Terrorist attacks by transnational armed groups cause on average 15,000 deaths every year worldwide, with the law enforcement agencies of some states facing many challenges in bringing those responsible to justice. Despite various attempts to codify the law on transnational terrorism since the 1930s, a crime of transnational terrorism under International Law remains contested, reflecting concerns regarding the relative importance of prosecuting members of transnational armed groups before the International Criminal Court. However, a study of the emerging jurisprudence of the International Criminal Court suggests that terrorist attacks cannot be classified as a war crime or a crime against humanity. Therefore, using organisational network theory, this thesis will probe the limits of international criminal law in bringing members of transnational armed groups to justice in the context of changing methods of warfare. Determining the organisational structure of transnational armed groups, provides a powerful analytical framework for examining the challenges in holding members of transnational armed groups accountable before the International Criminal Court, in the context of the relationship between the commanders and the subordinate members of the group.

Armed violence in Paraguay is not a recent phenomenon. During the second half of the XX Century, Paraguay saw the rise of a larger number of underground, revolutionary movements that sought the overthrow of the Alfredo Stroessner’s (1954-1989) government. From among those movements emerged the Partido Patria Libre (or, Free Fatherland, also known for its acronym PPL), made up of a two branches: one legal and the other one, operational. The latter was based on people’s power, as represented by “Ejército del Pueblo Paraguayo” (or, the Paraguayan People’s Army, with acronym EPP). After EPP broke with PPL in March 2008, this Marxist-oriented revolutionary project, which was apparently oriented to put an end to the social, political and economic inequalities in Paraguay, began to carry out markedly criminal activities, which included bank robberies, kidnappings, assassinations, terrorist attacks and armed confrontations. Its strategies and modus operandi utilized by the Armed Revolutionary Forces of Colombia (FARC). Paraguay features a farm sector in a state of crisis, in which cattle-ranchers, peasants and agro-exporting companies live in a constant strife. The Paraguayan Departments that are the most affected by this situation are Concepciόn, San Pedro, Canindeyú y Caazapá, which also suffer from a weak government presence. This deficiency has made these departments ripe for drug-trafficking activity by Brazilian groups such as Primer Comando Capital (i.e., First Capital command), also PCC and Comando Vermelho, (i.e., The Red Command). That is why many peasants, now recruited by EPP, have joined the drug-trafficking business and that, not only as marihuana growers but as “campanas” (i.e., early warning sentinels) for the organization. This helps shape their attitudes for their future involvement in all areas of drug-trafficking. Paraguayan society is the result of social inequity and inequality, such as those resulting from a lack of opportunity. Although Paraguay has successfully recovered from the last world economic crisis, economic growth, by itself, does not ensure an improvement in the quality of life. As long as such economic and social gaps persist and the government fails to enact the policies that would result in a more just society and toward EPP neutralization or containment, the latter is bound to grow stronger. In this context, the situation in Paraguay calls for more research into the EPP phenomenon. It would also seem necessary for Paraguay to promote an open national debate that includes all sectors of society in order to raise consciousness and to induce society to take actual steps to eliminate the EPP, as well as any other group that might arise in the immediate future. EPP has strong connections with the Frente Patriόtico Manuel Rodríguez in Chile and other armed groups and peasant movements in other countries of this region. Although most governments in the region are aware that the armed struggle is not a solution to current problems, it might be worth it to hold a regional debate about armed or insurgent groups in Latin American to seek common strategies and cooperation on dealing with them since the expansion of these armed groups is a problem for all.

