Volunteering is a very important part of life in Australia with an estimated 36% of the adult population volunteering in 2010. Voluntary work generates economic benefits, addresses community needs and develops the social networks that form the backbone of civil society. Without volunteers, many essential services would either cease to exist or become too expensive for many people to afford. These volunteers, who by definition are not in receipt of any remuneration for their work and services, are exposed to personal injury and to legal liability in the discharge of their functions. It is therefore appropriate that statutory protection is extended to volunteers and that volunteer organisations procure public liability and personal accident cover where possible. However, given the patchwork quilt of circumstances where statutory or institutional cover is available to volunteers and the existence of many and diverse exclusions, it is important to have regard also to what scope a volunteer may have to avail themselves of protection against liability for volunteering activity by relying upon their own personal insurance cover. This article considers the extent of private insurance cover and its availability to volunteers under home and contents insurance and under comprehensive motor vehicle insurance. The most common policies in the Australian market are examined and the uncertain nature of protection against liability afforded by these policies is discussed. This uncertainty could be reduced should the Federal Government through amendments to the Insurance Contracts Regulations standardise the circumstances and extent to which liability protection was afforded to an insured holding home and contents insurance and comprehensive motor vehicle insurance cover.

The convergence of corporate social responsibility (CSR) and corporate governance (CG) has changed the corporate accountability mechanism. This has developed a socially responsible ‘corporate self-regulation’, a synthesis of governance and responsibility in the companies of strong economies. However, unlike in the strong economies, this convergence has not been visible in the companies of weak economies, where the civil society groups are unorganised, regulatory agencies are either ineffective or corrupt and the media and non-governmental organisations do not mirror the corporate conscience. Using the case of Bangladesh, this article investigates the convergence between CSR and CG in the self-regulation of companies in a less vigilant environment.

This article provides evidence of the prevalence of wills and the principles underpinning the intended distribution of estates in Australia. Intentions around wealth transfers and the social norms that underpin them occur in the context of predicted extensive intergenerational transfers from the ageing baby boomer generation, policies of self provision and user pays for care in old age, broader views on what constitutes ‘family’, the increased importance of the not-for-profit sector in the delivery of services, and the related need for philanthropy. A national telephone survey conducted in 2012 with 2,405 respondents aged 18 and over shows that wills are predominantly used to distribute assets to partners and/or equally to immediate descendants. There is little evidence that will makers are recognising a wider group of relationships, obligations and entitlements outside the traditional nuclear family, or that wills are being replaced by other mechanisms of wealth transfer. Only a minority consider bequests to charities as important. These findings reflect current social norms about entitlements to ‘family’ money, a narrow view of what and who constitutes ‘family’, limited obligation for testators to recompense individuals or organisations for care and support provided, and limited commitment to charitable organisations and civil society.

