The Institution of Transmission Easement in Poland

The text presents an analysis of the institution of transmission easement, which is featured from the perspective of civil-law and public-law relations. The text does not address all the issues related to the institution of transmission easement, that is, no comprehensive analysis of the issues of the grounds for easement establishment, expiry, or remuneration and compensation for easement was conducted. The text presents a general description of the establishment of transmission easement against the backdrop of the Polish Civil Code and the Bill on Transmission Corridors of 18 July 2013, which is currently being drafted. The analysis of the easement institution, apart from the synthetic approach to legal provisions, features a functional and teleological interpretation. It is worth pointing out the aim that the legislator wished to achieve with respect to the work on new considerations both in the domain of the private and public law: 1. the legislator aimed to regulate the disorderly legal status of civil-law relations, but also to avoid dispute in the future, 2. with the aid of new regulations, the legislator wished to respond to the public interest.

Polska zrobiła w obszarze reform w latach 2009-2011 pierwsze kroki w kierunku, na który patrzymy bardzo życzliwie. Jednak pierwsze kroki wymagają kroków kolejnych – bardziej stanowczych i bardziej skoordynowanych, opartych na fundamencie zmian już wprowadzanych w życie – którym będzie towarzyszyć przekonująca wizja przyszłości, a także adekwatne do skali przewidywanych zmian publiczne nakłady finansowe. Wizja jest niezbędna. Wspólnota akademicka, a przede wszystkim jej najmłodsze pokolenie, musi wiedzieć, na jakich podstawach ma budować swoją akademicką przyszłość i czy jest w stanie się w niej odnaleźć. Warto jasno powiedzieć, że z czasem pojawi się bardziej zróżnicowany system instytucji szkolnictwa wyższego, o różnych możliwościach i różnych zadaniach w różnych miejscach, realizujących różne misje i oferujących różne możliwości awansowe i finansowe. Warto powiedzieć, że niezbędne – ale i możliwe – będą pionowe migracje w ramach różnicującego się systemu w zależności od indywidualnych zdolności, umiejętności, pracowitości, a przede wszystkim mierzalnych osiągnięć naukowych. Należy także przypomnieć, że profesja akademicka nie daje równych szans wszystkim, ponieważ talenty naukowe w ramach wspólnoty akademickiej nie rozkładają się równo, ale z pewnością daje duże szanse najzdolniejszym; że w najlepszych ośrodkach naukowy wymiar kariery akademickiej, tak jak w świecie zachodnim, jest najważniejszy, a wszystkie pozostałe są tylko jego tłem; że z czasem wzorce pracy akademickiej i wzorce akademickich zarobków – w wybranych miejscach i dla wybranych grup badaczy – będą przypominać wzorce znane z najlepszych systemów zachodnich; i wreszcie, że w tych wybranych miejscach (zwanych uniwersytetami badawczymi czy flagowymi) uprawianie nauki nie będzie jednostkowym, częściowo niezrozumiałym i częściowo jedynie tolerowanym, hobby.

We współczesnym świecie mamy do czynienia jedynie z wybranymi elementami – tradycjami jeszcze żywymi lub przetworzonymi i dostosowanymi do wymogów współczesnego odbiorcy – turysty, ale także artysty i projektanta. Obecne zainteresowanie polską sztuką ludową i rzemiosłem to kolejna fala mody folkowej. Projekty zaliczane do nurtu etnodizajnu cechuje przede wszystkim różnorodność wykorzystanych materiałów (tradycyjnych i nowoczesnych), sposób ich przetworzenia, zachowanie pierwotnej funkcji lub nadanie nowej. Większość tych projektów sytuuje się też w nurcie eko-artu, sztuki nawiązującej do natury, z wykorzystaniem ekologicznych materiałów. Jest więc etnodizajn XXI kontynuacją ideologii stworzonej już w wieku XIX – przeciwstawieniem dla przemysłu, technicyzacji i umasowienia. A dla współczesnego człowieka – miejskiego – może być etnodizajn powrotem do źródeł.

Artichoke leaf extract (Cynara scolymus) reduces plasma cholesterol in otherwise healthy hypercholesterolemic adults: A randomized, double blind placebo controlled trial

Cardiovascular diseases are the chief causes of death in the UK, and are associated with high circulating levels of total cholesterol in the plasma. Artichoke leaf extracts (ALEs) have been reported to reduce plasma lipids levels, including total cholesterol, although high quality data is lacking. The objective of this trial was to assess the effect of ALE on plasma lipid levels and general well-being in otherwise healthy adults with mild to moderate hypercholesterolemia. 131 adults were screened for total plasma cholesterol in the range 6.0-8.0 mmol/l, with 75 suitable volunteers randomised onto the trial. Volunteers consumed 1280 mg of a standardised ALE, or matched placebo, daily for 12 weeks. Plasma total cholesterol decreased in the treatment group by an average of 4.2% (from 7.16 (SD 0.62) mmol/l to 6.86 (SD 0.68) mmol/l) and increased in the control group by an average of 1.9% (6.90 (SD 0.49) mmol/l to 7.03 (0.61) mmol/l), the difference between groups being statistically significant (p = 0.025). No significant differences between groups were observed for LDL cholesterol, HDL cholesterol or triglyceride levels. General well-being improved significantly in both the treatment (11%) and control groups (9%) with no significant differences between groups. In conclusion, ALE consumption resulted in a modest but favourable statistically significant difference in total cholesterol after 12 weeks. In comparison with a previous trial, it is suggested that the apparent positive health status of the study population may have contributed to the modesty of the observed response. Artichoke leaf extract reduces symptoms of irritable bowel syndrome and improves quality of life in otherwise healthy volunteers suffering from concomitant dyspepsia: a subset analysis

