We report a measurement of the single top quark production cross section in 2.2 ~fb-1 of p-pbar collision data collected by the Collider Detector at Fermilab at sqrt{s}=1.96 TeV. Candidate events are classified as signal-like by three parallel analyses which use likelihood, matrix element, and neural network discriminants. These results are combined in order to improve the sensitivity. We observe a signal consistent with the standard model prediction, but inconsistent with the background-only model by 3.7 standard deviations with a median expected sensitivity of 4.9 standard deviations. We measure a cross section of 2.2 +0.7 -0.6(stat+sys) pb, extract the CKM matrix element value |V_{tb}|=0.88 +0.13 -0.12 (stat+sys) +- 0.07(theory), and set the limit |V_{tb}|>0.66 at the 95% C.L.

We report a search for single top quark production with the CDF II detector using 2.1 fb-1 of integrated luminosity of pbar p collisions at sqrt{s}=1.96 TeV. The data selected consist of events characterized by large energy imbalance in the transverse plane and hadronic jets, and no identified electrons and muons, so the sample is enriched in W -> tau nu decays. In order to suppress backgrounds, additional kinematic and topological requirements are imposed through a neural network, and at least one of the jets must be identified as a b-quark jet. We measure an excess of signal-like events in agreement with the standard model prediction, but inconsistent with a model without single top quark production by 2.1 standard deviations (sigma), with a median expected sensitivity of 1.4 sigma. Assuming a top quark mass of 175 GeV/c2 and ascribing the excess to single top quark production, the cross section is measured to be 4.9+2.5-2.2(stat+syst)pb, consistent with measurements performed in independent datasets and with the standard model prediction.

We report the observation of electroweak single top quark production in 3.2  fb-1 of pp̅ collision data collected by the Collider Detector at Fermilab at √s=1.96  TeV. Candidate events in the W+jets topology with a leptonically decaying W boson are classified as signal-like by four parallel analyses based on likelihood functions, matrix elements, neural networks, and boosted decision trees. These results are combined using a super discriminant analysis based on genetically evolved neural networks in order to improve the sensitivity. This combined result is further combined with that of a search for a single top quark signal in an orthogonal sample of events with missing transverse energy plus jets and no charged lepton. We observe a signal consistent with the standard model prediction but inconsistent with the background-only model by 5.0 standard deviations, with a median expected sensitivity in excess of 5.9 standard deviations. We measure a production cross section of 2.3-0.5+0.6(stat+sys)  pb, extract the value of the Cabibbo-Kobayashi-Maskawa matrix element |Vtb|=0.91-0.11+0.11(stat+sys)±0.07  (theory), and set a lower limit |Vtb|>0.71 at the 95% C.L., assuming mt=175  GeV/c2.

We measure a production cross section of 2.3+0.6-0.5(stat+sys) pb, extract the CKM matrix element value |Vtb|=0.91+0.11-0.11 (stat+sys)+-0.07(theory), and set a lower limit |Vtb|>0.71 at the 95% confidence level, assuming m_t=175 GeVc^2.

