Finnish education policy, educational legislation and the entire education system changed significantly during the 1990s as part of a general restructuring of public administration. There has been a clear divergence from the former tradition of a system of regulation, founded on detailed legislation and the principle of equality. The new governance, which is based more on individual choice, efficiency and evaluation, emphasizes that the development of a high standard of education is a necessity in the light of global competition. This study explores the legislative process regarding education policy in the Finnish Parliament during the 1990s, and highlights in particular how the international discourse on education policies was restructured in the context of Finnish legislation. The research material consists of all the public parliamentary documents relating to education, including government proposals, minutes from the discussions in the chamber and archive material (final protocols, reports and statements) for the Committee for Education and Culture. The discourse on the process of drafting and passing education legislation is modelled on three interrelated policy technologies (market, management and performance), which are understood here as mechanisms connecting general political ideas to normative legislation. The changes in the regulation of education were part of a general public administration reform instigated during the mid 1980s. The research results will prove that during the left-right coalition cabinet of PM Harri Holkeri, new policy technologies affected the parliamentary discourse on education policy. This was particularly influenced by a change in the preconditions for the management of education that was created as a result of the numerous demands to deregulate and delegate decision-making authority to the local and school levels while rendering the whole education system more effective. At the turn of the decade, market-type mechanisms were more indirectly manifested in the forms of individuality and freedom of choice, which were reflected, for example, in proposals to “lower the hurdles” by separating general from vocational secondary education with a view to encouraging students to select courses from other educational establishments, in addition to relaxing the requirements for establishing private schools and abolishing a hundred-year-old strict national catchment-area system. Later, in the course of the 1990s, after the subjects, players, and methods of evaluation had been more precisely defined, evaluation based on performance would result in the active measurement of the attainment of set objectives. In the spring of 1991, from the outset of PM Esko Aho's right-centre coalition cabinet, the education budget suffered cutbacks as a result of a global recession and this influenced the legislative work of, and discourses in, parliament. Representatives of the parties in power regarded the recession solely as an external factor that was remote from the political arena. In their view, the education system should rise to the challenge by ensuring the efficient and innovative use of the resources available and by developing new forms of indicators for evaluating results. Representatives of the opposition opposed the cabinet’s standpoint as a result of the recession, criticized the measures taken by pointing out the harmful effect of constantly cutting the budget and argued that the government had made political capital out of the recession by using it as an opportunity to give more room to market, management and performance technologies within the Finnish education system. Criticism of the new education policy became even stronger during PM Paavo Lipponen's first “rainbow” coalition cabinet with critical views being expressed not only from the opposition but also from representatives within the government. Representatives from the left demanded legislative restrictions and the instigation of measures to relieve the presumed negative effects of market, management and performance in the name of educational equality. The new management by results steering method within the university sector and the introduction of commercial education services in compulsory education were fiercely criticized. The argument over “setting outer limits” including, for example, the demands for more detailed legislation and earmarked state subsidies was characteristic of Parliament’s legislative discourse in the latter part of the 1990s. The number of Finnish pupils attending special education has increased for more than a decade (Tilastokeskus 1999, 2000, 2001, 2003, 2004, 2005a, 2006b, 2007b, 2008b, 2008e, 2009b; Virtanen ja Ratilainen 1996). In the year 2007 nearly third of Finnish comprehensive school pupils took part in special needs education. According to the latest statistics, in the autumn of 2008 approximately 47 000 pupils have been admitted or transferred to special education and approximately 126 000 pupils received part-time special education during the 2007 - 2008 academic year. (Tilastokeskus 2008b, 2009b.) The Finnish special education system is currently under review. The Reform, both in legislation and in practice, began nationwide in the year 2008 (e.g. Special education strategy document, November 2007 and the development project Kelpo). The aim of the study was the statistical description of the Finnish special education system and on the other hand to gain a deeper understanding about the Finnish special education system and its quantitative increase, by analysis based on the nationwide statistical information. Earlier studies have shown that the growth in special education is affected by multiple independent variables and cannot be solely explained by the pupil characteristics. The statistical overview and analysis have been carried out in two parts. In the first part, the description and analysis were based on statistical time series from the academic year 1979 -1980 until 2008. While, in the second, more detailed description and analysis, based on comparable time series from 1995 to 2008 and from 2001-2002 to 2007-2008, is presented. Historical perspective was one part of this study. There was an attempt to find reasons explaining the observed growth in the special needs education from late 1960s to 2008. The majority of the research was based on the nationwide statistics information. In addition to this, materials including educational legislation literature, different kind of records of special education and preceding studies were also used to support the research. The main results of the study, are two statistical descriptions and time series analysis of the quantitative increase of the special needs education. Further, a summary of the plausible factors behind the special education system change and its quantitative increase, is presented. The conclusions coming from the study can be summarised as follows: the comparable statistical time series analysis suggests that the growth in special education after the year 1999 could be a consequence of the changes in the structure of special education and that new group of pupils have been directed to special needs education. Este trabalho tem como problema central verificar se a integração do ensino médio facultada pelo Decreto n. 5.154/04 poderá constituir-se, ainda que sob os limites do capitalismo, num caminho que contribua para a concretização de uma concepção educacional voltada para a politecnia, tomando como referência a legislação educacional brasileira, no que diz respeito ao ensino médio e à educação profissional técnica de nível médio a partir da promulgação da LDB n. 9.394/96 e, tendo como foco principal de análise as disposições do Decreto n. 5.154/04 e as circunstâncias que eventualmente contribuem para que ele se constitua no caminho referido. Seu objetivo é analisar a precariedade, as limitações de alcance, mas também, as possibilidades do decreto como caminho alternativo na construção de outra concepção educacional, na perspectiva de superação do modelo vigente de inspiração neoliberal. O pressuposto ponto de partida é de que uma fundamentação teórico-metodológica, epistemológica e ético-política calcada na formação omnilateral e/ou politécnica que alcance significativamente os fóruns docentes, no âmbito do ensino médio e da educação profissional técnica de nível médio, dá suporte para que o Decreto n. 5.154/04 constitua-se de fato, numa possibilidade de travessia rumo à superação da concepção educacional de matiz neoliberal. No entendimento de que isso, todavia, não é algo que possa ocorrer espontaneamente, pelo contrário. Entendendo que a possibilidade dessa travessia implica uma intencionalidade e a disputa de um projeto que é também social. Uma preocupação se revela recorrente ao longo do trabalho: o que fazer? Face à opacidade do tempo presente pródigo em reduzir o oxigênio das nossas esperanças, em exaurir a possibilidade de se conceber uma sociabilidade que, diferente desta, tenha o homem como centro, agir de que maneira? E, principalmente, como propor uma ação que não pareça histriônica, descolada das atuais condições de tempo e espaço? Ao otimismo da vontade, ainda que face ao pessimismo da razão do pensamento gramsciano somamos utopia e poesia na expectativa de tornarmos a dimensão da transcendência mais tangível. Para lembramos que o homem pode ser maior do que o acabrunhado papel para ele determinado pelo sistema dominante. Com a intenção de dialogarmos com as experiências que se dão no chão das escolas, realizamos uma pesquisa intencional no campo empírico e através de dados colhidos junto a dirigentes e professores de três instituições da rede federal de educação tecnológica, de três unidades da federação, procuramos confrontar as informações obtidas com os principais argumentos apresentados no trabalho.

