Esta monografia examina a importância das Fundações Publicas de Planejamento como uma das formas pelas quais se expressa a ideologia do planejamento brasileiro - intimamente ligada ao crescente intervencionismo estatal brasileiro. Ela se pauta por um marco teórico onde se explicita a intervenção estatal na economia dos países contemporâneos e especificamente no Brasil, enfocando as justificativas baseadas em razões de cara ter econômico ou de carater administrativo. O discurso que procura legitimar o intervencionismo brasileiro ora tem suas bases nos problemas in ternos gerados por crises externas, ora se fixa na necessidade de se modernizar o aparato administrativo estatal tornando-o mais eficaz quando não lança mão destes dois argumentos simultaneamente.

The goal of this work is to present a contribution to the critical analysis of the rationality that supports the action of the members of productive organizations, starting from a perspective of the man's emancipation in the ambit of the work. The focus of attention is related to the administrative practices of one of the largest Brazilian's private foundations that they were analyzed based on the distinction among instrumental and substantive rationality and of the theory of the communicative action. The main research method used was the 'participant observation' that allowed to the author to verify in loco the rationality that permeates the administrative practices of the researched Foundation. The importance of this study is in the fact that are scarce the studies about the management of nonprofit organizations. For increasing, every day, the emphasis that the society is giving to the third sector, for the expectation of its growth, so much in quantitative level as of influence degree about the people's life, and for placing in the position of offering answers and solutions for the problems that the State doesn't get to solve, the third sector and its organizations need a theoretical reference for its administration that is coherent with its emancipatory purpose. The results led to conclusions that alert the managers of the private foundations to review the practices adopted in the management of those organizations and stimulate the debate and the continuity of researches on the theme.

Trata da caracterização da alternativa de gestão, fundação de apoio, sob os aspectos legais e de atuação em hospitais públicos. Aborda a questão da cidadania, tecendo considerações sobre o acesso aos hospitais públicos. Caracteriza as entidades jurídicas relativas à Administração Pública e à fundação privada. Menciona uma parceria concreta de fundação de apoio com hospital público, indicando uma possibilidade de gestão administrativa.

