In the lead-up to the discussions over IP and climate change in Copenhagen in 2009, the US House of Representatives passed a resolution that it should be the policy of US government officials in discussions over the long-term action under the United Nations Framework on Climate Change to ‘prevent any weakening of, and ensure robust compliance with and enforcement of, existing international legal requirements as of the date of the enactment of this Act for the protection of IP rights related to energy or environmental technology’.

The possibility of commercially exploiting plant, animal and human genetic resources unlocked by biotechnology has given rise to a wide range of cultural, environmental, ethical and economic conflicts. While supporters describe this activity as bioprospecting, critics refer to it as biopiracy. According to this latter view, international legal agreements and treaties have disregarded opposition and legalized the possibility of appropriating genetic resources and their derivative products through the use of patents. The legal framework that permits the appropriation of natural genetic products in Colombia also criminalizes aspects of traditional ways of life and enables a legally approved but socially harmful land-grabbing process. The article describes these processes and impact in terms of the inversion of justice and the erosion of environmental sustainability.

This new work provides a comprehensive and theoretically rich discussion of the law on cross-border insolvency. It engages with several current multi-billion dollar insolvencies such as those of Nortel Networks and Lehman Brothers to provide the reader with state of the art knowledge of the complex problems posed by transnational insolvency. As the number of transnational insolvencies grows due to prevailing economic conditions, practitioners are increasingly required to navigate the mass of legal rules applicable to cross-border insolvency situations. The associated challenges are heightened by the diversity of legal structures employed by modern business entities and a patchwork of costly, inefficient, and unpredictable national legal rules. The response has been a proliferation of international legal instruments such as the UNCITRAL Model Law and the the EU Insolvency Regulation, supplemented by judicial practice, adding further layers of complexity. Writing from an Australian perspective, the authors analyse this network of legal rules and subsequent case law. In addition, they explain the theoretical underpinnings of these rules in an accessible manner to build a solid foundation for practice, facilitate advanced reasoning, and enable the development of sophisticated arguments for law reform. Comparative case law from jurisdictions such as the United States and United Kingdom is also included. This book is highly relevant to insolvency practitioners faced with the recovery of assets located in different jurisdictions, transactional lawyers for whom knowledge of potential insolvency pitfalls is essential, and academics. It is invaluable for students at both undergraduate and postgraduate level seeking a sound understanding of this challenging area of law.

The prospect of widespread displacement in the Pacific as a result of climate change is becoming increasingly likely and it is possible that many will eventually need to relocate to other countries. Regional migration strategies not only offer the potential to minimise the harms of relocation, while acknowledging existing relationships of friendship and regional cooperation. This article examines the use of the language of ‘neighbourliness’ in Australia’s regional climate change strategies and argues that, while it expresses friendship, such language can also be employed to avoid the creation of stronger obligations. The article considers the international doctrine of good neighbourliness and concludes that, while international legal obligations may not yet exist, Australia should nonetheless begin planning for regional migration within the Pacific to allow people to migrate with dignity.

The rule of law is understood to be a core aspect in achieving a stable economy and an ordered society. Without the elements that are inherent in this principle the possibilities of anarchy, unfairness and uncertainty are amplified, which in turn can result in an economy with dramatic fluctuations. In this regard, commentators do not always agree that the rule of law is strictly adhered to in the international legal context. Therefore, this paper will explore one aspect of international regulation and consider whether the UNCITRAL Model Law on Cross-border Insolvency (1997) (‘Model Law’) and its associated Guide to Enactment and Interpretation (2013) contribute to the promotion of the key elements of the rule of law.

