Using figures derived from the UK Home Office, this paper analyses and reviews the impact and deployment of Part V of the Criminal Justice and Public Order Act 1994 since its enactment. This is done with special reference to its impact on citizenship and the regulation of ‘the environment’ and associated rural spaces. It is argued that, notwithstanding the actual use of the public order clauses in Part V of the Act, its underlying meanings are largely of a symbolic nature. Such symbolism is, however, a powerful indication of the defence of particularist constructions of rural space. It can also open out new conditions of possibility, providing a useful ‘oppressed’ status and media spectacle for a range of protesters and activists.

The establishment of an elite national Australian soccer league has been accompanied by an unprecedented growth in popularity for the world game in several Australian cities. Such growth presents numerous challenges for public order maintenance, particularly in light of the widespread concern over the relationship between soccer, disasters in major closed venues and violence. After outlining the emerging issues, and the extant Australian research into the phenomena of policing and sports crowd disorder, this study offers a knowledge based approach to foster informed, reflective and collaborative policing in elite and sub-elite soccer venues. Rather than advocating a fundamental shift in the current public order policing paradigm, we suggest drawing on elements of best practice that are currently adopted in other Australian sporting and public order settings and appropriate overseas experience to facilitate a better understanding of the dynamics of Australian soccer fandom. The result should be the promotion of safer yet exciting events at which interactive crowd management based on harm minimization principles are key features.

In recent years, Australian governments of various ideological persuasions at local, state and territory and federal levels have introduced a range of zonal governing techniques to manage the flow of people in urban spaces. Zonal governance involves the identification and formal declaration of a specific urban geographic region to enable police and security personnel to deploy special powers and allied forms of surveillance technologies as a supplement to their conventional public order maintenance functions.

Despite the impetus towards open flows or movement within sovereign territories or larger territorial groupings, such as the European Union, considerable governmental effort has been directed towards the use of new forms of criminal law to re-territorialize urban space through new administrative, property law and regulatory measures. These low-level spatial demarcations introduce various supplementary police powers and discretionary procedures that enhance surveillance within a declared area to increase the level of contemporary urban security. Of particular concern is the legal right to ban or exclude “undesirable” individuals and groups from entering or using certain designated urban zones, to prevent antisocial or violent behavior usually associated with alcohol consumption.

To date, most discussion of the impact of banning and related surveillance measures focuses on illegal migration through ports of entry into sovereign nations and the commensurate burdens this creates for both citizens and non-citizens to authenticate their movements at national geographic borders. This logic is permeating more localized forms of regulation adopted by Australian local and mid-tier state and territory governments to control the movement of people in and out of major event sites and in the urban night-time economy.

A survey of recent reforms in the state of Victoria reveals how this new logic of mass-surveillance aims to promote greater levels of urban security while reshaping the conventional order maintenance functions of both the public and private police. This chapter describes these procedures and their impact in sanctioning the efficient screening of people to promote order in specific zones within the contemporary Australian urban environment, at the expense of more progressive and inclusive crime prevention initiatives. We focus on two exemplars of the intensification of surveillance through zonal governance techniques: ‘major events’ and ‘designated alcohol zones’.

In 2011 the Chief Constable of the PSNI commissioned a review of public order policing in Northern Ireland, following closely behind a review of public order policing in Britain undertaken by Her Majesty’s Inspectorate of Constabulary (HMIC) (2011). As part of the review, the PSNI decided to adopt a ‘twin-track’ approach, with an internal review of organisational practice, experiences and roles/responsibilities; and an independent external review of community experiences of public order policing across the country. The external strand to the review was publically tendered during the first half of 2012 and was awarded to a joint bid by the University of Ulster and the Institute for Conflict Research. The overall aim of the research was to inform the PSNI’s review of public order policing in the widest possible sense so that community experiences and attitudes may be considered by the PSNI as part of decisions taken about future changes in police strategy and tactics on public order issues, with full cognisance of their community impact. In regard to the specific objectives, the research was tasked with the following:

• Provide qualitative information on community experiences and attitudes to public order policing;
• Identify critical issues, dilemmas and debates resulting from public order policing as delivered by the PSNI – both in terms of communities directly and indirectly affected;
• Highlight issues for the PSNI consideration in terms of carrying out its task of maintaining public order while upholding the human rights of all; and
• Explore the above issues in respect of both the PSNI’s style and tactics, along with community attitudes and approaches.

