RESUMO - 1. INTRODUÇÃO: Ao longo dos tempos, assistiu-se a um aumento da importância da Saúde Pública na Comunidade Europeia, mas só há relativamente pouco tempo teve o merecido lugar de destaque à luz da legislação comunitária. Neste contexto e com a adopção do Programa Europeu de Saúde Pública, surge a necessidade de actualizar o pensamento nesta área. Assim, é identificada uma oportunidade para formular uma estratégia, que seja passível de reduzir desigualdades e que também em compreenda as necessidades de saúde. Com o expandir da questão e com o propósito de reduzir as desigualdades, surge a Directiva 2011/24/UE, que visa regulamentar os direitos dos doentes em matéria de cuidados transfronteiriços. 2. OBJETIVO: Este trabalho apresenta como objetivo primordial analisar a Directiva 2011/24/UE, bem como a Lei n.º 52/2014, de 25 de Agosto, e identificar as principais barreiras, ao exercício do direito de acesso aos cuidados de saúde transfronteiriços, pelos beneficiários do SNS em Portugal, derivadas da aplicação de tais instrumentos legais. 3. METODOLOGIA: Foi utilizada uma abordagem analítica e documental, baseada na metodologia qualitativa. 4. CONCLUSÕES: As principais barreiras ao direito de acesso aos cuidados de saúde transfronteiriços, para os beneficiários do SNS em Portugal, são de ordem financeira, linguística e cultural, informacional, de mobilidade física, de proximidade geográfica, de carácter administrativo e de continuidade dos cuidados. A transposição da Directiva 2011/24/UE para o quadro jurídico português resulta essencialmente em iniquidades no âmbito do acesso aos cuidados de saúde transfronteiriços.

Tax evasion and fraud threaten the economic and social objectives of modern tax systems, precluding the state funding for the satisfaction of collective needs and the fair distribution of wealth, being a violation of basic principles and values of our society. In tax law, to give tax administration the necessary powers to supervise and control the information provided by taxpayers and combat tax evasion and fraud, over the last years the grounds for a derogation of bank secrecy without judicial authorization have been extended, which raises some constitutional compatibility issues. Similarly, this tendency of making this legal regime more flexible and increasing automatic exchange of information has been followed by the European Union and the international community. Banking secrecy, as a professional secrecy, is an instrument to protect the right to privacy but also appears as an anti-abuse and repressive mechanism of evasive and fraudulent behaviors. Because of the conflict of interests will always be necessary to make a practical agreement between them, ensuring the legality and the due guarantees of the taxpayers but also an effective way to combat tax evasion and fraud. Bank secrecy cannot be one method to, behind the right to privacy, taxpayers practice illegal activities. But the practice of these irregular conducts also does not justify a total annihilation of the right to banking secrecy, uncovering all documents and bank information’s. Although considering the legislative changes, the administrative derogation of bank secrecy will always be what the tax administration does of it.

This dissertation stands out the religious and social role of Christian religious minorities in Portuguese society, where the vast majority of the believers profess the Catholic faith. This work serves to demystify the widespread prejudice against minorities and clarify its place in the religious phenomenon in Portugal. We intend to define the concept of Religion, missing in the Portuguese legislation, framing it in Portuguese constitutional history, which allows us to evaluate the relations State/Catholic Church and State/religious minorities, since Liberalism. We attempt to measure how the legal system accepts the religious phenomenon and how to deal with religious diversity, according to the principle of religious freedom postulated in the Constitution of the Portuguese Republic. It is also our intention to relate the concepts of sect and religious minority, which tendentiously are misunderstood. In order to understand the underlying dynamics of religious minorities, we take the example of the Portuguese Evangelical Alliance, which we monitored closely throughout the investigation. We will give some space for a small analysis of the state and social discrimination experienced by the minorities. With this work we can conclude in general that Portugal, despite its weak religious diversity, has a good advance on the religious freedom. The Portuguese State has made a remarkable effort to cooperate with the churches, an effort that must be continued in order to fill some gaps found, particularly in the absence of legislation regarding the criminalization of religious discrimination and competence of the Committee on Religious Freedom in case of a possible complaint. We prove similarly that there is also a special attention to the Catholic Church in the composition of the Committee on Religious Freedom and the Committee Broadcast Time of Religious Confessions. In the end, we prove that the society is the major source of discrimination against minorities.