A presença crescente de pessoas jurídicas sob o regime de direito privado exercendo funções e atividades desempenhadas por pessoas jurídicas sob o regime de direito público tem apresentado desafios importantes para o estudo do Direito. A atuação das Fundações de Apoio no auxílio às Universidades Públicas Federais brasileiras são um exemplo disso. De um fenômeno espontâneo, timidamente regulado pela Lei n.º 8.958/1994, transformaram-se em um universo diversificado, em que se questiona a sua atuação junto à Instituições Federais de Ensino Superior. Ao desempenhar funções e atividades de auxílio à Universidades Federais, executam recursos públicos orçamentários e de Agências de Fomento. O questionamento da obrigatoriedade destas entidades realizarem prévio procedimento licitatório para contratação de terceiros quando estiverem auxiliando às Universidades Federais, a necessidade de cumprimento das regras de recolhimento de recursos público à Conta Única do Tesouro Nacional e a possibilidade de contratação de pessoal sem concurso público para trabalhar nas atividades de auxílio fazem parte das controvérsias enfrentadas no trabalho. Este trabalho procurou refletir sobre este fenômeno a partir de três frentes, uma proposta de análise do fenômeno fundacional, em que fundações de apoio são compreendidas como organizações de intermediação entre universidade e empresa, um levantamento das principais questões de compatibilização entre o regime de direito público e a atuação das fundações no contexto de auxílio ao desenvolvimento tecnológico das Universidades Públicas Federais e, por fim, o estudo de um caso em que há a compatibilização entre um modelo de fundação de apoio e o regime de direito público, o caso da Fundação de Apoio Institucional ao Desenvolvimento Científico e Tecnológico (FAI) da Universidade Federal de São Carlos (UFSCAR). Propomos um recorte específico para o estudo do auxílio realizado pelas fundações de apoio, caracterizando-as como organizações de intermediação da cooperação entre universidade e empresa, pois acreditamos que dado o conjunto significativo de transformações no papel desempenhado por universidades de pesquisa no âmbito da produção industrial, uma nova forma de leitura da intermediação é necessária para a compreensão do papel e da missão das Universidades de Pesquisa no desenvolvimento econômico do país. As universidades, além de formadoras da mão de obra especializada e da geração de conhecimento, passam a ser centros de geração de tecnologia, se aproximando da indústria, pois substituiria em parte os antigos departamentos de pesquisa e desenvolvimento de indústrias nacionais, ao mesmo tempo que também desempenharia o papel de fomentadora da geração de empresas de inovação, criando incubadoras de empresas e facilitando o intercâmbio entre seus professores e técnicos e profissionais da matriz industrial dos países. No Brasil, esta transformação se depara com um hiato importante. O país, por meio de suas Universidades Públicas é produtor de conhecimento, com um número significativo de publicações internacionais, contudo, não tem conseguido converter este conhecimento em aplicação industrial, em inovação tecnológica, medida pelo registro de patentes e pela transferência de tecnologia para a indústria. Em segundo lugar, a Lei de Inovação Tecnológica (Lei n.º 10.973/2004) como a primeira tentativa de estabelecer formas de reduzir este hiato, criou instrumentos jurídicos para permitir a cooperação entre Universidades Públicas Federais e Empresas Nacionais, posicionando as fundações de apoio como intermediadoras da relação entre Universidade e Empresa, ao lado dos Núcleos de Inovação. A Lei, por um lado, foi capaz de criar os instrumentos jurídicos para que a cooperação entre Universidade Pública e Empresa Nacional seja lícita, contudo, não enfrentou questões jurídicas importantes, além das questões sobre incidência do regime de direito público na intermediação realizada pelas fundações, também não definiu a função das fundações de apoio na captação e gestão de projetos de tecnologia, ou na gestão da propriedade intelectual e sua relação com os Núcleos de Inovação, ou a participação das fundações na formação de empresas de inovação por meio do processo de incubação de empresas nas Universidades Federais. Foi o Tribunal de Contas da União, como órgão de controle do emprego dos recursos públicos, o principal local de debate sobre as controvérsias jurídicas envolvendo a relação entre Fundações de Apoio e Universidades Federais. Em nosso entendimento, o Tribunal na Decisão n.º 655/2002, iniciou um processo de compatibilização entre a atuação das fundações de apoio e o regime de direito público, ao definir as fundações de apoio ligadas à projetos de desenvolvimento e transferência de tecnologia das Universidades Federais como organizações de intermediação, contudo, retrocedeu no Acórdão n.º 2.731/2008, ao definir de forma ampla o conceito de recurso público e recomendar aos Ministérios da Educação e da Ciência e Tecnologia que proibissem os repasses diretos de recursos de Agências de Fomento à Fundações de Apoio no âmbito federal. O caso da FAI é paradigmático, pois não apenas é um caso que reforça a nossa avaliação de que é possível haver compatibilidade entre o regime de direito público e a atuação das fundações apoio, como sinaliza para soluções de desenho institucional relevantes para a reflexão sobre a regulação das fundações de apoio no âmbito federal. A FAI como uma fundação voltada para a Universidade Federal de São Carlos é capaz de cumprir com as potencialidades de uma fundação almeja contribuir para o desenvolvimento tecnológico de Universidades Públicas Federais, uma vez que funciona como um “outro eu” da UFSCAR, um duplo positivo, executando atividades que se fossem feitas pela Universidade não teriam a mesma agilidade ou até não seriam realizadas.

