Les agents des services correctionnels sont appelés à travailler et à intervenir quotidiennement auprès des individus incarcérés et se trouvent au cœur du fonctionnement des établissements de détention provinciaux du Québec. Leurs pratiques disciplinaires envers les individus incarcérés étaient auparavant considérées comme arbitraires et prenaient place dans un milieu défini comme autonome, autosuffisant, fermé sur l’extérieur et ne nécessitant pas le support de la société (Goffman, 1961). Les dernières décennies ont apporté de nombreux changements, tels la reconnaissance des droits des individus incarcérés, l’ouverture du milieu carcéral sur la société ou encore la normalisation des conditions de détention. A ceux-ci se sont ajoutés la Loi sur le système correctionnel du Québec et son Règlement d’application qui vient régir le processus disciplinaire. L’objet de cette recherche vise la compréhension des pratiques des agents correctionnels en matière de poursuites disciplinaires suite à ces changements. Cette étude vise également à comprendre les éléments venant influencer la décision, par un agent correctionnel, de dresser un rapport disciplinaire. Nos résultats se divisent en deux volets. Le premier suggère que le droit disciplinaire est une question d’équilibre carcéral. Les agents correctionnels, ayant la mission de maintenir la sécurité et l’ordre au sein du milieu carcéral, prennent également part à la mission de réinsertion sociale des individus incarcérés. Les agents doivent moduler leurs pratiques disciplinaires selon des éléments administratifs et institutionnels, tout en entretenant une relation avec les individus incarcérés basée sur la négociation et le marchandage. Le deuxième suggère que le droit disciplinaire est une question de pouvoir. En effet, malgré l’encadrement des établissements carcéraux par des textes légaux, les agents correctionnels détiennent un pouvoir discrétionnaire reconnu et accepté dans l’application de la discipline.

La période de prospérité immobilière qu’a vécue le Québec a attiré de nombreuses personnes vers la pratique du courtage immobilier. Certains ont malheureusement choisi d’exercer cette « profession » pour les mauvaises raisons et sans se soucier des règles et valeurs régissant l’industrie du courtage immobilier au Québec, dont la protection est confiée à l’Organisme d’autoréglementation du courtage immobilier du Québec (ci-après : « Organisme » ou « OACIQ ». Ainsi, à l’ère où la question des conflits d’intérêts, et plus particulièrement ceux existants chez nos élus, envahie littéralement les médias, il nous a semblé pertinent d’étudier le concept de conflit d’intérêts à travers la Loi sur le courtage immobilier en vue de faire un constat sur l’état du droit. Dans la première partie de notre exposé, nous traiterons des fondements et origines de l’expression « conflit d’intérêts » ainsi que son évolution à travers le temps, jusqu’à présent. Cette première partie, également consacrée au lexique, nous permettra de comprendre l’étymologie des termes « conflit », « intérêt » et de l’expression « conflit d’intérêts ». Finalement, nous analyserons certaines lois et décisions traitant du sujet. Dans la seconde partie de notre mémoire, nous nous pencherons sur la place occupée par le conflit d’intérêts dans la Loi sur le courtage immobilier. L’historique des diverses versions de cette Loi, l’évolution des dispositions ainsi que les décisions du Comité de discipline de l’OACIQ concernant le conflit d’intérêts y seront étudiés. Nous conclurons ce mémoire par une synthèse de nos recherches et en proposant des modifications législatives à la Loi sur le courtage immobilier.

La falta disciplinaria será aquella conducta típica, antijurídica y culpable, pues eso se desprende de los principios rectores del derecho disciplinario, los cuales tienen una consagración normativa en el ordenamiento jurídico colombiano, más específicamente en la Ley 734 de 2002, actual Código Disciplinario Único. La Ilicitud Sustancial es el elemento que delimita la antijuridicidad de la responsabilidad disciplinaria, y se debe decir que el alcance de dicho concepto no ha sido definido de manera precisa por parte de la ley, ni de manera unánime por parte de la doctrina, ni muchos menos por parte de la jurisprudencia. Luego de exponer las reflexiones hechas respecto al alcance de la ilicitud sustancial, se argumentará el por qué se debe entender el alcance de ese concepto bajo la siguiente hipótesis: La ilicitud sustancial debe entenderse en términos de antijuridicidad material, lo cual apunta a que la falta, además de ser típica y culpable, debe vulnerar realmente la Función Pública como bien jurídico a proteger por el Derecho Disciplinario, o ponerla en peligro manifiesto, pues ese tipo de derecho sancionador debe ser estrictamente limitado, ya que sus consecuencias son muy gravosas para los derechos de la personas destinatarias de la Ley Disciplinaria.

This paper will describe a research project that examines the implications of multidisciplinary student cohorts on teaching and learning within undergraduate and postgraduate units in higher education. Whist students generally specialise in one discipline, it is also common that, at some point during their degree, they will choose to undertake subjects that are outside their specialist area. Students may choose a multidisciplinary learning experience either out of interest or because the subject is seen as complementary to their core discipline. When the lens of identity is applied to the multi-disciplinary cohorts in undergraduate and postgraduate units, it assists in identifying learning needs. The nature of disciplinarity, and the impact it has on students’ academic identity, presents challenges to both students and teachers when they engage in teaching and learning, impacting on curriculum design, assessment practices and teaching delivery strategies (Winberg, 2008). This project aims to identify the barriers that exist to effective teaching and learning in units that have multidisciplinary student cohorts. It will identify the particular needs of students in multidisciplinary student cohorts and determine a teaching and learning model that meets the needs of such cohorts. A just system of discipline within an organisation requires four characteristics: a clear set of offences, proportionate punishments clearly linked to the offences, oversight and appeals from disciplinary decisions and independence from political masters. This paper examines Queensland public sector legislation and policy from 1863 to the present to demonstrate how well these four criteria are addressed. An analysis of the presence of these four characteristics in the Queensland context finds that the public sector legislation in Queensland is in breach of the guidelines that define a just and fair system in which disciplinary action is dispensed. We argue that creation of arbitrary powers to punish or dismiss staff is unjust if the legislation does not fully inform staff of what constitutes a breach of discipline, does not guarantee proportionate punishments to offences, and/or it allows the disciplinary process to be used as a tool to coerce staff to perform in a politicised or otherwise unethical manner. We conclude by making recommendations as to how this situation may be rectified.

