Faced with the violence, criminality and insecurity now threatening peace and democratic governance in Central America, the region’s governments have decided to use the Armed Forces to carry out actions in response to criminal actions, looking to improve their performance. Although public demand for including the Armed Forces in these functions takes place within a legally legitimate framework, it is motivated by tangible circumstances such as increased levels of violence, delinquency and crime. Despite being coupled with the perception of institutional weakness within the security and judicial system (particularly police) and the recognition of prestige, efficiency, discipline and severity in fulfilling the Armed Forces’ missions, these arguments are insufficient to legitimize the use of the military as a police force. Within this context, this paper reflects on the implications or consequences of the use of the Armed Forces in duties traditionally assigned to the police in the Central American region with the goal of contributing to the debate on this topic taking place in the Americas. To achieve this end, first we will focus on understanding the actual context in which a decision is made to involve the Armed Forces in security duties in the region. Second, we will examine the effects and implications of this decision on the Armed Forces’ relations within their respective societies. Third and finally, considering this is already a reality in the region, this paper will provide recommendations. The main findings of this research, resulting from the application of an analyticaldescriptive and historically based study, are organized in three dimensions: the political dimension, by implication referring to the relationship between the ultimate political authority and the Armed Forces; the social dimension, by implication the opinion of citizens; and other implications not only affecting the structural and cultural organization of armies and police but also the complementary operational framework within a context of comprehensive response by the State. As a main conclusion, it poses there is an environment conducive to the use of the Armed Forces in citizen’s security, in view of the impact of threats provoked by criminal structures of a military nature currently operating in Central America. However, this participation creates an inevitable social and political impact if implemented in isolation or given a political leading role and/or operational autonomy. This participation poses risks to the institutions of the Armed Forces and the police as well. Finally, this paper identifies an urgent need for the Armed Forces’ role to be more clearly defined with regard to security matters, limiting it to threats that impact States’ governability and existence. Nonetheless, Central American States should seek a COMPREHENSIVE response to current crime and violence, using all necessary institutions to confront these challenges, but with defined roles and responsibilities for each and dynamic coordination to complement their actions.

Objectifs. L’objectif de ce mémoire est de parfaire nos connaissances quant à l’effet des actions policières sur les collisions routières au Québec. Ultimement, ce mémoire permettra d’identifier les conditions nécessaires pour que l’action policière influe sur les comportements des automobilistes. Pour se faire, deux études de cas sont employées. Dans un premier temps, nous évaluons l’effet d’un relâchement d’environ 60 % dans l’émission de constats d’infraction par les policiers de la ville de Québec sur les collisions avec blessures. Dans cet article, nous distinguons également les effets respectifs des constats d’infraction, des interceptions policières sans constat et des médias. Dans un second temps, nous évaluons l’impact d’une stratégie de sécurité routière mise en place conjointement par l’Association des directeurs de police du Québec (ADPQ) et la Société de l’assurance automobile du Québec (SAAQ). Dans les deux cas, un changement important est survenu dans l’émission de constats d’infraction émis en vertu du Code de la sécurité routière (CSR). Méthodologie. Afin d’évaluer l’effet de ces deux stratégies, nous avons agrégé les données sur les collisions et infractions au CSR sur une base mensuelle. Ces données proviennent principalement des rapports de collisions et des constats d’infraction remplis par les policiers et transmis à la SAAQ. Dans l’ensemble, nous avons utilisé un devis quasi-expérimental, soit celui des séries chronologiques interrompues. Résultats. Les résultats des deux articles démontrent que les policiers sont des acteurs clés en matière de sécurité routière. Les collisions avec blessures sont affectées par les fluctuations de leurs activités. La première série d’analyses établit qu’un relâchement d’environ 60 % dans le nombre de constats émis par les policiers se traduit par une hausse d’environ 10 % des collisions avec blessures, ce qui correspond à 15 collisions avec blessures supplémentaires par mois sur le territoire du Service de police de la ville de Québec. De plus, nos résultats montrent qu’une interception policière suivie d’un avertissement verbal n’est pas suffisante pour prévenir les collisions. De même, l’effet observé n’est pas attribuable aux médias. La deuxième série d’analyse montre que la stratégie conjointe de l’ADPQ et de la SAAQ, caractérisée par une hausse des constats émis et des campagnes médiatiques, fut suivie de baisses variant entre 14 et 36 % des collisions avec blessures graves. Interprétation. Les résultats démontrent que les actions policières ont une influence sur le bilan routier. Par contre, avant d’influer sur le comportement des automobilistes, certaines conditions doivent être respectées. Premièrement, l’intensité des contrôles policiers doit être suffisamment modifiée par rapport à son niveau initial. Deuxièmement, que ce soit une hausse ou une baisse, ce niveau doit être maintenu sur une période relativement longue (entre 12 et 24 mois environ) pour que les automobilistes soient exposés au message pénal et qu’ils considèrent ce changement dans le niveau de répression comme étant crédible. Troisièmement, l’émission de constats est un élément clé; la simple présence policière n’est pas suffisante pour prévenir les collisions. Enfin, les campagnes de sensibilisation semblent importantes, mais d’autres études sont nécessaires pour mieux apprécier leur rôle.

This paper proposes a model of natural-resource exploitation when private ownership requires costly enforcement activities. For a given wage rate, it is shown how enforcement costs can increase with labor's average productivity on a resource site. As a result, it is never optimal for the site owner to produce at the point where marginal productivity equals the wage rate. It may even be optimal to exploit at a point exhibiting negative marginal returns. An important parameter in the analysis is the prevailing wage rate. When wages are low, further decreases in the wage rates can reduce the returns from resource exploitation. At sufficiently low wages, positive returns can be rendered impossible to achieve and the site is abandoned to a free-access exploitation. The analysis provides some clues as to why property rights may be more difficult to delineate in less developed countries. It proposes a different framework from which to address normative issues such as the desirability of free trade with endogenous enforcement costs, the optimality of private decisions to enforce property rights, the effect of income distribution on property rights enforceability, etc.

In low-income countries, both nearby local villagers, “insiders”, and non-locals, “outsiders”, extract products from protected forests even though their actions are illegal. Forest managers typically combine enforcement and livelihood projects offered to nearby communities to reduce this illegal activity, but with limited budgets cannot deter all extraction. We develop a game theoretic model of a forest manager's decision interacting with the extraction decisions of insiders and outsiders. Our analysis suggests that, depending on the relative ecological damage caused by each group, budget-constrained forest managers may reduce total forest degradation by legalizing “insider” extraction in return for local villagers' involvement in enforcement activities against outsiders.

GPL enforcement is successful in Europe. In several court decisions and out of court settlements the license conditions of the GPL have been successfully enforced. In particular, embedded systems are the main focus of such compliance activities. The article describes the practice of enforcement activities and the legal prerequisites under the application of German law.

Using paired testing data from the 1989 and 2000 Housing Discrimination Studies (HDS) and data on fair housing enforcement activities during the 1990s in the corresponding metro areas, we investigate whether 1989-2000 changes in the metropolitan incidence of racial/ethnic discrimination correlate with fair housing enforcement activity during the 1990s. We found that higher amounts of state and local enforcement activity supported by HUD through its FHIP and FHAP programs (especially the amount of dollars awarded by the courts) were consistently associated with greater declines in discrimination against black apartment-seekers and home-seekers. The evidence does not support similar conclusions for housing market discrimination against Hispanics where the level of enforcement is much lower.