Esta investigação, no campo da produção acadêmica dos programas de pós-graduação de universidades brasileiras, sobre a temática altas habilidades/superdotação, teve como objetivos: mapear um conjunto significativo de trabalhos elaborados sob as formas de tese e dissertação, nas duas últimas décadas; e apresentar as contribuições desses estudos para o atendimento educacional aos portadores de altas habilidades/superdotados. A contextualização teórica da presente pesquisa refere-se à busca de uma teoria mais completa e abrangente sobre a inteligência humana, e da melhor compreensão das altas habilidades/superdotação, mencionando a legislação educacional mais recente sobre o atendimento a esses alunos especiais. A metodologia de pesquisa bibliográfica foi utilizada na sistematização da leitura e releitura dos textos, em vários níveis, para a exploração de seus conteúdos. O objetivo almejado foi a adequada identificação das linhas de pensamento dos autores, procurando-se manter o máximo possível de imparcialidade e respeito a cada um dos posicionamentos. Os assuntos foram categorizados por afinidade temática, em três capítulos, que em sua estrutura apresentam uma introdução, as sínteses descritivas dos trabalhos analisados e uma conclusão. Os resultados alcançados permitiram uma análise elucidativa da produção acadêmica em pauta, nas décadas de 80 e 90, estendendo-se aos anos 2000 e 2001. Sinalizaram evoluções conceituais concernentes às altas habilidades/superdotação. Pontuaram conclusões sobre: a identificação precoce; a estimulação ambiental; a auto-alfabetização precoce; a identificação e atendimento a crianças das classes populares e a preparação de professores; a elaboração de instrumento de observação a ser utilizado pelos professores. Mais conclusões puderam ser registradas em relação a: percepções da escola, pais e professores; percepção de professores universitários; autopercepção e os relacionamentos interpessoais de adultos e jovens adultos; incidentes e comportamentos críticos observados na escola; representação social da escola segundo os alunos; relação professora-aluno portador de altas habilidades; autopercepção e a percepção dos olhares da família, escola e companheiros, por adolescentes. Outras conclusões ainda foram evidenciadas sobre: estratégias educativas para estimulação e identificação de talentos na escola regular, no ensino fundamental e educação infantil; subsídios para a realização escolar no ensino fundamental; a capacidade acadêmica elevada no ensino fundamental; a avaliação de um curso de educação do pensamento por professores participantes. Incluem-se também neste conjunto de resultados: dados históricos sobre a questão das altas habilidades/superdotação; reflexões sobre a profissionalização na área tecnológica; uma crítica ao atendimento educacional aos portadores de altas habilidades/superdotados; e o estudo da trajetória escolar de alunos que receberam atendimento em escolas da rede pública de ensino.

