Considerando-se as recentes decisões do Supremo Tribunal Federal no controle de constitucionalidade, percebe-se o movimento de sincretização entre os controles abstrato e concreto. A visão da atual jurisdição constitucional revela que as últimas criações legislativas foram inseridas no controle abstrato, sendo o caminho utilizado para resolução das principais controvérsias judiciais, com seus efeitos erga omnes e vinculantes. Esse panorama não afastou a utilização do controle concreto, que se renova ao se aproveitar dos instrumentos do controle concentrado abstrato. Não apenas o controle concreto e difuso está se beneficiando do controle abstrato, como também a recíproca é verdadeira. O controle abstrato também se beneficia ao valer-se de diversos instrumentos que não seriam possíveis por suas características abstratas. O objetivo do presente trabalho é analisar esse movimento, através de casos emblemáticos e instrumentos criados pelas Leis que tratam sobre o controle de constitucionalidade, a fim de comprovar esse novo cenário na ordem jurídica brasileira. Este trabalho foi realizado através de pesquisas bibliográficas e casos perante o Supremo Tribunal Federal. O resultado da análise comprova essa tendência na utilização de pressupostos que seriam apenas de um controle, sendo utilizado pelo outro. Isso representa um grande avanço para o tema controle de constitucionalidade que tende cada vez mais a ser sincretizado.

The papers aims at considering the issue of relative efficiency measurement in the context of the public sector. In particular, we consider the efficiency measurement approach provided by Data Envelopment Analysis (DEA). The application considered the main Brazilian federal universities for the year of 1994. Given the large number of inputs and outputs, this paper advances the idea of using factor analysis to explore common dimensions in the data set. Such procedure made possible a meaningful application of DEA, which finally provided a set of efficiency scores for the universities considered .

Uma das principais modificações introduzidas pela Reforma do Judiciário (Emenda Constitucional 45/2004) foi a criação do Conselho Nacional de Justiça (CNJ). Dentre suas competências constitucionais, a do controle dos deveres funcionais dos magistrados por meio dos Processos Administrativos Sancionadores foi bastante questionada, chegando a ser objeto de controle concentrado de constitucionalidade pelo Supremo Tribunal Federal (STF). A composição do Conselho foi também alvo de reiteradas críticas, pois considerável parte dos conselheiros (6 dos 15, representando 40% do total) é composta por membros não oriundos da magistratura – vindos do Ministério Público, da Advocacia, além dos Juristas indicados pelo Congresso Nacional -, os conselheiros não-juízes. O Poder Judiciário, historicamente hermético e corporativista, passava a ser controlado por um órgão novo, um Conselho de Justiça que não contava apenas com conselheiros juízes entre seus membros. O presente trabalho estudou o CNJ a partir desses dois pontos mais controversos, com enfoque no controle disciplinar exercido pelo órgão sobre a magistratura nacional. Conselhos de Justiça, em especial em sua feição disciplinar, devem lidar com e existente tensão entre controle (ou accountability) e independência judicial. Observamos a atuação do Conselho Nacional de Justiça em vista dessa constante tensão ao longo de sua historia: por meio de uma análise que percorreu um período que vai da instalação do CNJ, em 2005, até o final do ano de 2013. Identificamos, com isso, as estratégias de legitimação institucional utilizadas para o exercício da competência disciplinar, analisamos as normas jurídicas surgidas nesse período, bem como descrevemos qual o perfil dos atores que ocuparam as cadeiras do colegiado enquanto conselheiros. Como resultado dessa observação, importante destacar que o Conselho Nacional de Justiça jogou luz sobre um Poder historicamente fechado, mas que ainda apresenta problemas de transparência. A dificuldade de localizar dados sobre matérias mais sensíveis (processos administrativos sancionadores) e as ausências de envio de informações quando solicitadas foram marcantes na pesquisa. Sobre o comportamento do órgão, mobilizamos a variável do profissionalismo (com especial enfoque na origem de carreira) para interpretar esse processo. Esperávamos um Conselho com duas características: corporativista e pouco harmônico. As análises empíricas quantitativas, que compuseram um retrato de todos os Processos Administrativos Sancionadores julgados até o final de 2013 pelo CNJ, mostraram um cenário inverso: um colegiado não corporativista e coeso. Mesmo em vista dessas características globais, identificamos que existem importantes diferenças no comportamento decisório e, quando elas estão presentes, o elemento da carreira é influente.

