O Ministério Público do Trabalho (MPT), como parte do sistema judicial brasileiro e integrante do Ministério Público Federal (MPF) é uma organização que se renovou ao longo de sua trajetória cujas bases remontam ao período Vargas. Contrariando a ideia de que a expansão do sistema judicial a partir dos anos oitenta do século XX exprime a continuação da tradição política autoritária brasileira, sob novo registro, a tese aqui desenvolvida demonstra que a nova ordem jurídica inaugurada com a constituição democrática de 1988 renovou tanto as bases de justificação do direito como a estrutura das instituições judiciais. O MPT é um caso singular de apropriação desta nova ordem para detonar o processo de profissionalização de seus membros e converter sua atuação aos novos tempos da democracia política, abandonando a tradição de alinhamento às eventuais ideologias de governo. Isto se explica com a ascensão do profissionalismo nos anos oitenta que permitiu a renovação dos seus meios de ação e a apropriação de um novo equipamento teórico por parte do grupo. O processo de judicialização das relações de trabalho, elemento constitutivo deste próprio campo no Brasil, desde a Era Vargas, é democratizado sob a nova ordem democrática inaugurada em 1988.

Cette thèse analyse la capacité d’action collective des populations marginalisées situées respectivement dans un bidonville appelé Cité de l’Éternel à Port-au-Prince (Haïti) et dans des campements à la Sierra Santa Catarina, Iztapalapa (Mexico). À Port-au-Prince, avant la chute de la dictature des Duvalier, des «tontons macoutes» envahirent un terrain situé en bordure du quai de la capitale, près du boulevard Harry Truman. Après s’y être installés, ils ont procédé à la vente de parcelles destinées à la construction de logement à des particuliers. Mais après la chute de Jean-Claude Duvalier, en 1986, des gens de la populace en ont profité pour envahir ce qui restait de ces terrains marécageux. Après l’occupation, ils se sont organisés pour défendre collectivement leur propriété avant d’entreprendre, par la suite, des démarches pour y amener des services et obtenir la régularisation de leur situation sur ces territoires. À la Sierra Santa Catarina, des populations conduites par des militants d’un Front populaire ont occupé des terrains situés au pied d’une montagne de sable afin d’accéder à la propriété et de construire leur demeure. À l’instar des populations de la Cité, ces gens se sont organisés pour aménager des espaces, y ériger des logements provisoires, monter la garde afin de ne pas être déguerpis par les forces de police. Tout en travaillant pour accéder à leur manière aux services de base, elles entreprennent des actions auprès des institutions publiques afin d’obtenir la régularisation de leur situation. Par rapport à la capacité d’action collective de ces populations, les théories sociologiques sont divisées. D’un côté, certains auteurs soutiennent la thèse de l’incapacité de ces populations d’avoir des intérêts collectifs et d’agir en conséquence. Selon eux, sans une médiation sociale ou à défaut d’une agrégation et d’une représentation politiques, ces populations sont incapables d’avoir une subjectivité collective. De l’autre, des auteurs pensent qu’à partir des liens d’amitié de parenté et de voisinage, indépendamment de leurs situations socioéconomiques, ces populations peuvent créer des stratégies de subsistance et de luttes qui leur permettent de trouver des solutions à des problèmes tant individuels que collectifs. S’agissant des populations qui envahissent des terrains en milieu urbain pour habiter, les actions de ces gens là sont définis déjà comme une forme d’action collective inscrite dans des rapports sociaux qui se caractérisent par la différenciation entre les groupes sociaux dans l’accès à la propriété. Ainsi, leurs revendications de reconnaissance et de régularisation auprès des instances étatiques sont déterminées par leur mode d’accès aux biens et aux richesses inégalement réparties en Haïti et au Mexique. Les populations des deux territoires ont entrepris diverses démarches auprès de certaines institutions et réalisé des actions collectives soit pour amener des services de base tels que l’eau et l’électricité, soit pour obtenir de l’État la reconnaissance des territoires envahis, c’est-à-dire leur jonction à la cartographie de la ville. Cette reconnaissance implique non seulement l’installation des services réguliers au bénéfice de la population mais aussi l’octroi à chaque