The "Europeanization" of non-EU countries' laws is predominantly seen as an "export" of the EU acquis, especially in the case of so-called "quasi-member" states such as Switzerland. Based on an examination of the Swiss experience, this paper highlights the flaws of this conceptualization: the Europeanization of Swiss Law is a highly differentiated phenomenon, encompassing several forms of approximation to EU Law. All of these forms fall short of an "export" of norms, and result in the creation of something new: a "Europeanized law" that is similar to, but qualitatively different from, EU Law. Another drawback of the "export" metaphor is the emphasis it places on the isomorphism of positive legislation. Europeanization goes deeper than that. As shown in this paper, it is a process of transformation involving not only positive law, but also legal thinking. The Swiss case demonstrates how significant such deeper transformations can be: the Europeanization of positive law has induced an alteration of the traditional canon of legal interpretation. It also demonstrates how problematic such transformations can be: the above-mentioned alteration has not given rise to a new and universally accepted canon of interpretation. This reflects the tension between the need for clear "rules of reference" for EU legal materials - which are required in order to restore coherence and predictability to an extensively Europeanized legal system - and the reluctance to give a legal value to foreign legal materials - which is rooted in a traditional understanding of the concept of "law". Such tension, in turn, shows what deep and difficult transformations are required in order to establish a viable model of legal integration outside supranational structures.

This book advances a fresh philosophical account of the relationship between the legislature and courts, opposing the common conception of law, in which it is legislatures that primarily create the law, and courts that primarily apply it. This conception has eclectic affinities with legal positivism, and although it may have been a helpful intellectual tool in the past, it now increasingly generates more problems than it solves. For this reason, the author argues, legal philosophers are better off abandoning it. At the same time they are asked to dismantle the philosophical and doctrinal infrastructure that has been based on it and which has been hitherto largely unquestioned. In its place the book offers an alternative framework for understanding the role of courts and the legislature; a framework which is distinctly anti-positivist and which builds on Ronald Dworkin’s interpretive theory of law. But, contrary to Dworkin, it insists that legal duty is sensitive to the position one occupies in the project of governing; legal interpretation is not the solitary task of one super-judge, but a collaborative task structured by principles of institutional morality such as separation of powers which impose a moral duty on participants to respect each other's contributions. Moreover this collaborative task will often involve citizens taking an active role in their interaction with the law.

At all normative levels, family migration law can disproportionally and negatively affect immigrant women’s rights in this field, producing gendered effects. In some cases, such effects are related to the normative and judicial imposition of unviable family-related models (e.g., the ʻgood mother ̕ the one-breadwinner family, or a rigid distinction between productive and reproductive work). In other cases, they are due to family migration law’s overlooking of the specific needs and difficulties of immigrant women, within their families and in the broader context of their host countries’ social and normative framework.To effectively expose and correct this gender bias, in this article I propose an alternative view of immigrant women’s right to family life, as a cluster of rights and entitlements rather than as a mono-dimensional right. As a theoretical approach, this construction is better equipped to capture the complex experiences of immigrant women in the European legal space, and to shed light on the gendered effects generated not by individual norms but by the interaction of norms that are traditionally assigned to separated legal domains (e.g., immigration law and criminal law). As a judicial strategy, this understanding is capable of prompting a consideration by domestic and supranational courts of immigrant women not as isolated individuals, but as ‘individuals in context’. I shall define this type of approach as ‘contextual interpretation’, understood as the consideration of immigrant women in the broader contexts of their families, their host societies and the normative frameworks applicable to them. Performed in a gendersensitive manner, a contextual judicial interpretation has the potential to neutralize the gendered effects of certain family migration norms. To illustrate these points, I will discuss selected judicial examples offered by the European Court on Human Rights, as well as from domestic jurisdictions of countries with a particularly high incidence of immigrant women (Italy and Spain).

El sistema tributario es fundamental en el Estado social y democrático de Derecho, pues el ejercicio y efectivo disfrute de muchos derechos fundamentales depende del correcto funcionamiento de la actividad tributaria. Además de esto, la situación económica actual demanda una adecuada política en contra del fraude tributario, lo que necesariamente implica analizar si el modelo penal vigente es el más adecuado para enfrentar el fraude fiscal. Teniendo en cuenta que muchas de las características de la criminalidad tributaria no son exclusivas de un país, pues ésta trasciende habitualmente las fronteras de los países por medio del recurso a empresas multinacionales o la localización de empresas en “paraísos fiscales”, el análisis del fraude tributario no debe limitarse al examen jurídico del modelo legislativo español, debiendo trascender a un estudio de política criminal que vincula consideraciones criminológicas y jurídicas. En consecuencia, en esta investigación se propone un análisis que no se reduce a los debates exclusivamente jurídicos. Se busca, además, efectuar un examen que tenga por fundamento una perspectiva criminológica y de Law in action a fin de evaluar críticamente la respuesta a la criminalidad tributaria por parte del modelo de regulación penal vigente en España. Esta orientación permitirá una más amplia comprensión del fenómeno de la criminalidad tributaria, así como de las categorías jurídicas adecuadas político criminalmente para su prevención. Este estudio interdisciplinario nos conducirá, al final de la investigación, tanto a proponer la interpretación del modelo de legislación penal vigente, como una reforma al mismo que pretenda solucionar algunos de los problemas de prevención que a lo largo de la investigación se señalan.

