Outlines the factors which the court needs to consider when deciding whether to grant an application for the sale of a property where the owner becomes bankrupt. Considers the different priorities to be given to the claims of trustees in bankruptcy and to secure lenders, with reference to the Trusts of Land and Appointment of Trustees Act 1996 ss.14 and 15, the Insolvency Act 1986 s.355A, and the exceptional circumstances in which claims will not be granted. Surrogacy has produced some positive outcomes creating an opportunity for otherwise childless couples to live their dream of parenthood. However it has also been problematic, particularly where the surrogate mother fails to relinquish a child born as a result of the surrogacy arrangement. This article examines whether a surrogate mother, who is genetically related to the child she delivers, is less likely to relinquish the child than one who has no genetic ties. An examination of empirical evidence provides support for this argument. Legislation and case law in three jurisdictions, Australia, the United States and the United Kingdom, is examined to determine which, if any, of these jurisdictions take into account the existence, or otherwise, of a genetic link between the surrogate mother and the child she bears. The article concludes that surrogacy legislation should, subject to exceptional circumstances, encourage surrogacy arrangements where the child and the surrogate are not genetically related.

Lack of water can be the least of a farmer’s worries in times of drought. Predatory banks can be just as deadly to a farmer’s livelihood. Former Queensland farmer and grazier Lynton Freeman has become increasingly anxious about the financial tightrope being walked by Australian farmers as the record floods of 2011 have given way in only three years to savage drought. He fears for hundreds of family farmers at risk — not from lack of water, but from lack of knowledge in how to manage their businesses through the drought and keep their heads above the financial water that will threaten many before this drought breaks.

From bark bread to pizza - Food and exceptional circumstances: reactions of Finnish society to crises of food supply This study on the food supply under exceptional circumstances lies within the nutritional, historical and social sciences. The perspective and questions come under nutrition science, but are part of social decision-making. The study focuses on the first and second world wars as well as on contemporary society at the beginning of the 21st century. The main purpose of this study is to explore how Finnish society has responded to crises and what measures it has taken to sustain institutional food services and the food supply of households. The particular study interests include the school catering and food services in hospitals during the world wars. The situation in households is reflected in the counseling work carried out by state-run or civic organisations. Interest also focuses on the action of the scientific community. The decisions made in Finland are projected onto the solutions developed in some other European countries. The study is based primarily on the archive documents and annual reports prepared by food and health care authorities. Major source materials include scientific and professional publications. The evaluation of the situation in contemporary Finnish society is based on corresponding emergency plans and guidelines. The written material is supplemented by discussions with experts. Food rationing during the WWI and WWII differed in extent, details and unity. The food intake of some population groups was occasionally inadequate both in quantity, quality and safety. The counseling of the public focused on promoting self-sufficiency, improving cooking skills and widening food habits. One of the most vulnerable groups in regard to nutrition was long-term patients in institutions. As for future development, the world wars were never-theless important periods for public food services and counseling practices. WWII was also an important period for product development in the food industry. Significant work on food substitutes was carried out by Professor Carl Tigerstedt during WWI. The research of Professors A. I. Virtanen and Paavo Simola during WWII focused on vitamins. Crises threatening societies now differ from those faced a hundred years ago. Finland is bet-ter prepared, but in many ways more vulnerable to and dependent on other actors. Food rationing is a severe means of handling the scarcity of food, which is why contemporary society relies primarily on preparedness planning. Civic organisations played a key role during the world wars, and establishing an emergency food supply remains on their agenda. Although the objective of protecting the population remains the same for nutrition, food production, and food consumption, threat scenarios and the knowledge and skill levels of citizens are constantly changing. Continuous monitoring and evaluation is therefore needed.

Cuida-se de dissertação elaborada com o escopo de precisar os fundamentos e os critérios para a responsabilização civil do terceiro cúmplice nas lesões ao crédito alheio. O amplo desenvolvimento das relações obrigacionais no comércio jurídico exigiu do jurista o reconhecimento de situações nas quais o inadimplemento fosse ocasionado por uma conduta proveniente de um terceiro estranho à relação obrigacional. A imperiosa infiltração dos princípios constitucionais nas situações jurídicas subjetivas e a consagração normativa dos princípios da função social do contrato e da boa-fé objetiva contribuíram sobremaneira para uma revigorada análise acerca do momento patológico das obrigações, permitindo-se a admissão de atribuição de responsabilidade civil pela violação ao crédito perpetrada por um estranho alheio à relação contratual que deu origem ao referido crédito. A configuração da tutela externa do crédito perpassa pela necessidade de instituição de um dever de respeito ao crédito importo ao terceiro, cuja violação enseje sua responsabilização pelos danos ocasionados. O desiderato essencial do presente trabalho reside na identificação dos fundamentos capazes de subsidiar a existência de tal dever, bem como averiguar critérios seguros para a determinação das hipóteses nas quais se exija a observância de tal dever, cabendo ao ordenamento promover adequadamente os interesses do credor, que serão reputados merecedores de tutela em observância às circunstâncias e vicissitudes do caso concerto que apontarão para sua prevalência sobre os interesses do terceiro. Tratando-se de estudo sobre responsabilidade civil, obedece-se a um itinerário metodológico que pretende identificar os fundamentos do dever cuja violação possibilite a responsabilização do terceiro; analisar os pressupostos genéricos da responsabilidade civil em obediências às especificidades que a hipótese de tutela externa do crédito acarreta, bem como examinar critérios alusivos às circunstâncias excepcionais que regem a matéria; e revelar as consequências e os efeitos que a extensão subjetiva do dever reparatório decorrente do inadimplemento poderá repercutir na relação obrigacional.

