GATS and the Social Regulation of Services. IES WORKING PAPER 3/2010

Many service transactions are highly complex, and their quality is difficult to ascertain for consumers. In order to have properly functioning service markets, the services thus often require regulation. However, with the advent of the WTO, international trade in services has become increasingly rule-bound. GATS has considerable, intricate effects on social regulation due to the characteristics of services. The allocation of regulatory jurisdiction between home and host country, for example, is rendered difficult by the process-based nature of a lot of services. The WTO US – Gambling dispute settlement report is the first to address GATS disciplines on social regulation in a detailed manner. This working paper submits that the US - Gambling report has increased interference with domestic social regulation and created regulatory uncertainty for WTO members. However, it is also argued that the real impact of the GATS on social regulation can only be understood by looking beyond the text of the GATS. GATS disciplines may become amplified through their interaction with domestic and other international law. The GATS also contains some “political” counterbalancing mechanisms that allow members to renegotiate their commitments. It is argued that these political mechanisms strengthen subsidiarity in the GATS, and make WTO dispute settlement bodies accountable to WTO members.

Contribution to Load-Frequency Regulation of a Hydropower Plant with Long Tail-Race Tunnel

In this paper, a hydroelectric power plant with long tail-race tunnel has been modelled for assessing its contribution to secondary regulation reserve. Cavitation problems, caused by the discharge conduit length, are expected downstream the turbine where low pressure appears during regulation manoeuvres. Therefore, governor's gains should be selected taking into account these phenomena. On the other hand, regulation services bidden by the plant operator should fulfil TSO (Transmission System Operator) quality requirements. A methodology for tuning governor PI gains is proposed and applied to a Hydro power plant in pre-design phase in northwest area of Spain. The PI gains adjustment proposed provides a proper plant response, according to some established indexes, while avoiding cavitation phenomena.

Global regulation of the knowledge-based economy: The rise of standards in educational services

This article examines the extent and limits of non-state forms of authority in international relations. It analyses how the information and communication technology (ICT) infrastructure for the tradability of services in a global knowledge-based economy relies on informal regulatory practices for adjustment of ICT-related skills. Companies and associations provide training and certification programmes as part of a growing market for educational services setting their own standards. The existing literature on non-conventional forms of authority in the global political economy has emphasised that the consent of actors subject to informal rules and explicit or implicit state recognition remains crucial for the effectiveness of those new forms of power. However, analyses based on a limited sample of actors tend toward a narrow understanding of the issues and fail to fully explore the differentiated space in which non-state authority is emerging. This paper examines the form of authority underpinning the global knowledge-based economy within the broader perspective of the issues likely to be standardised by technical ICT specification, the wide range of actors involved, and the highly differentiated space where standards become authoritative. The empirical findings highlight the role of different private actors in establishing international educational norms in this field. They also pinpoint the limits of profit-oriented standard-settings, notably with regard to generic norms.

Simulating the impact of regulation changes on the market for prostitution services

The paper draws on recent research on the economics of prostitution focussing on the role of stigma in shaping the interaction between demand and supply and the resulting sub-markets in which this activity is typically organised. Here we extend the framework to consider the role of reputation and stigma in determining policy decisions regarding the regulation of prostitution and show how sub-optimal outcomes (from the point of view of the welfare of sex workers) may prevail.

Ecosystem services and urban vegetation coverage in Belém: the influence on noise pollution, air pollution and climate regulation

A ligação entre as zonas urbanas e as questões ambientais ficam mais próximas na medida em que cresce a conscientização global de conservar, melhorar e valorizar os serviços ambientais prestados pela natureza para a sustentabilidade da vida, dentro e fora da cidade. Cobertura vegetal (ou cobertura verde) está dentre as principais fontes de tais serviços. Uma vez que o processo de urbanização se mostra irreversível e os problemas ambientais urbanos se alastram em tamanho e extensão, a presença do verde está diretamente relacionada aos indicadores de qualidade de vida urbana. Como reflexo do processo de urbanização, a cidade de Belém perdeu uma grande porcentagem de seus ecossistemas naturais, de modo que este trabalho se concentrou em analisar alguns serviços ecossistêmicos—qualidade do ar, poluição do ar e regulação do clima - fornecidos pela qualidade e pela quantidade de cobertura vegetal local, considerando as alterações na distribuição espaço-temporal, em três distritos administrativos. Um marco teórico foi construído e analisado; a cobertura vegetal foi calculada, utilizando-se NDVI e Cobertura Vegetal Fracional em imagens do LANDSAT 5, ao longo de um período de 23 anos. A partir de uma proposta de escala mais detalhada de NDVI, análises quantitativas e qualitativas da cobertura verde evidenciaram perda significativa de cobertura muito densa, densa, moderada e aumento de áreas de pouca ou nenhuma vegetação. Ademais, lesão das áreas verdes sinalizou tendências de aumento da poluição do ar, da poluição sonora e da temperatura. A carência de dados relacionados ao meio ambiente não deixa dúvida sobre a urgência de investimento nos serviços ambientais provenientes da cobertura vegetal, para a sustentabilidade urbana em Belém, cujos cenários previstos são de drásticas perdas de área verde. Mais pesquisas e iniciativas de instituições públicas e privadas são necessárias para a contribuição aos serviços ambientais em Belém e, consequentemente, ao bem-estar público.

GATS and the Regulation of Trade in Services

This collection of essays takes stock of the key challenges that have arisen since the entry into force of the General Agreement on Trade in Services in the mid-1990s and situates them in the context of the WTO's Doha Development Agenda and the proliferation of preferential agreements addressing services today. The multidisciplinary approach provides an opportunity for many of the world's leading experts and a number of new analytical voices to exchange ideas on the future of services trade and regulation.