The freedom of social communication referred to those freedoms exercised under of the media. The journalism is professional activity responsible for factual information, real, pluralistic and of the public interest, directed diffusely to social orientation. The right of the information, characterized as diffuse right or of fruition by uncertain and numerous holders, is subdivided in the right of the inform, inform yourself and right to be informed. The journalists, as occupants of a enlarged spectrum concerning of right of the inform, have responsibility for the information they disseminate, devoir that puts on the basis of the constitutional right to be informed. This duty is divided with journalistic companies, when them realized. In the research, examined the existence of constitutional guarantees the right to be informed. To answer the question, realized research to support bibliographical and documentary. The guaranty is a empirical preoccupation coated with legality, since lends itself effect concretize a right. This paper analyzes the relationship between fundamental rights and the exercise of the claim punitive society in a democratic state. It starts with the premise that there are fundamental rights that limit and determine the validity of all forms of manifestation of the claim punitive society (legislating, investigative, adjudicative or ministerial) and there are others that require the state the right exercise, fast and effective of these activities. Travels to history in order to see that the first meaning of these rights was built between the seventeenth and eighteenth centuries, after all a history of abuses committed by state agents in the exercise of criminal justice, and positively valued in the declarations of human rights and proclaimed in the constitutions after the American and French Revolutions, while the second meaning has been assigned between the nineteenth and twentieth centuries, when, because of the serious social problems generated largely by absenteeism state, it was noted that in addition to subjective rights the individual against the state, fundamental rights are also objective values, which trigger an order directed the state to protect them against the action of the offending individuals themselves (duty to protect), the mission of which the State seeks to discharge, among other means, through the issue of legal rules typifying the behavior detrimental to such rights, subject to penalties, and the concrete actions of public institutions created by the Constitution to operate penal law. Under this double bias, it is argued that the rule violates the Constitution in the exercise of the claim punitive society as much as by excess malfere fundamental rights that limit, as when it allows facts wrong by offending fundamental rights, remain unpunished either by inaction or by insufficient measures taken abstractly or concretely provided

The right against self-incrimination is a fundamental right that works in the criminal prosecution, and therefore deserves a study supported by the general theory of criminal procedure. The right has a vague origin, and despite the various historical accounts only arises when there is a criminal procedure structured that aims to limit the State´s duty-power to punish. The only system of criminal procedure experienced that reconciles with seal self-incrimination is the accusatory model. The inquisitorial model is based on the construction of a truth and obtaining the confession at any cost, and is therefore incompatible with the right in study. The consecration of the right arises with the importance that fundamental rights have come to occupy in the Democratic Constitutional States. In the Brazilian experience before 1988 was only possible to recognize that self-incrimination represented a procedural burden for accused persons. Despite thorough debate in the Constituent Assembly, the right remains consecrated in a textual formula that´s closer to the implementation made by the Supreme Court of the United States, known as "Miranda warnings", than the text of the Fifth Amendment to the U.S. Constitution that established originally the right against self-incrimination with a constitutional status. However, the imprecise text does not prevent the consecration of the principle as a fundamental right in Brazilian law. The right against self-incrimination is a right that should be observed in the Criminal Procedure and relates to several of his canons, such as the the presumption of not guilty, the accusatory model, the distribution of the burden of proof, and especially the right of defense. Because it a fundamental right, the prohibition of self-incrimination deserves a proper study to her constitutional nature. For the definition of protected persons is important to build a material concept of accused, which is different of the formal concept over who is denounced on the prosecution. In the objective area of protection, there are two objects of protection of the norm: the instinct of self-preservation of the subject and the ability to self-determination. Configuring essentially a evidence rule in criminal procedure, the analysis of the case should be based on standards set previously to indicate respect for the right. These standard include the right to information of the accused, the right to counsel and respect the voluntary participation. The study of violations cases, concentrated on the element of voluntariness, starting from the definition of what is or is not a coercion violative of self-determination. The right faces new challenges that deserve attention, especially the fight against terrorism and organized crime that force the development of tools, resources and technologies about proves, methods increasingly invasive and hidden, and allow the use of information not only for criminal prosecution, but also for the establishment of an intelligence strategy in the development of national and public security

