Desde la introducción del postulado de la “autonomía de la voluntad” en el Estatuto de Contratación Estatal, es posible afirmar que trajo consigo grandes cambios, los cuales se ven reflejados en varios escenarios de la contratación y que sin lugar a duda revelan suma importancia, pero cuando nos referimos a la tipología contractual, primer estadio al cual deben enfrentarse las partes al momento de contratar, este postulado toma real trascendencia al proporcionar libertad a los contratantes, tanto para la entidad como para el particular, de crear conforme a sus necesidades y a los fines estatales la forma contractual que más se ajuste, teniendo en cuenta las limitantes generales que el ordenamiento jurídico le impone. Este entorno ha sido la clave para que se llegue a hablar del contrato estatal atípico, tópico que ha generado discusiones entorno a su admisibilidad en el derecho público por no serle originalmente propio a este.

En la presente investigación se contrasta el Modelo Tradicional de Concesión con el Renovado Esquema de Asociación Público Privada propuesto por la Ley 1508 de 2011 y sus decretos reglamentarios, para establecer, a partir de puntos de contacto y fuga entre una y otra institución, que existe una verdadera transformación del paradigma; y que, este modelo mejorado de participación privada que cuenta con sus propios rasgos definitorios, se erige en principio, como una solución a las exigencias actuales de los proyectos viales de la Cuarta Generación de Concesiones en Colombia, pero a la vez da apertura al debate para la construcción académica del conocimiento, por su reciente implementación.

El trabajo de grado se estructuró en tres capítulos. El primero constituye un marco teórico sobre el cual se fundamentan los siguientes, pues se realiza un análisis de la cláusula penal en el derecho privado, incluidas las prácticas comerciales internacionales. El segundo capítulo aborda el tema de las multas en la contratación estatal, para lo cual se estudió la normatividad y jurisprudencia pertinente; en esa parte del escrito se incluyó el apartado correspondiente al derecho comparado. Finalmente, en el tercer capítulo, se formula una propuesta que permite hacer de esta medida coercitiva provisional una herramienta idónea para lograr el correcto y oportuno cumplimiento del contrato.

Two forms of the activated beta(1)-adrenoceptor exist, one that is stabilized by (-)-noradrenaline and is sensitive to blockade by (-)-propranolol and another which is stabilized by partial agonists such as (-)-pindolol and (-)-CGP 12177 but is relatively insensitive to (-)-propranolol. We investigated the effects of stimulation of the propranolol-resistant PI-adrenoceptor in the human heart. Myocardium from non-failing and failing human hearts were set up to contract at 1 Hz. In right atrium from non-ailing hearts in the presence of 200 nM (-)-propranolol, (-)-CGP 12177 caused concentration-dependent increases in contractile force (-logEC(50)[M] 7.3+/-0.1, E-max 23+/-1% relative to maximal (-)-isoprenaline stimulation of beta(1)- and beta(2)-adrenoceptors, n=86 patients), shortening of the time to reach peak force (-logEC(50)[M] 7.4+/-0.1, E-max 37+/-5%, n=61 patients) and shortening of the time to reach 50% relaxation (t(50%), -logEC(50)[M] 7.3+/-0.1, E-max 33+/-2%, n=61 patients). The potency and maxima of the positive inotropic effects were independent of Ser49Gly- and Gly389Arg-beta(1)-adrenoceptor polymorphisms but were potentiated by the phosphodiesterase inhibitor 3-isobutyl-1-methylxanthine (-logEC(50)[M] 7.7+/-0.1, E-max 68+/-6%, n=6 patients, P

Children occupy centre-stage in any new welfare equilibrium. Failure to support families may produce either of two undesirable scenarios. We shall see a society without children if motherhood remains incompatible with work. A new family policy needs to recognize that children are a collective asset and that the cost of having children is rising. The double challenge is to eliminate the constraints on having children in the first place, and to ensure that the children we have are ensured optimal opportunities. The simple reason why a new social contract is called for is that fertility and child quality combine both private utility and societal gains. And like no other epoch in the past, the societal gains are mounting all-the-while that families’ ability to produce these social gains is weakening.In the following 1 analyze the twin challenges of fertility and child development. I then examine which kind of policy mix will ensure both the socially desired level of fertility and investment in our children? The task is to identify a Paretian optimum that will maximize efficiency gains and social equity simultaneously.

This report pursuant to Department of Management procedures provides an overview of the State Public Defender’s fiscal year 2013 operations related to court-appointed counsel, claims processing, and other indigent defense matters. This information, in accordance with the Accountable Government Act, is meant to help improve decision making and increase accountability to stakeholders and the citizens of Iowa. Iowa’s indigent defense system remains strong. The more than 200 employees of the State Public Defender System have been efficiently providing high quality representation on more cases than ever before. In Fiscal Year 2013, public defender offices closed more than 91,000 cases, at an average cost per case of $282.02, and there was a final finding of ineffective assistance of counsel in less than .002% of these cases. Similarly, more than 1,000 contract attorneys continue to provide high quality representation throughout all 99 of Iowa’s counties. In Fiscal Year 2013, 60,929 claims were submitted to the indigent defense fund, at an average cost per claim of $507.86. This was an decrease of nearly 350 claims from Fiscal Year 2012, and the total amount spent from the indigent defense fund increased slightly.
