Freee write manifestos by taking a pencil (or a laptop) to an historical text, usually belonging to the entwined traditions of the avant-garde and political activism. Sometimes, as Tristan Tzara advised, we choose the text according to its length, while other times, such as in this instance, we selected the text according to the conditions of the invitation that triggered the writing of the manifesto. Our manifesto ‘To Hell with Herbert Read’ was written originally as a contribution to a conference held in Manchester that took its title from Herbert Read’s book ‘To Hell with Culture’. ‘To Hell with Culture’ is a book that cuts itself off from the world whereas ‘To Hell with Herbert Read’ relocates Read’s book in a world of cultural, social, economic and political actualities that are part of common experience. Read rejects culture because he thinks it is a useless, wasteful, elitist, puffed-up, decorative supplement to the functional, factual, palpable, purposeful world of things. He is a positivist kind of modernist who presents himself as the opposite, an enemy of the status quo. He is an anarchist of a particularly bourgeois hue: he wants us all to have decent pots and pans, not the inferior ones that are supplied by market forces cheaply. Rather than taking his aim precisely to target the dominant forces of his day - the industrial capitalists and their financiers - he rejects the world and all its inhabitants. He not only despises elitist culture but popular culture too.

Cette recherche s'intéresse au parcours d'athlètes de haut niveau lors de leur transition d'une carrière sportive vers autre chose (nouvelle identité, nouvelle carrière, nouveaux projets, etc.). Même si les athlètes savent que la retraite sportive est la plupart du temps inévitable, plusieurs écrits soulignent les difficultés qui l'accompagnent, notamment sur le plan identitaire, les athlètes ayant à faire le deuil d'une identité fortement valorisée. Des retraités de la compétition sportive décrivent même cette étape comme le passage d'être exceptionnel à simple citoyen. Les écrits sur l'identité athlétique indiquent que le degré d'identification au rôle d'athlète et le degré d'exclusivité que la personne accorde à son rôle s'accroissent avec le niveau sportif atteint. La transition serait particulièrement difficile pour les athlètes de haut niveau, c'est-à-dire pour ceux qui ont obtenu une reconnaissance de leur statut d'athlète sous la forme d'une sélection pour des compétitions nationales ou internationales, dont les jeux olympiques. Lorsque ces personnes quittent la scène sportive, ils vivent un sentiment de vide et d'incertitude face à leur avenir. En plus d'avoir l'impression de perdre leur identité, ils disent manquer la stimulation, la reconnaissance sociale et le style de vie de leur ancienne vie. La transition serait particulièrement difficile pour les personnes qui partent à la retraite parce qu' elles y sont forcées, par exemple en raison de blessures. Les études qui ont utilisé une méthodologie qualitative ont permis de constater une évolution dans les questionnements identitaires des athlètes ainsi que sur la façon dont ils s'adaptent à leur nouvelle situation.Cette recherche poursuit dans cette voie en s'intéressant au parcours identitaire d'athlètes de haut niveau. Elle décrit les dynamiques et stratégies identitaires mises en oeuvre par des athlètes. Six athlètes de haut niveau ont été interrogés à propos de ce qu'ils ont vécu sur le plan identitaire durant leur carrière, mais principalement à partir du moment où celle-ci a pris fin. Les athlètes se sont également prononcés sur leurs projets d'avenir. Ces athlètes ont participé à la recherche sur une base volontaire, à la suite d'une invitation lancée par un organisme national de sport. Cet échantillonnage au hasard a mené à une grande diversité quant à la durée de la carrière (entre 15 et 25 ans de pratique sportive et 13 et 25 ans de participation à des compétitions), le nombre et l'ampleur des succès obtenus ainsi qu'au temps écoulé depuis leur retraite. Les données ont été analysées sous la forme d'études de cas, en faisant une mise en relation avec les composantes de l'identité athlétique (Cieslak, 2004), les dynamiques identitaires (Kaddouri, 1999, 2002, 2006) et les stratégies identitaires (Carver et al. , 2000). Même si tous les athlètes ont vécu une carrière marquée de succès importants, on observe une grande diversité dans la façon de réagir à la retraite. Certains s'engagent rapidement dans une dynamique de transformation identitaire, même avant la fin de la carrière, alors que d'autres passent par de nombreux tourments où se succède l'adoption de dynamiques identitaires différentes, axées parfois sur une redéfinition de l'identité ou une reconstruction de celle-ci. Les athlètes ont utilisé une grande diversité de stratégies pour s'adapter à leur nouvelle situation, parfois des stratégies de type résolution de problèmes par exemple en planifiant leur avenir avant de prendre leur retraite, parfois des stratégies de gestion des émotions, par exemple en réinterprétant la situation de façon positive ou en recherchant un soutien moral chez leurs proches. Certaines stratégies ont cependant été déclarées comme étant peu efficaces et les athlètes ont fourni quelques conseils pour les personnes qui font face à la transition de carrière sportive vers autre chose.