The neoconstitutionalism led to a process of ethical revaluation of the normative systems and the process of constitutionalization of the many fields of law. This study examines the consequences of this process in criminal law, so important a Law field for the protection of the most valuable assets by the society, including the fundamental guarantees, thus emphasizing the necessity of protection of the collective and individual rights, which are guided by the observance of the defendants individual rights in the course of criminal proceedings and the search for the best efficiency of penal protection, according to the corollaries of defense against the state (prohibition of the excess or Übermassverbot) and the provision of rights by the state (prohibition of insufficient protection or Untermassverbot). The offense of fuel adulteration is taken as an object of study, since it is a vital market to a nation dependent of people and good s movement for their living, driven by fossil and biofuels. Such a crime affects essential legal interests to the development of society, interests such as the environment, consumer relations and economic order, particularly the principle of free competition. This paper seeks to analyze the need of a greater efficiency of this particular criminal protection, once concluded the conduct harm and social fear as a consequence by it as growing, and therefore having its former crime type, engraved in Article 1 of Law No. 8.176/1991, rewritten in compliance with the criminal law s principle of legality. Thus, the reformation proposals and legislative creation involving this crime were observed, with emphasis on the bill No. 2498/2003, which keeps it as blank heterogeneous criminal norm, kind of penal normative whose constitutionality is raised, including the forethought of criminal responsibility in the perpetrating of the offense as culpable and subsequently increasing the applicable minimum penalty, as well as the inclusion of new activities in the typical nucleus

The fundamental social right to education has a lengthy constitutional argument, having been declared as a right to everyone in the Title dedicated to the fundamental rights and warrants and, later, scrutinized in the Social Order Chapter exclusively devoted to this theme, where specific rights are guaranteed and fundamental duties are imposed to family, society, and state. In that which concerns education, the 1988 Constitution is the result of a historical-normative process which, since the days of the Lusitanian Empire wavering between distinct levels of protection warrants in some way the educational process. Nevertheless, not even the State s oldest commitment to education has been fully achieved, namely, the annihilation of illiteracy. Even as other fundamental social rights, education is inflicted with the lack of effective political will to reach its fulfillment, and this is reflected in the production of doctrine and jurisprudence which reduce the efficacy of these rights. The objective of this work is to analyze what part is to be played by the constitutional jurisdiction in the reversal of this picture in regards to the fulfillment of the fundamental social right to education. Therefore it is indispensable to present a proper conception of constitutional jurisdiction its objectives, boundaries and procedures and that of the social rights in the Brazilian context so as to establish its relationship from the prism of the right to education. The main existing obstacles to the effective action of constitutional jurisdiction on the ground of social rights are identified and then proposals so as to overcome them are presented. The contemplative and constructive importance of education in the shaping of the individual as well as its instrumental relevance to the achievement of the democratic ideal through the means of the shaping of the citizen is taken into account. The historical context which leads to the current Brazilian educational system is analyzed, tracing the normative area and the essential content of the fundamental right to education aiming to delineate parameters for the adequate development of the constitutional jurisdiction in the field. This jurisdiction must be neither larger nor narrower than that which has been determined by the Constitution itself. Its activity has been in turns based on a demagogic rhetoric of those fundamental rights which present a doubtful applicability, or falling short of that which has been established showing an excessive reverence to the constituent powers. It is necessary to establish dogmatic parameters for a good action of this important tool of constitutional democracy, notably in regards to the fundamental social right to education, for the sake of its instrumental role in the achievement of the democratic ideals of liberty and equality