La investigación analiza el comportamiento de la participación electoral (PE) y su relación con las dinámicas de violencia política en Norte de Santander durante 1997-2011, con el fin de demostrar que la región del Catatumbo ha tenido un comportamiento electoral diferente al resto del departamento dado que tiene una tendencia en porcentajes de participación bajos durante las elecciones locales que se dieron en 1997, 2000 y 2003, lo cual se debe a la presencia y disputa por el control territorial entre los Grupos Armados Ilegales (GAI). Contrario a lo anterior, en las elecciones de 2007 y 2011 se presenta una variación positiva al aumentar la PE en el departamento en general. This chapter explores the responsibility of armed non-state actors for reparations to victims. Traditionally international law has focused on the responsibility of the state, and more recently the responsibility of convicted individuals before the International Criminal Court, to provide reparations for international crimes. Yet despite the prevalence of internal armed conflict over the past few decades, there responsibility of armed groups for reparations has been neglected in international law. Although there is a tentative emerging basis for armed groups to provide reparations under international law, such developments have not yet crystallized into hard law. However, when considering the more substantive practice of states in Northern Ireland, Colombia and Uganda, a greater effort can be discerned in ensuring that such organizations are responsible for reparations. This paper finds that not only can armed non-state actors be held collectively responsible for reparations, but due to the growing number of internal armed conflict they can play an important role in ensuring the effectiveness of reparations in remedying victims’ harm. Yet, finding armed groups responsible for reparations is no panacea for accountability, due to the nature of armed conflicts, responsibility may not be distinct, but overlapping and joint, and such groups may face difficulties in meeting their obligations, thus requiring a holistic approach and subsidiary role for the state.

El desplazamiento forzado ha sido una situación que se ha venido evidenciado en la zona de La Macarena debido no solo al conflicto armado, sino a factores políticos y económicos, entendiéndose el primero como la falta de presencia estatal que ha conllevado a que grupos armados al margen de la ley se asienten en la zona y a su vez ha permitido que la económica ilegal cobre fuerza, esta última analizada en la investigación como un factor económico generador del desplazamiento. A raíz de esta situación en el año 2008 se implementa el Plan de Consolidación Integral de La Macarena (PCIM), con el fin de solventar los problemas de esta parte del país, sin embargo para esta monografía el factor político, el factor económico y la implementación del PCIM influyeron en el aumento del desplazamiento forzado en la Macarena-Meta. Periodo 2006-2010.

El presente trabajo tuvo como objetivo realizar una revisión de la literatura sobre la participación de niños y niñas en los grupos armados ilegales de Colombia en estudios nacionales, para analizar desde un enfoque psicosocial los procesos de reclutamiento/vinculación, permanencia y desmovilización. Se revisaron 26 investigaciones publicadas entre 2005 y 2015 de bases de datos especializadas y catálogos de universidades. Los resultados mostraron que la mayoría de los estudios realizados sobre participación de niños y niñas en los grupos armados se concentran en los procesos de vinculación y desvinculación. Puntualmente, los estudios desde el enfoque psicosocial encontrados hacen referencia a la comprensión del fenómeno desde el enfoque ecológico. En ello, abordan temas como la configuración de la identidad, las motivaciones, las interacciones con su entorno cercano y con las instituciones sociales y políticas.

Reparations have been often used victim-centred measures to redress both private harm and gross violations of human rights. However, with the increasing occurrence of internal armed conflict and political violence, identities of victims and perpetrators in protracted conflicts can become blurred for some individuals. In countries like Peru and Northern Ireland that have suffered protracted violence, victimhood has been contested around which individuals are seen as innocent and deserving to exclude any members of non-state armed groups from claiming reparations. This article explores the issue of a proposed bill on a pension for injured victims of the Troubles in Northern Ireland. It identifies that there is no consistent state practice or human rights jurisprudence in this area, but instead offers a more complex approach through four models that can grapple with the seeming diametrically opposed victimhood and responsibility, by including victimised-perpetrators in reparations programmes such as that proposed for a pension of seriously injured victims in Northern Ireland.