O estudo tem como objetivo verificar a constitucionalidade da Proposta de Emenda à Constituição (PEC) nº 99/2011, em tramitação perante o Congresso Nacional. A PEC propõe positivar Associações Religiosas de âmbito nacional como legitimados ao ensejo da jurisdição constitucional. Como forma de viabilizar o estudo proposto, será analisada a evolução do controle de constitucionalidade concentrado no Brasil e a ratio para a adoção do rol de legitimados ativos, especialmente na Constituição da República Federativa do Brasil de 1988. Nesse sentido, faz-se necessário inicialmente analisar o entendimento e as iniciativas do Supremo Tribunal Federal para reduzir o número de ações do controle concentrado propostas, para então entender a necessidade da inclusão das Associações Religiosas no artigo 103 da Constituição da República. Torna-se igualmente indispensável conceituar “Poder Constituinte Derivado”, buscando identificar os limites à alteração da Constituição e analisar se a referida PEC violaria algum dos limites materiais. Conforme se demonstrará, a PEC violaria a laicidade do Estado e os direitos individuais tutelados na CRFB/88, tais quais a igualdade, o pluralismo religioso e a liberdade de crença, todos cláusulas pétreas, consoante o disposto no artigo 60 da Constituição.

Qual o impacto de uma transferência incondicional a um município quando seu vizinho também recebe a transferência? Nesse artigo n os testamos se uma transferência do governo federal, o Fundo de Participação dos Municípios (FPM), afeta os gastos municipais de forma diferente dependendo dos municípios vizinhos. Nos utilizamos municípios próximos a um dos quatro pontos de descontinuidade no repasse do FPM de acordo com faixas de população e que possuíam vizinhos próximos a pontos de descontinuidade diferentes. Nós estimamos o impacto do FPM recebido pelo próprio municípios e pelo vizinho usando o método de Regressões em Descontinuidade (RDD). Os resultados indicam que parte do efeito flypaper do FPM sobre a economia local estimado na literatura pode ser explicado pelo aumento de gastos nos municípios vizinhos. O spillover e em geral positivo, com exceção dos gastos em saúde e saneamento em algumas faixas populacionais. Nós também consideramos uma amostra de vizinhos mais distantes dos pontos de descontinuidade, e mostramos que nesse caso as diferenças nas estimativas quando controlamos pelo FPM do vizinho não são substanciais.

No ano de 2004, o Supremo Tribunal Federal definiu os critérios a serem utilizados na aplicação do princípio da insignificância. O mencionado princípio, em conjunto com outros princípios do direito penal, como fragmentariedade, subsidiariedade e intervenção mínima, pauta-se por intervir minimamente nas condutas sociais. Preza o princípio da bagatela afastar a aplicação da lei penal em situações que não há uma lesão significativa ao bem jurídico. O presente trabalho analisou como o princípio da insignificância vem sendo aplicado pela Suprema Corte em determinados crimes. Observou-se, ainda, porém de forma mais pormenorizada, o tratamento do STF na aplicação do princípio em relação ao crime de descaminho e de furto, a partir de um levantamento de julgados no período de 2009 a 2014.