propriétaire de son titre de propriété. Si dans le cas de la Sierra Santa Catarina les démarches sont entreprises auprès des institutions publiques, dans celui de Port-au-Prince, ce sont les ONG ou les agence de coopération qui sont touchées et qui fournissent certains services à la population conformément à la priorité de leurs bailleurs de fonds. Les interventions auprès de l’État se font plutôt dans le but d’obtenir une autorisation de fonctionnement d’une association locale. Il ressort des approches théoriques et des actions collectives réalisées par ces populations qu’on ne peut pas dire qu’elles sont incapables d’avoir une subjectivité collective et des intérêts communs sans une agrégation et une représentation politique. À partir de différents liens entre les individus, des associations sont créées lesquelles permettent d’établir une médiation entre les populations et d’autres organismes. Dans le cas des campements, les actions collectives sont certainement mises à contribution par quelques leaders. Cela participe de toute une tradition politique au Mexique. Néanmoins, dans certains campements, des populations parviennent à tenir tête jusqu’à révoquer certains leaders. Au-delà de leur situation socioéconomique, de l’emprise de certains dirigeants de campement, de l’indifférence de l’État (dans le cas de Port-au-Prince, notamment), ces populations font preuve d’une étonnante capacité critique de leur situation tant dans leurs relations avec les dirigeants des associations et des campements que par rapport à l’État. Ceci pourrait soulever des doutes quant à la possibilité qu’elles soient réellement ou inconsciemment manipulées. Esta dissertação pretende analisar criticamente o julgado da ADPF 130, a luz do pensamento político de Hannah Arendt, em razão de conduzir o debate do significado da imprensa idônea para a promoção da liberdade de expressão quando torna efetivo o princípio da publicidade na esfera pública. O pensamento da autora contribui para avaliar criticamente a racionalidade do Poder judiciário brasileiro na decisão da ADPF 130 pelo fato deste conceber de modo questionável a imprensa ter o papel democrático de ser formadora de opinião pública e de compreender que qualquer lei para regulamentar a atividade midiática implica automaticamente em cair no risco da censura prévia. No capítulo I, o trabalho sumariza as argumentações propostas na ADPF para indicar que a maioria dos votos dos ministros se situa a partir das concepções gerais do liberalismo e as suas consequências para atuação da imprensa na democracia brasileira. Em seguida, na primeira parte do capítulo II serão apresentadas as principais características do pensamento político de Arendt contempladas nas obras A condição humana e Origens do totalitarismo, em uma perspectiva de situá-las na tradição política do pensamento político ocidental, expondo, de forma geral, os contornos de seu sistema político, como: distinção entre domínio público e domínio privado, vita activa e doxa e função da lei. Assim, passa-se a analisar, em momento posterior no capítulo II as manifestações do pensamento arendtiano em torno da liberdade de expressão e a repercussão do seu significado na imprensa idônea. O capítulo III posiciona o pensamento arendtiano na tradição política do mundo ocidental. Nele, Arendt aponta quando a liberdade política que se manifesta entre o eu-posso e eu-quero se dissocia, o qual ocasiona obstáculos para a aparição da doxa no agir em concerto entre os homens. Assim, equivocadamente a política passa a ser vista apenas como um velho truísmo de assegurar a liberdade. Compreendemos que, neste contexto, a imprensa é concebida pela maioria dos votos dos ministros com o papel de ser formadora de opinião pública pelo fato de considerarem implicitamente que vivemos numa democracia onde os homens não participam efetivamente na vida pública.

Este artigo argumenta que, ao buscar modelos no repertório abolicionista estrangeiro para construir sua propaganda, os abolicionistas brasileiros viram suas possibilidades de escolha restritas pelas oportunidades políticas locais e pela tradição local católica. Contingências que impediram a simples transposição do modelo de ativismo estrangeiro e conduziram a uma atividade criativa de apropriação, em diálogo com o contexto e a tradição brasileiros. Processo que resultou numa reinvenção, uma vez que as artes, sobretudo o teatro, ganharam na propaganda abolicionista brasileira a proeminência que a religião teve na anglo-americana.

