Dans les crypto-monnaies telles Bitcoin, l’anonymité des utilisateurs peut être compromise de plusieurs façons. Dans ce mémoire, nous effectuons une revue de littérature et une classification des différents protocoles existants pour anonymiser les usagers et analysons leur efficacité. S’appuyant sur certains critères désirables dans de tels protocoles, nous proposons un modèle de mixeur synchrone décentralisé. Nous avons ciblé deux approches qui s’inscrivent dans ce modèle, le plan de transaction et le réseau de transactions, le second étant une contribution originale de ce mémoire. Nous expliquons son fonctionnement puis analysons son efficacité dans le contexte actuel d’utilisation de Bitcoin

A existência de instrumentos monetários paralelos àqueles “oficiais” não é um fenômeno recente: ao longo da história, diversas foram as formas e ocasiões em que circularam moedas paralelas. No entanto, nos últimos anos, esses instrumentos fundiram-se com a tecnologia, atingindo um alcance praticamente ilimitado, trazendo consequências que ainda não se sabe como estimar. Este trabalho tem por objetivo estudar um caso específico de moeda paralela de alta complexidade tecnológica, o Bitcoin, e descrever quais têm sido os posicionamentos adotados por uma série de jurisdições a esse respeito. Trata-se de uma aproximação mais palatável da linguagem da Tecnologia da Informação e da Economia aos operadores do Direito. O estudo estende-se na direção de propor uma reflexão acerca do significado de se reconhecer no Bitcoin uma moeda paralela – muito embora a discussão acerca de ser ou não moeda constituir apenas uma das discussões possíveis. Explora-se quais têm sido as opções de regulação adotadas pelos Estados que se vêem obrigados a assumir uma posição em relação às moedas virtuais, em geral, e ao Bitcoin, em particular. Percebe-se que a terminologia escolhida pelas jurisdições no tratamento do Bitcoin resulta na sua inclusão em diferentes categorias do Direito e, como consequência direta disso, as implicações jurídicas variam de acordo com a terminologia adotada. O principal tratamento dispensado ao Bitcoin é aquele via tributação, notando-se a preocupação de cada Estado em classificar juridicamente o Bitcoin de acordo com a regulação específica que se pretende invocar a incidência. De acordo com o levantamento realizado, 62 jurisdições já assumiram um posicionamento em relação ao Bitcoin. Com cada vez mais atenção dispensada por órgãos regulatórios internacionais – como é o caso do Banco Central Europeu e do Fundo Monetário Internacional – o Bitcoin reforça seu potencial e suas limitações, principalmente no tocante aos desafios enfrentados à uma regulação eficaz. A conclusão deste trabalho procura reforçar que o tratamento jurídico dispensado a fenômenos novos não é uniforme, e que, uma vez encarado pelo viés da teoria econômica que reconhece a existência das moedas paralelas, o Bitcoin pode ser mais facilmente apreendido em um aparato regulatório.