Partindo da constatação de que o Brasil acompanha hoje um fenômeno global de protagonismo das cortes supremas nas sociedades complexas contemporâneas, notadamente na criação de políticas-públicas e regulação, o estudo procura mapear a evolução – e progressiva democratização – de uma estrutura de freios e contrapesos prevista na Constituição da República Federativa do Brasil de 1988 (“Constituição”), qual seja, o processo de seleção dos ministros do Supremo Tribunal Federal. Ao longo do texto é analisada a arquitetura institucional e constitucional do processo de indicação e aprovação de novos ministros, bem como exemplificadas mudanças no perfil dos atores políticos, no plexo de competências das instituições envolvidas e no contexto social, político, econômico e cultural que forçaram a transformação prática do modelo de seleção institucional, sem alteração, no entanto, da formatação originalmente prevista desde o Século XIX. Mapeando a origem e evolução da fórmula constitucional de colaboração entre o Poder Executivo e o Poder Legislativo para a escolha dos membros da cúpula do Poder Judiciário, o estudo identifica a origem do modelo brasileiro na inspiração da experiência norte-americana, descrevendo esta e os paralelos possíveis com aquele. A partir do marco central da Constituição, o trabalho procura demonstrar uma progressiva mobilização de atores políticos e sociais em relação ao processo de escolha, notadamente em relação ao momento em que os indicados para o Supremo Tribunal Federal são sabatinados pela Comissão de Constituição, Justiça e Cidadania do Senado Federal. Finalmente, são analisadas concretamente as sabatinas e algumas das suas principais discussões, buscando extrair lições que sirvam de norte colaborativo para a evolução da forma de seleção dos ministros do Supremo Tribunal Federal, inclusive como instrumento de controle prévio de seus membros, futuros elaboradores de políticas-públicas.

PETROBRAS, a Brazilian oil company, follows principles of public administration and from the Constitutional Amendment 9/95 in Brazil began to compete with other companies with the flexibility of the oil monopoly. In this new model started to use the simplified procedure for bidding so that could compete on equal terms. The ordinance that adopted a simplified procedure for bidding has been the subject of some criticism and lawsuits especially under the Court of Audit and the Supreme Court in Brazil. The analysis of their constitutionality, and the possibility of their use by other group companies is the theme of this work, and for this purpose, permeates through the notions of judicial review in the Brazilian law on the stage of law and economics analysis of the norm, and the principles applicable to PETROBRAS and the devices most frequently asked about the implementation of 2745/98 Decree. For this, the basic issue that should be investigated further is the regulatory power of the Federal Executive and the delegation of powers within the legislature and its conformation to the constitutional regency

Brazil since its first republican constitution has adopted systems of laws control. The review activity was given to three state powers or functions state, Executive, Legislative and Judiciary. However, it appears that in the country along the constitutional history, has stood considerably the jurisdictional control of the most important control. Initially, back in 1891, Brazil adopted the jurisdictional control of diffuse from U.S, whose role in monitoring of standards is delivered to all organs of the judiciary, which may face a case, put on trial, ascertain whether or not the possibility of applying a law, removing its impact in case of unconstitutionality. In 1969, entered in the second legal model of judicial review, the concentrated control of constitutionality, whose inspiration comes from the positivist theory of Hans Kelsen, and was adopted by the Austrian Constitution of 1920. According to the abstract control the supervision of law is given to a Court or Constitutional Court, responsible for the analysis of the legal constitutionality independent of its application to a specific case. In Brazil the role of concentrated control was handed over exclusively to the Supreme Court, which serves as the Constitutional Court, which accumulates that function with other constitutionally provided jurisdiction. Throughout this period, from 1891 until today, Brazil has maintained a dual system of judicial control of legal constitutionality, where they coexist and harmonize the diffuse control exercised by any organ of the Judiciary, and concentrated control of competence the Supreme Court. However, one must recognize that with the advent of the Federal Constitution of 1988, the concentrated control has emerged on the national stage due to two important factors: the expansion of the legal capacity to sue and the inclusion of other ways control, besides the already known Direct Claim of Unconstitutionality. This concentrated control and projection of the Supreme Court s attempt to become a true constitutional court, led to a relative weakening of diffuse control even when performed by the Brazilian Constitutional Court. In order to become a true constitutional court, all decisions handed down by the Supreme in the exercise of constitutional jurisdiction should have the same weight and the same measure, or at least bring improvement to similar effects, once is the responsible for the final word when it comes to constitutional interpretation. Thus, the writs of certiorari and stare decisis were responsible for profound changes in the diffuse control, allowing the Supreme Court can strengthen its decisions even in the diffuse control. These two institutions have substantially changed the legal status of diffuse control, allowing an extension of the effects of decisions handed down by the Supreme Court, so that you can no longer be said that the effects of this control to restrict the disputing parties in the process