Prostate cancer is the most common cancer in males. Although many patients with localized disease can be cured with surgery and radiotherapy, advanced disease and especially castration resistant metastatic disease remains incurable, with a median life expectancy of less than 18 months. Oncolytic adenoviruses (Ads) are a new promising treatment against cancer due to their innate capacity to kill cancer cells. Viral replication in tumor cells leads to oncolysis and production of a multiplicity of new virions that are capable of further destroying cancerous tissue. Oncolytic Ads can be modified for tumor targeted infection and replication and be armed with therapeutic transgenes to maximize the oncolytic effect. Worldwide, clinical trials with oncolytic Ads have demonstrated good safety while the antitumor efficacy remains to be improved. Importantly, the best responses have been reported when oncolytic adenoviruses have been combined with standard cancer treatments, such as chemotherapy and radiation. Further, a challenge in many virotherapy approaches has been the monitoring of virus replication in vivo. Reporter genes have been extensively used as transgenes to evaluate the biodistribution of the virus and activity of specific promoters. However, these techniques are often limited to preclinical evaluation and not amenable to human use. The aim of the thesis was to find and develop new oncolytic Ads with maximum efficacy against metastatic, castration resistant prostate cancer and study them in vitro and in vivo combined to different forms of radiation therapy. Using combination therapy, we were aiming for better antitumor efficacy with reduced side effects. Capsid modified Ads for enhanced transduction were studied. Serotype 3 targeted chimera, Ad5/3, was found to have enhanced infectivity for prostate cancer and was used for developing new viruses for the study. Correlation between Ad-encoded marker peptide secretion and simultaneous viral replication was evaluated and the effects of radiotherapy on viral replication were studied in detail. We found that the repair of double strand breaks caused by ionizing radiation was inhibited by adenoviral proteins and led to autophagic cell death. Both subcutaneous models and intrapulmonary tumor models mimicking metastatic, aggressive disease were used in vivo. Virus efficacy was evaluated by intratumoral injections. Also, intravenous administration was evaluated to study the effectiveness in metastatic disease. Oncolytic adenovirus treatment led to significant tumor growth control and increased the survival rate of the mice. These results were further improved when oncolytic Ads were combined with radiation therapy. Oncolytic Ads expressing human sodium/iodide transporter (hNIS) as a transgene were evaluated for their oncolytic potency and for the functionality of hNIS in vitro and in vivo. Monitoring of viral replication was also assessed using different imaging modalities relative to clinical use. SPECT imaging of tumor-bearing mice was evaluated and combined with simultaneous CT-scanning to obtain important anatomical information on biodistribution, also in a three-dimensional form. It was shown that hNIS-expressing adenoviruses could harbour a bi-functional transgene allowing for localization and imaging of viral replication. Targeted radiotherapy was applied by systemic radioiodide administration and resulted in iodide accumulation into Ad-infected tumor. The combination treatment showed significantly enhanced antitumor efficacy in mice bearing prostate cancer tumors. In summary, the results presented above aim to provide new treatment modalities for castration resistant prostate cancer. Molecular insights were provided for better understanding of the benefits of combined radiation therapy and oncolytic adenoviruses, which will hopefully facilitate the translation of the approach into clinical use for humans.

The TOTEM collaboration has developed and tested the first prototype of its Roman Pots to be operated in the LHC. TOTEM Roman Pots contain stacks of 10 silicon detectors with strips oriented in two orthogonal directions. To measure proton scattering angles of a few microradians, the detectors will approach the beam centre to a distance of 10 sigma + 0.5 mm (= 1.3 mm). Dead space near the detector edge is minimised by using two novel "edgeless" detector technologies. The silicon detectors are used both for precise track reconstruction and for triggering. The first full-sized prototypes of both detector technologies as well as their read-out electronics have been developed, built and operated. The tests took place first in a fixed-target muon beam at CERN's SPS, and then in the proton beam-line of the SPS accelerator ring. We present the test beam results demonstrating the successful functionality of the system despite slight technical shortcomings to be improved in the near future.

Words as Events introduces the tradition of short, communicative rhyming couplets, the mantinádes, which are still sung and recited in a variety of performance situations on the island of Crete. The local focus on communicative economy and artistry is further examined in an in-depth analysis of the processes and ideals of composition. Short genres of oral poetry have been widely neglected in folklore research; however, their demand for structural and semantic coherence as well as their dialogic nature appeals to very different human needs from those of the longer poems. In contemporary Crete, poems also appear in written contexts, they are submitted to modern mass media, and people widely exchange them as text messages. By striving to understand the tradition during a period of change, this study analyzes the larger principles that ground the communication, self-expression and creativity in the genre. The aim of this research is thus twofold: to present this specific register of dialogic oral poetry as well as to create a theoretical approach sensitive to the creativity of such short registers. The study is based on long-term ethnographic fieldwork conducted in Crete between the years 1997 2009. An important aspect of the methodology was to create long-term ties with a number of key-informants who composed mantinádes. The interdisciplinary theoretical and methodological basis for this analysis is in the contemporary Finnish and international research on oral poetry and on anthropological research on communicative speech genres. These theoretical insights are extended by addressing questions of spontaneity and individual agency. Since mantinádes are at the same time a model for composition and a reserve of poems in fixed form, the aesthetics and objectives of performance and composition are also plural. In a traditional singing event, the basic motivation for the singers is to provide a meaningful contribution to a selected theme, which is the shared topic of the poetic dialogue. Consequently, similar topics giving rise to poetic associations can be encountered during various moments of everyday life: the dialogic nature is embodied in the tradition to such degree that it also arises in the performances and composition of single poems and outside of any institutionalized performance arenas. Therefore, as this study discusses in detail, even the apparently non-contextualized poems recited between locals or occurring in the contemporary mass media arenas, are understood and evaluated as utterances that provide an individual perspective within a certain dialogue.