Examines the Court of Appeal ruling in Midill (97PL) Ltd v Park Lane Estates Ltd on whether the court should exercise its discretion to return a deposit paid under a contract for the sale of a property where, despite the claimant having defaulted on its purchase, the owner obtained a higher price than would have been paid by the claimant when it subsequently sold the property to a third party. Considers the need for special or exceptional circumstances to be present to override the rule that deposits were to be forfeited upon the purchaser's default.

The pursuit of hard-core cartel activity represents the core aspect of modern antitrust. Since the late 1990s, increased recognition of dangers posed by cartelization has led European competition regulators to initiate organizational changes and to modernize procedures and practice to combat cartels. However, has policy toward hard-core cartels softened in a harsher economic environment from late 2008? This article provides a comparative examination of the approach towards cartels by the European Commission and, at the national level, by the German Bundeskartellamt. It argues that, on current evidence, any doubts about how far the heightened anti-cartel drive could be sustained in the economic downturn post 2008 should be put aside. While some adjustments to fines have been made to take into account inability to pay in exceptional circumstances, no special provisions have been introduced to allow crisis cartels and it appears that the legislation continues to be interpreted strictly by the competition authorities as before.

La recrudescence des conflits internes dans le contexte post-guerre froide a permis de propulser à l’avant-plan la préoccupation pour les individus. Alors que la paix et la sécurité internationales ont historiquement constitué les piliers du système institutionnel international, une porte s’ouvrait pour rendre effectif un régime de protection des droits de l’homme par-delà les frontières. Pour les humanistes, l’intervention humanitaire représentait un mal nécessaire pour pallier aux souffrances humaines souvent causées par des divergences ethniques et religieuses. Pourtant, cette pratique est encore souvent perçue comme une forme de néo-colonialisme et entre en contradiction avec les plus hautes normes régissant les relations internationales, soit les principes de souveraineté des États et de non-intervention. La problématique du présent mémoire s’inscrit précisément dans cette polémique entre la préséance des droits de l’État et la prédilection pour les droits humains universels, deux fins antinomiques que la Commission internationales pour l’intervention et la souveraineté des États (CIISE) a tenté de concilier en élaborant son concept de responsabilité de protéger. Notre mémoire s’inscrit dans le champ de la science politique en études internationales mais s’articule surtout autour des notions et enjeux propres à la philosophie politique, plus précisément à l’éthique des relations internationales. Le travail se veut une réflexion critique et théorique des conclusions du rapport La responsabilité de protéger, particulièrement en ce qui concerne le critère de la juste cause et, dans une moindre mesure, celui d’autorité appropriée. Notre lecture des conditions de la CIISE à la justification morale du déclenchement d’une intervention humanitaire – critères issues de la doctrine de la guerre juste relativement au jus ad bellum – révèle une position mitoyenne entre une conception progressiste cosmopolitique et une vision conservatrice d’un ordre international composé d’États souverains. D’une part, la commission se dissocie du droit international en faisant valoir un devoir éthique d’outrepasser les frontières dans le but de mettre un terme aux violations massives des droits de l’homme et, d’autre part, elle craint les ingérences à outrance, comme en font foi l’établissement d’un seuil de la juste cause relativement élevé et la désignation d’une autorité multilatérale à titre de légitimateur de l’intervention. Ce travail dialectique vise premièrement à présenter et situer les recommandations de la CIISE dans la tradition de la guerre juste. Ensuite, il s’agit de relever les prémisses philosophiques tacites dans le rapport de la CIISE qui sous-tendent le choix de préserver une règle de non-intervention ferme de laquelle la dérogation n’est exigée qu’en des circonstances exceptionnelles. Nous identifions trois arguments allant en ce sens : la reconnaissance du relativisme moral et culturel; la nécessité de respecter l’autonomie et l’indépendance des communautés politiques en raison d’une conception communautarienne de la légitimité de l’État, des réquisits de la tolérance et des avantages d’une responsabilité assignée; enfin, l’appréhension d’un bouleversement de l’ordre international sur la base de postulats du réalisme classique. Pour finir, nous nuançons chacune de ces thèses en souscrivant à un mode de raisonnement cosmopolitique et conséquentialiste. Notre adhésion au discours individualiste normatif nous amène à inclure dans la juste cause de la CIISE les violations systématiques des droits individuels fondamentaux et à cautionner l’intervention conduite par une coalition ou un État individuel, pourvu qu’elle produise les effets bénéfiques désirés en termes humanitaires.

