O presente estudo trata da discussão de um novo modelo organizacional para a Perícia Criminal no qual seja possível a um só tempo, uma atuação integrada, harmônica e independente em relação à Investigação Policial, de modo a contribuir para alterar o modelo atual em que a Perícia Criminal atua apenas de forma limitada e pontual, para um modelo que permita um paralelismo entre esta e aquela, ressaltando a importância da aplicação da criminalística como ferramenta de excelência na investigação criminal e no combate à impunidade nos procedimentos investigatórios. Inicialmente, são apresentados o tema estudado seus objetivos, delimitação e relevância. Em seguida, é realizado um panorama de trabalhos anteriores relevantes para o tema aqui abordado, incluindo uma sintética exposição dos conceitos basilares da Criminalística e suas interrelações no Sistema de Justiça Criminal de modo a demonstrar o seu potencial no procedimento investigatório. É apresentada então a metodologia de pesquisa utilizada, para, em seguida, discutir-se a análise dos processos de investigação policial e perícia criminal e os resultados da pesquisa exploratória e sua análise, buscando-se identificar os problemas e propor mecanismos de melhoria do modelo organizacional. São apresentados também casos que envolvam áreas diversas do conhecimento pericial, em que se chegou a resultados efetivos graças à aplicação do modelo proposto. Ao final espera-se demonstrar que a implementação de um modelo organizacional em que haja paralelismo, integração e independência dos processos de investigação de campo e perícia técnica possibilitará uma otimização no desenvolvimento e no resultado da investigação criminal, o que contribuirá para uma maior eficiência do sistema de persecução penal e justiça criminal.

The Trans-Pacific Partnership is a sweeping trade agreement, spanning the Pacific Rim, and covering an array of topics, including intellectual property. There has been much analysis of the recently leaked intellectual property chapter of the Trans-Pacific Partnership by WikiLeaks. Julian Assange, WikiLeaks’ Editor-in-Chief, observed “The selective secrecy surrounding the TPP negotiations, which has let in a few cashed-up megacorps but excluded everyone else, reveals a telling fear of public scrutiny. By publishing this text we allow the public to engage in issues that will have such a fundamental impact on their lives.” Critical attention has focused upon the lack of transparency surrounding the agreement, copyright law and the digital economy; patent law, pharmaceutical drugs, and data protection; and the criminal procedures and penalties for trade secrets. The topic of trade mark law and related rights, such as internet domain names and geographical indications, deserves greater analysis.

O presente trabalho busca analisar a aplicabilidade da Justiça Penal Negociada no ordenamento jurídico brasileiro a partir do papel desempenhado pelas partes no processo penal. Nesse sentido, quanto ao Ministério Público, serão estudadas as funções exercidas pelos seus membros, bem como as principais características institucionais, a fim de se interpretar a natureza da sua atividade na promoção da ação penal pública, especialmente o dilema entre a possibilidade de atuação discricionária ou a sua vinculação à obrigatoriedade. Em relação ao imputado, serão examinadas a possibilidade jurídica de limitação infraconstitucional aos seus direitos fundamentais e de renúncia ao exercício das suas garantias processuais individuais. Por fim, a partir do atual panorama evolutivo dos acordos criminais existentes na nossa legislação, espera-se verificar se de fato há uma tendência de fortalecimento do papel das partes e de desfocalização da figura do juiz, passando para o Ministério Público a tarefa de regulador do processo penal, ao negociar com o imputado as repercussões penais de suas condutas.