This report provides an analysis of the cultural, policy and legal implications of ‘mash-ups’. This study provides a short history of mash-ups, explaining how the current ‘remix culture’ builds upon a range of creative antecedents and cultural traditions, which valorised appropriation, quotation, and transformation. It provides modern examples of mash-ups, such as sound recordings, musical works, film and artistic works, focusing on works seen on You Tube and other online applications. In particular, it considers - * Literary mash-ups of canonical texts, including Pride and Prejudice and Zombies, The Wind Done Gone, After the Rain, and 60 Years Later; * Artistic mash-ups, highlighting the Obama Hope poster, the ‘Column’ case, and the competition for extending famous album covers; * Geographical mash-ups, most notably, the Google Australia bushfires map; * Musical mash-ups, such as The Grey Album and the work of Girl Talk; * Cinematic mash-ups, including remixes of There Will Be Blood and The Downfall; and This survey provides an analysis of why mash-up culture is valuable. It highlights the range of aesthetic, political, comic, and commercial impulses behind the creation and the dissemination of mash-ups. This report highlights the tensions between copyright law and mash-ups in particular cultural sectors. Second, this report emphasizes the importance of civil society institutions in promoting and defending mash-ups in both copyright litigation and policy debates. It provides a study of key organisations – including: * The Fair Use Project; * The Organization for Transformative Works; * Public Knowledge; * The Electronic Frontier Foundation; and * The Chilling Effects Clearinghouse This report suggests that much can be learnt from this network of organisations in the United States. There is a dearth of comparable legal clinics, advocacy groups, and creative institutions in Australia. As a result, the public interest values of copyright law have only received weak, incidental support from defendant companies – such as Network Ten and IceTV – with other copyright agendas. Third, this report canvasses a succinct model for legislative reform in respect of copyright law and mash-ups. It highlights: * The extent to which mash-ups are ‘tolerated uses’; * The conflicting judicial precedents on substantiality in Australia and the United States; * The debate over copyright exceptions relating to mash-ups and remixes; * The use of the take-down and notice system under the safe harbours regime by copyright owners in respect of mash-ups; * The impact of technological protection measures on mash-ups and remixes; * The possibility of statutory licensing in respect of mash-ups; * The use of Creative Commons licences; * The impact of moral rights protection upon mash-ups; * The interaction between economic and moral rights under copyright law; and * Questions of copyright law, freedom of expression, and political mash-ups.

Non-governmental organisations (NGOs) have gained an important role in development co-operation during the last two decades. The development funding channelled through NGOs has increased and the number of NGOs engaged in development activities, both North and South, has been growing. Supporting NGOs has been seen as one way to strengthen civil society in the South and to provide potential for enhancing more effective development than the state, and to exercise participatory development and partnership in their North-South relationships. This study focuses on learning in the co-operation practices of small Finnish NGOs in Morogoro, Tanzania. Drawing on the cultural-historical activity theory and the theory of expansive learning, in this study I understand learning as a qualitative change in the actual co-operation practices. The qualitative change, for its part, emerges out of attempts to deal with the contradictions in the present activity. I use the concept of developmental contradiction in exploring the co-operation of the small Finnish NGOs with their Tanzanian counterparts. Developmental contradiction connects learning to actual practice and its historical development. By history, in this study I refer to multiple developmental trajectories, such as trajectories of individual participants, organisations, co-operation practices and the institutional system in which the NGO-development co-operation is embedded. In the empirical chapters I explore the co-operation both in the development co-operation projects and in micro-level interaction between partners taking place within the projects. I analyse the perceptions of the Finnish participants about the different developmental trajectories, the tensions, inclusions and exclusions in the evolving object of co-operation in one project, the construction of power relations in project meetings in three projects, and the collision of explicated partnership with the emerging practice of trusteeship in one project. On the basis of the empirical analyses I elaborate four developmental contradictions and learning challenges for the co-operation. The developmental contradictions include: 1) implementing a ready-made Finnish project idea vs. taking the current activities of Tanzanian NGO as a starting point; 2) gaining experiences and cultural interaction vs. access to outside funding; 3) promoting the official tools of development co-operation in training vs. use of tools and procedures taken from the prior activities of both partners in actual practice; and 4) asymmetric relations between the partners vs. rhetoric of equal partnership. Consequently, on the basis of developmental contradictions four learning challenges are suggested: a shift from legitimation of Finnish ideas to negotiation, transcending the separate objects and finding a partly joint object, developing locally shared tools for the co-operation, and identification and reflection of the power relations in the practice of co-operation. Gentlemen, Lads and the Art of War The Construction of Citizen Soldier- and Professional Soldier Armies into the Miracle of the Winter War During the 1920s and 1930s The Miracle of the Winter War was not a myth - at least according to them, who were making that miracle to happen. This study is not just about the Armed Forces and society, but moreover a study about civil society inside the organization of armed forces. Conscription kept Finnish military organization (and is still keeping) very closely connected with civil society and therefore there is no need to locate the possible critical misunderstandings brought by two different identity-based approaches. The great performance of the Armed Forces during the Second World War was not made of superior art of war. It was not the high level of discipline either. Art of war is basically a (deep level) cultural level equation that has more to do with culturally absorbed schemes of meaning making than rational decision-making. Naturally attrition based approach to effect-making directed the organizational methods in attrition based organisational practices, where there were only minor possibilities to practice any manoeuvre-based organisational behaviour. The practice and method of leadership lent similarly to the attrition-based thinking, which directed the organisational cultural thoughts towards composition that confirmed antagonism between gentlemen and lads . This setting has been absorbed and learned through cultural socialisation and was therefore not a product of the military organisation itself. The Finnish Armed Forces included two different communities (gentlemen and lads) within the same organisation as there were both the official and the unofficial organisations presented. This caused problems as they both made meaning-making processes simultaneously. These organisations had their own overlapping and in most cases also contradictory social meanings. The unofficial organisation has been overshadowed by the vast number of studies concerning the official organisation. The main reason for this systematic neglect is based on the reality of the attitudes and living conditions of the micro-level organisation which produced (perhaps) too realistic and repulsive viewpoints that are presenting a picture of a national level identity process in a way that is separating it from the ideals made to verify the ethos of national values. Complaining, griping, grumbling and moaning are usually situated in a category of abnormal and unwanted behaviour. However, within the context of a citizen soldier army community this was more of a characteristic feature of that organisation (in Finland) and therefore it was crucially important to locate the context of that abnormal behaviour. According to this study, it was not a malicious act but moreover seriously formed efforts in trying to use common sense in the chaos citizen soldiers faced when they were uniformed and placed in an unfamiliar process of disciplinary measures and frictions and competition between different ranks. There is much evidence that reinforces the argument that what seemed to be the most unconventional behaviour was finally the most efficient in a sense of military performance.

