Media diversity as a guarantee to cultural diversity: the promotion of identities from an international law approach

This article deals with several international instruments which provide legal guarantees for media diversity, which is essential for the promotion of cultural diversity. Based on several articles of the Convention of cultural diversity, the General Comment of the Committee on Economic, Social and Cultural Rights No. 21 on the right to take part in cultural life, as well as the work of the UN Independent Expert on Cultural Rights, this article aims to identify legal tools for the establishing of measures promoting cultural diversity in the media. This article looks at the case study of Honduran Garifuna community radios. It emphasizes the importance of taking into account the economic aspects of cultural and communicational rights.

The Affordable Care Act and the Transformation of US Health Care

The neoliberal period was accompanied by a momentous transformation within the US health care system.  As the result of a number of political and historical dynamics, the healthcare law signed by President Barack Obama in 2010 ‑the Affordable Care Act (ACA)‑ drew less on universal models from abroad than it did on earlier conservative healthcare reform proposals. This was in part the result of the influence of powerful corporate healthcare interests. While the ACA expands healthcare coverage, it does so incompletely and unevenly, with persistent uninsurance and disparities in access based on insurance status. Additionally, the law accommodates an overall shift towards a consumerist model of care characterized by high cost sharing at time of use. Finally, the law encourages the further consolidation of the healthcare sector, for instance into units named “Accountable Care Organizations” that closely resemble the health maintenance organizations favored by managed care advocates. The overall effect has been to maintain a fragmented system that is neither equitable nor efficient. A single payer universal system would, in contrast, help transform healthcare into a social right.

PCE, Santiago Carrillo: enero de 1977 o el giro sacrificial de la Transición

La Transición española a la democracia ha sido objeto de uno de los más sólidos relatos construidos por el periodismo y refrendado por la sociedad civil. En su corazón tiene lugar un momento de violencia que se concentra en la llamada semana negra de enero de 1977, cuyo clímax está representado por la matanza de Atocha. El presente artículo analiza las distintas etapas de cristalización de ese relato: un capítulo de La Transición (Elías Andrés, Victoria Prego, 1995), Siete días de enero (J.A. Bardem, 1978), un reportaje de Interviú (febrero de 1977) y las crónicas periodísticas de El País, Diario16 y Mundo Obrero. Especial atención se presta a la figura de Santiago Carrillo, identificado con la estrategia del PCE, cuya consideración cambió radicalmente durante esa semana.

A nobreza doutural da bruzundanga: Profissionais liberais e fetiche do coutoramento no Brasil

Analisa-se, a partir da obra Os Bruzundangas (1922) de Lima Barreto, o fascínio brasileiro pelo título de doutor, e a necessidade de ostentá-lo demonstrada por alguns profissionais liberais. Inicialmente, sintetiza-se a obra limabarretiana, enfatizando-se o tratamento e a sátira feita pelo autor aos doutores e à doutorice dos anos 1910. Em seguida, discute-se a construção histórica da associação entre o título e o valor social do poder e do prestígio, destacando, de um lado, a tradição lusitana do bacharelismo, e, de outro, a bacharelização promovida por D. Pedro II. Discorre-se, então, acerca das tentativas contemporâneas de apropriação e/ou manutenção do doutoramento pelos advogados, juízes, médicos e outros profissionais de saúde. Por fim, aborda-se a problemática do ponto de vista discursivo, levantando-se algumas questões linguísticas e ideológicas envolvidas.

Special employment centers in Castile and León 2007-2013: effects of the crisis in relation to these centers’ registered legal personalities

The aim of this paper is to carry out an economic and financial study of the Special Employment Centres in Castile and León based on a classification of these entities’ registered legal personalities in order to view how the economic crisis that began at the end of 2007 may have affected them. Various items from the Centres’ financial statements are analysed and the results are compared to those from the period 2007-2013 as to provide a broader perspective of their size, development, growth and behaviour. The following economic figures were used: total assets, turnover and revenue. The variable “employment” is compared with the subsidies received by the Centres, showing that the crisis does affect the Centres depending on their registered legal personalities. Associations and physical persons are the most affected personalities, to the point of possible extinction. An account reversal for the Centres is also included in this article, which measures the percentage of public aid received by the Centres that is returned to society.