A Lei nº 11.343 de 23 de agosto de 2006 (Lei de Drogas) instituiu o Sistema Nacional de Políticas Públicas sobre Drogas e criou as diretrizes para a política de drogas brasileira. Dentre o conjunto de medidas trazidas pela lei em seu dispositivo criminal está a criação de um tipo penal específico de cultivo de plantas para produção de drogas para consumo pessoal (art. 28, §1º). O plantio para consumo recebe o mesmo tratamento jurídico-penal que o porte para consumo (art. 28), sendo previstas sanções alternativas à privação de liberdade. O §2º do art. 28 da Lei de Drogas estabelece os critérios que as autoridades competentes do sistema de justiça criminal deverão considerar na tipificação penal das situações de cultivo. Este trabalho se debruça sobre a tipificação penal de situações de cultivo de canábis em acórdãos do Tribunal de Justiça de São Paulo. A problemática de pesquisa aqui desenvolvida discute especificamente quais são os argumentos e como eles são apresentados nas decisões para justificar a determinação de que uma situação de cultivo é para fins de tráfico ou de consumo pessoal. O trabalho busca identificar como os critérios do §2º do art. 28 da Lei de Drogas são apresentados na fundamentação de decisões judiciais em que se discute na esfera criminal se uma situação de cultivo é para “consumo pessoal” ou “destinada a terceiros”. Uma pergunta central norteia a pesquisa realizada: quais os elementos e de que forma eles são utilizados nas decisões analisadas para tipificação do plantio para consumo pessoal (art. 28, §1º, da Lei de Drogas) e do plantio destinado a fornecer drogas a terceiros (art. 33, §1º, II)? Para enfrentar a problemática de pesquisa utilizamos a ferramenta de busca de acórdãos disponibilizada no sítio eletrônico do Tribunal de Justiça de São Paulo. Foram analisados 135 acórdãos do TJSP que enfrentam diretamente a controvérsia relativa à tipificação penal de situações de cultivo de canábis. Os acórdãos foram proferidos entre os anos de 1998 e 2014 e foram selecionados segundo os critérios especificados no capítulo metodológico da dissertação. Os resultados quantitativos da pesquisa dizem respeito às informações gerais dos processos, elementos de prova mencionados nos acórdãos, características das situações de cultivo e fundamentação da tipificação penal. A discussão qualitativa sobre os resultados da pesquisa é promovida em quatro frentes: (i) interpretação e valoração da quantidade de drogas; (ii) antecedentes criminais, circunstâncias da prisão e do agente; (iii) materiais de venda e outros elementos relevantes na tipificação penal; e (iv) características do conjunto probatório. As questões discutidas nestas frentes circunscrevem o problema de pesquisa e é a partir delas que é feita a análise apresentada neste trabalho. Esperamos conseguir contribuir para melhor compreensão (i) da determinação da finalidade do cultivo e (ii) das implicações jurídicas que decorrem da opção legislativa pela não utilização de critérios quantitativos na definição dos crimes de tráfico de drogas e plantio para consumo.

This legal research aims to demonstrate the prohibition in the Brazilian criminal system of a multiple imputation for the same fact in a simultaneous or successive way. For that it is developed a different idea of the subject. Through comparative, eletronic and bibliographical researches, the dissertation was accomplished in a way to establish the content of the foundations of the criminal procedural emphasizing as fundamental premise the values of the Constitution. In the first section it was demonstrated the limits of the theme and the objective of the research. After that, it was analyzed the basic function of the criminal suit which has the important mission of limiting state's punitive power. In the same way, the criminal procedure corresponds to a warranty of the citizens' freedom. In the same section, it is shown how it is possible to abandon the myth of the real truth in the criminal law system. In the third section of the research, there were pointed elements and definitions about the cognition object, specially the litigious object or "thema decidendum", and also the peculiarities of the judged cases. In the fourth section the subject about origins and evolution of the criminal procedure and its objectives in the legal system is developed to demonstrate its perspectives. Some aspects of the identity's concept of the presupposition of the facts are as well demonstrated in order to relate the theme to the prohibition of multiple imputation. There are also considerations about some other important aspects as the incidence of the legal rules and the possible change on the elements of the penal type. There are several comments about legal procedural in other legal systems comparing them to Brazilian's most elevated Courts. In the end it was systematized the limits to criminal imputation, emphasizing the defende's right as a foundation of the legal system. Is was registered that the ius persequendi can be exercised once

