Traditional approaches to evaluate performance in hotels, have mainly used financial measures. Building on Speckbacher et al. (2003), this Work Project aims to design and propose a Balanced Scorecard Type II as a performance measurement/management system for the hospitality industry based on data collected at the Luxury Brand Hotels of Pestana Group. The main contribution is to better align the vision, strategy and financial and non-financial performance measures in this category of hotels, in particular those of Pestana Group, and by doing so, lead their managers to focus on what is really critical and, consequently improve the overall performance.

This report represents four months of study on activities in the public prosecution service at the Local Instance of Setúbal judiciary district, started in September 2014 and completed of the same year. This report was prepared considering all the teachings of criminal law courses and criminal procedural law, doctrine, jurisprudence and all the practical experience experienced with prosecutors. In this context, their traineeship provided contact with different procedural stages: the investigation stage that allowed to understand better the progress of the processing of summary proceedings; the expedient distribution of urgent cases; the investigation stage, as regards the procedural impulse assistant and the accused; and the trial stage. This last phase allowed contact with different types of crimes especially road crimes and the crime of domestic violence. The analysis carried out the summary proceedings in the Public Ministry service would acquire relevant information to explain the incidence of road crimes. Topics will be addressed that were found on stage during the various procedural stages, as the implementation of new judicial map. The relationship between the prosecution and the Criminal Police Bodies was also an issue to be addressed. The work also raises awareness of the issue of archives in order to find out the position of assistant.

RESUMO - Pretende-se com este projecto fazer uma reflexão sobre a problemática dos modelos de governação na gestão pública de hospitais e sobre a forma de incrementar a capacidade estratégica da gestão, contextualizando a governação dos hospitais num quadro mais amplo e comunitário, integrando os interesses e expectativas dos diversos interessados no funcionamento dos hospitais públicos. Sinteticamente, a questão fundamental de investigação é: Como conseguirá o sistema de governação de um hospital público incorporar os interesses de todos os seus stakeholders e shareholders? A resposta a esta questão integra duas fases, uma primeira dedicada ao estudo de um novo modelo de configuração para o órgão de governação de topo do hospital público e uma segunda fase dedicada à construção de um questionário para discussão e validação do modelo proposto através da técnica Delphi. A metodologia utilizada passou pela condução prévia de entrevistas exploratórias a informadores privilegiados e pela divisão do projecto em duas partes – uma primeira parte de enquadramento que segue a metodologia clássica da revisão bibliográfica e uma segunda parte prática que segue a metodologia Delphi, precedida de um levantamento das questões críticas para integrar no questionário que servirá de base à discussão dos peritos. Como resultado, o actual modelo pareceu-nos dificultar a consideração das expectativas e dos interesses dos proprietários/accionistas e dos stakeholders em geral do hospital público, concluindo-se pela necessidade de um novo modelo que estabeleça, inequivocamente, os papéis e as funções inerentes ao órgão de governação, garantindo a internalização da perspectiva de todos os interessados. -------------------------------ABSTRACT - The objective of this project is to reflect on the problematic of models of governance in the public management of hospitals and on the means for incrementing strategic management capacity. It does so by contextualizing the governance of public hospitals on a more ample community–wide scale, integrating the interests and expectations of different parties. The main research question is: how can the system of governance of a public hospital incorporate the interests of all its stakeholders and shareholders? The answer to this question involves two phases, one dedicated to the study of the configuration of the top-level governing body of the public hospital and, a second, dedicated to the construction of a questionnaire for discussion and validation of the proposed model by means of a Delphi technique. The methodology involved, first of all, exploratory interviews with key- informants and by the structuring of the project in two parts – the first, dedicated to contextualization by means of a standard literature review and the second, essentially practical by means of the Delphi technique, preceded by the raising of critical questions that integrate the questionnaire that will form the basis of expert discussion. The present model of public hospital governance appears to limit the possibility of integrating the expectations and interests of stakeholders and owner/shareholders. ABSTRACT - The Portuguese National Health Service (SNS), a universal, centralized and public owned health care system, exhibits an extraordinary record of equalization in the access to health care and health gains in the late thirty years. However, the most recent history of the Portuguese health reform is pervaded by the influence of decentralization and privatization. Decentralization has been present in the system design since the 1976 Constitution, at least in theory. Private ownership of health care suppliers and out-ofpocket expenditures, on the financing side, both have a long tradition of relevance in the NHS mix of services. The initial aim of this study was to demonstrate expected parallelism between health reforms and public administration reforms, where a common pattern of joint decentralization and privatization was observed in many countries. Observers would be tempted to consider these two movements as common signs of new public management (NPM) developments. They have common objectives, are established around the core concepts of gains in effectiveness, efficiency, equity and quality of public services, through improved accountability. However, in practice, in Portugal, each movement was developed in a totally separated way. Besides those rooted in the NPM theory, there are few visible signs of association between decentralization and privatization. Decentralization, in the Portuguese SNS, was never intended to be followed by a privatization movement; it was seen merely as a public administration tool. Private management of health services, as stated in the most recent SNS legislation, was never intended to have decentralization as a condition or as a consequence. Paradoxically, in the Portuguese context, it has led invariably to centralized control. While presented as separate instruments for a common purpose, the association between decentralization and privatization still lacks a convincing demonstration. Many common health care management stereotypes remain to be checked out if we want to look for eventual associations between these two organizational tools.

