizadas como solução de controle de acesso a diversos sistemas há anos, mas o simples uso da biometria não pode ser considerado como solução final e perfeita. Muitos riscos existem e não devem ser ignorados. A maioria dos problemas está relacionada ao caminho de transmissão entre o local onde os usuários requerem seus acessos e os servidores onde são guardados os dados biométricos capturados em seu cadastro. Vários tipos de ataques podem ser efetuados por impostores que desejam usar o sistema indevidamente. Além dos aspectos técnicos, existe o aspecto social. É crescente a preocupação do usuário tanto com o armazenamento quanto o uso indevido de suas biometrias, pois é um identificador único e, por ser invariável no tempo, pode ser perdido para sempre caso seja comprometido. O fato de que várias empresas com seus diferentes servidores guardarem as biometrias está causando incomodo aos usuários, pois as torna mais suscetíveis à ataques. Nesta dissertação, o uso de cartões inteligentes é adotado como possível solução para os problemas supracitados. Os cartões inteligentes preparados para multi-aplicações são usados para realizar as comparações biométricas internamente. Dessa forma, não seria mais necessário utilizar diversos servidores, pois as características biométricas estarão sempre em um único cartão em posse do dono. Foram desenvolvidas e implementadas três diferentes algoritmos de identificação biométrica utilizando diferentes características: impressão digital, impressão da palma da mão e íris. Considerando a memória utilizada, tempo médio de execução e acurácia, a biometria da impressão da palma da mão obteve os melhores resultados, alcançando taxas de erro mínimas e tempos de execução inferiores a meio segundo.

This study was carried out to identify factors that influence choice of fishing location and carry out profitability analysis of Chilimira and Gillnet in different fishing locations. A survey using semi-structured questionnaire was administered to 99 Gillnet and 101 Chilimira fishers in Nankumba Peninsula in Mangochi District. The logit model was used to determine the factors influencing choice of fishing location among the fishers. The study showed that 92.1% of Chilimira fishers are operating in offshore areas while 69.7% Gillnet fishers are operating in inshore areas. Chilimira offshore fishers have higher daily average gross margins than their inshore counterparts and Gillnet fishers. However, they incurred more operating costs than the inshore Chilimira and Gillnet fishers. Furthermore, they find their fishing occupation more rewarding as evidenced by the higher returns to labour. The factors that influenced fisher’s choice of fishing location were Age of the fisher, type of fishing vessel and gear, possession of motor sail engine and access to information about previous day’s catch rates. Finally the study concluded that artisanal fishers in Malawi use different criteria in deciding where to fish. The criterion involves a complex interaction of biological, technological, personal and economical factors and time. However, the resource constrained artisanal fisher will need support to enable him exploit offshore fishery resources. Consequently the study recommends that appropriate fishery development interventions by the government and other stakeholders must adapt to the economics and lifestyles driving the artisanal fishers to fish in particular locations and therefore, build on this foundation to improve the existing fishing technologies.

O presente estudo procura estabelecer critérios para orientar as decisões sobre conflitos surgidos entre os verdadeiros proprietários de imóveis e terceiros de boa-fé. A partir da evolução do conceito de propriedade, do individualismo liberal da era moderna ao feixe de direitos, deveres e poderes jurídicos de uma relação jurídica complexa nos dias atuais, destaca-se a importância do registro de imóveis e da publicidade que lhe é inerente para a segurança das transações imobiliárias e a proteção de interesses individuais e coletivos. Considerando a prevalência dos valores existenciais sobre os patrimoniais e tendo por referência o princípio supremo da dignidade da pessoa humana, são sugeridos, como critérios de ponderação, a posse e a função social da propriedade, a boa-fé, a usucapião e a teoria da aparência. Examina-se, assim, a possibilidade de flexibilizar a norma que faculta ao proprietário o direito de reivindicar o imóvel independentemente da boa-fé do terceiro adquirente, se o registro for cancelado, discutindo-se ainda as soluções encontradas pela doutrina e pela jurisprudência para o problema proposto.