The aim of this paper is to present the evolution of the Francovich doctrine within the European legal order. The first part deals with the gradual development of the ECJ's case law on State liability in damages for breach of EC law. Starting from the seminal Francovich and Brasserie du Pêcheur, the clarification of the criteria set by the Court is attempted with reference to subsequent case law, whereas issues concerning the extent and form of the compensation owned are also mentioned. The second part concerns one of the more recent developments in the field, namely State liability for breaches of Community law attributed to national judiciary. The Court's ruling in Köbler is examined in connection with two other recent judgments, namely Commission v. Italy of 2003 and Kühne & Heitz, as an attempt of the ECJ to reframe its relationships with national supreme courts and appropriate for itself the position of the Supreme Court in the European legal order. The implications on State liability claims by the ruling in Commission v. France of 1997 constitute the theme of the third part, where it is submitted that Member States can also be held liable for disregard of Community law by private individuals within their respected territories. To this extent, Schmidberger is viewed as a manifestation of this opinion, with fundamental rights acquiring a new dimension, being invoked by the States, contra the individuals as a shield to liability claims. Finally, the third part examines the relationship between the Francovich doctrine and the principle of legal certainty and concludes that the solutions employed by the ECJ have been both predictable and acceptable by the national legal orders. Regional autonomy in Indonesia was initially introduced as a means of pacifying regional disappointment at the central government. Not only did the Regional Autonomy Law of 1999 give the Balinese a chance to express grievance regarding the centralist policies of the Jakarta government but also provided an opportunity to return to the regional, exclusive, traditional village governance (desa adat). As a result, the problems faced by the island, particularly ethnic conflicts, are increasingly handled by the mechanism of this traditional type of governance. Traditional village governance with regard to ethnic conflicts (occurring) between Balinese and migrants has never been systematically analyzed. Existing analyses emphasized only the social context, but do not explain either the cause of conflicts and the ensuing problems entails or the virtues of traditional village governance mechanisms for mediating in the conflict. While some accounts provide snapshots, they lack both theoretical and conflict study perspective. The primary aim of this dissertation is to explore the expression and the causes of conflict between the Balinese and migrants and to advance the potential of traditional village governance as a means of conflict resolution with particular reference to the municipality of Denpasar. One conclusion of the study is that the conflict between the Balinese and migrants has been expressed on the level of situation/contradiction, attitudes, and behavior. Yet the driving forces behind the conflict itself consist of the following factors: absence of cooperation; incompatible position and perception; inability to communicate effectively; and problem of inequality and injustice, which comes to the surface as a social, cultural, and economic problem. This complex of factors fuels collective fear for the future of both groups. The study concludes that traditional village governance mechanisms as a means of conflict resolution have not yet been able to provide an enduring resolution for the conflict. Analysis shows that the practice of traditional village governance is unable to provide satisfactory mechanisms for the conflict as prescribed by conflict resolution theory. Traditional village governance, which is derived from the exclusive Hindu-Balinese culture, is accepted as more legitimate among the Balinese than the official governance policies. However, it is not generally accepted by most of the Muslim migrants. In addition, traditional village governance lacks access to economic instruments, which weakens its capacity to tackle the economic roots of the conflict. Thus the traditional mechanisms of migrant ordinance , as practiced by the traditional village governance have not yet been successful in penetrating all aspects of the conflict. Finally, one of the main challenges for traditional village governance s legal development is the creation of a regional legal system capable of accommodating rapid changes in line with the national and international legal practices. The framing of the new laws should be responsive to the aspirations of a changing society. It should not only protect the various Balinese communities interests, but also that of other ethnic groups, especially those of the minority. In other words, the main challenge to traditional village governance is its ability to develop flexibility and inclusiveness.

Functional transition theory: administration, legal order and institutions in Russia This dissertation examines some of the salient characteristics of Russia that are deemed to have impeded the growth of its economy and investments in particular. These characteristics are the volatility of the administrative and legal systems, corruption, and the perceived irrationality and difference in the operating environment in comparison with European conditions. The dissertation is one of the first studies on Russia that approaches the subject from the perspective of comprehensive social scientific theories. The study is based on the structural functionalistic theory, which is widely used in the social sciences. Adopting a sufficiently ambitious theoretical examination will provide a systematic and logical explanation of the characteristics of Russian institutions and ways of operations, such as corruption, that are commonly perceived as inexplicable. The approach adopted in the dissertation sheds light on the history of Russia's development and provides a comparative view of other societies in transition. Furthermore, it suggests recommendations as to how the structures of Russian society could be comprehensively strengthened.

