La presente tesi di dottorato ha ad oggetto l’analisi dei profili critici emersi nella prassi in relazione alle transnational damages group actions. All’interno di tale esteso ambito di ricerca, senza pretese di esaustività, si affronteranno determinati aspetti, tenendo in considerazione quanto accaduto negli ordinamenti che, sebbene in modo assai limitato, hanno già conosciuto tali problematiche. A seguito di una prima parte meramente introduttiva, nel secondo capitolo, si inquadreranno brevemente gli strumenti di tutela collettiva risarcitoria, indicando in che cosa consistano, a quali esigenze rispondano e quale origine abbiano; si indicheranno altresì i criteri distintivi e di classificazione che maggiormente possono rilevare nell’ottica di una cross border litigation. Nel terzo capitolo si analizzerà in termini essenziali la disciplina delle azioni collettive di alcuni Paesi, al fine di porre le basi necessarie per comprendere in quale contesto normativo si pongano le problematiche inerenti alle multi-jurisdictional collective redress actions. Nel quarto capitolo, si prenderà in considerazione la dimensione transnazionale delle azioni collettive, tenendo presenti le categorie e le regole affermatesi nel diritto internazionale privato e processuale e, soprattutto, quelle esistenti nell’ordinamento italiano e comunitario. Si individueranno poi gli obiettivi prioritari che si deve porre il giudice richiesto di giudicare sull’azione collettiva nella necessità di rendere una pronuncia o approvare una transazione che, da un lato, sia riconosciuta ed eseguita nei Paesi in cui dovrà essere riconosciuta ed eseguita e che, dall’altro lato, in ipotesi di opt out procedure, precluda ai soggetti che la pronuncia o la transazione dovrebbe vincolare successive azioni individuali e/o collettive in altri Paesi. Nel quinto capitolo, alla luce dei dati indicati nel terzo capitolo e delle considerazioni effettuate nel quarto capitolo, si analizzeranno alcuni dei profili critici posti dalla dimensione transnazionale delle azioni collettive; a tal fine, la trattazione verrà suddivisa in diversi punti che, pur essendo necessariamente connessi tra loro, nella loro individualità riescano ad evidenziare l’importanza e la centralità di determinate questioni. Peraltro, nell’intento di rispondere in modo adeguato alle problematiche analizzate, si indicheranno alcune delle soluzioni sperimentate dalla pratica giudiziaria o proposte dalla recente letteratura sul tema. Seguirà, infine, un ultimo capitolo contenente le osservazioni conclusive sugli esiti del lavoro.

Abstract | In this article the shuffling of cards is studied by using the concept of a group action. We use some fundamental results in Elementary Number Theory to obtain formulas for the orders of some special shufflings, namely the Faro and Monge shufflings and give necessary and sufficient conditions for the Monge shuffling to be a cycle. In the final section we extend the considerations to the shuffling of multisets.

Dans ce mémoire, on s'intéresse à l'action du groupe des transformations affines et des homothéties sur l'axe du temps des systèmes différentiels quadratiques à foyer faible d'ordre trois, dans le plan. Ces systèmes sont importants dans le cadre du seizième problème d'Hilbert. Le diagramme de bifurcation a été produit à l'aide de la forme normale de Li dans des travaux de Andronova [2] et Artès et Llibre [4], sans utiliser le plan projectif comme espace des paramètres ni de méthodes globales. Dans [7], Llibre et Schlomiuk ont utilisé le plan projectif comme espace des paramètres et des notions à caractère géométrique global (invariants affines et topologiques). Ce diagramme contient 18 portraits de phase et certains de ces portraits sont répétés dans des parties distinctes du diagramme. Ceci nous mène à poser la question suivante : existe-t-il des systèmes distincts, correspondant à des valeurs distinctes de paramètres, se trouvant sur la même orbite par rapport à l'action du groupe? Dans ce mémoire, on prouve un résultat original : l'action du groupe n'est pas triviale sur la forme de Li (théorème 3.1), ni sur la forme normale de Bautin (théorème 4.1). En utilisant le deuxième résultat, on construit l'espace topologique quotient des systèmes quadratiques à foyer faible d'ordre trois par rapport à l'action de ce groupe.

We focus on kernels incorporating different kinds of prior knowledge on functions to be approximated by Kriging. A recent result on random fields with paths invariant under a group action is generalised to combinations of composition operators, and a characterisation of kernels leading to random fields with additive paths is obtained as a corollary. A discussion follows on some implications on design of experiments, and it is shown in the case of additive kernels that the so-called class of “axis designs” outperforms Latin hypercubes in terms of the IMSE criterion.