The aim of this study is to garner comparative insights so as to aid the development of the discourse on further education (FE) conceptualisation and the relationship of FE with educational disadvantage and employability. This aim is particularly relevant in Irish education parlance amidst the historical ambiguity surrounding the functioning of FE. The study sets out to critically engage with the education/employability/economy link (eee link). This involves a critique of issues relevant to participation (which extends beyond student activity alone to social relations generally and the dialogic participation of the disadvantaged), accountability (which extends beyond performance measures alone to encompass equality of condition towards a socially just end) and human capital (which extends to both collective and individual aspects within an educational culture). As a comparative study, there is a strong focus on providing a way of conceptualising and comparatively analysing FE policy internationally. The study strikes a balance between conceptual and practical concerns. A critical comparative policy analysis is the methodology that structures the study which is informed and progressed by a genealogical method to establish the context of each of the jurisdictions of England, the United States and the European Union. Genealogy allows the use of history to diagnose the present rather than explaining how the past has caused the present. The discussion accentuates the power struggles within education policy practice using what Fairclough calls a strategic critique as well as an ideological critique. The comparative nature of the study means that there is a need to be cognizant of the diverse cultural influences on policy deliberation. The study uses the theoretical concept of paradigmatic change to critically analyse the jurisdictions. To aid with the critical analysis, a conceptual framework for legislative functions is developed so as to provide a metalanguage for educational legislation. The specific contribution of the study, while providing a manner for understanding and progressing FE policy development in a globalized Ireland, is to clear the ground for a more well-defined and critically reflexive FE sector to operate and suggests a number of issues for further deliberation.

Se analiza la legislación educativa en este país, desde los orígenes de la educación especial hasta la actual orientación y apoyo a la educación inclusiva, que consiste en beneficiar a todos los estudiantes, tanto de educación general como especial (ya que los beneficios no deben ser para un grupo a costa del otro) y mejorar el nivel profesional de todos los adultos. No solamente es inaceptable moralmente, sino que es probable que conduzca a un fracaso de la estrategia. De forma creciente, los datos de evaluación de todos los distritos escolares y de los Estados en todo el país, a partir de iniciarse esta experiencia en Nueva York garantizan que bien aplicados, los programas de educación inclusiva benefician a todos los estudiantes discapacitados y no discapacitados, académica, conductal y socialmente. En Nueva York en 1905 se establecio uan escueal sin internado para alumnos con frecuentes índices de absentismo, delincuentes y niños incorregibles. Parte de la lógica de esta escuela era sacar a estos estudiantes de la escuela habitual beneficiaría a los que permanecieran en ella. Este modelo continuó existiendo a medida que los programas se desarrollaron y así a partir de la Ley Especial de Educación Pública de 1975 enfrentó a las escuelas pública de este estado a retos para su continuo desarrollo.