Resumen: En este ensayo, el autor plantea el tema de las relaciones entre el Estado y las escuelas de la sociedad civil. En 1993 la Ley Federal de Educación estableció que las escuelas públicas y privadas aportan por igual al bien común de la sociedad. Sin embargo, en los últimos años, esta idea ha dado pie a la creación de un proyecto de re-estatización de la educación privada que Torrendell denuncia puesto que en caso de efectivizarse, cercenaría la participación de la sociedad civil en el ámbito educativo. Frente a esto, debe reconocerse el valioso papel de las escuelas privadas que enriquecen a la sociedad con su pluralismo democrático.

This report presents a discussion of communications strategies to influence policy outcomes. It is based on a series of interviews with projects, NGOs and regional organisations to review current activities and assess the implications for STREAM of developing a communications strategy within a livelihoods framework. The main message of the report is that in order to fulfil its guiding principles. STREAM must acknowledge that policy change is related to governance and civil society, and requires a broad range of partnerships and a broad range of voices in the policy-making arena. Este trabalho tem por objetivo conhecer, na visão da militância com atuação no setor saúde no âmbito do Estado do Rio Janeiro, as perspectivas para a ampliação e qualificação da participação social no SUS, considerando a contribuição das políticas da SEGEP/MS para a democratização das políticas públicas de saúde. Parte do conceito de Estado e sociedade civil do liberal Hobbes, buscando a evolução histórica dos termos até os marxistas, com especial atenção ao conceito de Estado ampliado de Gramsci. A concepção gramsciana nos ajuda a compreender o processo de desenvolvimento da sociedade civil brasileira e a relação de nosso objeto de estudo com o Estado. Consultando as Portarias de criação e os relatórios de gestão da SGEP/MS, construímos nossa base documental que, confrontada com os depoimentos de militantes do setor saúde que atuam no Estado do Rio de Janeiro, subsidiaram nosso estudo. Nossas considerações finais apontam para as contradições típicas de um governo de coalizão, composto por frações da classe subalterna que negociam o poder com a classe dominante.