Resumen: Este trabajo tiene como objetivo principal desarrollar un análisis conceptual de “Derechos Humanos”. Primeramente se dará cuenta de las definiciones habituales, entre ellas, aquellas facultades e institutos que, en cada momento histórico, concretan las exigencias de libertad, igualdad y dignidad humana, y que deben ser reconocidos por los ordenamientos normativos interno e internacional. A su vez, se pasará revista a sus características (innatos, necesarios, inalienables, imprescriptibles, oponibles erga omnes , universales, laicos, carentes de connotación ideológica, ya sea religiosa o política, fundados en una filosofía humanista e indivisibles. Luego, se enunciarán y analizarán sus fuentes y antecedentes históricos: desde 1945 con la Carta de la ONU, hasta 1993 en la Conferencia de Viena. Además, se estudiarán los principales sistemas de protección tanto a nivel nacional como internacional. Finalmente -y como ejemplo ilustrativo de uno de los Derechos Humanos-, se explicitará a la Bioética, puntualizando el análisis en el derecho a la salud

A soberania já foi conceituada de diversos modos ao longo da história. Apesar disso, não deixou de ser a categoria mais elementar do direito internacional; expressando o fundamento de atuação dos Estados, foi através da soberania que o direito internacional se desenvolveu do Século XVII até os dias de hoje. Isso evidencia uma distinção entre o conteúdo da soberania, quer dizer, o seu modo de manifestação, o seu conceito, que se altera em cada período histórico, de um lado, e, do outro, a forma jurídica internacional expressa pela soberania, que se mantém intacta e que existe independentemente do conteúdo que lhe é dado, quer dizer, o lugar que ela ocupa no direito internacional. Através da análise do conceito de soberania fornecido por três autores clássicos de diferentes períodos históricos Hugo Grotius, Pasquale Mancini e Hans Kelsen o presente trabalho tem por objetivo demonstrar o caráter ideológico de cada teoria e, conseqüentemente, sua inexatidão. Para fazê-lo, foi adotado o método materialista dialético, através do qual a produção de idéias por parte do homem deve ser observada nos limites das suas condições de existência e as idéias produzidas como um reflexo consciente do mundo real. Cuida-se, assim, de observar o direito de superioridade afirmado por Grotius nos limites das condições de existência humana que se alteravam com a transição do feudalismo para capitalismo, e extrai-se o seu sentido da luta entre a Igreja e os monarcas que iam centralizando sob si o poder. Da mesma forma, observa-se o direito de nacionalidade de Mancini sob as condições de existência propiciadas pelo amadurecimento das classes sociais do capitalismo na Europa Ocidental como fruto da Revolução Industrial, extraindo-se seu sentido das lutas revolucionárias por libertação nacional que ali se desenrolavam. O caráter essencialmente limitado da soberania de Kelsen, enfim, será observado no contexto da passagem do capitalismo para sua época imperialista, como um reflexo consciente dos desenvolvimentos experimentados pelo direito internacional no fim do Século XIX e início do Século XX, após a Primeira Guerra Mundial. Assim, além de demonstrar o caráter ideológico e a inexatidão dos conceitos mencionados, busca-se demonstrar que o conteúdo da soberania em cada período histórico analisado encontra sua razão de ser na correspondente fase de desenvolvimento do capitalismo e que a forma jurídica soberania, isto é, o lugar que ela ocupa no direito internacional, é determinado pela necessidade do capitalismo de um instrumento de força que assegure a acumulação de capital, o Estado soberano.