Esta investigação faz um registro de um estudo de caso realizado com o objetivo de avaliar quais as contribuições trazidas pelo Fundo de Manutenção e Valorização da Educação Básica (FUNDEB) ao ensino fundamental, no Município de Nazarezinho – Paraíba/Brasil, no período de 2007 a 2009. O estudo está fundamentado nos principais acontecimentos históricos da educação brasileira: o financiamento educacional, as políticas de investimento e monitoramento internacional, as políticas neoliberais, o governo de Fernando Henrique Cardoso, a organização e vigência das principais legislações educacionais do país. Os principais programas educacionais da gestão do Presidente Luiz Inácio Lula da Silva, origem e desenvolvimento do FUNDEB a nível nacional e local, também fundamentaram a pesquisa conceitos de qualidade, financiamento educacional e políticas educacionais. Como aporte teórico, buscou-se as principais referências brasileiras: Davies (2008), Pinto (2004), Arelaro (2005), Azevedo (2005) e (Saviani) (2008). Como metodologia foram utilizadas técnicas de análise documental e entrevistas semiestruturadas com professores da rede municipal de ensino. A amostra documental foi feita através de estudo dos relatórios, balanços, demonstrativos de receitas e despesas do FUNDEB, Atas do Conselho de Acompanhamento do FUNDEB. Os resultados da pesquisa apontam que o novo fundo, no citado município, trouxe significativas melhorias em vários aspectos educacionais: formação docente, aquisição de equipamentos e infraestrutura das escolas. Porém, na questão da aplicação condigna dos recursos, ainda são necessários ajustes. Também percebemos que o índice de evasão e repetência continua muito alto. A pesquisa trouxe contribuições efetivas no que diz respeito às informações sobre os recursos do FUNDEB, inclusive abrindo debate para que o município pudesse discutir as formas de aplicação dos recursos conforme a lei na sociedade e no Conselho de Acompanhamento do FUNDEB.

The Disability Standards for Education 2005 make it unlawful for an education authority to discriminate against a person on the grounds of the person's disability, and providers of adult and community education (ACE) are specifically noted as education authorities in the Standards. Most ACE providers, working as they do from a community development basis, would consider themselves to be non-discriminatory. The devil, nevertheless, is in the detail, and it is one particular detail of the Standards that this article considers – Part 7: Standards for student support services. Research has indicated that this is an area with which ACE providers are likely to have problems. This article looks firstly at the place of people with a disability in ACE, and then at some of the provisions of the Standards as they relate to student support. Evidence to support the discussion is taken from three research projects into ACE provision for people with a disability. These studies are outlined before the author moves on to some of the issues indicated in the research. Further, some suggestions are made for compliance, and the need for ACE providers to go beyond compliance and consider advocacy to support the inclusion of people with a disability into ACE.

This research¿s main goal was to analyze the existing relationship between both environmental and organizational values from three State Schools located in the city of Curitiba. These are: Protásio de Carvalho School, Guaíra School and Rio Branco School. At a theoretical empirical reference, an environmental approach has been performed, followed by aspects regarding organizational values, including the discussion on the theme of organizational culture, and, finally, a study on the prevalent values in public educational institutions. The method that best features this research is a comparative case report, with the use of multiple sources of evidence. Secondary data in order to identify the environmental values has been obtained through references of two of the most important newspapers in the State of Paraná, reports published by the State¿s Secretary of Education, publications from the State¿s Teachers Union and through the Educational Legislation in both Federal and State levels. The organizational values have been identified from primary data obtained through semi-structured interviews, performed with the School Principals and through questionnaires distributed to the School Principals and Teachers. The analysis over this data has been carried out in a descriptive-qualitative way by using both documentary and content analysis techniques. The database revealed that there are a few consistencies between environmental and organizational values, in a way that certain values identified in society and in the Government are, several times, more congruent with the values identified in the group of School Principals, whereas the values identified in the Teacher¿s Union have a higher consistency with the prevalent values in the group of teachers. At schools, mainly in the group of teachers, there¿s a noticeable refraction towards actions promoted by the government, and a certain skepticism towards actions promoted by the Teacher¿s Union. The student¿s education is given a higher value than one¿s cognitive education, in the work atmosphere as much as in the organizations; the Society has been gradually taking the responsibility regarding public education, with the support of school boards, teachers, and even of the Government, at a time when teachers, unlike the Society and the Government, appear to give very little value to their own profession.