A presente tese apresenta a usucapião superficiária de bens públicos como uma alternativa para assegurar o direito fundamental à moradia em áreas de exclusão social. Para chegar a tal desiderato, encontra-se supedâneo jurídico-normativo na função social da propriedade, especialmente no tocante à sua observância em terras públicas. Utiliza-se, ainda como suporte teórico à tese, a noção contemporânea de que a propriedade hodierna é um instituto plural, complexo, tomando emprestadas as ideias de Salvatore Pugliatti. Além disso, diante dos contornos atuais do Direito Civil-Constitucional, também é importante como lastro a análise da posse com função social, que em muitos casos pode até ser priorizada no confronto com o direito de propriedade meramente formal. Na construção da tese, foram utilizadas duas premissas. A primeira apoia-se na possibilidade do reconhecimento da posse em bens públicos, fundamentando-se especificamente nos regimes legais que a admitem, como a Lei 11.977/2009, por exemplo. Já a segunda se consubstancia na interpretação de que a vedação constitucional à usucapião de bens públicos não é absoluta, obstando apenas a aquisição da propriedade plena destes bens por particulares. A partir destes fundamentos são analisados os requisitos e as consequências do modelo de usucapião superficiária de imóveis públicos para fins de moradia, com ênfase particular quanto ao animus da posse. Conclui-se, ao final, que essa nova modalidade aquisitiva da propriedade superficiária pode ser um importante instrumento para a regularização fundiária em áreas de exclusão social, conferindo segurança jurídica aos moradores e transformando em ativo um amplo estoque fundiário que hodiernamente se apresenta como capital morto, conforme defende Hernando de Soto.

De inegável relevância na vida humana, a posse se configura como um dos temas mais controvertidos no âmbito do Direito Civil. Em todos os seus contornos e características, incluindo sua natureza jurídica, terminologia, efeitos e classificações, observamos um debate acirrado e polêmico a seu respeito, o que demonstra o firme interesse dos estudiosos sobre a possessio através dos séculos. Ademais, compete ao aplicador do Direito compreender o fenômeno possessório a partir das premissas e valores constitucionais fundamentais, em especial o princípio da dignidade da pessoa humana, levando em consideração as mutações sociais e a realidade dos fatos, para que seja possível extrair do ordenamento caminhos efetivos à concretização de uma sociedade justa e solidária, a fim de erradicar a pobreza e diminuir as desigualdades sociais. Neste contexto, de forma prospectiva e adequando os conceitos civilistas à Carta da República, defendemos a aplicação do artigo 1276 do Código Civil também em benefício do ocupante qualificado de imóvel abandonado, de modo a consolidar o domínio em seu favor no mesmo triênio conferido à Administração Pública, garantindo-se então aos menos favorecidos o legítimo acesso à moradia e ao trabalho. Na medida em que o ser humano se constitui no foco de atenção, preocupação e proteção do ordenamento jurídico acreditamos que as exegeses normativas devem concretizar o disposto no artigo 1, inciso III, da Constituição da República, razão pela qual a posse de outrem exercida ininterruptamente sobre bem abandonado merece funcionar como forma de aquisição originária da propriedade imóvel privada no lapso de tempo estatuído no artigo 1276 do Código Civil.

Este trabalho tem por finalidade apresentar um estudo sobre as contribuições do serviço de registro imobiliário, com destaque em procedimentos de regularização fundiária de imóveis urbanos. Não raras vezes, empreendedores, administradores públicos, juízes, sociedade deparam-se com situações em que há a necessidade de titulação da terra como mecanismo de formalização da propriedade, oportunidade em que são exigidos os requisitos estabelecidos na legislação de regência. A adoção em caráter estrito das regras estabelecidas, em contraposição às peculiaridades e ao desregramento de assentamentos informais, importaria em eterna manutenção dos mesmos à margem da lei. Há, assim, de se criar mecanismos de consenso e soluções de compromisso, em que poder público, registrador imobiliário, operadores do direito e a própria comunidade envolvam-se no sentido de colmatar uma solução intermediária. Solução esta que, sem perder a necessária segurança jurídica dos registros públicos, possibilite a adoção de mecanismos que facilitem o acesso dos ocupantes à titulação da terra em que vivem. O título de propriedade representa mais do que mero papel. Traduz o poder de direito sobre determinado terreno, alçando-o da condição de um capital morto para elemento ativo em um mercado cada dia mais globalizado. Nesta esteira, arregimenta economicamente não apenas a população diretamente envolvida, quanto também possibilita, através da inserção dos imóveis regularizados no mercado, um aproveitamento e um incremento econômico catalisador de transformações econômico-sociais. Novos direitos, novos bens em garantia, novas condições de crédito, renovada segurança jurídica, enfim, novas oportunidades são desdobradas aos detentores, que agora podem investir sem o receio da precariedade decorrente de mera situação de posse. Estuda-se, assim, neste trabalho a importante atuação do registrador imobiliário e as vantagens decorrentes do processo de regularização fundiária, como um processo a ser estimulado e incrementado, concretizador de cidadania e efetivador dos direitos fundamentais de propriedade (art 5 CF/88) e de moradia (art. 6 da CF/88).