Entre os anos de 2009 a 2012 o município de Duque de Caxias realizou uma parceria com uma organização social civil de interesse público (OSCIP) para gerir seis unidades mistas de saúde. A tuberculose (TB) é um grave problema de saúde pública no Brasil. Em Duque de Caxias o Programa de Controle de Tuberculose necessitava ampliação e descentralização para o maior acesso à população. Objetivo: Este estudo teve como objetivo avaliar o impacto da gestão de uma OSCIP em seis unidades de saúde do município de Duque de Caxias, Estado do Rio de Janeiro, tendo como base os resultados alcançados no Programa de Controle da Tuberculose (PCT). Metodologia: Realizou-se uma pesquisa quantitativa, descritiva, de evolução temporal dos indicadores do PCT, com base em dados secundários gerados através do banco de dados do SINAN/DC, assim como a análise documental do Livro de Registros das Baciloscopias e Culturas do PCT. Levantamento na literatura sobre o tema. Também através de pesquisa eletrônica pela internet realizou-se um levantamento na literatura sobre o tema. Resultado e Discussão: A parceria com a OSCIP possibilitou a descentralização do Programa de Controle da Tuberculose para os quatro distritos do município. Na análise dos indicadores observou-se melhor desempenho das unidades de saúde sob a gerência da OSCIP em alguns indicadores de processo, como realização do exame anti-HIV e percentual de baciloscopias realizadas. Quanto aos indicadores de resultado, em ambos os tipos de gerência, observou-se baixa atuação no alcance das metas nacionais. Conclusão: Apesar das limitações metodológicas, como o curto período de tempo da análise dos indicadores, a utilização de dados secundários (SINAN), o presente estudo permitiu um olhar inicial das vantagens, desvantagens e limitações da parceria com uma OSCIP no serviço público. Serão necessários novos estudos com período maior de tempo além da inclusão de outros indicadores

The idea of participation is becoming increasingly important in international human rights law and recent political and constitutional theory. There is an emerging international law right of minorities to participate in public life. There are many problems though with putting this right into practice. It is not enough to offer formal opportunities for representation or even to facilitate more participatory processes. This article explores how participation is more easily proclaimed than practised by examining the position of one ethnic minority, Travellers, in a liberal democracy, Ireland. While there are many formal opportunities for participation, these do not necessarily result in effective participation on a basis of equality, and may still result in decisions which fail to consider the Traveller culture and identity. Travellers still suffer from an imbalance of power in these arrangements. There are hopeful avenues to pursue in improving participation, the role of civil society and the use of a dialogue between non-governmental organisations and international organisations to put pressure on a national government, including special representation to offset the disadvantages of traditional representative democracy and emphasising the role of special parliamentary bodies; and the need to address the politics of recognition so as to strengthen the hand of disadvantaged groups such as Travellers.

This paper reports the results of research into social capital levels in the Central Housing Community Network, part of the community consultation structure of the Northern Ireland Housing Executive. Membership of the forum increased the bonding, bridging and linking social capital of its members and appeared to improve community relations, although that was not its stated purpose. However, the empirical link between social capital and the quality of community relations remains unproven. The research provides an example of the state creating a positive space for interaction with civil society through consultation on service delivery issues. In an international policy environment where ‘mixed’ communities are the ideal, the potential of service-based forums to contribute to community cohesion may have been underestimated.