The work is to demonstrate the scope of modern-day major regulatory provisions and the policies implemented to adoption of biofuels in the national energy matrix. The adoption of biofuels as an alternative to fossil fuels, is based on the realization of the fundamental right to an ecologically balanced environment mitigating hazards and environmental hazards arising from a postmodern society. However, the change in the Brazilian energy matrix observe the precepts of certain environmental principles to essentially environmental preservation The proposed Environmental rule of law is founded on the realization of the right (duty) key to an ecologically balanced environment for sustainable development. Thus, it is up to the State, in addition to considering the dangers and risks fruits of government decisions, present the possible instruments to mitigate the irreversible environmental damage to the environment. The management of environmental risks present in the ideals of an Environmental rule of law, plays an important role in the preservation and economic development, using, therefore, of acautelatórios legal instruments, such as environmental licensing and the ecological-economic zoning, measures adopted in the light of the principles of precaution and preservation. The adoption of research in the environmental field, improvement and development of environmental technology, building a system to observe ecological changes, imposition of environmental policy objectives to be achieved in the medium and long term and systematization of organizations plan a protection policy environmental, are essential measures to control possible environmental risks and damage guided by the aforementioned environmental principles. Thus, it will be used the inductive method of approach, starting from the analysis of the new perspective of Environmental rule of law and the implementation of biofuels in the context of a post-modern society, marked by uncertainty and the risk of damage, from the study of the principles of caution, maintaining and cautionary measures in mitigating the hazards and potential risks.

This dissertation focus, as main objective, to address the issue of fundamental rights and political freedoms of the individuals, guaranteed by the Constitution of 1988, with emphasis of study in the constitutional guarantee of freedom of speech, as well as in national related constitutional law institutions and its derivatives, and the connection with the historical and political affirmation of fundamental human rights and its importance for the construction, maintenance and consolidation of constitutional democracy in the Federative Republic of Brazil. This paper mainly deals with aspects of juspostive nature, focused mainly within its doctrinal aspect, making, for such, references both to the patrian doctrine and the foreign one, without forgetting the necessary jurisprudencial focus and analysis of the positive patrian planning with references to comparative law, in order to describe and analyze the emergence, evolution and dissemination of the institute, both in the major countries of the Western World and along the Brazilian constitutional history.

This work has as objective to rise stages of the human beings dignity evolution and its superposing with the entirety and the men s activities development, until its elevation as a constitutional principle and its evolution as a judicial decisions vector, being important to register that conviction ethics or convenience ethics imposes the existence of the constitutional principle. Human beings dignity principle deals about a historic and cultural, politic and social and economical construction, whose sloping is violently imposed to the production resources, which drives the present work through a trial of clarifying and aggregating all those nuances of the men s stages until they find out, welcome and construct the human beings dignity in all its subjective and objective aspects. The adopted research method was based in historic enrolment of the appearance among people since the bases of the word dignity until the acceptation of this value in the Brazilian society. This research searched dignity s doctrinaire valuation at the juridical point of view and the way of appreciation of this value, in its condition of constitutional principle, by the Brazilian Judicial Power. This paper focuses on a study of public policy jurisdictional control as some effectiveness mechanism for cultural, economical, and social fundamental rights. It investigates the juridical profile of public policies based on premises of the current (Neo)Constitutional State model and the assertion of an essentially constitutionalist Law paradigm from its genesis to its most peculiar elements, and through tormenting issues, such as: its position between Law and Politics, the difference with reflective subjective rights, and the problem of high financial costs. Once its object is identified, it moves forward into the theme itself, which is that of jurisdictional control, investigating its legitimacy based on paradigmatic judicial precedents and the facing of themes such as: current role of the Judicial Power, the splitting of state functions, administrative discretion, financial affordability, illegal omissions, and budget control. Finally, it examines, as its study central object, objective parameters for definition control, execution, and transparency of public policies, as well as identifying the most appropriate collective jurisdictional tutoring to its purposes together with some of its law process means. Therefrom, it shows new perspectives for the recent study on jurisdictional control of public policies, building foundations for the fundamental rights effectiveness