El artículo pretende abordar el modo en el que la obra de Reiner Schürmann, a través de un original interpretación del pensamiento de Martin Heidegger, consigue desarrollar un tipo de filosofía política anárquica. Se intentará analizar, en la dispersa obra del filósofo holandés, la idea de anarquía como condición existencial, prestando especial atención al nexo entre el concepto de muerte de la metafísica y la posibilidad de una praxis política anárquica. El artículo se compone de tres partes: en la primera se examinará la noción de Ser y de “a priori práctico” en el trabajo de Schürmann. En la segunda se verá la diferencia entre el nihilismo del autor y el de Vattimo, y en la tercera, se profundizará en las consecuencias más propiamente políticas del pensamiento de Schürmann.

This work develops the foundations of an Islamic argument for secular, liberal democracy from within the Islamic discursive tradition. First, it challenges the presentation of contemporary Islamic political thought as a unified, continuous development of the classical canon by showing the influence of the now marginalized medieval rationalists in the development of Islamic political thought. The classical rationalist concern with divine justice forced the founders of Sunni orthodoxy to state their epistemologies and their positions on ethical ontology. The orthodox positions, and their related methods of legal-juristic reasoning, are shown to be incapable of accommodating the modern Islamic positions on political representation, slavery, and just war. This leads to the second argument of the work, that the modern Islamic discourse is better understood as a reflection of the central concern with justice and its rationalist epistemology and ethical ontology we find in the writings of classical rationalists. This argument is made by examining the works of three classical rationalists, a theologian, a philosopher, and a historian. Their political positions, shaped by their rationalism and concern with justice, challenged their orthodox contemporaries, and provide substantive critiques of the classical political accommodations, methods of politico-legal reasoning, and hence, of modern Islamist political projects. The final chapter reveals how far the mainstream of Islamic political thought has deviated from the classical discourses, since the 19th century, by adopting the language and ideals of the European Enlightenment. This shift is presented as a triumph of classical rationalism over literalism, whose epistemological foundations and ontological implications have yet to be acknowledged and appreciated.

In this this paper I identify specific historical trajectories that are directly contingent upon the deployment and use of new media, but which are actually hidden by a focus on the purely technological. They are: the increasingly abstract and alienated nature of economic value; the subsumption of all labour - material and intellectual - under systemic capital; and the convergence of formerly distinct spheres of analysis –the spheres of production, circulation, and consumption. This paper examines the implications of the knowledge economy from an historical materialist perspective. I synthesise the systemic views of Marx (1846/1972, 1875/1972 1970 1973 1976 1978 1981), Adorno (1951/1974 1964/1973 1991; Horkheimer and Adorno 1944/1998; Jarvis 1998), and Bourdieu (1991 1998) to argue for a language-focused approach to new media research and suggest aspects of Marxist thought which might be useful in researching emergent socio-technical domains. I also identify specific categories in the Marxist tradition which may no longer be analytically useful for researching the effects of new media.

In late 2007, newly elected Prime Minister Kevin Rudd placed education reform on centre stage as a key policy in the Labor Party's agenda for social reform in Australia. A major policy strategy within this 'Education Revolution' was the development of a national curriculum, the Australian Curriculum Within this political context, this study is an investigation into how social justice and equity have been used in political speeches to justify the need for, and the nature of, Australia's first official national curriculum. The aim is to provide understandings into what is said or not said; who is included or excluded, represented or misrepresented; for what purpose; and for whose benefit. The study investigates political speeches made by Education Ministers between 2008 and 201 0; that is, from the inception of the Australian Curriculum to the release of the Phase 1 F - 10 draft curriculum documents in English, mathematics, science and history. Curriculum development is defined here as an ongoing process of complex conversations. To contextualise the process of curriculum development within Australia, the thesis commences with an initial review of curriculum development in this nation over the past three decades. It then frames this review within contemporary curriculum theory; in particular it calls upon the work of William Pinar and the key notions of currere and reconceptualised curriculum. This contextualisation work is then used as a foundation to examine how social justice and equity have been represented in political speeches delivered by the respective Education Ministers Julia Gillard and Peter Garrett at key junctures of Australian Curriculum document releases. A critical thematic policy analysis is the approach used to examine selected official speech transcripts released by the ministerial media centre through the DEEWR website. This approach provides a way to enable insights and understandings of representations of social justice and equity issues in the policy agenda. Broader social implications are also discussed. The project develops an analytic framework that enables an investigation into the framing of social justice and equity issues such as inclusion, equality, quality education, sharing of resources and access to learning opportunities in political speeches aligned with the development of the Australian Curriculum Through this analysis, the study adopts a focus on constructions of educationally disadvantaged students and how the solutions of 'fixing' teachers and providing the 'right' curriculum are presented as resolutions to the perceived problem. In this way, it aims to work towards offering insights into political justifications for a national curriculum in Australia from a social justice perspective.