Currently, Angola portrays a notorious economic growth and due to recent innovative legislations, it has become the major investment attracting pole, especially in Sub-Saharan Africa, having, thus, an extraordinary potentiality for a rapid and sustainable development, likely to place her in outstanding positions in the world economic ranking. Yet, such economic growth entails demanding levels of intensive investment in infrastructure, what has been reported of the Angolan Government to be unable to respond to, save if recurring to very high index of external debt, poisoning, in this way, the future budgeting of the country. Due to these infrastructure investment shortages, the cost of production remains highly onerous and the cost of life extremely unaffordable. On this account, the current study disserts about the contract of Project Finance; an alternative finance resource given as a viable solution for the private financing of infrastructure, aiming to demonstrate that such contractual figure, likewise the experience of several emerging economies and others, is a contract bid framework to take into account in today’s world. It refers to a financing technique – through which the Government may satisfy a common need (for example, the construction of a public domain or public servicing), without having to pay neither offer any collateral – based on a complex legal-financial engineering, arranged throughout a coalition of typical and atypical agreements, whereby it is mandatory to look back at the basic concepts of corporate law. More than just a simple financial study, the dissertation at stake analyses the nature and legal framework of Project Finance, which is a legally atypical and innominate contract, concluding that there is a relevant need for regulating and devoting a special legal regime in the Angolan jurisdiction for this promising legal form in the contemporary corporate finance world.