La expansión de las tecnologías de la información y las comunicaciones (TIC) ha traído muchas ventajas, pero también algunos peligros. Son frecuentes hoy en día las noticias sobre delitos relacionados con las TIC. Se usa a menudo el término cibercrimen y el de ciberterrorismo pero, ¿realmente son una amenaza para la sociedad?. Este trabajo realiza un análisis del cibercrimen y el ciberterrorismo. Para ello se hace un estudio en profundidad desde distintos puntos de vista. En primer lugar se analizan varios aspectos básicos de la materia: el contexto en el que se desarrollan estas actividades, el ciberespacio y sus características, las ventajas que tiene el cibercrimen respecto a la delincuencia tradicional, características y ejemplos de ciberterrorismo y la importancia de la protección de las infraestructuras críticas. Luego se realiza un estudio del mundo del cibercrimen, en el cual se muestran los distintos tipos de cibercriminales, los actos delictivos, herramientas y técnicas más habituales usadas por el cibercrimen, la web profunda y la criptomoneda; se indican asimismo varios de los grupos criminales más conocidos y algunas de sus acciones, y se realiza un estudio de las consecuencias económicas del cibercrimen. Finalmente se hace un repaso a los medios legales que distintos países y organizaciones han establecido para combatir estos hechos delictivos. Para ello se analizan estrategias de seguridad de distinto tipo aprobadas en multitud de países de todo el mundo y los grupos operativos de respuesta (tanto los de tipo policial como los CSIRT/CERT), además de la legislación publicada para poder perseguir el cibercrimen y el ciberterrorismo, con especial atención a la legislación española. De esta manera, tras la lectura de este Proyecto se puede tener una visión global completa del mundo de la ciberdelincuencia y el ciberterrorismo. ABSTRACT. The expansion of Information and Communications Technology (ITC) has brought many benefits, but also some dangers. It is very usual nowadays to see news about ITC-related crimes. Terms like cyber crime and cyber terrorism are usually used but, are they really a big threat for our society?. This work analyzes cyber crime and cyber terrorism. To achieve it, a deep research under different points of view is made. First, basic aspects of the topic are analyzed: the context where these activities are carried out, cyber space and its features, benefits for cyber criminals with respect to traditional crime, characteristics and relevant examples of cyber terrorism, and importance of critical infrastructures protection. Then, a study about the world of cyber crime is made, analyzing the typology of different kinds of cyber criminals, the most common criminal acts, tools and techniques used by cyber crime, and the deep web and cryptocurrency. Some of the most known criminal groups and their activities are also explored, and the economic consequences of cyber crime are assessed. Finally, there is a review of the legal means used by countries and organizations to fight against these unlawful acts; this includes the analysis of several types of security strategies approved by countries all around the world, operational response groups (including law enforcement and CSIRT/CERT) and legislation to fight cyber crime and cyber terrorism, with special emphasis on Spanish legal rules. This way, a global, complete view of the world around cyber crime and cyber terrorism can be obtained after reading this work.

Imagine being told that your wage was going to be cut in half. Well, that’s what’s soon going to happen to those who make money from Bitcoin mining, the process of earning the online currency Bitcoin. The current expected date for this change is 11 July 2016. Many see this as the day when Bitcoin prices will rocket and when Bitcoin owners could make a great deal of money. Others see it as the start of a Bitcoin crash. At present no one quite knows which way it will go. Bitcoin was created in 2009 by someone known as Satoshi Nakamoto, borrowing from a whole lot of research methods. It is a cryptocurrency, meaning it uses digital encryption techniques to create bitcoins and secure financial transactions. It doesn’t need a central government or organisation to regulate it, nor a broker to manage payments. Conventional currencies usually have a central bank that creates money and controls its supply. Bitcoin is instead created when individuals “mine” for it by using their computers to perform complex calculations through special software. The algorithm behind Bitcoin is designed to limit the number of bitcoins that can ever be created. All Bitcoin transactions are recorded on a public database known as a blockchain. Every time someone mines for Bitcoin, it is recorded with a new block that is transmitted to every Bitcoin app across the network, like a bank updating its online records.

The past several years have seen the surprising and rapid rise of Bitcoin and other “cryptocurrencies.” These are decentralized peer-to-peer networks that allow users to transmit money, tocompose financial instruments, and to enforce contracts between mutually distrusting peers, andthat show great promise as a foundation for financial infrastructure that is more robust, efficientand equitable than ours today. However, it is difficult to reason about the security of cryptocurrencies. Bitcoin is a complex system, comprising many intricate and subtly-interacting protocol layers. At each layer it features design innovations that (prior to our work) have not undergone any rigorous analysis. Compounding the challenge, Bitcoin is but one of hundreds of competing cryptocurrencies in an ecosystem that is constantly evolving. The goal of this thesis is to formally reason about the security of cryptocurrencies, reining in their complexity, and providing well-defined and justified statements of their guarantees. We provide a formal specification and construction for each layer of an abstract cryptocurrency protocol, and prove that our constructions satisfy their specifications. The contributions of this thesis are centered around two new abstractions: “scratch-off puzzles,” and the “blockchain functionality” model. Scratch-off puzzles are a generalization of the Bitcoin “mining” algorithm, its most iconic and novel design feature. We show how to provide secure upgrades to a cryptocurrency by instantiating the protocol with alternative puzzle schemes. We construct secure puzzles that address important and well-known challenges facing Bitcoin today, including wasted energy and dangerous coalitions. The blockchain functionality is a general-purpose model of a cryptocurrency rooted in the “Universal Composability” cryptography theory. We use this model to express a wide range of applications, including transparent “smart contracts” (like those featured in Bitcoin and Ethereum), and also privacy-preserving applications like sealed-bid auctions. We also construct a new protocol compiler, called Hawk, which translates user-provided specifications into privacy-preserving protocols based on zero-knowledge proofs.