In this paper we prove a Lions-type compactness embedding result for symmetric unbounded domains of the Heisenberg group. The natural group action on the Heisenberg group TeX is provided by the unitary group U(n) × {1} and its appropriate subgroups, which will be used to construct subspaces with specific symmetry and compactness properties in the Folland-Stein’s horizontal Sobolev space TeX. As an application, we study the multiplicity of solutions for a singular subelliptic problem by exploiting a technique of solving the Rubik-cube applied to subgroups of U(n) × {1}. In our approach we employ concentration compactness, group-theoretical arguments, and variational methods.

Introduction: According to the theoretical model of Cranach, Ochsenbein, and Valach (1986) understanding group actions needs consideration of aspects at both the group level and the level of individual members. For example individual action units constituting group actions are motivated at the individual level while potentially being affected by characteristics of the group. Theoretically, group efficacy beliefs could be a part of this motivational process as they are an individual’s cognitive contents about group-level abilities to perform well in a specific task. Positive relations between group level efficacy-beliefs and group performance have been reported and Bandura and Locke (2003) argue that this relationship is being mediated by motivational processes and goal setting. The aims of this study were a) to examine the effects of group characteristics on individual performance motivation and b) to test if those are mediated by individual group efficacy beliefs. Methods: Forty-seven students (M=22.83 years, SD=2.83, 34% women) of the university of Berne participated in this scenario based experiment. Data were collected on two collection points. Subjects were provided information about fictive team members with whom they had to perform a group triathlon. Three values (low, medium, high) of the other team members’ abilities to perform in their parts of the triathlon (swimming and biking respectively) were combined in a 3x3 full factorial design (Anderson, 1982) yielding nine groups. Subjects were asked how confident they were that the teams would perform well in the task (individual group efficacy beliefs), and to provide information about their motivation to perform at their best in the respective group contexts (performance motivation). Multilevel modeling (Mplus) was used to estimate the effects of the factors swim and bike, and the context-varying covariate individual group efficacy beliefs on performance motivation. Further analyses were undertaken to test if the effects of group contexts on performance motivation are mediated by individual group efficacy beliefs. Results: Significant effects were reported for both the group characteristics (βswim = 7.86; βbike = 8.57; both p < .001) and the individual group efficacy beliefs (βigeb; .40, p < .001) on performance motivation. The subsequent mediation model indicated that the effects of group characteristics on performance motivation were partly mediated by the individual group efficacy beliefs of the subjects with significant mediation effects for both factors swim and bike. Discussion/Conclusion: The results of the study provide further support for the motivational character of efficacy beliefs and point out a mechanism by which team characteristics influence performance relevant factors at the level of individual team members. The study indicates that high team abilities lead to augmented performance motivation, adding a psychological advantage to teams already high on task relevant abilities. Future investigations will be aiming at possibilities to keep individual performance motivation high in groups with low task relevant abilities. There is nothing mysterious about how coastal rivers, their estuaries, and their relationship with the sea all work to satisfy many of our greatest needs, including drinkable water, fish and shellfish, and soils essential for sustaining the production of food and fiber. Nor are the methods that have proved successful in the protection and restoration of watershed health difficult to understand. It is difficult, however, to imagine how we are to survive without healthy watersheds. Each watershed along California’s coast shows signs of increasing abuse from road construction and maintenance, livestock grazing, residential development, timber harvesting, and a dozen other human activities. In some cases whole streams have simply been wiped away. This document has been created to guide and support every person in the community, from homemaker to elected official, who wants her or his watershed to provide clean water, harvestable fish resources and other proof that life in the watershed cannot only be maintained but also enjoyed. It is based on years of experience with watershed protection and restoration in California. If citizen involvement is to be effective, it must draw not only on scientific knowledge but also on an understanding of how to translate individual views into commitments and capable group action. This guide briefly reviews the condition of California’s coastal watersheds, identifies the kinds of concerns that have led citizens to successful watershed protection efforts, explains why citizen, in addition to government, effort is essential for watershed protection and restoration to succeed, and puts in the reader’s hands both the technical and organizational “tools of the trade” in the hope that those who use this guide will be encouraged to join in efforts to make their watershed serve this and future generations better.