Enchytraeid surveys were made in China, mainly along the Changjiang (Yangtze) River Basin, during the period 1991-1999. Among the findings, four terrestrial species of Marionina are new to science and well illustrate the taxonomic complexity of the genus as currently defined. Marionina sinica sp. n. is characterized by a specific chaetal distribution, the marionine pattern of the dorsal blood vessel, and elongate, fusiform, spermathecal ectal ducts. Marionina sacculata sp. n. is distinguished by the possession of a pair of pouch-like oesophageal appendages in IV, the lack of lateral chaetae in VII-XI, a marionine pattern of the dorsal blood vessel, and short spermathecal ectal ducts gradually expanding into spherical ampullae. Both M. sinica and M. sacculata have minute bodies (2-3 mm long in vivo) and lack spermathecal accessory glands. The former species shows its closest aYnities with the European M. brendae Rota, 1995, whereas the latter is closest to the German M. hoVbaueri Moller, 1971, for which an amended diagnosis is provided. Marionina seminuda sp. n. has only ventral chaetal bundles, distributed from III onwards and bisetose. It is similar to the Holarctic M. subterranea (Knollner, 1935) in lacking entirely the lateral chaetae and in having the brain incised posteriorly, the dorsal vessel bifurcating behind the pharynx, and coelomocytes containing opaque granules, but diVers from it in having the longest chaetae in preclitellar segments and gland cells distributed all over the spermathecal ectal ducts. Marionina righiana sp. n. is diagnosed by the location of the head pore on the prostomium, the absence of lateral chaetae from VIII ( VII or IX) onwards, the possession of free spermathecae extending backwards through one to four segments, the brain deeply incised posteriorly, the lumbricilline pattern of the dorsal blood vessel, and the opacity of coelomocytes in vivo. Prior to this study, members of the genus so atypical as M. righiana with respect to the position of the head pore and the structure of the spermathecae were known only from South American soils. Until the taxonomy of Marionina has been more thoroughly assessed and revised, the assignment of the four species to this large assemblage should be regarded as tentative.

笔者对汉台区粮食生产的现状、粮食消费与需求进行分析,研究结果表明:汉台区人均粮食为229kg,远低于全国人均粮食380kg拥有量的水平。粮作比、粮食总产量和人均粮食产量总体上呈现下降的趋势;汉台区近30年粮食缺口较大,粮食自给率低,粮食供给难以满足当地粮食需求;按90%自给率计算,要实现2010年小康的总产目标,必须保证34575hm2种植面积。

Background and Aims Rheum, a highly diversified genus with about 60 species, is mainly confined to the mountainous and desert regions of the Qinghai-Tibetan plateau and adjacent areas. This genus represents a good example of the extensive diversification of the temperate genera in the Qinghai-Tibetan plateau, in which the forces to drive diversification remain unknown. To date, the infrageneric classification of Rheum has been mainly based on morphological characters. However, it may have been subject to convergent evolution under habitat pressure, and the systematic position of some sections are unclear, especially Sect. Globulosa, which has globular inflorescences, and Sect. Nobilia, which has semi-translucent bracts. Recent palynological research has found substantial contradictions between exine patterns and the current classification of Rheum. Two specific objectives of this research were (1) to evaluate possible relationships of some ambiguous sections with a unique morphology, and (2) to examine possible occurrence of the radiative speciation with low genetic divergence across the total genus and the correlation between the extensive diversification time of Rheum and past geographical events, especially the recent large-scale uplifts of the Qinghai-Tibetan Plateau.Methods The chloroplast DNA trnL-F region of 29 individuals representing 26 species of Rheum, belonging to seven out of eight sections, was sequenced and compared. The phylogenetic relationships were further constructed based on the sequences obtained.Key Results Despite the highly diversified morphology, the genetic variation in this DNA fragment is relatively low. The molecular phylogeny is highly inconsistent with gross morphology, pollen exine patterns and traditional classifications, except for identifying all samples of Sect. Palmata, three species of Sect. Spiciformia and a few species of Sect. Rheum as corresponding monophyletic groups. The monotypic Sect. Globulosa showed a tentative position within the clade comprising five species of Sect. Rheum. All of the analyses revealed the paraphyly of R. nobile and R. alexandrae, the only two species of Sect. Nobilia circumscribed by the possession of large bracts. The crude calibration of lineages based on trnL-F sequence differentiation implied an extensive diversification of Rheum within approx. 7 million years.Conclusions Based on these results, it is suggested that the rich geological and ecological diversity caused by the recent large-scale uplifts of the Qinghai-Tibetan Plateau since the late Tertiary, coupled with the oscillating climate of the Quaternary stage, might have promoted rapid speciation in small and isolated populations, as well as allowing the fixation of unique or rare morphological characters in Rheum. Such a rapid radiation, combined with introgressive hybridization and reticulate evolution, may have caused the transfer of cpDNA haplotypes between morphologically dissimilar species, and might account for the inconsistency between morphological classification and molecular phylogeny reported here.