Currently, Portugal assumes itself as a democratic rule of substantive law State, sustained by a legal system seeking the right balance between the guarantee of fundamental rights and freedoms constitutional foreseen in Portugal’s Fundamental Law and criminal persecution. The architecture of the penal code lies with, roughly speaking, a accusatory basic structure, “deliberately attached to one of the most remarkable achievements of the civilizational democratic progress, and by obedience to the constitutional commandment”, in balance with the official investigation principle, valid both for the purpose of prosecution and trial. Regarding the principle of non self-incrimination - nemo tenetur se ipsum accusare, briefly defined as the defendant’s right of not being obliged to contribute to the self-incrimination, it should be stressed that there isn’t an explicit consecration in the Portuguese Constitution, being commonly accepted in an implicit constitutional prediction and deriving from other constitutional rights and principles, first and foremost, the meaning and scope of the concept of democratic rule of Law State, embedded in the Fundamental Law, and in the guidelines of the constitutional principles of human person dignity, freedom of action and the presumption of innocence. In any case, about the (in) applicability of the principle of the prohibition of self-incrimination to the Criminal Police Bodies in the trial hearing in Court, and sharing an idea of Guedes Valente, the truth is that the exercise of criminal action must tread a transparent path and non-compliant with methods to obtain evidence that violate the law, the public order or in violation of democratic principles and loyalty (Guedes Valente, 2013, p. 484). Within the framework of the penal process relating to the trial, which is assumed as the true phase of the process, the witness represents a relevant figure for the administration of criminal justice, for the testimonial proof is, in the idea of Othmar Jauernig, the worst proof of evidence, but also being the most frequent (Jauernig, 1998, p. 289). As coadjutant of the Public Prosecutor and, in specific cases, the investigating judge, the Criminal Police Bodies are invested with high responsibility, being "the arms and eyes of Judicial Authorities in pursuing the criminal investigation..." which has as ultimate goal the fulfillment of the Law pursuing the defense of society" (Guedes Valente, 2013, p. 485). It is in this context and as a witness that, throughout operational career, the Criminal Police Bodies are required to be at the trial hearing and clarify the Court with its view about the facts relating to occurrences of criminal context, thus contributing very significantly and, in some cases, decisively for the proper administration of the portuguese criminal justice. With regards to the intervention of Criminal Police Bodies in the trial hearing in Court, it’s important that they pay attention to a set of standards concerning the preparation of the testimony, the very provision of the testimony and, also, to its conclusion. Be emphasized that these guidelines may become crucial for the quality of the police testimony at the trial hearing, thus leading to an improvement of the enforcement of justice system. In this vein, while preparing the testimony, the Criminal Police Bodies must present itself in court with proper clothing, to read before and carefully the case files, to debate the facts being judged with other Criminal Police Bodies and prepare potential questions. Later, while giving his testimony during the trial, the Criminal Police Bodies must, summing up, to take the oath in a convincing manner, to feel comfortable, to start well by convincingly answering the first question, keep an attitude of serenity, to adopt an attitude of collaboration, to avoid the reading of documents, to demonstrate deference and seriousness before the judicial operators, to use simple and objective language, to adopt a fluent speech, to use nonverbal language correctly, to avoid spontaneity responding only to what is asked, to report only the truth, to avoid hesitations and contradictions, to be impartial and to maintain eye contact with the judge. Finally, at the conclusion of the testimony, the Criminal Police Bodies should rise in a smooth manner, avoiding to show relief, resentment or satisfaction, leaving a credible and professional image and, without much formality, requesting the judge permission to leave the courtroom. As final note, it’s important to stress that "The intervention of the Police Criminal Bodies in the trial hearing in Court” encloses itself on a theme of crucial importance not only for members of the Police and Security Forces, who must welcome this subject with the utmost seriousness and professionalism, but also for the proper administration of the criminal justice system in Portugal.

Desenhado por Jacque Fresco, o Projecto Vénus é uma proposta de reconfiguração social, tendo como ferramenta de trabalho a cidade. A cidade projectada por Jacque Fresco responde de alguma forma a necessidade de encontrar programas de hibridização que ultrapassem os receios do determinismo em relação ao papel da tecnologia, e conferindo um cariz mais aproximado dos conceitos antropológicos de Leroi-Gourhan quando este apelida a técnica de utensílio colocado fora do corpo e que permitiu ao homem sobreviver num mundo hostil. A diferença é que a técnica já assumiu uma condição que transcende o mero instrumento, para ser já ela própria configuradora da realidade, como Kittler dizia em acerca dos media. Fresco coloca a cidade como paradigma de uma revolução cibernética, uma tecnotopia, em que a tecnologia servirá para libertar o humano de condições políticas, económicas e sociais que o autor considera obsoletas. Uma nova configuração multidimensional que se apoia numa nova esfera pública, ambicionando um ethos global com uma estrutura digital para comunicações em rede. Fresco atribui uma dimensão de extrema importância aos factos de a tecnologia, no Projecto Vénus, ficar paredes meias com a natureza sem que tenha uma relação intrusiva, mas antes uma relação de responsabilidade pela gestão eficaz dos sistemas circundantes que preconizam muitas das “expectativas messiânicas” de que Walter Benjamin nos falava acerca da tecnologia. O objectivo da presente dissertação será a partir da definição de técnica e da tecnologia e, mais tarde discutindo esta cidade cibernética chamada Projecto Vénus, tentar responder às seguintes perguntas: como Gourhan nos diz, a técnica foi colocada fora do corpo para permitir aos seres humanos sobreviver, podemos supor que, neste momento, com a emergência de novas áreas, como a biotecnologia, nanotecnologia e robótica, a tecnologia retorna ao corpo humano para resolver a falha que, de acordo com o mito de Epimeteu, lhe deu origem? Se assim for, este processo de incorporação dos aparelhos protéticos, pode significar que estamos a entrar na era de reprodutibilidade do corpo humano como um objecto? Além disso, será a crescente visibilidade do Projecto Vénus um sintoma de uma crescente sociedade tecnológica, uma tecnotopia cujo fim último é a reconfiguração da máquina antropológica tal como Agamben colocou em «The Open»?