This article examines the challenges of investigating and prosecuting forced displacement in the Central African countries of Democratic Republic of Congo and Uganda, where higher loss of life was caused by forced displacement, than by any other. In the Democratic Republic of Congo, armed groups intentionally attacked civilian populations displacing them from their homes, to cut them off from food and medical supplies. In Northern Uganda, the government engaged in a forced displacement policy as part of its counter-insurgency against the Lord’s Resistance Army, driving the civilian population into “protected villages”, where at one point the weekly death toll was over 1,000 in these camps. This article critically evaluates how criminal responsibility can be established for forced displacement and alternative approaches to accountability through reparations.

Ce mémoire de maîtrise porte sur la survivance des femmes en contexte de violence organisée. Notre recherche s’appuie sur le témoignage de deux femmes rwandaises réfugiées au Canada dont le récit sera exploré afin de comprendre leurs points de vue sur trois dimensions de la survivance : la victimisation et la revictimisation qu’elles ont subi, les actes qu’elles ont pu poser pour survivre et le sens qu’elles ont donné aux situations vécues. D’abord, ces femmes rapportent qu’au-delà du génocide de 1994, elles ont vécu dans un climat d’insécurité, d’incertitude et d’impunité durant la guerre au Rwanda (1990-1994) et en exil, durant la guerre qui a visé le renversement de Mobutu, le massacre des ressortissants rwandais et le pillage des ressources naturelles par l’AFDL. Leurs récits confirment donc la continuité de la violence organisée d’un régime politique à un autre. De plus, les femmes témoignent de la non-reconnaissance de leur statut de réfugié par les bureaux qui traitent outre-mer les demandes d’asile, du traitement déshumanisant et accusateur des administrateurs de l’aide humanitaire et, de manière plus importante, de la non-reconnaissance des crimes commis par les forces armées du gouvernement actuellement au pouvoir au Rwanda et de leur impunité. Ensuite, les témoignages recueillis montrent des actrices sociales engagées dans l’activisme politique, l’action collective, la protection, la sécurité, la survie et l’établissement de leurs proches, du début du conflit jusqu’à leur arrivée au Canada. En effet, pour surmonter les difficultés engendrées par la violence organisée, elles ont mobilisé et transformé de manière créative toutes les ressources de leur capital humain, social et économique pour subvenir aux besoins de leurs proches et de leur communauté, et ce, tout au long de leur parcours migratoire. Enfin, au sujet du sens, nous verrons d’une part comment les femmes conçoivent leurs expériences individuelles de souffrances comme une histoire de victimisation collective, ce qui semble les aider à normaliser leurs expériences. D’autre part, nous verrons comment une identité de femmes fortes, résilientes et capables de s’adapter dans un climat d’adversité se dégage de leur témoignage, ce qui semble favoriser chez elles un sentiment de cohérence, de continuité et nourrir une certaine fierté.

Cette étude analyse l’impact du processus libéral de paix en République Démocratique du Congo sur la poursuite des violences dans les provinces du Nord et du Sud Kivu. Elle soutient que les dynamiques conflictuelles dans ces deux régions sont entretenues par l’établissement d’un programme de partage de pouvoir (power sharing), inclusif, jumelé à l’application des réformes économiques libérales. En se concentrant sur la réforme du secteur de sécurité et l’harmonisation de la politique nationale (en vue des élections post-conflictuelles de 2006), le processus de paix néglige les enjeux politiques et socio-économiques locaux. Le désengagement de l’État et la libéralisation du secteur minier accentuent le taux de corruption du gouvernement de transition et renforcent l’exploitation illégale des ressources par les groupes armés. Cette recherche soutient que l’implantation massive d’entreprises minières multinationales dans les provinces du Nord et du Sud Kivu aggrave la déformation des tissus socio-économiques locaux, accentue la dépendance des populations aux réseaux de gouvernance informelle et renforce les divers groupes armés présents sur le terrain. Par conséquent, les réformes structurelles menées dans le cadre du processus libéral de paix font perdurer les violences et occasionnent de nouvelles dynamiques conflictuelles localisées autour du contrôle des ressources locales, qu’elles soient d’ordre économique ou politique.