This study investigates the role of social media as a form of organizational knowledge sharing. Social media is investigated in terms of the Web 2.0 technologies that organizations provide their employees as tools of internal communication. This study is anchored in the theoretical understanding of social media as technologies which enable both knowledge collection and knowledge donation. This study investigates the factors influencing employees’ use of social media in their working environment. The study presents the multidisciplinary research tradition concerning knowledge sharing. Social media is analyzed especially in relation to internal communication and knowledge sharing. Based on previous studies, it is assumed that personal, organizational, and technological factors influence employees’ use of social media in their working environment. The research represents a case study focusing on the employees of the Finnish company Wärtsilä. Wärtsilä represents an eligible case organization for this study given that it puts in use several Web 2.0 tools in its intranet. The research is based on quantitative methods. In total 343 answers were obtained with the aid of an online survey which was available in Wärtsilä’s intranet. The associations between the variables are analyzed with the aid of correlations. Finally, with the aid of multiple linear regression analysis the causality between the assumed factors and the use of social media is tested. The analysis demonstrates that personal, organizational and technological factors influence the respondents’ use of social media. As strong predictive variables emerge the benefits that respondents expect to receive from using social media and respondents’ experience in using Web 2.0 in their private lives. Also organizational factors such as managers’ and colleagues’ activeness and organizational guidelines for using social media form a causal relationship with the use of social media. In addition, respondents’ understanding of their responsibilities affects their use of social media. The more social media is considered as a part of individual responsibilities, the more frequently social media is used. Finally, technological factors must be recognized. The more user-friendly social media tools are considered and the better technical skills respondents have, the more frequently social media is used in the working environment. Maaseutupolitiikan yhteistyöryhmä on pääosin poliittis-hallinnollisessa tilassa toimiva, uusi verkostomainen hallintasommitelma, jossa on mukana myös hallinnon ulkopuolisia toimijoita ja tahoja. Kokonaisuutta nimitetään tässä YTR-verkostoksi. Itsearvioinnin tarkoituksena oli argumentoida esiin YTR-verkoston toiminnan kriittiset kohdat. Arviointitutkimuksesta vastasi Helsingin yliopiston Ruralia-instituutti ja sen toteutti 25.8. – 31.12.2010 välisenä aikana tutkimusjohtaja, dosentti Torsti Hyyryläinen. Itsearviointiin osallistui valtioneuvoston viisivuotiseksi toimikaudeksi (2008-2013) nimeämän maaseutupolitiikan yhteistyöryhmän jäseniä ja varajäseniä. Kokoavana tuloksena esitetään seuraava analyysi: 1. YTR-verkoston tiedollinen kapasiteetti on vahva. 2. YTR-verkostolla on potentiaalisesti laajat suhderesurssit mutta ne ovat alihyödynnettyjä. 