La doctrina de la Proliferación teórica de Paul Karl Feyerabend ha sido interpretada por sus especialistas como un intento de salvaguardar el ideal del progreso científico. Aunque tales estudios hacen justicia, en parte, a la intencionalidad de nuestro filósofo no explicitan la crítica fundamental que implica para Feyerabend el pluralismo teórico. La proliferación teórica constituye en sí misma una reductio ad absurdum de los distintos intentos del positivismo lógico y del racionalismo crítico por definir la ciencia a expensas de lo metafísico. Este artículo presenta la proliferación teórica como una reivindicación del papel positivo que ocupa la metafísica en el quehacer científico. Se consigna la defensa que hace Feyerabend de la metafísica en cuanto que ésta constituye la posibilidad de superar el conservadurismo conceptual, aumentar de contenido empírico de la ciencia y recuperar el valor descriptivo de las teorías científicas.

Ten years after the production of the initial 'We Never Give Up' film, this documentary filmis a follow-up film about the experiences of ten survivors of South Africa apartheid and their struggle for reparations. Produced by the Human Rights Media Centre, Cape Town, the film was directed and filmed by Cahal McLaughlin in a collaborative relationship with Khulumani Support Group Western Cape.

This documentary film, produced with the Human Rights Media Centre, Cape Town, and in collaboration with Khulumani Support Group Western Cape, is the ten-year follow up to We Never Give Up (2002), which addressed the issues of reparations as dealt with by the South African government and the Truth and Reconciliation Commission. We Never Give Up II (2012) returns to these themes and to the same participants, asking how life has changed in the interim. The process of collaborative practices acknowledges the importance of sharing ownership/authorship in the storytelling processes as well as in validating traumatic experiences by those who survived major and sustained political violence. Made over a two-year period, involving close consultation with participants, the film offers insights, by those most directly affected, to what might constitute legal, financial, social and psychological reparations. The film has been screened in Cape Town, Bloemfontain, Zanzibar Film Festival, Belfast (Belfast Film Festival), Brighton, Guildford, Galway and London, always accompanied by discussion of the issues raised in Q&As. To emphasise the importance of the film for debates on policy around reparations, a 25 minute edited version was selected to be screened on SABC on ‘Special Assignment’ by SABC on April 29th, 2013 (South Africa’s ‘Freedom Day’), followed by a debate with Department of Justice spokesperson, Dr Khotso De Wee. This essay argues that Romanticism’s legacy in modern Indian literature has been constructed under the shadow of its colonial heritage. Although the Romantic period witnessed the enthusiastic “discovery” of classical Indian literature by British Orientalists, Romantic imperialism (which went hand-in-hand with Romantic orientalism) played a darker role in instituting a colonial educational system in India which denigrated Indian languages and literatures. Modern Indian literature represented by popular fictional writers from R.K. Narayan to Arundhati Roy registers this complex colonial inheritance by its qualified and often ironic celebration of British Romantic literature along with its associated ideologies of freedom, truth, and beauty.

In this book, Piotr Blumczynski explores the central role of translation as a key epistemological concept as well as a hermeneutic, ethical, linguistic and interpersonal practice. His argument is three-fold: (1) that translation provides a basis for genuine, exciting, serious, innovative and meaningful exchange between various areas of the humanities through both a concept (the WHAT) and a method (the HOW); (2) that, in doing so, it questions and challenges many of the traditional boundaries and offers a transdisciplinary epistemological paradigm, leading to a new understanding of quality, and thus also meaning, truth, and knowledge; and (3) that translational phenomena are studied by a broad range of disciplines in the humanities (including philosophy, theology, linguistics, and anthropology) using various, often seemingly unrelated concepts which nevertheless display a considerable degree of qualitative proximity. The common thread running through all these convictions and binding them together is the insistence that translational phenomena are ubiquitous. Because of its unconventional and innovative approach, this book will be of interest to translation studies scholars looking to situate their research within a broader transdisciplinary model, as well as to students of translation programs and practicing translators who seek a fuller understanding of why and how translation matters.

In Europe, maximum journey time for transported sheep is set at 29. h (EC Regulation 1/2005), after which animals must be unloaded, fed and watered in control posts stopping for 24. h, as all other species, before continuing their journey. The industry considers these resting times too general, not taking into account the peculiar differences between species or age classes. Also, loading and unloading have been reported to be detrimental for the animals. Therefore, the industry pushes to reduce the times at control post and avoid unloading the animals from the truck. Since there is little information concerning the effect of resting in a stationary truck after long journeys, the present study aims to evaluate the effect of an 8. h rest stop on the truck for transported ewes compared to being unloaded for resting in a control post for the same amount of time, considering physiological and behavioural measures. Two groups of ewes were transported for 29. h, after which one was unloaded and housed in a pen (P) at the control post while the other was left inside the truck (T). After 8. h stop, a further 6. h travel was headed to the farm of origin. A third group (C) stayed at the farm as control. During the stop, standing, resting, moving and eating behaviour of all groups was recorded. Blood parameters, salivary and faecal cortisol were assessed at different stages. The behaviour of P animals during the resting period was more similar to C than to T ones, where feeding and lying behaviours were restricted by the limited space allowance on the truck. After returning to the farm of origin, both T and P animals showed different parameters' levels as compared to C. P ewes showed a mean loss weight of 2. kg not recorded in group T and showed higher signs of muscular damage compared to C group. It was concluded that, with so short resting times as 8. h, there is no clear advantages in terms of animal welfare for avoiding the unloading and loading of the animals in the control post after long journeys.

