Os direitos dos animais

This work has the purpose of presenting the current state of the debate concerning animal rights, both in the Portuguese legal system and in foreign systems. In order to do so, it starts with an analysis of the evolution of the legal status of animals through History, and the status they have achieved in today’s legal systems. The aim of this work is to reflect upon the challenges that would result from a change of position regarding this subject, from the current legal classification as things, to a complete personalization based on the Constitution, or through the creation of a tertium genus between Men and things, that would stress the fact that animals are sentient beings.

Diagnóstico de danos sobre grandes áreas de mosaicos conservados in situ

Os trabalhos de conservação e restauro sobre grandes áreas de mosaico conservados in situ levantam diversos problemas logísticos inerentes ao registo, nomeadamente da forma e conteúdos dos painéis, do diagnóstico de patologias e do relatório de intervenção. A necessidade de registar dados que têm expressão ao nível de uma tessela – área frequentemente inferior a 1cm2 – sobre áreas totais da ordem das dezenas ou centenas de metros quadrados, limitada pelas condições do local – meteorologia, ciclo diário e sazonal, etc. – obriga a que se instituam metodologias que permitam abreviar o tempo necessário para resolver todas as operações de registo com a acuidade essencial. Os métodos e as ferramentas fundamentais para agilizar o processo de registo são os assuntos deste artigo.

Visões do Império : a 1ª EXposição Colonial de 1934 e alguns dos seus álbuns

A Primeira Exposição Colonial Portuguesa realizada no Porto em 1934 foi a consequência visível do impulso que Salazar quis dar à «política colonial» portuguesa e a uma orientação imperial em que colonizar e civilizar as populações indígenas eram as palavras de ordem. Como corolário da exposição foram produzidos, entre outros, dois importantes álbuns, hoje documentos de inegável interesse histórico, não só enquanto discurso de propaganda do regime do Estado Novo, mas também enquanto narrativas visuais ou “visões do Império”. São eles, o Álbum Fotográfico da autoria do fotógrafo Domingos Alvão e o Álbum Comemorativo, com reproduções de pinturas e desenhos do pintor Eduardo Malta. Neste trabalho pretendemos reflectir sobre essas “visões do Império”, pois elas expressam uma visualidade e um imaginário que se traduz em práticas sociais, em valores e em relações de dominação que definem uma política do olhar, onde o corpo se torna um espaço de inscrição, bem como de categorização racial e cultural. Em suma, é através dessas imagens que vemos as relações de poder e as formas de dominação sobre o outro, que impregnaram a exposição.

Processo especial de revitalização

The following report aims to present the internship developed under the Master in Legal Sciences Business in the Legal Affairs management of Caixa Geral de Depósitos S.A. Activities were developed in the field of Banking Law, focusing on the Special Revitalization Process. The aim of these activities was to promote the construction of a study that, apart from its doctrinal and jurisprudential research, also excels in the practical adequacy of the regime lectured. The revitalizing effectiveness of the Special Revitalization Process is erected in the Article 17-E, nº 1, which establishes a series of procedural – stand still effects - which aim to allow the debtor "breathing space", ie, a period during which creditors are prevented from setting up "actions for debt collection" against him, suspending the pending actions with identical purposes. Therefore, this report essentially studies these effects, considering "actions in debt collection" executive actions that are intended to recover a debt of any kind, including anticipatory precautionary procedures of an action of this nature. In addition, it is necessary to set boundaries temporally and subjectively to the standstill period, understanding that this period should be extended beyond the legally established period, in order to preserve the ratio of the process, concretely, until the recovery plan effects. In turn, we understand that the standstill effects only apply to the established material in connection with the debtor, remaining the rights of creditors unaffected over the ones of the guarantors and debtors.