On révise les prérequis de géométrie différentielle nécessaires à une première approche de la théorie de la quantification géométrique, c'est-à-dire des notions de base en géométrie symplectique, des notions de groupes et d'algèbres de Lie, d'action d'un groupe de Lie, de G-fibré principal, de connexion, de fibré associé et de structure presque-complexe. Ceci mène à une étude plus approfondie des fibrés en droites hermitiens, dont une condition d'existence de fibré préquantique sur une variété symplectique. Avec ces outils en main, nous commençons ensuite l'étude de la quantification géométrique, étape par étape. Nous introduisons la théorie de la préquantification, i.e. la construction des opérateurs associés à des observables classiques et la construction d'un espace de Hilbert. Des problèmes majeurs font surface lors de l'application concrète de la préquantification : les opérateurs ne sont pas ceux attendus par la première quantification et l'espace de Hilbert formé est trop gros. Une première correction, la polarisation, élimine quelques problèmes, mais limite grandement l'ensemble des observables classiques que l'on peut quantifier. Ce mémoire n'est pas un survol complet de la quantification géométrique, et cela n'est pas son but. Il ne couvre ni la correction métaplectique, ni le noyau BKS. Il est un à-côté de lecture pour ceux qui s'introduisent à la quantification géométrique. D'une part, il introduit des concepts de géométrie différentielle pris pour acquis dans (Woodhouse [21]) et (Sniatycki [18]), i.e. G-fibrés principaux et fibrés associés. Enfin, il rajoute des détails à quelques preuves rapides données dans ces deux dernières références.

Ce mémoire porte sur quelques notions appropriées d'actions de groupe sur les variétés symplectiques, à savoir en ordre décroissant de généralité : les actions symplectiques, les actions faiblement hamiltoniennes et les actions hamiltoniennes. Une connaissance des actions de groupes et de la géométrie symplectique étant prérequise, deux chapitres sont consacrés à des présentations élémentaires de ces sujets. Le cas des actions hamiltoniennes est étudié en détail au quatrième chapitre : l'importante application moment y est définie et plusieurs résultats concernant les orbites de la représentation coadjointe, tels que les théorèmes de Kirillov et de Kostant-Souriau, y sont démontrés. Le dernier chapitre se concentre sur les actions hamiltoniennes des tores, l'objectif étant de démontrer le théorème de convexité d'Atiyha-Guillemin-Sternberg. Une discussion d'un théorème de classification de Delzant-Laudenbach est aussi donnée. La présentation se voulant une introduction assez exhaustive à la théorie des actions hamiltoniennes, presque tous les résultats énoncés sont accompagnés de preuves complètes. Divers exemples sont étudiés afin d'aider à bien comprendre les aspects plus subtils qui sont considérés. Plusieurs sujets connexes sont abordés, dont la préquantification géométrique et la réduction de Marsden-Weinstein.

Un algorithme permettant de discrétiser les équations aux dérivées partielles (EDP) tout en préservant leurs symétries de Lie est élaboré. Ceci est rendu possible grâce à l'utilisation de dérivées partielles discrètes se transformant comme les dérivées partielles continues sous l'action de groupes de Lie locaux. Dans les applications, beaucoup d'EDP sont invariantes sous l'action de transformations ponctuelles de Lie de dimension infinie qui font partie de ce que l'on désigne comme des pseudo-groupes de Lie. Afin d'étendre la méthode de discrétisation préservant les symétries à ces équations, une discrétisation des pseudo-groupes est proposée. Cette discrétisation a pour effet de transformer les symétries ponctuelles en symétries généralisées dans l'espace discret. Des schémas invariants sont ensuite créés pour un certain nombre d'EDP. Dans tous les cas, des tests numériques montrent que les schémas invariants approximent mieux leur équivalent continu que les différences finies standard.

Este estudo tem como objetivo verificar a influência dos jogos eletrônicos e do gênero sobre o comportamento social dos jovens da geração Y brasileira do ponto de vista da propensão a agir mais individualmente ou socialmente. E a forma como tal comportamento afeta os indivíduos no mercado de trabalho. Para atingir tal objetivo, além da bibliografia referente ao assunto foram utilizados dados de jovens brasileiros colhidos através de um questionário online. Ficou constatado, por meio da análise dos resultados, que o hábito de jogar não influencia o jovem a agir mais individualmente ou coletivamente. A internet e os jogos eletrônicos não interferiram nas atitudes da amostra pesquisada frente às relações de amizade, lealdade e ação coletiva. Porém, foi possível observar que o gênero dos jovens os faz terem comportamentos sociais diferentes.