Dans Suresh c. Canada (Ministre de la Citoyenneté et de l'Immigration) (2002), la Cour suprême du Canada en vient à la conclusion que les principes de justice fondamentale prévus à l'm1icle 7 de la Charte canadienne des droits et libertés autorisent, dans des circonstances exceptionnelles, l'expulsion d'une personne vers la torture. La Cour nous indique que l'identification des principes de justice fondamentale doit se fonder sur une démarche contextuelle et sur un consensus dans la société canadienne. Le fondement factuel dans le raisonnement de la Cour est pourtant inexistant. Elle ne traite ni du contexte en matière d'immigration, ni du contexte en matière de sécurité nationale entourant cette décision. La Cour prescrit un haut degré de retenue pour le contrôle judiciaire de la décision du Ministre de la Citoyenneté et de l'Immigration d'expulser une personne vers la torture. Cette retenue explique en partie le traitement déficient des faits. La Cour conclut qu'il y aurait un consensus dans la société canadienne sur le principe de justice fondamentale qui autorise l'expulsion d'une personne vers la torture sans fournir la preuve de ce fait social. L'absence de traitement des faits et de la preuve affecte la légitimité – la force persuasive - de la décision de la Cour suprême dans Suresh.

The strengthening of the European Union’s fiscal rules with the approval of the so-called ‘six-pack’, and the parallel worsening of economic conditions in Europe, re-opened the debate about the relationship between fiscal discipline and growth. Influential voices have argued against the EU’s perceived obsession with fiscal discipline, which risks being self-defeating in bad times. However, EU fiscal rules are not as rigid as commonly thought, but represent a sophisticated system of surveillance and ex-post control that provides sufficient room for manoeuvre under exceptional circumstances.

This paper demonstrates that recent influential contributions to monetary policy imply an emerging consensus whereby neither rigid rules nor complete discretion are found optimal. Instead, middle-ground monetary regimes based on rules (operative under 'normal' circumstances) to anchor inflation expectations over the long run, but designed with enough flexibility to mitigate the short-run effect of shocks (with communicated discretion in 'exceptional' circumstances temporarily overriding these rules), are gaining support in theoretical models and policy formulation and implementation. The opposition of 'rules versus discretion' has, thus, reappeared as the synthesis of 'rules cum discretion', in essence as inflation-forecast targeting. But such synthesis is not without major theoretical problems, as we argue in this contribution. Furthermore, the very recent real-world events have made it obvious that the inflation targeting strategy of monetary policy, which rests upon the new consensus paradigm in modern macroeconomics is at best a 'fair weather' model. In the turbulent economic climate of highly unstable inflation, deep financial crisis and world-wide, abrupt economic slowdown nowadays this approach needs serious rethinking to say the least, if not abandoning it altogether

Purpose: Increasing costs of health care, fuelled by demand for high quality, cost-effective healthcare has drove hospitals to streamline their patient care delivery systems. One such systematic approach is the adaptation of Clinical Pathways (CP) as a tool to increase the quality of healthcare delivery. However, most organizations still rely on are paper-based pathway guidelines or specifications, which have limitations in process management and as a result can influence patient safety outcomes. In this paper, we present a method for generating clinical pathways based on organizational semiotics by capturing knowledge from syntactic, semantic and pragmatic to social level. Design/methodology/approach: The proposed modeling approach to generation of CPs adopts organizational semiotics and enables the generation of semantically rich representation of CP knowledge. Semantic Analysis Method (SAM) is applied to explicitly represent the semantics of the concepts, their relationships and patterns of behavior in terms of an ontology chart. Norm Analysis Method (NAM) is adopted to identify and formally specify patterns of behavior and rules that govern the actions identified on the ontology chart. Information collected during semantic and norm analysis is integrated to guide the generation of CPs using best practice represented in BPMN thus enabling the automation of CP. Findings: This research confirms the necessity of taking into consideration social aspects in designing information systems and automating CP. The complexity of healthcare processes can be best tackled by analyzing stakeholders, which we treat as social agents, their goals and patterns of action within the agent network. Originality/value: The current modeling methods describe CPs from a structural aspect comprising activities, properties and interrelationships. However, these methods lack a mechanism to describe possible patterns of human behavior and the conditions under which the behavior will occur. To overcome this weakness, a semiotic approach to generation of clinical pathway is introduced. The CP generated from SAM together with norms will enrich the knowledge representation of the domain through ontology modeling, which allows the recognition of human responsibilities and obligations and more importantly, the ultimate power of decision making in exceptional circumstances.