3. YTR-verkostolla on mobilisoitikapasiteettia mutta sen omat voimavarat ovat niukat. YTR-verkostolla on ollut keskeinen rooli maaseutupolitiikan muotoutumisessa ja kehittymisessä. Keskustelu maaseudun kehittämistä olisi Suomessa ollut oleellisesti vähäisempää, heikommin jäsenneltyä ja tietopääomaltaan suppeampaa ilman YTR-verkostoa. Verkostossa on monialaista asiantuntemusta, jonka perusteella se on kyennyt vastaamaan laajoihin maaseutupoliittisiin kommunikaatiotarpeisiin. Tästä yhtenä esimerkkinä on maaseutupoliittisen selonteon perusteellinen valmistelu ja monivaiheinen käsittely eduskunnassa vuonna 2010. Verkostosuhteiden hallinnan kehittäminen nousee arvioinnissa tärkeimmäksi YTR-verkoston toimintakyvyn, tuloksellisuuden ja vaikuttavuuden kehittämisen painopisteeksi. Verkosto näyttää saavuttaneen tärkeän kehitysvaiheen, josta ei päästä eteenpäin ilman sen kysymyksen pohdintaa, miten YTR-verkoston suhdekapasiteettia, eli suhteita keskeisiin sidosryhmiin voitaisiin kehittää. Valta on YTR-verkostossa komplisoiduinta ja ongelmallisinta juuri suhderesurssien alueilla. Se kiteytyy kysymykseen poliittisesta valmistelu- ja päätösvallasta, eli kenellä on legitiimi asema toisaalta muotoilla poliittiseen päätöksentekoon etenevät aloitteet ja lopulta tehdä poliittisesti sitovia päätöksiä koskien maaseutua ja sen kehittämistä. Medioiden vaikutusvallan huomioiminen on entistä tärkeämpää. Niiden suuntaan vahvemmin kommunikoimalla YTR-verkosto voi tulevaisuudessa lisätä vaikutusvaltaansa. Toistaiseksi lähes täysin käyttämätön potentiaali on sosiaalisen median verkostoissa, joihin YTR:n säikeet eivät vielä juurikaan ulotu. Suhdepääomassa on siis YTR:n voima ja samalla sen heikkous. Tämä johtopäätös on merkittävä erityisesti valtioneuvoston asettaman yhteistyöryhmän itsensä kannalta. Yhteistyöryhmän tulisi itse vapautua komiteamaisista työtavoista ja kehittää niitä monimuotoisemmiksi. Paikallaan on myös kysyä: mitä yhteistyöryhmän jäsenet ja jäsenyhteisöt ovat valmiita tekemään YTR:n suhderesurssien kehittämiseksi?

Background: Antioxidants might protect against oxidative stress, which has been suggested as a cause of aging. Methods: The ATBC Study recruited males aged 50-69 years who smoked at least 5 cigarettes per day at the baseline. The current study was restricted to participants who were followed up past the age of 65. Deaths were identified in the National Death Registry (1445 deaths). We constructed Kaplan-Meier survival curves for all participants, and for four subgroups defined by dietary vitamin C intake and level of smoking. We also constructed Cox regression models allowing a different vitamin E effect for low and high age ranges. Results: Among all 10,837 participants, vitamin E had no effect on those who were 65 to 70 years old, but reduced mortality by 24% when participants were 71 or older. Among 2284 men with dietary vitamin C intakes above the median who smoked less than a pack of cigarettes per day, vitamin E extended life-span by two years at the upper limit of the follow-up age span. In this subgroup, the survival curves of vitamin E and no-vitamin E participants diverged at 71 years. In the other three subgroups covering 80% of the participants, vitamin E did not affect mortality. Conclusions: This is the first study to strongly indicate that protection against oxidative stress can increase the life expectancy of some initially healthy population groups. Nevertheless, the lack of effect in 80% of this male cohort shows that vitamin E is no panacea for extending life expectancy.