A paternidade responsável se destaca no contexto da Constituição de 1988, refletindo seus efeitos para todo o sistema. Os pais, ao assumirem esse status, passam a ser titulares de diversas obrigações sendo verdadeiro afirmar que deles, de alguma forma, sempre se exigiu certo tipo de responsabilidade. Seu conteúdo, todavia, é que variou no histórico da construção da família brasileira. A proteção aos filhos, anteriormente mais formalista e restrita à aplicação de medidas de suspensão ou destituição do poder familiar (pátrio poder), cedeu espaço para outros valores. Atualmente, cabe aos pais, em essência, a formação e a emancipação da pessoa do filho. Assistir, educar e criar são as ações básicas que informam a sua responsabilidade, sendo ainda titulares do dever de inserir o menor no contexto da família e da sociedade. A igualdade, a solidariedade e a autonomia se mesclam ao encargo parental, a bem da formação física e psíquica da prole. Mas, é necessário observar que o dever de cuidado, imposto constitucionalmente aos pais, é transferido para os filhos após a maioridade, por meio de uma lógica de reciprocidade e vulnerabilidade. Assim, passam estes a ser responsáveis pela assistência e pelo cuidado dos ascendentes doentes ou, por qualquer outro motivo, necessitados. Considerado o fato de que a verdadeira parentalidade é aquela que cria o estado concreto de pai-filho, reflexo do cumprimento da responsabilidade, é forçoso concluir pela inexistência de seus efeitos jurídicos nos casos em que o vínculo restou fixado pela simples formalidade do registro. Defende-se, então, para o fim de eximir os filhos de seus deveres, a desconstituição do vínculo registral ou a inocuidade de seus efeitos, sempre que os pais não tenham cumprido responsavelmente as suas funções em benefício da prole. As normas jurídicas constitucionais e infraconstitucionais legitimam tal prerrogativa, afastando as obrigações dos filhos cujos direitos fundamentais não foram respeitados pela incúria daqueles que tinham contrariamente o encargo de assistir e cuidar.

Este trabalho se propõe a desvendar os contornos principiológicos e instrumentais daquilo que doravante iremos chamar Justo Processo Coletivo Laboral, ramo especialíssimo do processo dedicado à resolução de lides trabalhistas metaindividuais. O foco de nossas atenções é a tutela que é prestada em favor e não contra a coletividade. A falta de disposições específicas na CLT a respeito da tutela de direitos difusos, coletivos e individuais homogêneos próprios à realidade do trabalho torna imperiosa a inserção do Processo Trabalhista no circuito normativo de tutela coletiva, no chamado microssistema coletivo de tutela, composto, dentre outros diplomas, pelo Código de Defesa do Consumidor e pela Lei da Ação Civil Pública. A acomodação do Processo do Trabalho no ambiente coletivista será feita à luz da constelação de princípios constitucionais do processo e sob influxo do paradigma processual instrumental. A partir da identificação das principais barreiras que repelem o trabalhador do Poder Judiciário, procura-se demonstrar de que modo podem as ações coletivas contribuir para sua superação e assim para alavancar e universalizar o acesso à justiça, meta síntese para a qual convergem todos os esforços da processualística contemporânea. Apresentadas suas nuanças principiológicas, parte-se para a análise de seus principais institutos e do modo como deverá ser operacionalizado no dia-a-dia, isto é, de como irá funcionar. A crise de efetividade do processo de bases individualistas, especialmente para o trabalhador hipossuficiente, acentua a importância do devido processo legal coletivo do trabalho, instrumentalmente vocacionado a tornar justo o embate Capital X Trabalho e a conduzir grupos de trabalhadores de uma só vez à justa ordem jurídico-social.

[ES]Este trabajo analiza la formación y el perfeccionamiento de los contratos electrónicos celebrados entre consumidores y empresarios. Para ello, nuestro examen se centrará en la legislación española sobre esta materia, teniendo también presente tanto la regulación de la Unión Europea como la internacional. Así, analizaremos las fases que preceden a la perfección, el perfeccionamiento y la confirmación de la aceptación. Finalmente, tendrá mención especial el derecho de desistimiento.

O presente trabalho tem por intento principal evidenciar relação entre a produção brasileira de biodiesel e seus motivadores gerados na ordem ambiental internacional. Esta ordem possui em seu contexto as questões ambientais e energéticas contemporâneas, as quais têm evidenciado o ideário do Desenvolvimento Sustentável como possível solução para as incongruências entre a produção capitalista do espaço e as leis da termodinâmica. Destarte, faz-se a análise da territorialização da produção brasileira de biodiesel e os (re)arrajos promovidos no espaço agrário, tendo como fito a inserção da agricultura familiar no complexo agroindustrial do biodiesel, dado que o Programa Nacional de Produção e Uso do Biodiesel a preconiza como alvo das ações de inclusão social. Diante disso, torna-se fundamental analisar o papel de Petrobras Biocombustível enquanto principal promotor dessa inserção, sobretudo na região Nordeste.