Non‐governmental organizations (NGOs) in societies undergoing socio‐economic transition are widely regarded as central to building a civil society that encourages democracy. At the moment, the Bulgarian civil society depends greatly on foreign funding whilst NGOs are unable to empower their beneficiaries in decision‐making. Given this reality, are cross‐national NGO partnerships able to strengthen organisations? What kinds of support are on offer, what kinds of (inter) dependency relations occur and to what extent do NGOs model their management practices on their mentor and with what results?
This paper sets out to situate these questions in the context of a proposed theoretical construct, organizational mentoring, which occurs where national or local organisations have access to and support of well‐established NGOs abroad. The model is constructed on the findings of a qualitative case study conducted in Bulgaria on the development of a Bulgarian NGO and its relationship with a UK NGO. This is preceded by a discussion on selected literature reflecting the meaning of transition, change in societal values and organizational practices in Eastern Europe, and the development of voluntary sector organizations in transforming countries. The theoretical model proposed here is relevant in providing a systematic discussion on organizational change towards a more enlightened engagement between civil society organizations in cross‐national partnerships. Such discussion has implications for the development of hybrid forms of coexistence between Eastern and Western European partners reflected in their interdependent organizational practices.

A tese tem como foco quatro eixos centrais: o ensino superior, a sociedade civil, a cidadania e a hegemonia. Na primeira parte da tese, estes eixos teórico-conceptuais são explanados numa perspectiva da promoção de uma compreensão mais ampla da sociedade civil e do estado, nomeadamente o contratualismo, o liberalismo, o materialismo e o neoliberalismo. Um protagonismo fundamental é atribuído às concepções de Antonio Gramsci de sociedade civil, cidadania e estado aplicadas no ensino superior no Sul da Amazónia brasileira. A segunda parte da tese concentra-se num estudo de caso com três premissas de análise: a fragmentação do ensino superior brasileiro; a reconfiguração da cidadania e hegemonia; e o ensino superior no contexto do Amazonas. O ensino superior no Brasil teve início com as escolas jesuíticas, que, depois de encerradas pelo Marquês de Pombal não tiveram sucessoras em solo brasileiro, ao nível do que poderia ter sido o embrião de um sistema de ensino superior. A chegada da Corte Imperial Portuguesa, em 1808, permite reinstalar novos cursos. A primeira unidade de ensino superior no Amazonas surge apenas no princípio do século XX. Um século depois, tem início o processo de expansão com a implantação de unidades no interior do estado. O ensino superior no Brasil, nas últimas décadas, assumiu um caráter híbrido e de massificação. A massificação, no entanto, ainda é uma realidade a ser alcançada. Apesar dos avanços realizados na última década, ainda subsiste ainda uma forte exclusão de estudantes. O enfoque sobre o ensino superior e a cidadania, no contexto do Amazonas, surge na articulação de um conjunto de informação empírica, extraída de entrevistas realizadas com atores chave locais, com as categorias de pensamento de Antonio Gramsci, que sustentam teoricamente o estudo. Esta articulação tem no ensino superior a possibilidade de desenvolver a cidadania como o princípio organizador e fim último deste nível de ensino. Neste sentido, a hegemonia ganha um estatuto de orientação e direção que permite aos sujeitos envolvidos no ensino superior maior possibilidade de autonomia, liberdade, justiça social, empregabilidade e desenvolvimento social. O modelo de universidade para a cidadania apresenta-se como uma possibilidade de mudanças no horizonte social, económico e também político, no interior da própria universidade. O ensino superior, perspectivado como um instrumento essencial para a cidadania, tem como objetivo primordial a qualificação de professores para a educação de base, Reflexivamente, esta qualificação não deixará potencialmente de produzir retornos positivos na própria expansão e abrangência numérica e educativa do próprio ensino superior. Desta forma, a cidadania no ensino superior é perspectivada neste estudo como um deslocamento de lógicas de compreensão individual e de individualização elitista dos benefícios para lógicas assentes em construções mais coletivas, portadoras de benefícios sociais. A interiorização do ensino superior no Amazonas é assumida no estudo como uma possibilidade de formação académica para o desenvolvimento de práticas pedagógicas e científicas críticas e mais conscientes, constituindo um horizonte determinante para a ativação de processos de integração regional e nacional. Em suma, os pontos de confluência entre o ensino superior, a sociedade civil, a cidadania e as propostas de Gramsci, estão relacionados com a formação, a conscientização política, e o bem-estar económico e social.