Cette thèse s'inscrit dans un paradigme compréhensif et herméneutique et dans une démarche de recherche qualitative. Elle utilise l'autoethnographie comme méthodologie. L'autoethnographie cherche à comprendre une histoire singulière sociohistoriquement inscrite dans des contextes culturels déterminés L'autoethnographie est à la fois une méthode de recherche, un style d'écriture, une oeuvre et une aventure transformatrice à travers laquelle la chercheure devient le sujet de son histoire. Ici, c'est la vie et l'expérience de la chercheure qui constitue le corpus des données. L'autoethnographie offr une invitation sensible à créer une relation dynamique entre la personne qui raconte son histoire et ses lecteurs. C'est une approche originale, qui fait appel à la vulnérabilité, à la sincérité et à l'authenticité de la chercheure. Le style d'écriture vise à décrire, à montrer et invite à pénétrer la réalité de l'expérience plutôt qu'à théoriser, expliquer ou défendre des certitudes. Cette thèse dévoile la quête transpersonnelle du sujet-chercheure qui traverse une vie d'élève, de mère, d'enseignante, d'étudiante, de formatrice d'adultes et, enfin, d'enseignante en formation initiale à l'enseignement. Une quête vécue dans la culture de l'éducation et qui s'est actualisée à travers des moments clés où se joue, dans et pour la chercheure, une tension entre des approches éducatives centrées sur la personne et son potentiel, et d'autres approches centrées sur les instruments, les contenus et l'évaluation. Cette autoethnographie est présentée sous forme de vignettes qui offrnt au lecteur l'accès à des moments significatifs de vie. La production des données s'est faite à l'aide d'outils variés tels le journal de recherche, le récit de vie, des récits phénoménologiques, des photographies, des poésies, des extraits de travaux d'étudiantes, des documents et des articles. Ces données ont été analysées et interprétées de manière qualitative et en mode écriture en vue de permettre une meilleure compréhension de l'autrice et de sa praxis.

This article aims to interrogate law's ambivalent relationship with urban space. It deals with the paradoxical relation between law and the city, visibility and invisibility, materiality and abstraction, and polis and metropolis. It builds on previous work on the lawscape, namely the priority of invitation by law or the city to be conditioned by the other, and expands this line of thought towards a more tangible understanding of visibility and its mutual constitution with invisibility. We believe that spatialisation is a relevant avenue for law's (re)conceptualisation because it moves away from a description of humanism based on the universality of subjectivity, and paves the way for a particularised and material description of law's multiplicity that specifically addresses law's social positioning. This inevitably leads to a dematerialisation of space and the reinstatement of circularity between concreteness and abstraction. Inspired by some of the themes addressed by the contributors in this issue, we begin constructing a vocabulary of lawscaping, where law and urban space are brought together in an epistemological embrace that targets and eventually questions the solipsistic way in which the two of them have been conceptualised so far.

This is a thought-provoking contribution on the space of ontological vulnerability as the awareness of being existentially exposed. This space, conceptualised as a space of ‘the middle’ (as opposed, emphatically, to ‘the centre’) offers an opportunity to think away from the sterile debate on eco/anthropocentricity and from such limiting hierarchies as animal/human, human/environmental, natural/artificial. This new, vulnerable position of the middle allows the reconfiguration of ecological processes, and more specifically the position of environmental law in relation to them. Environmental law now finds itself amidst a new, moving, ‘open ecology’ of social, biological and ecological processes. This is a new, radical conceptualisation of what the author has called ‘critical environmental law,’ based upon an epistemology of observation and an ontology of being part of this open ecology. Environmental law, in this light, is simultaneously reformulated as an invitation to disciplinary and ontological openness and yet a call to remain immanent within existing legal structures. This finds expression in four critical environmental positions that set the stage for the further elaboration of a critical environmental law.

O presente trabalho versa sobre a aplicação do princípio da igualdade pelo Poder Judiciário. Busca-se analisar de que maneira o mandamento constitucional de igualdade se concretiza no contexto jurídico-evolutivo enquanto princípio de norma de controle, que é justamente no âmbito em que ele é justificado pelo órgão jurisdicional. Saber até onde o juiz constitucional pode ir, conhecer seus limites de atuação, parcos ou largos, definíveis ou nubilosos, bem como o que vem contido nessa vertente do princípio que o distingue de um enunciado geral da igualdade, faz dessa dissertação um estudo interdisciplinar, mas que não deixa de ser voltado para o entendimento jurídico-normativo dessa função específica do princípio. A conhecida fórmula da proibição do arbítrio recebe uma leitura que não é inovadora, mas que almeja aferir a sua suficiência no exercício daquela função. Ou algo mais vem a ser exigido do princípio? Desde já uma resposta de tal envergadura não pode ser encontrada sem o retrato da jurisprudência respectiva. Por isso que, ao fim, e sem a pretensão de esgotamento, se optou por conhecer alguns dos julgados do Tribunal Constitucional português sobre o tema proposto. A indicação da disfunção ou não do perfil da referida Corte com a posição doutrinária só pode ser resultante da análise conclusiva sobre o tema. Fica o convite à leitura.