In this paper, taking Madong district of Huanghua depression as a case, based on the theory of sequence stratigraphy, sedimentology, reservoir geology and geophysics, according to core analysis, seismic attribute analysis, logging constrained inversion, multi-data correlation of strata, reservoir modeling, etc. the lower and middle first member of Shahejie formation of the study area was forecasted and evaluated. As a result, a number of reservoir prediction and remaining oil distribution methods suitable to oil exploitation of gravity flow channel reservoir are presented. Scientific foundation is provided to the next adjustment of development program and exploitation of the remaining oil. According to high resolution sequence stratigraphy theory, precise stratigraphic framework was founded, the facies types and facies distribution were studied under the control of stratigraphic framework, the technologies of seismic attribute abstraction and logging constrained inversion. Result shows that gravity flow channel, as the main facies, developed in the rising period of base-level cycle, and it was formed during the phase of contemporaneous fault growth. As the channel extends, channel width was gradually widened but thickness thined. The single channels were in possession of a great variety of integrated modes, such as isolated, branching off, merging and paralleling, forming a kind of sand-mud interblending complex sedimentary units. Reservoir quality differs greatly in vertical and horizontal direction, and sedimentary microfacies is main controlling factor of the reservoir quality. In major channel, deposition thickness is great, and petrophysical property is well. While in marginal channel, reservoir is thinner, and petrophysical property is unfavorable. Structure and reservoir quality are main factors which control the oil and gas distribution in the study area. On the basis of the research about the reservoir quality, internal, planar and 3-D reservoir heterogeneities are characterized, and the reservoir quality was sorted rationally. At last, based on the research of reservoir numerical simulation of key well group, combined with reservoir performance analysis and geological analysis above, remaining oil distribution patterns controlled by internal rhythm of gravity flow channel were set up. Through this research, a facies-restrained reservoir prediction method integrating multi-information was presented, and potential orientation of remaining oil distribution in gravity flow channel reservoir is clarified.