O presente trabalho visa demonstrar que o instituto do caso julgado, não obstante as diversas teorias que o explicam, especialmente no que toca à imutabilidade, funda-se, primordialmente, no princípio da segurança jurídica. Busca-se, com tal princípio, a estabilização das relações jurídicas acertadas por decisão judicial, evitando-se a eternização dos conflitos. Com isso, mesmo havendo esforços, no âmbito do desenvolvimento da relação processual, na busca da verdade, a jurisdição se satisfaz com a verdade estabelecida formalmente, decorrente dos meios argumentativos, probatórios e decisivos. A imutabilidade, assim, encerra a busca da verdade, impedindo a rediscussão da matéria transitada em julgado. Contudo, há situações em que o sistema mitiga o prestígio à imutabilidade, permitindo-se, excepcionalmente, a rediscussão do conflito em atenção à rediscussão da verdade. Em tais situações, a segurança jurídica cede espaço ao valor verdade e, por conseguinte, à obtenção de uma decisão mais justa. O presente trabalho visa analisar o embate entre os valores segurança jurídica e verdade, focando situações em que esta supera aquela.

Dans ce mémoire, nous nous interrogeons sur de nouvelles règles de preuve du Code criminel pour déterminer si elles ont complètement éliminé le phénomène de victimisation des plaignantes dans les procédures en matière d'agression sexuelle. Nous émettons l'hypothèse qu'elles n'ont pas éliminé le traitement inéquitable des victimes dans le procès pénal et que ce traitement inéquitable nuit autant à la recherche de la vérité qu'au respect des droits des plaignantes. Nous examinons d'abord les droits constitutionnels respectifs de la plaignante et de l'accusé dans le procès en matière de crimes sexuels et leur interaction avec des règles qui portent sur la réputation et l'état de santé des deux protagonistes dans de telles affaires. Nous observons que ces règles de preuve offriraient une symétrie apparente au sujet du traitement de la mauvaise réputation de l'accusé et de la réputation sexuelle et la santé mentale de la victime dans la procédure. Cette symétrie serait toutefois imparfaite, inappropriée ou biaisée par le caractère adversaire du procès et la priorité accordée aux droits constitutionnels de l'inculpé et ce, parfois même au détriment de la vérité et de la justice. Enfin, nous proposons des modifications aux règles actuelles de preuve et de procédure en matière d'agression sexuelle pour favoriser une meilleure recherche de la vérité et un respect accru des droits constitutionnels des victimes

La conception heideggérienne du « cercle de la compréhension » exposée aux §§ 31 et 32 de Sein und Zeit est bien connue et a souvent été analysée, notamment par Hans-Georg Gadamer dans Vérité et méthode (1960) et Jean Greisch dans son commentaire de Sein und Zeit (1994). Mais on a trop peu vu que la théorie du cercle herméneutique déterminait aussi la conception heideggérienne de la philosophie. Notre recherche s’efforcera de le montrer et d’expliquer pourquoi il en est ainsi. Au plan de la méthodologie, nous proposerons, en nous inspirant des commentateurs les plus autorisés (Greisch, Gadamer, Courtine, et al.), un commentaire serré des §§ 31 et 32 de Sein und Zeit, sans oublier le § 63 où Heidegger souligne lui-même la « situation herméneutique » de sa propre enquête, ni le § 68 où se trouve mise en évidence la dimension temporelle du cercle de la compréhension. Nous tâcherons ensuite de montrer en quoi ce cercle affecte la conception heideggérienne de la philosophie telle que présentée au § 7 de Sein und Zeit et dans d’autres textes de Heidegger tels que Les problèmes fondamentaux de la phénoménologie (GA 24).

Situé entre entre le roman et le récit personnel, Cru. prend la forme d'un aller-retour entre fiction et autobiographie. Le texte, construit à l'aide d'une écriture syncopée et brute, présente deux personnages homosexuels à l'ère « post-sida », alors que ceux-ci tentent de comprendre ce que veut dire « être un homme » dans un contexte social où le mépris (envers les autres et soi-même) est encore présent, mais peut-être encore plus pernicieux qu'auparavant, parce que camouflé sous l'idée d'une acceptation globale. Au final, Cru. soulève la délicate question du droit à la vérité dans une démarche autobiographique et celle de l'implication de la cruauté dans un récit qui ne concerne pas que l'auteur, mais son entourage aussi. Cruauté nécessaire : le devoir d'une vérité autobiographique chez Guibert, Dustan et Rémès est un essai qui vise l'analyse de différents procédés se rattachant à l'écriture autobiographique homosexuelle des années 1990, particulièrement aux textes appartenant à la littérature du sida. Si l'autobiographie vise, dans une certaine mesure, le dévoilement de la vérité, comment ne pas parler de cruauté alors que les auteurs qui la pratiquent y vont de révélations qui ne concernent pas qu'eux? Si le processus d'écriture autobiographique se veut bénéfique, le résultat est-il purement diabolique? Il faudra d'abord, évidemment, définir ce que l'on entend par « vérité » et « cruauté » (lire « bénéfique » et « maléfique »). En ce qui concerne le Bien et le Mal, les textes de Bataille et Nietzsche contribueront à définir deux concepts qui peuvent, souvent, être relatifs. En confrontant les textes des trois auteurs français – tous séropositifs au moment de l'écriture – à différentes théories autobiographiques (Doubrovsky, Lejeune, Miraux) et identitaires (Foucault, Schecter, Butler), et à certains écrits sur le devoir et la responsabilité (Donner, Brooks), l'on tentera de démontrer que la cruauté dont Guibert, Dustan et Rémès font preuve est essentielle à l'écriture autobiographique.