In the teaching practice of architecture and urbanism in Brazil, educational legislation views modeling laboratories and workshops as an indispensable component of the infrastructure required for the good functioning of any architectural course of study. Although the development of information technology at the international level has created new possibilities for digital production of architectural models, research in this field being underway since the early 1990s, it is only from 2007 onwards that such technologies started to be incorporated into the teaching activity of architecture and urbanism in Brazil, through the pioneering experience at LAPAC/FEC/UNICAMP. It is therefore a recent experiment whose challenges can be highlighted through the following examples: (i) The implementation of digital prototyping laboratories in undergraduate courses of architecture and urbanism is still rare in Brazil; (ii) As a new developing field with few references and application to undergraduate programs, it is hard to define methodological procedures suitable for the pedagogical curricula already implemented or which have already been consolidated over the years; (iii) The new digital ways for producing tridimensional models are marked with specificities which make it difficult to fit them within the existing structures of model laboratories and workshops. Considering the above, the present thesis discusses the tridimensional model as a tool which may contribute to the development of students skills in perceiving, understanding and representing tridimensional space. Analysis is made of the relation between different forms of models and the teaching of architectural project, with emphasis on the design process. Starting from the conceptualization of the word model as it is used in architecture and urbanism, an attempt is made to identify types of tridimensional models used in the process of project conception, both through the traditional, manual way of model construction as well as through the digital ones. There is also an explanation on how new technologies for digital production of models through prototyping are being introduced in undergraduate academic programs of architecture and urbanism in Brazil, as well as a review of recent academic publications in this area. Based on the paradigm of reflective practice in teaching as designed by Schön (2000), the experiment applied in the research was undertaken in the integrated workshop courses of architectural project in the undergraduate program of architecture and urbanism at Universidade Federal do Rio Grande do Norte. Along the experiment, physical modeling, geometric modeling and digital prototyping are used in distinct moments of the design process with the purpose of observing the suitability of each model to the project s phases. The procedures used in the experiments are very close to the Action Research methodology in which the main purpose is the production of theoretical knowledge by improving the practice. The process was repeated during three consecutive semesters and reflection on the results which were achieved in each cycle helped enhancing the next one. As a result, a methodological procedure is proposed which consists of the definition of the Tridimensional Model as the integrating element for the contents studied in a specific academic period or semester. The teaching of Architectural Project as it is developed along the fifth academic period of the Architecture and Urbanism undergraduate program of UFRN is taken as a reference

The 1988 Constitution was the legal marc to define changes in Brazilian State with major importance to the layout of public politician. In that moment of redefinitions e openness to new ways the redemocratization, participation and decentralization of public school had as their starter the elementary school. This work focus on the manage of FUNDESCOLA, particularly one of its politics called PDE (Educational Development Plan) wich purpose is guarantee a better quality in teaching and spread out democracy throughout its methodology. It was chosen two public schools: Professor Ulisses de Góis and Antonio Campos. The theoretical and methodological orientation is based on the theory of participative democracy developed by authors such as Putnam and Pateman. They says that a cultural background precedes individual participation in society. The collected data (educational legislation, surveys with all sectors of schools and technicians of Natal educational secretary, and relevant documents of de institutions) showed that PDE. Implementation had opposite runnings in the schools studied. In one, as a consequence of bad preparations of its teachers to absorve its methodology, PDE failed. In another way, PDE achieved its goals, especially helping the structure of action plans of the school and the administrative organization making possible several pedagogic activities planned. The work concludes that the main factor the failure or success of PDE relies on the organizational (both political and pedagogical) structure of each school. This discovery implies three important guidelines when comes to formulation of public politicians: a) Constitution of school; b) the local actors who manages the actions; c) the colletive interest in taking part of decisions

This paper is set in a scenario in which higher education institutions suffer from external pressure to increase efficiency. The legislation after the Law of Directives and Bases for Education (LDBE), from 1996, is characterized by the fragmentation in its implementation, raising a concern with flexibility and innovation in several normative devices as well as aspects that must be incorporated to its organizational structure. The policies examined in this thesis are: Distance Education (DE); Law of Innovation and the Program of Support to Restructuring and Expansion of Federal Universities (PSREFU). This thesis aims to observe to what extent the characteristics of innovation and flexibility, which mark the new post- LDBE educational legislation, influence the organizational redesign of the Federal University of Ceará (UFC). For being about implementation policies, using contingency approach in order to collect the internal dynamics permeating the redesign of higher education institutions, the thesis focuses on the impacts caused by flexibility and innovation. This is a qualitative research, with case study methods, archive research and semi-structured interviews with members of the university administration. The results don t allow us to confirm the adoption of a more flexible and innovative configuration in the university but it is possible to identify the presence of those elements in the implementation changes, characterizing the hybrid structure. The changes mainly expose the extension of the management of projects to the administrative and academic components related to the institution. In terms of projection, the study found changes in the elements which characterize the current setting and the tendency of the university for adopting a diverse organizational structure. However, if the decentralization of management persists, the academic units may adopt their own structural solutions, but with no evidence of changes in the professional organization in most units. In this perspective, this thesis states that there are difficulties when incorporating innovation and flexibility to their organizational structure, which lead to improvised solutions, superposing skills through the redundancy of structures created with the same purpose or copying exogenous solutions