Problem-solving courts appear to achieve outcomes that are not common in mainstream courts. There are increasing calls for the adoption of more therapeutic and problem-solving practices by mainstream judges in civil and criminal courts in a number of jurisdictions, most notably in the United States and Australia. Currently, a judge who sets out to exercise a significant therapeutic function is likely to be doing so in a specialist court or jurisdiction, outside the mainstream court system, and arguably, outside the adversarial paradigm itself. To some extent, this work is tolerated but marginalised. However, do therapeutic and problem-solving functions have the potential to help define, rather than simply complement, the role of judicial officers? The core question addressed in this thesis is whether the judicial role could evolve to be not just less adversarial, but fundamentally non-adversarial. In other words, could we see—or are we seeing—a juristic paradigm shift not just in the colloquial, casual sense of the word, but in the strong, worldview changing sense meant by Thomas Kuhn? This thesis examines the current relationship between adversarialism and therapeutic jurisprudence in the context of Kuhn’s conception of the transition from periods of ‘normal science’, through periods of anomaly and disciplinary crises to paradigm shifts. It considers whether therapeutic jurisprudence and adversarialism are incommensurable in the Kuhnian sense, and if so, what this means for the relationship between the two, and for the agenda to mainstream therapeutic jurisprudence. The thesis asserts that Kuhnian incommensurability is, in fact, a characteristic of the relationship between adversarialism and therapeutic jurisprudence, but that the possibility of a therapeutic paradigm shift in law can be reconciled with many adversarial and due process principles by relating this incommensurability to a broader disciplinary matrix.

This chapter considers the role of the law in communicating patient safety. Downie, Lahey, Ford, et al’s (2006) preventing, knowing and responding theoretical framework is adopted to classify the different elements of patient safety law. Rather than setting out all relevant patient safety laws in detail, this chapter highlights key legal strategies which are employed to: prevent the occurrence of patient safety incidents (preventing); support the discovery and open discussion of patient safety incidents when they do occur (knowing),; and guide responses after they occur (responding) (Downie, Lahey, Ford, et al 2006). The law is increasingly being invoked to facilitate open discussion of and communication surrounding patient safety. After highlighting some legal strategies used to communicate patient safety, two practice examples are presented. The practice examples highlight different aspects of patient safety law and are indicative of communication issues commonly faced in practice. The first practice example focuses on the role of the Ccoroner in communicating patient safety. This example highlights the investigative role of the law in relation to patient safety (knowing). It also showcases the preventing responding and preventing elements in respect of the significant number of communication errors that can occur in a multi-disciplinary, networked health system. The main focus of the second practice example is responding example illustrates how the law responds to health service providers’ and professionals’ miscommunication (and subsequent incidents) during treatment, however it also touches upon knowing and preventing.

The present study provides a usage-based account of how three grammatical structures, declarative content clauses, interrogative content clause and as-predicative constructions, are used in academic research articles. These structures may be used in both knowledge claims and citations, and they often express evaluative meanings. Using the methodology of quantitative corpus linguistics, I investigate how the culture of the academic discipline influences the way in which these constructions are used in research articles. The study compares the rates of occurrence of these grammatical structures and investigates their co-occurrence patterns in articles representing four different disciplines (medicine, physics, law, and literary criticism). The analysis is based on a purpose-built 2-million-word corpus, which has been part-of-speech tagged. The analysis demonstrates that the use of these grammatical structures varies between disciplines, and further shows that the differences observed in the corpus data are linked with differences in the nature of knowledge and the patterns of enquiry. The constructions in focus tend to be more frequently used in the soft disciplines, law and literary criticism, where their co-occurrence patterns are also more varied. This reflects both the greater variety of topics discussed in these disciplines, and the higher frequency of references to statements made by other researchers. Knowledge-building in the soft fields normally requires a careful contextualisation of the arguments, giving rise to statements reporting earlier research employing the constructions in focus. In contrast, knowledgebuilding in the hard fields is typically a cumulative process, based on agreed-upon methods of analysis. This characteristic is reflected in the structure and contents of research reports, which offer fewer opportunities for using these constructions.

Privacy has now become a major topic not only in law but in computing, psychology, economics and social studies, and the explosion in scholarship has made it difficult for the student to traverse the field and identify the significant issues across the many disciplines. This series brings together a collection of significant papers with a multi-disciplinary approach which enable the reader to navigate through the complexities of the issues and make sense of the prolific scholarship published in this field.

The three volumes in this series address different themes: an anthropological approach to what privacy means in a cultural context; the issue of state surveillance where the state must both protect the individual and protect others from that individual and also protect itself; and, finally, what privacy might mean in a world where government and commerce collect data incessantly. The regulation of privacy is continually being called for and these papers help enable understanding of the ethical rationales behind the choices made in the sphere of regulation of privacy.

The articles presented in each of these collections have been chosen for the quality of their scholarship and their utility to the researcher, and feature a variety of approaches. The articles which debate the technical context of privacy are accessible to those from the arts and humanities; overall, the breadth of approach taken in the choice of articles has created a series which is an invaluable and important resource for lecturers, researchers and student.