The economic regional integration is a phenomenon observed in numerous occasions inside the global economic reality. Watchful to that phenomenon, the 1988 s Brazilian constitutional order establish in its 4th article, single paragraph, the commitment to seek for the Latin- American integration, as a Fundamental Principle to the Brazilian Federative Republic. Regarding the mentioned constitutional disposition s realization, the Brazilian State celebrated, specially, the 1980 s Montevideo Treaty, creating the Latin-American Integration Association, and the 1991 s Asuncion Treaty, performing the duty to establish a common market, in sub regional level, with Argentina, Paraguay and Uruguay, called Mercado Comum do Sul. However, due to an addiction to a wrong comprehension of State s Sovereignty Principle, the Constitution imposes to the international rules an incorporation process, without providing any privilege to those ones regarding the integration constitutional disposition s realization, whether original or derived. The Brazilian s Supreme Court, as matter of fact, affirmed that it is not possible, facing the actual constitutional order, to grant any character of preference. Also in the controversies solution mechanism, responsible for the law s execution in case of its noncompliance, where found malfunctions, most notably the system s open character and its excessive procedural flexibility, in addiction to restricting the access of individuals. It follows from these findings, then, the lack of legal certainty provided by the Mercosul s legal system, considering its effects both international and within the Brazilian state. Among the possible solutions to reduce or eliminate the problem are using the practice of the so-called executive agreements in the Mercosul s original rules incorporation to the Brazilian state, the creation of a Mercosul s court of law and/or a constitutional reform

The paper investigates the legal mechanisms used by the Legislature and the Executive to implement the constitutional principle of the teacher s minimum wage, which is proclaimed in the Constitution as a strategy of professional appreciation for this category. The text demonstrates that the legal mechanisms used to value the teacher were: the 1988 Constitution, the constitutional amendments to this Charter updated and modified the original text in relation to the matter, and finally, the Minimum Wage Law . Article nº 206 of 1988 s Federal Constitution established that basic education teachers, who work in public schools, would be entitled to a national minimum wage. Law nº 11.738/2008 ( Minimum Wage Law ) regulated the matter and made other determinations on the relationship between the State and the teachers such as the establishment of parameters for the distribution of the workload of teachers. Based on this law, since 2009 the minimum wage has been set annually by the Federal Government. However, state governments and municipalities throughout Brazil protested prescriptions contained in the Minimum Wage Law . In this context, some governors and mayors led the Supreme Court regarding the constitutionality of this law. The complainants considered that there was unconstitutional by the following: definition of the teacher s workday, which in the complainants point of view was competence of local governments; ensuring that teachers receive salaries tied to the minimum wage with retroactive effect; transformation of the minimum wage in basic salary, lack of sufficient budget in the states and municipalities to honor with the new values to be paid to teachers and, finally, determining workload for the teacher to perform other activities besides classroom activities. At the trial held at the STF the majority of Ministers rejected the claim and considered that the Minimum Wage Law , taken together, was constitutional. However, this decision did not alter the position of the managers or the interpretation of the ministers who agreed with the unconstitutionality of some aspects of the law. This means that one law can present differences in interpretation between ordinary people and among members of the Judiciary. The search showed the following conclusions: the law is not a definitive parameter of justice, because it is deeply linked to various interests; the development, implementation, and judgment of laws dealing with minimum wage of teaching are linked to historical and cultural aspects of society; the demand for enhancement of teacher and setting a minimum wage has only emerged in the late twentieth century, a fact explained in this work based on data that indicate the recent concern of Brazilian State with schooling a phenomenon typically Republican and with the professionalization of teaching emerging concern from the knowledge society; the Legislative and Executive search mechanism to implement the minimum wage of the teachers because of the contemporary need for professionalization of teaching