Trabalho sobre a concretização dos direitos fundamentais pela jurisdição constitucional, mostrando a importância da interpretação da Constituição para a obtenção da eficácia de tais direitos. Desenvolve-se a pesquisa a partir da explicação histórica sobre o constitucionalismo moderno, que implantou o Estado Liberal de Direito e as constituições escritas, e no qual encontra a jurisdição constitucional o seu embasamento cultural e a sua justificação histórica. Verifica-se que a origem da jurisdição constitucional assenta-se no controle da constitucionalidade das leis e atos normativos do poder público, fundado no princípio da supremacia da Constituição. Destaca-se o realce dado pela teoria material da Constituição à normatividade dos princípios constitucionais, tecendo considerações em torno da classificação das normas constitucionais em regras e princípios. Remarca o trabalho que o controle da constitucionalidade pode ser formal ou material, apresentando esta última modalidade uma conotação acentuadamente política, já que, por ele, a aferição da compatibilidade da norma infraconstitucional é feita com o conteúdo material da Constituição. A função primacial da jurisdição constitucional é tutelar os direitos fundamentais, especialmente os das minorias sociais. Tal função sobreleva-se até mesmo contra textos legislativos produzidos por maiorias eventuais, pois o princípio da supremacia da Constituição prevalece sobre a regra da maioria vigente nos regimes democráticos. Comprova-se que a concepção substancialista, adotada para definir os contornos funcionais da jurisdição constitucional, propõe uma maior intervenção desta na apreciação dos casos que lhe são submetidos. Salienta-se que, no Estado Democrático de Direito, derivado da aglutinação do Estado Liberal com o Estado Social e acrescida de um elemento novo voltado à transformação da realidade social, a jurisdição constitucional passa a levar em conta, com mais atenção e destaque, os princípios constitucionais e a sincronia do ordenamento constitucional com a sociedade por ele ordenada. Realça também o estudo que a atuação da jurisdição constitucional, segundo a ideologia democrática defendida pelo Estado Democrático de Direito, tem logrado obter uma sociedade mais justa, e que a comprovação histórica é francamente favorável ao seu ativismo judicial. Os direitos fundamentais dificilmente se dissociam da democracia, que lhes garante a eficácia pela limitação e visibilidade do exercício do poder, traços políticos que constituem a nota típica dos regimes democráticos. Mesmo que os direitos fundamentais tenham tido um caráter pré-estatal como preconizado pelo jusnaturalismo, são eles normas, e não valores, pois tão logo sejam positivados pela Constituição eles se tornam direitos vigentes. Assevera a pesquisa que os métodos concretistas de interpretação constitucional mostram-se mais adequados à obtenção da eficácia da Constituição, pela importância que os elementos objetivos, relacionados com o contexto material da norma, assumem no seu processo de aplicação e interpretação. Conclui-se ser essencial que os operadores e estudiosos do Direito se conscientizem de que a interpretação constitucional deve assumir uma feição principiológica e concretista, de modo a ser obtida a máxima eficácia possível das normas constitucionais, especialmente as de direitos fundamentais, acentuando-se mais a necessidade de um Tribunal Constitucional, cuja criação no Brasil constitui ainda tema polêmico entre os doutrinadores

The present work consists of studying to diffuse control of constitutionality in Brazil, with emphasis in a procedural alternative to the evolution of that model: the incident to challenge of unconstitutionality. Starting from the discussion about the new role of constitutional jurisdiction in peripheral countries and in the globalized society, without forgetting to face inevitable doubts about its legitimacy before other powers of the State, the Brazilian control of constitutionality is revealed, under a diffuse, non-dichotomical view, through a number of inconsistencies and misunderstandings, that compromise social peace, the credibility of democratic institutions and the supremacy of juridical security. In order to achieve the goal, the study in course discussed the main difficulties of the Brazilian mixed model of constitutionality control, as well as, directing its view to the incident of challenge of unconstitutionality, which the most adequate forms to assure its appropriateness, legitimacy, processing and decisory effects are. Is was essential, in this point of view, to establish the difference between the incident of challenge of unconstitutionality conceived in article of the Brazilian Federal Constitution and the incident of challenge of unconstitutionality such as it is known in the European models. The insertion of the incident of challenge of unconstitutionality based on European models in the Brazilian control system, without jeopardizing the North-American essence the Brazilian constitutional history presents since 1981, is the hypothesis that is presented as an improvement of constitutional protection