Rock mass is widely recognized as a kind of geologic body which consists of rock blocks and discontinuities. The deformation and failure of rock mass is not only determined by rock block,but also by discontinuity which is virtually more important. Mutual cutting and combination of discontinuities controlled mechanical property of rock mass. The complex cutting of discontinuities determine the intense anisotropy on mechanical property of rock mass,especially under the effect of ground stress. Engineering practice has show that the brittle failure of hard rock always occurs when its working stress is far lower than the yield strength and compressive strength,the failure always directly related to the fracture propagation of discontinuities. Fracture propagation of discontinuities is the virtue of hard rock’s failure. We can research the rock mass discontinuous mechanical properties precisely by the methods of statistical analysis of discontinuities and Fracture Mechanics. According to Superposition Principle in Fracture Mechanics,A Problem or C Problem could be chosen to research. Problem A mainly calculates the crack-tip stress field and displacement field on internal discontinuities by numerical method. Problem C calculate the crack-tip stress field and displacement field under the assumption of that the mainly rock mass stress field has been known. So the Problem C avoid the complex mutual interference of stress fields of discontinuities,which is called crack system problem in Fracture Mechanics. To solve Problem C, field test on stress field in the rock mass is needed. The linear Superposition of discontinuities strain energies are Scientific and Rational. The difference of Fracture Mechanics between rock mass and other materials can mostly expression as:other materials Fracture Mechanics mostly face the problem A,and can’t avoid multi-crack puzzle, while the Rock mass Fracture Mechanics answer to the Problem C. Problem C can avoid multi-discontinuities mutual interference puzzle via the ground stress test. On the basis of Problem C, Fracture Mechanics could be used conveniently in rock mass. The rock mass statistics fracture constitutive relations, which introduced in this article, are based on the Problem C and the Discontinuity Strain Energy linear superposition. This constitutive relation has several merits: first, it is physical constitutive relation rather than empirical; second, it is very fit to describe the rock mass anisotropy properties; third, it elaborates the exogenous factors such as ground stress. The rock mass statistics fracture constitutive relation is the available approach to answer to the physical, anisotropic and ground stress impacted rock mass problems. This article stand on the foundation of predecessor’s statistics fractures constitutive relation, and improved the discontinuity distributive function. This article had derived the limitation of negative exponential distribution in the course of regression analysis, and advocated to using the two parameter negative exponential distribution for instead. In order to solve the problems of two-dimension stability on engineering key cross-sectional view in rock mass, this article derived the rock mass planar flexibility tensor, and established rock mass two-dimension penetrate statistics fracture constitutive relation on the basis of penetrate fracture mechanics. Based on the crack tip plasticity research production of penetrate fracture, for example the Irwin plasticity equifinality crack, this article established the way to deal with the discontinuity stress singularity and plastic yielding problem at discontinuity tip. The research on deformation parameters is always the high light region of rock mass mechanics field. Different monolith were adopted the penetrate fracture statistics constitutive relation or bury fracture statistics constitutive relation selectively. Statistics fracture constitutive relation is fit for the intensity anisotropy and heterogeneity rock mass of Xiao Wan hydroelectric power station dam foundation. This article had contrastive analysis the statistics fracture constitutive relation result with the inclined plane load test actual measurement elastic modulus and RMR method estimated elastic modulus, and find that the three methods elastic modulus have got greatly comparability. So, the statistics fracture constitutive relations are qualified for trust. According to epistemic theory of meaning the meaning is not understanding-transcendent – understanding is a kind of knowledge and the meaning is the content of this knowledge. The main problem of such a theory is to provide an adequate characteristic of the notion of knowledge. Dummett claims that understanding cannot be reduced neither to purely practical abilities, nor to explicit theoretical knowledge. In his opinion the most important part of the knowledge that constitutes understanding is a kind of implicit knowledge, something halfway between practical ability and theoretical knowledge. Unfortunately is not so simple to provide sufficiently clear characteristics of it. Moreover, because of implicitness of this knowledge, there is problem with manifestation of possession of such knowledge. Understanding should be related to the practice of making assertions. In the article I try to argue for soundness of thesis that important part of knowledge that constitutes understanding is a kind of procedural knowledge. This type of knowledge (called “knowledge-how”) cannot be reduced to propositional or conceptual knowledge (“knowledge-that”). Procedural knowledge has manifestation in activities doing in accordance with some set of the rules, but possession of this knowledge does not require explicit knowledge-that of the rules. Procedural knowledge is also located in the middle of the spectrum – between reflex actions and theoretical knowledge.

BACKGROUND:Zambia was the first African country to change national antimalarial treatment policy to artemisinin-based combination therapy - artemether-lumefantrine. An evaluation during the early implementation phase revealed low readiness of health facilities and health workers to deliver artemether-lumefantrine, and worryingly suboptimal treatment practices. Improvements in the case-management of uncomplicated malaria two years after the initial evaluation and three years after the change of policy in Zambia are reported.METHODS:Data collected during the health facility surveys undertaken in 2004 and 2006 at all outpatient departments of government and mission facilities in four Zambian districts were analysed. The surveys were cross-sectional, using a range of quality of care assessment methods. The main outcome measures were changes in health facility and health worker readiness to deliver artemether-lumefantrine, and changes in case-management practices for children below five years of age presenting with uncomplicated malaria as defined by national guidelines.RESULTS:In 2004, 94 health facilities, 103 health workers and 944 consultations for children with uncomplicated malaria were evaluated. In 2006, 104 facilities, 135 health workers and 1125 consultations were evaluated using the same criteria of selection. Health facility and health worker readiness improved from 2004 to 2006: availability of artemether-lumefantrine from 51% (48/94) to 60% (62/104), presence of artemether-lumefantrine dosage wall charts from 20% (19/94) to 75% (78/104), possession of guidelines from 58% (60/103) to 92% (124/135), and provision of in-service training from 25% (26/103) to 41% (55/135). The proportions of children with uncomplicated malaria treated with artemether-lumefantrine also increased from 2004 to 2006: from 1% (6/527) to 27% (149/552) in children weighing 5 to 9 kg, and from 11% (42/394) to 42% (231/547) in children weighing 10 kg or more. In both weight groups and both years, 22% (441/2020) of children with uncomplicated malaria were not prescribed any antimalarial drug.CONCLUSION:Although significant improvements in malaria case-management have occurred over two years in Zambia, the quality of treatment provided at the point of care is not yet optimal. Strengthening weak health systems and improving the delivery of effective interventions should remain high priority in all countries implementing new treatment policies for malaria.