The current study presents an analysis about the automation of the lawsuits in Brazil, which opens a new direction to be followed by the National Secretary of Justice, applied indistinctively to the civil, criminal and labor lawsuits, as well as to the special court houses at any degree of juridisdiction. It treats, specifically, about the transition from the classic lawsuit with bureaucratic aspects to the electronic one, based on the simplicity of the functions, the quality of the oral and the readiness. The light of the constitutional principle of the reasonable duration of the lawsuit, while fundamental rigth of the defendant and, under de protection of the democratic guarantee, it investigates, from the theory of the fundamental rights to the reform movement of the lawsiut, in the scenery of the alien law and national law, the latter, mostly because it has the automation as a necessary improvement claimed by modernity, yet without forgetting of the humane character inherent to the criminal lawsuit. It faces the issue of of the disruption of the paradigm of the written formality of the Brazilian lawsuit, the problem of the resistance to the new automized method, the use of the video conference for the inquest of the witnesses as well as for the questioning of the defendant, the advancements of the virtual lawsuit on the Superior Courts, Federal Supreme Court and Superior Court of Justice, it treats also about the role of the National Council of Justice - CNJ - to uniformize the legal proceedings in the country. Without neglecting the effective respect to the fundamental rights, it focuses the cultural change necessary so that the electronic technology can be, in fact, in the indictment system, the means to reach with excellency the citizenship by the simplification of the legal proceedings, transposing the baseless bureaucracy and assuring an effective judicial service assistance in order to have a better quality of life

The right against self-incrimination is a fundamental right that works in the criminal prosecution, and therefore deserves a study supported by the general theory of criminal procedure. The right has a vague origin, and despite the various historical accounts only arises when there is a criminal procedure structured that aims to limit the State´s duty-power to punish. The only system of criminal procedure experienced that reconciles with seal self-incrimination is the accusatory model. The inquisitorial model is based on the construction of a truth and obtaining the confession at any cost, and is therefore incompatible with the right in study. The consecration of the right arises with the importance that fundamental rights have come to occupy in the Democratic Constitutional States. In the Brazilian experience before 1988 was only possible to recognize that self-incrimination represented a procedural burden for accused persons. Despite thorough debate in the Constituent Assembly, the right remains consecrated in a textual formula that´s closer to the implementation made by the Supreme Court of the United States, known as "Miranda warnings", than the text of the Fifth Amendment to the U.S. Constitution that established originally the right against self-incrimination with a constitutional status. However, the imprecise text does not prevent the consecration of the principle as a fundamental right in Brazilian law. The right against self-incrimination is a right that should be observed in the Criminal Procedure and relates to several of his canons, such as the the presumption of not guilty, the accusatory model, the distribution of the burden of proof, and especially the right of defense. Because it a fundamental right, the prohibition of self-incrimination deserves a proper study to her constitutional nature. For the definition of protected persons is important to build a material concept of accused, which is different of the formal concept over who is denounced on the prosecution. In the objective area of protection, there are two objects of protection of the norm: the instinct of self-preservation of the subject and the ability to self-determination. Configuring essentially a evidence rule in criminal procedure, the analysis of the case should be based on standards set previously to indicate respect for the right. These standard include the right to information of the accused, the right to counsel and respect the voluntary participation. The study of violations cases, concentrated on the element of voluntariness, starting from the definition of what is or is not a coercion violative of self-determination. The right faces new challenges that deserve attention, especially the fight against terrorism and organized crime that force the development of tools, resources and technologies about proves, methods increasingly invasive and hidden, and allow the use of information not only for criminal prosecution, but also for the establishment of an intelligence strategy in the development of national and public security