This work offers a novel interpretation of David Hume’s (1711–1776) conception of the conjectural development of civil society and artificial moral institutions. It focuses on the social elements of Hume’s Treatise of human nature (1739–40) and the necessary connection between science of man and politeness, civilised monarchies, social distance and hierarchical structure of civil society. The study incorporates aspects of intellectual history, history of philosophy and book history. In order to understand David Hume’s thinking, the intellectual development of Bernard Mandeville (1670–1733) needs to be accounted for. When put into a historical perspective, the moral, political and social components of Treatise of human nature can be read in the context of a philosophical tradition, in which Mandeville plays a pivotal role. A distinctive character of Mandeville and Hume’s account of human nature and moral institutions was the introduction of a simple distinction between self-love and self-liking. The symmetric passions of self-interest and pride can only be controlled by the corresponding moral institutions. This is also the way in which we can say that moral institutions are drawn from human nature. In the case of self-love or self-interest, the corresponding moral institution is justice. Respectively, concerning self-liking or pride the moral institution is politeness. There is an explicit analogy between these moral institutions. If we do not understand this analogy, we do not understand the nature of either justice or politeness. The present work is divided into two parts. In the first part, ‘Intellectual development of Bernard Mandeville’, it is argued that the relevance of the paradigmatic change in Mandeville’s thinking has been missed. It draws a picture of Mandeville turning from the Hobbism of The Fable of the Bees to an original theory of civil society put forward in his later works. In order to make this change more apparent, Mandeville’s career and the publishing history of The Fable of the Bees are examined comprehensively. This interpretation, based partly on previously unknown sources, challenges F. B. Kaye’s influential decision to publish the two parts of The Fable of the Bees as a uniform work of two volumes. The main relevance, however, of the ‘Intellectual development of Mandeville’ is to function as the context for the young Hume. The second part of the work, ‘David Hume and Greatness of mind’, explores in philosophical detail the social theory of the Treatise and politics and the science of man in his Essays. This part will also reveal the relevance of Greatness of mind as a general concept for David Hume’s moral and political philosophy.

The thesis aims at analyzing concept of citizenship in political philosophy. The concept of citizenship is a complex one: it does not have a definitive explication, but it nevertheless is a very important category in contemporary world. Citizenship is a powerful ideal, and often the way a person is treated depends on whether he or she has the status of a citizen. Citizenship includes protection of a person’s rights both at home and abroad. It entails legal, political and social dimension: the legal status as a full member of society, the recognition of that status by fellow citizens and acting as a member of society. The thesis discusses these three dimensions. Its objective is to show how all of them, despite being insufficient in some aspects, reach something important about the concept. The main sources of the thesis are Civic Republicanism by Iseult Honohan (Routledge 2002), Republicanism by Philip Pettit (Clarendon Press 1997), and Taking Rights Seriously by Ronald Dworkin (1997). In addition, the historical part of the thesis relies mainly on the works of Aristotle, Immanuel Kant, Adam Smith, Quentin Skinner, James Pocock and James Tully. The writings of Will Kymlicka, John Rawls, Chantal Mouffe, and Shane Phelan are referred to in the presentation and critique of the liberal tradition of thought. Hannah Arendt and Seyla Benhabib’s analysis of Arendt’s philosophy both address the problematic relations between human rights and nation-states as the main guarantors of rights. The chapter on group rights relies on Peter Jones’ account of corporate and collective rights, after which I continue to Seumas Miller’s essay on the (liberal) account of group rights and their relation to the concept of citizenship. Republicanism and Political Theory (2002) edited by Cécile Laborde and John Maynor is also references. David Miller and Maurizio Viroli represent the more “rooted” version of republicanism. The thesis argues that the full concept of citizenship should be seen as containing legal, political and social dimensions. The concept can be viewed from all of these three angles. The first means that citizenship is connected with certain rights, like the right to vote or stand for election, the right to property and so on. In most societies, the law guarantees these rights to every citizen. Then there is also the social dimension, which can be said to be as important as the legal one: the recognition of equality and identities of others. Finally, there is the political dimension, meaning the importance of citizens’ participation in the society, which is discussed in connection with the contemporary account of republicanism. All these issues are discussed from the point of view of groups demanding for group-specific rights and equal recognition. The challenge with these three aspects of citizenship is, however, that they are difficult to discuss under one heading. Different theories or discourses of citizenship each approach the subject from different starting points, which make reconciling them sometimes hard. The fundamental questions theories try to answer may differ radically depending on the theory. Nevertheless, in order to get the whole image of what the citizenship discourses are about all the aspects deserve to be taken into account.