Modeling and forecasting of implied volatility (IV) is important to both practitioners and academics, especially in trading, pricing, hedging, and risk management activities, all of which require an accurate volatility. However, it has become challenging since the 1987 stock market crash, as implied volatilities (IVs) recovered from stock index options present two patterns: volatility smirk(skew) and volatility term-structure, if the two are examined at the same time, presents a rich implied volatility surface (IVS). This implies that the assumptions behind the Black-Scholes (1973) model do not hold empirically, as asset prices are mostly influenced by many underlying risk factors. This thesis, consists of four essays, is modeling and forecasting implied volatility in the presence of options markets’ empirical regularities. The first essay is modeling the dynamics IVS, it extends the Dumas, Fleming and Whaley (DFW) (1998) framework; for instance, using moneyness in the implied forward price and OTM put-call options on the FTSE100 index, a nonlinear optimization is used to estimate different models and thereby produce rich, smooth IVSs. Here, the constant-volatility model fails to explain the variations in the rich IVS. Next, it is found that three factors can explain about 69-88% of the variance in the IVS. Of this, on average, 56% is explained by the level factor, 15% by the term-structure factor, and the additional 7% by the jump-fear factor. The second essay proposes a quantile regression model for modeling contemporaneous asymmetric return-volatility relationship, which is the generalization of Hibbert et al. (2008) model. The results show strong negative asymmetric return-volatility relationship at various quantiles of IV distributions, it is monotonically increasing when moving from the median quantile to the uppermost quantile (i.e., 95%); therefore, OLS underestimates this relationship at upper quantiles. Additionally, the asymmetric relationship is more pronounced with the smirk (skew) adjusted volatility index measure in comparison to the old volatility index measure. Nonetheless, the volatility indices are ranked in terms of asymmetric volatility as follows: VIX, VSTOXX, VDAX, and VXN. The third essay examines the information content of the new-VDAX volatility index to forecast daily Value-at-Risk (VaR) estimates and compares its VaR forecasts with the forecasts of the Filtered Historical Simulation and RiskMetrics. All daily VaR models are then backtested from 1992-2009 using unconditional, independence, conditional coverage, and quadratic-score tests. It is found that the VDAX subsumes almost all information required for the volatility of daily VaR forecasts for a portfolio of the DAX30 index; implied-VaR models outperform all other VaR models. The fourth essay models the risk factors driving the swaption IVs. It is found that three factors can explain 94-97% of the variation in each of the EUR, USD, and GBP swaption IVs. There are significant linkages across factors, and bi-directional causality is at work between the factors implied by EUR and USD swaption IVs. Furthermore, the factors implied by EUR and USD IVs respond to each others’ shocks; however, surprisingly, GBP does not affect them. Second, the string market model calibration results show it can efficiently reproduce (or forecast) the volatility surface for each of the swaptions markets.

In the study, two upper elementary school health education textbooks were investigated. The purpose of the study was to examine the health discourses and subject- and reader positions constructed in text. Theoretically, the study is based on poststructuralist thought and critical sociology of health promotion. Methodologically, it draws mainly on critical lingvistics and new rhetorics. Textbooks were understood as informative, argumentative and persuasive texts in which different lexical and grammatical methods to secure the readers´ responsiveness were utilized. Also, the relations of the text to wider genres, social situations, structures, institutions and practices were investigated. The interpersonal and ideational dimensions of the texts were analysed with the aim of finding out the kinds of identities for and relations between the speaker and the ideal reader were constructed and the kinds of representations of health and the world around were produced in the textbooks. Multiple discourses of health, and genres and styles characteristic for many kinds of contexts and situations were found. The identities of and the relationships between the speaker and the ideal reader of the text were also multiple and changing. The text echoes both biomedical health discourse emphasizing prevention of illness and holistic discourse emphasizing personal welfare, fulfillment and happiness. Furthermore, traces for example from development psychological, ecological and civilization critical discourses were perceived. Formal scientific genre was found to be mixed with informal chatting imitating close and equal relationship between participants characteristic for advertisements and other persuasive texts, and obliging and ordering expression typical for school context and other situations where the relationship between participants is unequal and distant. The ideal reader of the text can be characterized as adolescent living in the world saturated by advertising and media. He or she is interested in the life of the celebrities, and is interested rather in her or his appearance, image and short-term enjoyment than health and long-term welfare. In the textbooks, healthy way of life is attempted to create a product which appeals to the values and interests of the imaginary public, the ideal reader of the text. Marketing healthy choices tend to reproduce stereotyped ideas of happiness, good life, youth and sex. Furthermore, individualizing approach mixed with wide definition of health legitimizes easily an erraneous impression of health, beauty and success being personal achievements dependent only on attitudes and competences.