Family Health Program (FHP) presents itself as a restructured model on basic cares besides having prevention practices and promotion in health as essential parts. According to that, the purpose of this study is to perceive which prevention practices in oral health are accomplished by the dentists from the FHP of Natal-RN as well as the way they have been developed, the knowledge basis to execute the procedure and the use of evaluation instruments by the dentists and by the Oral Health Co-Ordinator. A list of dentists participating on the FHP of Natal in March, 2006 (n= 91) was obtained so it was possible to formulate a structured interview. After excluding those with less than six months attending to the program, and considering the loss, eighty dentists got to be interviewed. It had questions about individual and group preventive procedures, sources of basement to develop the activities and to verify the impact and evaluation instruments. Besides that, an interview was made with the Oral Health Co-Ordinator about the evaluating process and the existence of a protocol as well as about document analysis in the Ambulatory Informations System Unique Health System (AIS-UHS), Information of Basic Care System and Pact of Recorder. The main individual activities consist on Oral Hygiene Orientation (87,5%) and Fluoridization (95%). Group activities remain at scholar groups acts(91,25%) being fluoridization done by 91,25% and educative activities by 86,25% mainly through speeches (61,25%).Orientations about oral cancer were detached on the aged group (39,96%)and hypertensive and diabetic group (19,51%), as well as integration with the health team was respectively 21,93% and 39,02%. Speeches and talk rounds are the main activities for aged, hypertensive and diabetics, and are also expressive to pregnant women. For pregnant women and babies group predominate hygiene and diet orientation. About the evaluation instruments 73,75% of the dentists do not consider their existence, despite 73,75% consider that actions have impact specially due to a increase of hygiene and decrease of caries index on the children. The main sources of basement are clinical experience (42,5%) and preparative courses (33,75%), only 7,5% mentioned population need and local reality. The Oral Health Co-Ordinator related the Attention Pact Recorder and records from the AIS - UHS as evaluation source but also detached the lack of epidemiologic surveying. She mentioned the increase of supervised brushing as a positive result and detached the hardness of the professional to act inside the family and as a team. The AIS-UHS records showed that fluoridization is more used individually and the supervised brushing is predominant as a group action, besides that educative activities at the Health Establishment predominate due to actions at the community. Facing the results, it was verified the act in different groups, special attention given to scholars, as well as focus the activities on caries giving less emphasis to other oral problems. Despite that, there was no epidemiologic instruments or data of the local reality to guide the actions and to be part of the planning and evaluation process

Let f : M --> N be a continuous map between two closed n-manifolds such that f(*): H-*(M, Z(2)) --> H-* (N, Z(2)) is an isomorphism. Suppose that M immerses in Rn+k for 5 less than or equal to n < 2k. Then N also immerses in Rn+k. We use techniques of normal bordism theory to prove this result and we show that for a large family of spaces we can replace the homolog condition by the corresponding one in homotopy. The present thesis is a contribution to the multi-variable theory of Bergman and Hardy Toeplitz operators on spaces of holomorphic functions over finite and infinite dimensional domains. In particular, we focus on certain spectral invariant Frechet operator algebras F closely related to the local symbol behavior of Toeplitz operators in F. We summarize results due to B. Gramsch et.al. on the construction of Psi_0- and Psi^*-algebras in operator algebras and corresponding scales of generalized Sobolev spaces using commutator methods, generalized Laplacians and strongly continuous group actions. In the case of the Segal-Bargmann space H^2(C^n,m) of Gaussian square integrable entire functions on C^n we determine a class of vector-fields Y(C^n) supported in complex cones K. Further, we require that for any finite subset V of Y(C^n) the Toeplitz projection P is a smooth element in the Psi_0-algebra constructed by commutator methods with respect to V. As a result we obtain Psi_0- and Psi^*-operator algebras F localized in cones K. It is an immediate consequence that F contains all Toeplitz operators T_f with a symbol f of certain regularity in an open neighborhood of K. There is a natural unitary group action on H^2(C^n,m) which is induced by weighted shifts and unitary groups on C^n. We examine the corresponding Psi^*-algebra A of smooth elements in Toeplitz-C^*-algebras. Among other results sufficient conditions on the symbol f for T_f to belong to A are given in terms of estimates on its Berezin-transform. Local aspects of the Szegö projection P_s on the Heisenbeg group and the corresponding Toeplitz operators T_f with symbol f are studied. In this connection we apply a result due to Nagel and Stein which states that for any strictly pseudo-convex domain U the projection P_s is a pseudodifferential operator of exotic type (1/2, 1/2). The second part of this thesis is devoted to the infinite dimensional theory of Bergman and Hardy spaces and the corresponding Toeplitz operators. We give a new proof of a result observed by Boland and Waelbroeck. Namely, that the space of all holomorphic functions H(U) on an open subset U of a DFN-space (dual Frechet nuclear space) is a FN-space (Frechet nuclear space) equipped with the compact open topology. Using the nuclearity of H(U) we obtain Cauchy-Weil-type integral formulas for closed subalgebras A in H_b(U), the space of all bounded holomorphic functions on U, where A separates points. Further, we prove the existence of Hardy spaces of holomorphic functions on U corresponding to the abstract Shilov boundary S_A of A and with respect to a suitable boundary measure on S_A. Finally, for a domain U in a DFN-space or a polish spaces we consider the symmetrizations m_s of measures m on U by suitable representations of a group G in the group of homeomorphisms on U. In particular,in the case where m leads to Bergman spaces of holomorphic functions on U, the group G is compact and the representation is continuous we show that m_s defines a Bergman space of holomorphic functions on U as well. This leads to unitary group representations of G on L^p- and Bergman spaces inducing operator algebras of smooth elements related to the symmetries of U.