Dentro del ordenamiento jurídico colombiano, gracias a nuestro legislador se ha presentado un arduo trabajo de parte de las altas cortes en el sentido de tener que ir más allá de la simple interpretación tal como la conocemos y entendemos, la hermenéutica jurídica aplicada debe observar cómo se legisla cada vez más en los despachos de los honorables magistrados; con la regulación de las diferentes conductas que se pueden enmarcar en los tipos penales, se inicia una carrera entre la realidad y el derecho, que como sabemos deben ir de la mano pero en algunas ocasiones esta máxima deja de tener aplicación y nos vemos de nuevo envueltos en un sistema de leyes muertas.

A debate occurred in 1958 at the Harvard Law Review has become a landmark for contemporary philosophy of law. Still under the philosophical and moral impact of the Second World War, Herbert L. A. Hart published his version of legal positivism whitin the article entitled Positivism and the Separation of Law and Moral. The answer came from Lon Fuller’s Positivism and Fidelity to Law – A Reply to Prof. Hart. Much of the debate took place over a seemingly prosaic exemple: a rule prohibiting vehicles from a park. With this exemple, Hart argued that rules have a core of clear aplications, but this core meaning would be sorrounded by a penumbra of uncertainty. Fuller uses a counter-exemple to instist that legal language, by itself, cannot determine a certain outcome: it is necessary to understand the purpose for wich the rule was suppose to serve. This paper analyses this controversy from its most important features: i) the connection between legal philosophy and philosophy of language; ii) the possibility of legal interpretation; iii) and the different possibles points of view for the analysis of law. This paper argues that the study of these features sheds light on the problems we encounter in contemporary philosophy of law, especialy with regard to theories of legal argumentation and its relation with legal langague and legal interpretation.

Este estudo objetiva averiguar a possibilidade de participação direta ou indireta de capital estrangeiro em operadoras de planos privados de assistência à saúde, no Brasil, que possuem rede própria. Utilizando técnicas interpretativas da hermenêutica jurídica, como o método histórico evolutivo, sistemático e teleológico, busca-se entender a inteligência exegética do artigo 199, §3o, da Constituição Federal. Considerando-se que este dispositivo constitucional vedou a participação direta ou indireta de capital estrangeiro na assistência à saúde, salvo nos casos previstos em lei, o estudo revela em que hipóteses a vedação foi excepcionada e se a exceção infraconstitucional abrange as operadoras de plano de saúde que possuem rede própria. Ademais, o estudo analisa o posicionamento da Agência Nacional de Saúde (ANS), na aquisição da Amil Participações S.A, pela operadora norte-americana United Health Group Incorporated. A análise desta operação se torna de muita relevância ao estudo, pois envolve a maior operadora de planos de saúde com rede própria do país, além de ter a presença da maior importância de capitais estrangeiros na assistência à saúde na história do Brasil.

A presente dissertação tem o objetivo de analisar alguns dos principais espaços territoriais especialmente protegidos existentes no Direito brasileiro, a partir da perspectiva socioambiental e eticamente comprometida com os povos da Amazônia, identificando seus limites e suas possibilidades na defesa contra os potenciais impactos produzidos pela introdução da soja transgênica na região. Para isso, analisa-se o processo de inserção histórica da Amazônia no sistema-mundo vigente, sob a forma de um desenvolvimento desigual e combinado, marcado por diversos conflitos, pela violência e pela grilagem de terras. Dentro desse contexto, buscou-se identificar as especificidades da forma como o agronegócio altamente capitalizado da soja se insere na região, a partir do conceito-chave da geopolítica, que, com a introdução da biotecnologia, produz o nascimento da biopolítica. A forma jurídica dos OGM é então analisada enquanto produto desta biopolítica, ensejando uma série de riscos socioambientais ainda não esclarecidos plenamente pela ciência, e que exigem, justamente por isso, a aplicação do princípio da precaução. Tal princípio, não obstante constituir-se como um dos pilares do Direito Ambiental brasileiro, foi inconstitucionalmente afastado do regime jurídico dos transgênicos, provocando polêmicas inclusive no que tange à possibilidade jurídica do cultivo de variedades GM nas proximidades de áreas protegidas. Analisando o atual processo de introdução e expansão da soja transgênica na Amazônia, região configurada por uma enorme sócio-biodiversidade e repleta de espaços territoriais especialmente protegidos, busca-se então conferir uma Interpretação jurídica de caráter socioambiental, portanto coerente com a Constituição Federal de 1988, no que tange ao regime jurídico vigente para o cultivo de transgênicos no entorno de unidades de conservação, terras indígenas e territórios quilombolas, selecionados em virtude do potencial protagonismo dos povos da Amazônia na ação de resistência e de insurgência contra o projeto da Totalidade dominadora, que, ao produzir suas vítimas, produz também a possibilidade histórica da organização destas vítimas e a mobilização política para a construção de um projeto político de libertação.