Puhtaat varallisuusvahingot kohdistuvat useimmiten elinkeinonharjoittajiin. Puhtaiden varallisuusvahinkojen korvaamista sopimuksenulkoisissa suhteissa on kuitenkin rajoitettu. Niiden korvaamisen edellytyksenä on, että vahinko on korvauskelpoinen erityislainsäädännön perusteella, tai että jokin vahingonkorvauslain 5:1:n erityisedellytyksistä täyttyy. Tilanteita, jotka eivät kuulu erityislainsäädännön alaan ovat mm. julkinen arvostelu ja sopimattomat kilpailuteot, joissa on usein kysymys immateriaalioikeusloukkauksia muistuttavista tilanteista. Nämä ovat tutkielmassa tarkastelun kohteena. Yritystoiminta ja varallisuusarvot ovat muuttuneet vuonna 1974 voimaan tulleen vahingonkorvauslain säätämisen jälkeen. Aineettomien intressien, kuten yrityksen imagon ja yrityksen sisäisen erityisosaamisen merkitys liiketoiminnassa on jatkuvasti kasvanut. Puhtaiden varallisuusvahinkojen ja esinevahinkojen erottelu erilaisin korvausperustein ei näin ollen välttämättä ole enää ajankohtaista ja vahingonkorvauslakiin kohdistuu uudistamispaineita. Tutkielmassa on tarkasteltu puhtaiden varallisuusvahinkojen korvaamista elinkeinonharjoittajien välisissä oikeussuhteissa silloin kun kysymys on VahL 5:1 :n soveltamisalaan kuuluvista tilanteista. Yleensä korvauskannetta voidaan ajaa VahL 5:1 :n erittäin painavat syyt -kohdan nojalla, mutta koska tämä kohta ei ole yksiselitteinen puutteellisen ja epäselvän lainvalmisteluaineiston vuoksi, eikä erittäin painavien syiden sisältö ole vieläkään muotoutunut oikeuskäytännössä täysin selkeäksi, on vahingonkärsijän usein hankala arvioida mahdollisuutensa saada vahingonkorvauksia kärsimästään puhtaasta varallisuusvahingosta, jolloin oikeusvarmuus kärsii. Useimmiten oikeuskäytännössä on katsottu hyvän tavan vastaisuuden muodostavan erittäin painavat syyt vahingon korvaamiselle, mutta tästä ratkaisulinjasta on poikkeuksia. Tutkielmassa tarkastellaan sitä, onko ajatus puhtaiden varallisuusvahinkojen rajoitetusta korvattavuudesta vanhentunut ottaen huomioon yritysten muuttuneen toimintaympäristön ja varallisuusarvojen merkityksen kasvamisen. Kysymyksen tarkastelu jakautuu kahteen osaan: Ensinnäkin tutkimuksessa selvitetään puhtaiden varallisuusvahinkojen rajoitetun korvaamisen syitä ja käydään keskustelua niiden soveltumisesta yritysten muuttuneeseen toimintaympäristöön. Toiseksi tarkastellaan sellaisia yrityksille ongelmallisia puhtaiden varallisuusvahinkojen aiheutumistilanteita, jotka eivät ole erityislainsäädännön suojan piirissä, ja sitä miten suojan tarve on saattanut kasvaa varallisuusarvojen muutoksen ja teknologian kehittymisen myötä. Median aiheuttamat puhtaat varallisuusvahingot ovat tulleet yhä merkityksellisemmiksi varallisuusarvojen dematerialisoitumisen myötä. Internet mahdollistaa julkaistun viestin leviämisen laajalle joukolle lyhyessä ajassa hyvin helposti, joka saattaa johtaa vahinkojen kertaantumiseen. Tiedonvälitys on myös kaupallistunut entisestään ja tiedon tuottaminen on nykyään hyvin nopeaa, ja se saattaa johtaa virheellisen tiedon julkaisemiseen. Median kohdalla on kuitenkin otettava huomioon sananvapauden vahva asema, arvosteluvapauden laajuus sekä median vallankäytön valvonnan rooli yhteiskunnassa. Toisaalta elinkeinonharjoittajan omaisuuden suoja toimii tilanteissa vastaperiaatteena, jota ei voida sivuuttaa harkittaessa vahingonkorvausvelvollisuutta yksittäistapauksissa. SopMenL on luonteeltaan erityislaki. Yleensä puhtaiden varallisuusvahinkojen korvaamisen kannalta relevantit erityislait sisältävät oman korvaussäännöksensä puhtaiden varallisuusvahinkojen korvaamisesta. SopMenL ei tällaista säännöstä kuitenkaan sisällä, vaikka siinä sääntelyn kohteena onkin joukko sellaisia tilanteita, joissa tyypillisesti aiheutuu puhtaita varallisuusvahinkoja. Suojan taso on siis varsin heikko, sillä vahingonkorvausvelvollisuus tulee arvioitavaksi VahL 5:1 :n perusteella. SopMenL tilanteissa korvaamista hillitsevänä tekijänä on otettava