This volume contains a fair copy of minutes from Corporation meetings held from Sept. 17, 1750 through April 23, 1778. It begins with an alphabetical index and contains entries related to a wide range of topics, including the challenges of operating the Charlestown ferry (due to the river freezing, fear of smallpox, and other issues); increases in "pecuniary mulcts" (fines) for breaches of specific College laws; the establishment of the Dudleian lecture; the selection and financial support of missionaries to various Indian tribes; honorary degrees awarded to Benjamin Franklin and George Washington; gifts to the library as it was rebuilt in the wake of the fire of 1764 (many entries provide the title and author of books donated); the management of land and property belonging to Harvard; Treasurers' reports and other financial accounts; changes in the College laws; gifts to the College, ranging from two Egyptian mummies to a solar microscope; the construction of the First Parish Meeting House in Cambridge and the use of adjacent College property by parishoners; rules of endowed professorships; salaries and appointments; closures due to the threat of smallpox; rules governing Commons and the College Library; reports of various Visiting Committees; class schedules, according to subject; student disorders; the establishment of a designated museum space to display "Curiosities"; the effects of the Revolutionary War on Harvard, including repeated requests to the General Court after the war for compensation for damage to College buildings; the cost of various foods and changes in what was served at Commons; and the danger of the chapel's roof, built of too-heavy slate, falling in. Also of interest are minutes from a May 5, 1761 meeting, which note that the General Court voted to pay for Hollis Professor John Winthrop to travel to Newfoundland to observe the transit of Venus "over the Suns disc."

This study examines the quantification of compensation for non-pecuniary damage, awarded by means of judicial decisions based on equity, and seeks to verify whether such calculation safeguards legal certainty and predictability when applying the law, as well as whether it observes the principles of proportionality and equality. Firstly, the limits for discretionary judgment permitted to the judge were determined, by evaluating the criteria established under the law. Then, by examining the grounds of the judicial decisions in cases that had been selected beforehand, this study sought to detect operation modes in concrete considerations of equity used by judges. The examination of the grounds on which these judicial decisions are based permitted the comprehension of the calculation method used in each case and the observation that the criteria of compensatory nature, such as the extent of the damage and the respective consequences, assumed a primary role. Despite discrepancies in viewpoints with regard to certain issues of law, the jurisprudence examined reveals that great care is taken to consider the solutions reached in similar cases, in an attempt to ensure that the different criteria applied in the quantification of compensation are given uniform relevance. The comparison of decisions, reported to cases with similar legal contours, did not reveal relevant discrepancies in the calculation criteria used, nor are they disproportionate regarding the amount of compensation awarded, which means that resorting to equity, in determining the compensation to be awarded due to nonpecuniary damage, does not jeopardize legal certainty or predictability when applying the law, and observes the principle of proportionality, which is anchored in the constitutional principle of equality. The study performed, led to the conclusion that the grounds on which judicial decisions are based, by itemising the elements which are taken into account and the criteria adopted by the judge, allow these to be taken into consideration in similar cases, contributing towards uniform interpretation and application of the law, ensuring legal certainty and predictability when resorting to equity while quantifying compensation.

Existen conductas empresariales de muy diversa naturaleza que pueden dar lugar a la transgresión del derecho de huelga. En estos casos se hace necesario reparar los daños que tales conductas provocan, tanto en el plano individual (trabajador) como en el plano colectivo (sindicatos u órganos de representación unitaria), teniendo en cuenta que la indemnización que derive de ello debe cumplir una función ejemplarizante, además de la propiamente reparadora. En el presente estudio, siguiendo los criterios que han ido sentando nuestros Tribunales, se identifican distintas conductas empresariales susceptibles de conculcar el derecho de huelga, a la par que se analizan todas y cada una de las partidas que debieran estar presentes a la hora de calcular el monto indemnizatorio, así como los criterios de valoración a tener en cuenta en estos casos.

Cette recherche propose une analyse critique du droit applicable à deux dimensions de la gestion des risques : l’indemnisation des dommages au moyen de l’assurance et la prévention des risques au moyen du principe de précaution. Dans une perspective interdisciplinaire, l’interaction du droit avec les rationalités politique, économique, scientifique et sociale est soulignée par l’opposition de deux théories : la Société du risque d’Ulrich Beck et la Société assurantielle de François Ewald. L’argumentation révèle les différentes significations de la limite de l’assurance privée en droit et les discours dissonants quant aux stratégies juridiques utilisées face aux risques. Le mémoire fournit ainsi des balises essentielles à la réflexion juridique critique. L’originalité de l’angle d’analyse, qui tient compte de l’évolution du droit en lien avec la modification de la rationalité politique survenue au XIXe siècle avec l’industrialisation des sociétés occidentales, permet d’enrichir l’épistémologie juridique. Il en découle entre autres une réflexion au sujet de l’évolution des conceptions théoriques du droit et de son rôle social escompté.

Lesions to left frontal cortex in humans produce speech production impairments (nonfluent aphasia). These impairments vary from subject to subject and performance on certain speech production tasks can be relatively preserved in some patients. A possible explanation for preservation of function under these circumstances is that areas outside left prefrontal cortex are used to compensate for the injured brain area. We report here a direct demonstration of preserved language function in a stroke patient (LF1) apparently due to the activation of a compensatory brain pathway. We used functional brain imaging with positron emission tomography (PET) as a basis for this study.