Objectives: Does artichoke leaf extract (ALE) ameliorate symptoms of Irritable bowel syndrome (IBS) in otherwise healthy volunteers suffering concomitant dyspepsia? Methods: A subset analysis of a previous dose-ranging, open, postal study, in adults suffering dyspepsia. Two hundred and eight (208) adults were identified post hoc as suffering with IBS. IBS incidence, self-reported usual bowel pattern, and the Nepean Dyspepsia Index (NDI) were compared before and after a 2-month intervention period. Results: There was a significant fall in IBS incidence of 26.4% (p<0.001) after treatment. A significant shift in self-reported usual bowel pattern away from "alternating constipation/diarrhea" toward "normal" (p<0.001) was observed. NDI total symptom score significantly decreased by 41% (p<0.001) after treatment. Similarly, there was a significant 20% improvement in the NDI total quality-of-life (QOL) score in the subset after treatment. Conclusion: This report supports previous findings that ALE ameliorates symptoms of IBS, plus improves health-related QOL.

A moving-mesh finite element method and its application to the numerical solution of phase-change problems

A distributed Lagrangian moving-mesh finite element method is applied to problems involving changes of phase. The algorithm uses a distributed conservation principle to determine nodal mesh velocities, which are then used to move the nodes. The nodal values are obtained from an ALE (Arbitrary Lagrangian-Eulerian) equation, which represents a generalization of the original algorithm presented in Applied Numerical Mathematics, 54:450--469 (2005). Having described the details of the generalized algorithm it is validated on two test cases from the original paper and is then applied to one-phase and, for the first time, two-phase Stefan problems in one and two space dimensions, paying particular attention to the implementation of the interface boundary conditions. Results are presented to demonstrate the accuracy and the effectiveness of the method, including comparisons against analytical solutions where available.

Molecular analysis of maltotriose active transport and fermentation by Saccharomyces cerevisiae reveals a determinant role for the AGT1 permease

Incomplete and/or sluggish maltotriose fermentation causes both quality and economic problems in the ale-brewing industry. Although it has been proposed previously that the sugar uptake must be responsible for these undesirable phenotypes, there have been conflicting reports on whether all the known alpha-glucoside transporters in Saccharomyces cerevisiae (MALx1, AGT1, and MPH2 and MPH3 transporters) allow efficient maltotriose utilization by yeast cells. We characterized the kinetics of yeast cell growth, sugar consumption, and ethanol production during maltose or maltotriose utilization by several S. cerevisiae yeast strains (both MAL constitutive and AM inducible) and by their isogenic counterparts with specific deletions of the AGT1 gene. Our results clearly showed that yeast strains carrying functional permeases encoded by the MAL21, MAL31, and/or MAL41 gene in their plasma membranes were unable to utilize maltotriose. While both high-and low-affinity transport activities were responsible for maltose uptake from the medium, in the case of maltotriose, the only low-affinity (K-m, 36 +/- 2 mM) transport activity was mediated by the AGT1 permease. In conclusion, the AGT1 transporter is required for efficient maltotriose fermentation by S. cerevisiae yeasts, highlighting the importance of this permease for breeding and/or selection programs aimed at improving sluggish maltotriose fermentations.

Gas-Phase Nucleophilic and Elimination Reactions in Simple Alkyl Nitrates

There has been increasing interest in the gas-phase reactivity of alkyl nitrates because of their well-known applications as explosives and because of then role in atmospheric and in marine processes This manuscript describes an experimental study by FT-ICR techniques of the gas-phase reactions of OH(-) and F(-) with methyl and ethyl Innate For methyl nitrate, the main reaction channel is found to be an elimination process promoted by abstraction of an a proton from the methyl group. Nucleophilic displacement of nitrate anion through an S(N)2 process at the carbon center Is also found to he an important reaction channel with methyl nitrate In ethyl nitrate, Ruination of NO(3)(-) is greatly enhanced and this is attributed to the ease of an E2-type elimination process promoted by proton abstraction at the beta position of the ethyl group. Theoretical calculations at the MP2/6-311+G(3df,2p)//MP2/6-31+G(d) level of theory ale consistent with the relative importance of the reaction channels and suggest that these reactions proceed through a double well potential The calculations also predict that nucleophilic attack by OH(-) at the nitrogen center (Sn2@N) is energetically the rueful ad pathway but experiments with (18)OH(-) showed no evidence for this channel. Single-point calculations reveal a strong preference for approach to the emboli center and may explain the lack of reactivity at the nitrogen center. Calculations were also carried out or NH(2)(-) and SH(-) to establish the reactivity pattern to provide a better understanding of environmentally relevant nitrate esters.

Etikettdesign hos framgångsrika alesorter i Sverige från olika produktionsländer

Föreliggande studie syftar till att kartlägga vilka designfaktorer som främst förekommer på etiketter hos framgångsrika aleproducenter från olika länder, samt undersöka om konsumenter kan urskilja produktionsland endast genom granskning av etiketten. För att undersöka detta genomfördes en visuell innehållsanalys för att ta fram designfaktorer för fem utvalda länder, varefter fem typexempel skapades. Typexemplen testades på konsumenter via en webbenkät. Slutsatsen är att det i vissa fall går att ta fram ett typexempel och i vissa fall kan en del av konsumenterna se vilket det tänkta produktionslandet är. I majoriteten av fallen gick det emellertid inte att ta fram ett perfekt typexempel och konsumenten kunde inte urskilja det tänkta produktionslandet.