The thesis is a historical and philological study of the mature political theory of Miki Kiyoshi (1897-1945) focused on Philosophical Foundations of Cooperative Communitarianism (1939), a full translation of which is included. As the name suggests, it was a methodological and normative communitarianism, which critically built on liberalism, Marxism and Confucianism to realise a regional political community. Some of Miki’s Western readers have wrongly considered him a fascist ideologue, while he has been considered a humanist Marxist in Japan. A closer reading cannot support either view. The thesis argues that the Anglophone study of Japanese philosophy is a degenerating research programme ripe for revolution in the sense of returning full circle to an original point. That means returning to the texts, reading them contextually and philologically, in principle as early modern European political theory is read by intellectual historians, such as the representatives of Cambridge School history of political thought. The resulting reading builds critically on the Japanese scholarship and relates it to contemporary Western and postcolonial political theory and the East Asian tradition, particularly neo-Confucianism. The thesis argues for a Cambridge School perspective radicalised by the critical addendum of geo-cultural context, supplemented by Geertzian intercultural hermeneutics and a Saidian ‘return to philology’. As against those who have seen radical reorientations in Miki’s political thought, the thesis finds gradual progression and continuity between his neo-Kantian, existentialist, Marxian anthropology, Hegelian and finally communitarian phases. The theoretical underpinnings are his philosophical anthropology, a structurationist social theory of praxis, and a critique of liberalism, Marxism, nationalism and idealism emphasising concrete as opposed to abstract theory and the need to build on existing cultural traditions to modernise rather than westernise East Asia. This post-Western fusion was imagined to be the beginning of a true and pluralistic universalism.

This dissertation is an account of how contemporary Pakistani ulama grapple with their political realities and the Islamic state of Pakistan. The central conceptual question that scaffolds my dissertation is: How do Pakistani ulama negotiate tradition, authority and sovereignty with the Islamic Republic of Pakistan? In engaging with this issue, this dissertation employs a methodology that weds ethnography with rigorous textual analysis. The ulama that feature in this study belong to a variety of sectarian persuasions. The Sunni ulama are Deobandi and Barelvi; the Shia ulama in this study are Ithna Ashari.

In assessing the relationship between Pakistani ulama and their nation-state, I assert that the ulama's dialectical engagements with the state are best understood as a dexterous navigation between affirmation, critique, contestation and cultivation. In proposing this manner of thinking about Pakistani ulama's engagements with their state, I provide a more detailed and nuanced view of the ulama-state relationship compared to earlier works. While emphasizing Pakistani ulama's vitality and their impact on their state, this dissertation also draws attention to the manners in which the state impacts the ulama. It theorizes the subject formation of the ulama and asserts the importance of understanding the ulama as formed not just by the ethico-legal tradition in which they are trained but also by the state apparatus.

It is almost a tradition that celluloid (or digital) villains are represented with some characteristics that remind us the real political enemies of the producer country of the film, or even enemies within the country according to the particular ideology that sustains the film. The case of Christopher Nolan The Dark Knight trilogy, analyzed here, is representative of this trend for two reasons. First, because it gets marked by political radicalization conducted by the US government after the attack of September 11, 2001. Secondly, because it offers a profuse gallery of villains who are outside the circle of friends as the new doctrine “either with us or against us” opened by George Bush for the XXI century. This gallery includes from the very terrorists who justify the War on Terror (Ra's al Ghul, the Joker), to the “radical left” (Bane, Talia al Ghul) including liberal politicians (Harvey Dent), and corrupt that take advantage of the softness of the law to commit crimes with impunity (Dr. Crane, the Scarecrow).