OBJECTIVE: Participation, an indicator of screening programme acceptance and effectiveness, varies widely in clinical trials and population-based colorectal cancer (CRC) screening programmes. We aimed to assess whether CRC screening participation rates can be compared across organized guaiac fecal occult blood test (G-FOBT)/fecal immunochemical test (FIT)-based programmes, and what factors influence these rates. METHODS: Programme representatives from countries participating in the International Cancer Screening Network were surveyed to describe their G-FOBT/FIT-based CRC screening programmes, how screening participation is defined and measured, and to provide participation data for their most recent completed screening round. RESULTS: Information was obtained from 15 programmes in 12 countries. Programmes varied in size, reach, maturity, target age groups, exclusions, type of test kit, method of providing test kits and use, and frequency of reminders. Coverage by invitation ranged from 30-100%, coverage by the screening programme from 7-67.7%, overall uptake/participation rate from 7-67.7%, and first invitation participation from 7-64.3%. Participation rates generally increased with age and were higher among women than men and for subsequent compared with first invitation participation. CONCLUSION: Comparisons among CRC screening programmes should be made cautiously, given differences in organization, target populations, and interpretation of indicators. More meaningful comparisons are possible if rates are calculated across a uniform age range, by gender, and separately for people invited for the first time vs. previously.

To explore the idea of education to close the ingenuity gap I use Thomas Homer-Dixon's work to define ingenuity. The notion that the supply of ingenuity to solve our technical and social problems is not keeping pace with the ingenuity required to solve those problems is called the ingenuity gap. Man-made technological developments are increasing the density, intensity, and pace of globalisation. People must reorganise decision-making organisations and problem-solving methods to pragmatically combat the growing ingenuity gap. John Dewey's work illustrates the fundamental attitudes for the thinking and judgment associated with educating for ingenuity. Howard Gardner's idea that truth, beauty, and morality ought to form the core values and tenets of the philosophy of educating for ingenuity is integral to this thesis. The act of teaching facilitates the invitation to the communication necessary to foster ingenuity. John Novak-discusses the five relationships of educational leadership that enhance an environment of ingenuity. The International Baccalaureate (IB) is an existing model of global education, one that defines some of the school experiences and academic development of core values of educating for ingenuity. Expanding upon the structure of the IB and other research within this thesis, I speculate upon what my school, where educating for ingenuity so as to close the ingenuity gap is the goal, would be like.

This qualitative narrative inquiry was driven by my desire to further explore my personal discovery that my utilization of educational technologies in teaching and learning environments seemed to heighten a sense of creativity, which in turn increased reflective practice and authenticity in my teaching. A narrative inquiry approach was used as it offered the opportunity to uncover the deeper meanings of authenticity and reflection as participants' personal experiences were coconstructed and reconstructed in relationship with me and in relationship to a social milieu. To gain further insight into this potential phenomenon, I engaged in 2 conversational interviews with 2 other teachers from an Ontario College in a large urban centre who have utilized educational technologies in their teaching and learning communities and I maintained a research journal, constructed during the interview process, to record my own emerging narrative accounts, reflections, insights and further questions. The field texts consisted of transcriptions of the interviews and my reflective journal. Research texts were developed as field texts were listened to multiple times and texts were examined for meanings and themes. The educational technologies that both women focused on in the interview were digital video of children as they play, learn and develop and the use of an audible teacher voice in online courses. The invitation given to students to explore and discover meaning in videos of children as they watched them with the teacher seemed to be a catalyst for authenticity and a sense of synergy in the classroom. The power of the audible teacher voice came through as an essential component in online learning environments to offer students a sense of humanness and connection with the teacher. Relationships in both online and face to face classrooms emerged as a necessary and central component to all teaching and learning communities. The theme of paradox also emerged as participants recognized that educational technologies can be used in ways that enhance creativity, authenticity, reflection and relationships or in ways that hinder these qualities in the teaching and learning community. Knowledge of the common experiences of college educators who utilize educational technologies, specifically digital video of children to educate early childhood educators, might give meaning and insight to inform the practice of other teachers who seek authentic, reflexive practice in the classroom and in on line environments.