huomioon kilpailuvapauden ja toimintavapauden periaatteet ja se, että kaupankäyntikysymyksissä on perinteisesti korostettu laajaa itsemääräämisoikeutta ja on pidetty olennaisena, että valtion puuttuminen olisi mahdollisimman pieni. Vahingonkorvausta koskevan sääntelyn jättämistä VahL:n varaan on myös perusteltu sillä, että elinkeinonharjoittajat voivat melko tehokkaasti suojautua loukkauksilta sopimuksin. Aina tämä ei kuitenkaan ole mahdollista. Esimerkiksi liikesalaisuuksien loukkaustilanteissa sekä jäljittelytilanteissa on usein kyse kilpailutilanteesta, jossa sopimuksin suojautuminen ei ole mahdollista. Puhtaiden varallisuusvahinkojen merkitys on kasvanut jatkuvasti ja niiden korvaussääntelyn uudistamistarpeeseen on myös Suomessa kiinnitetty huomiota. Aineettomien intressien suojaa olisi mahdollista parantaa usealla eri tavalla. Vuonna 2002 oikeusministeriö teetti selvityksen VahL 5:1 :n uudistamistarpeesta, mutta selvitys ei kuitenkaan johtanut lain uudistamiseen. Lainsäädäntöä voitaisiin kehittää esimerkiksi uudistamalla VahL 5:1 :n sääntelyä ja säätämällä SopMenL:n oma vahingonkorvaussäännöksensä.

This study deals with how ethnic minorities and immigrants are portrayed in the Finnish print media. The study also asks how media users of various ethnocultural backgrounds make sense of these mediated stories. A more general objective is to elucidate negotiations of belonging and positioning practices in an increasingly complex society. The empirical part of the study is based on content analysis and qualitative close reading of 1,782 articles in five newspapers (Hufvudstadsbladet, Vasabladet, Helsingin Sanomat, Iltalehti and Ilta-Sanomat) during various research periods between 1999 and 2007. Four case studies on print media content are followed up by a focus group study involving 33 newspaper readers of Bosnian, Somalian, Russian, and 'native' Finnish backgrounds. The study draws from different academic and intellectual traditions; mainly media and communication studies, sociology and social psychology. The main theoretical framework employed is positioning theory, as developed by Rom Harré and others. Building on this perspective, situational self-positioning, positioning by others, and media positioning are seen as central practices in the negotiation of belonging. In support of contemporary developments in social sciences, some of these negotiations are seen as occurring in a network type of communicative space. In this space, the media form one of the most powerful institutions in constructing, distributing and legitimising values and ideas of who belongs to 'us', and who does not. The notion of positioning always involves an exclusionary potential. This thesis joins scholars who assert that in order to understand inclusionary and exclusionary mechanisms, the theoretical starting point must be a recognition of a decent and non-humiliating society. When key insights are distilled from the five empirical cases and related to the main theories, one of the major arguments put forward is that the media were first and foremost concerned with a minority actor's rightful or unlawful belonging to the Finnish welfare system. However, in some cases persistent stereotypes concerning some immigrant groups' motivation to work, pay taxes and therefore contribute are so strong that a general idea of individualism is forgotten in favour of racialised and stagnated views. Discussants of immigrant background also claim that the positions provided for minority actors in the media are not easy to identify with; categories are too narrow, journalists are biased, the reporting is simplifying and carries labelling potential. Hence, although the will for the communicative space to be more diverse and inclusive exists — and has also in many cases been articulated in charters, acts and codes — the positioning of ethnic minorities and immigrants differs significantly from the ideal.