Over the last two and a half decades, corruption in the police service in Australia has come under increased official and public scrutiny. Numerous scandals involving police officers has caused concerned about the integrity and ethics within the Police Service. This paper examines the Wood Royal Commission, specifically looking at testimony from Trevor Haken. This paper provides insights into the nature of police corruption as well as the process or ‘slippery slope’ corrupt officers go through. This paper also contributed to the existing literature by providing knowledge into the types of corruption used by police officers in real-life situations, and deepening understanding of how corruption emerges and why. It specifically confirms the literature on slippery slope arguments about police corruption and the role of trust in building a corrupt career. The paper contributes to the existing literature by providing insights into the nature of corruption used by police officers in real-life situations, and deepens the understanding of the process of corruption. The findings also contribute to our understanding that corruption is not just an individual incident but rather a result of reoccurring incidents that are generated by the nature of work, organizational structure and society in relation to corruption.

This paper is a selected review of research on issues surrounding the investigation of intra-familial child sexual abuse for children aged eight and above, in the criminal justice system. Particular attention is paid to features of the investigative interview in relation to the child's level of understanding, ability to report and likely emotional response when the proceedings take place. Best practice by police and social care agencies involves establishing valid and reliable information from children while attending to their developmental level and emotional state. The review aims to distil principles optimising this process from both the investigative judicial perspective and the child's focus, as well as from the inter-agency perspective and information sharing. Recommendations are made for improving the interview process based on research and methods from a range of disciplines and to optimise information recording in a format easily shared between agencies. Updated and ongoing training procedures are key to successful practice with training shared across police and social work agencies. The focus of this review is informed by preliminary findings from pilot research in progress on behalf of the Metropolitan Police Child Abuse Investigation Command.

Cooperation between police forces is a topic that is increasingly relevant. The emergence of new threats, as well as looking for new ways to fight crime, require from the, careful monitoring and strict sharing of all relevant information. This Work is entitled “The GNR and cooperation between Criminal Police Bodies in the Risk Society. Case Study: District of Lisbon” and aims to study the cooperation and coordination between police forces in Lisbon district, and verify if there is an parallel between the rule of law and the police procedures. The work is organized in four chapters. The first consists in a theoretical framework to perceive the context and objectives of this work. The second addresses the role of the, the different types of cooperation and instruments that promote cooperation between them. The third presents and analyzes the results. Finally, the fourth and last chapter the conclusions are woven answered the questions derived and starting question, tested hypotheses, and those limitations and future recommendations. In conclusion, the District of Lisbon, there is cooperation, materialized in a constant exchange of information, based on personal and informal relationship between the elements of the various Police Forces.

In order for young people to meaningfully participate in the criminal justice system they must possess an understanding of their rights and legal procedures. To examine their understanding, 50 young people between the ages of 13-17 who received an extrajudicial sanction or were sentenced to probation, were recruited from the Finch Courthouse in Toronto, Ontario. Semi-structured interviews were conducted with participants regarding their understanding of their due process rights and their rights under the United Nations Convention on the Rights of the Child. Youth who indicated involvement in plea bargaining were also asked about their experiences during this procedure. In addition, the present study examined youths' perceptions of power differences in their interactions with criminal justice officials working within an institution that has tremendous control over offenders' lives. The results indicate that while youth seem to have some understanding oftheir rights and legal procedures, they nevertheless feel ill-equipped to invoke their rights in an adult-led criminal justice system. Furthermore, while past literature has often conceptualized youth understanding based on age (e.g., Crawford & Bull, 2006) the findings of the present study demonstrate that while age plays some role, the lack of power experienced by youth vis-a-vis adults, and specifically criminal justice professionals, has the most bearing on the inability of youth to exercise their rights.