Pour les États récepteurs d’un message diffusé sur le Web, il est difficile d’y faire respecter leur propre ordre public interne. Pour y parvenir, il faudra un réel rapport de puissance ou de contrainte à l’encontre d’un contrevenant sur le Web. L’auteur nous illustre cette idée à travers deux affaires sensiblement identiques pour ce qu’il en est des faits, mais diamétralement opposées pour ce qu’il en est de leur conclusion. Dans l’une (Yahoo! Inc.), l’État français, confronté à plusieurs difficultés, ne réussit aucunement à faire respecter sa législation dans le monde virtuel de l’Internet. Dans l’autre (World Sports Exchange), l’État américain réussit aisément à condamner un homme qui violait sa législation à travers le Web et ce, même si le site Internet de cet homme n’était pas hébergé aux États-Unis. Constatant ces divergences, l’auteur se questionne alors quant à savoir s’il n’y existerait pas une définition commune d’un ordre public international face à Internet. Il souligne l’importance de trouver une réponse rapide à cette question et ce, dans le but d’échapper aux inégalités de fait entre les États et surtout à la prééminence de fait des États-Unis. D’ailleurs, à la lumière de l’analyse de l’Accord PNR (conclu entre l’Europe et les États-Unis), l’auteur nous démontre bien cette prééminence en matière de terrorisme. Il en vient alors à la conclusion que l’internationalisation du droit applicable dans le domaine du cyberespace semble être la seule solution possible pour en arriver à un respect de l’égalité des États dans ce domaine.

Rates of female delinquency, especially for violent crimes, are increasing in most common law countries. At the same time the growth in cyber-bullying, especially among girls, appears to be a related global phenomenon. While the gender gap in delinquency is narrowing in Australia, United States, Canada and the United Kingdom, boys continue to dominate the youth who commit crime and have a virtual monopoly over sexually violent crimes. Indigenous youth continue to be vastly over-represented in the juvenile justice system in every Australian jurisdiction. The Indigenisation of delinquency is a persistent problem in other countries such as Canada and New Zealand. Young people who gather in public places are susceptible to being perceived as somehow threatening or riotous, attracting more than their share of public order policing. Professional football has been marred by repeated scandals involving sexual assault, violence and drunkenness. Given the cultural significance of footballers as role models to thousands, if not millions, of young men around the world, it is vitally important to address this problem. Offending Youth explores these key contemporary patterns of delinquency, the response to these by the juvenile justice agencies and moreover what can be done to address these problems. The book also analyses the major policy and legislative changes from the nineteenth to twenty first centuries, chiefly the shift the penal welfarism to diversion and restorative justice. Using original cases studied by Carrington twenty years ago, Offending Youth illustrates how penal welfarism criminalised young people from socially marginal backgrounds, especially Aboriginal children, children from single parent families, family-less children, state wards and young people living in poverty or in housing commission estates. A number of inquiries in Australia and the United Kingdom have since established that children committed to these institutions, supposedly for their own good, experienced systemic physical, sexual and psychological abuse during their institutionalisation. The book is dedicated to the survivors of these institutions who only now are receiving official recognition of the injustices they suffered. The underlying philosophy of juvenile justice has fundamentally shifted away from penal welfarism to embrace positive policy responses to juvenile crime, such as youth conferencing, cautions, warnings, restorative justice, circle sentencing and diversion examined in the concluding chapter. This report examines publically-available research literature from North America, Australia and New Zealand on the effectiveness of measures that aim to reduce non-violent offending by Indigenous people. It identifies culturally safe and relevant principles for the design and implementation of measures that have been found to be promising in terms of reducing this category of offending. These principles are important for policy-makers and practitioners to understand, given that many Indigenous people come into contact with the criminal justice system in relation to non-violent offences such as public order and driving offences. The principles set out in the report include: incorporating Indigenous culture, family and community into treatment programs; combining Indigenous approaches with effective Western treatment models such as Cognitive Behavioural Therapy; and addressing the substance abuse, trauma, and historical and social context often associated with offending by Indigenous people. In addition to promoting these principles, the report provides an overview of Indigenous people’s contact with the criminal justice system in relation to non-violent crimes, as well as a discussion of specific programs that have been used with this group of offenders.

Resumen: La prisión preventiva es la medida cautelar más grave e intensa del proceso penal, en tanto importa la coactiva privación de la libertad personal del imputado. Se trata de un instituto problemático, que plantea un contrapunto particularmente dilemático con la presunción de inocencia. Posee un fundamento constitucional, directamente vinculado con la necesidad de asegurar, en la medida de lo posible, la realización del derecho penal material. Aunque la regla general es que durante el desarrollo del proceso penal el imputado debe permanecer en libertad, no puede negarse la existencia de ciertos supuestos legitimadores de la prisión preventiva. La realidad social y la necesidad de respuestas racionales a los fenómenos de la inseguridad y de la delincuencia violenta han revelado serias fisuras en el paradigma según el cual los únicos supuestos legitimadores son los llamados peligros procesales de fuga o entorpecimiento de la investigación. Surgen así como datos que deben ser también necesariamente tenidos en cuenta para la detención cautelar tanto la especial gravedad del delito cometido y su relación con la preservación del orden público, como la existencia de un peligro de reiteración delictiva constatable. Estos dos últimos presupuestos legitimadores de la prisión preventiva cobran independencia conceptual de los primeramente mencionados. Además, cuando la prisión preventiva se funda en la especial gravedad del delito o en el peligro de reiteración delictiva, se transforma, aunque sin mutar su esencia, en un instrumento más en las políticas de seguridad dirigidas a combatir el fenómeno de la delincuencia.
